INTRODUCTION Social media1 has taken the world by storm.2 As of 2016, over three billion people in the world are active Internet users,3 and over two billion are active on social media.4 Facebook reports 1.79 billion monthly active users worldwide,5 while another statistic reporting the number of active Facebook users says it is “still counting.”6 With lower but still influential numbers, Twitter reports 313 million monthly active users for 2016.7 In 2013, social media surpassed email J.D. Twitter,12 for example, enables users to post statements called “tweets.”13 Tweets contain up to 140 characters, and may be accompanied by photos, videos, and links.14 Within the 140 characters, users may include Emoticons. An Emoticon, more commonly referred to as an emoji, is “[a] small digital image or icon used to express an idea, emotion, etc.[,]” in 8. The Twitter Glossary, supra note 12. https://openscholarship.wustl.edu/law_journal_law_policy/vol52/iss1/15 2016] The Emoji that Cost $20,000 229 electronic communication.15 Emojis are often included alongside text to portray an emotion or otherwise add to readers’ understanding of the text.16 The most basic emoji is a yellow smiley face, but emojis span from face emotions, like happy, sad, and angry, to animals and ordinary objects, like a cat or a briefcase.17 With such options, tweets are largely only limited by individual users’ creativity. After a user posts a tweet, the tweet displays on the user’s personal timeline. More popular tweets may also end up on blogs and other websites.18 Twitter, like other social media websites, gives users the ability to post statements virtually, affording opportunities for disconnected communication19 and anonymity,20 along with the power to reach millions from a desktop at home.21 The popularity of social media has given rise to new legal issues.22 Social media provides users with a new medium for communication, 15.   • Lord Mcalpine Sues – but Not Any Shills
    The internet is awash with reports of widespread paedophilia within government, banking, police, judiciary, the Royal family ... Former Tory Party treasurer Lord McAlpine was one of the names widely circulated [and one which had been exposed in the, now defunct, Scallywag mag back in the 1990s]. Phillip Schofield on primetime TV was primed to ‘ambush’ PM Cameron with a list of names and to emphasise that he got them “in 3 minutes on the internet”. Sexually abused victim Steve Messham was set up to participate in a Newsnight programme which would specifically not mention names and state that evidence was insufficient to do so. On the day that McAlpine’s lawyers released a statement denying that he is a paedophile or in any way involved in the North Wales children’s homes scandal, Messham issues an apology to Lord McAlpine saying that it was a case of ‘mistaken identity’ and that he should never have named him. [Publicly he hadn’t.] He states: "After seeing a picture in the past hour of the individual concerned, this is not the person I identified by photograph presented to me by the police in the early 1990s, who told me the man in the photograph was Lord McAlpine." Steve Messham had obviously been ‘got at’ by the dark suits. Part 1: Extended Introduction ! “ It is inconceivable that the courts should continue to struggle forever with a monstrous fungoid growth of law which has sprung up without rhyme or reason, entirely haphazard, and with no thought as to its consequences. ” 1 ! — Professor William Prosser on libel law (1953) ! ! Between the sheer wealth of academic commentary on defamation, and the many decided cases on same, there is material enough to inspire a PhD thesis, let alone an LLM dissertation. Indeed, one’s first discovery in researching defamation law, especially in a technological context, is that so many issues are inter-connected, meaning discussion of one feels incomplete without limited discussion of others. Therefore, by way of an extended introduction, it is proposed to give an overview of the role that defamation law plays in society, the controversial distinction it has long made (and will continue to make) between printed and spoken words, and the obvious difficulty of applying this distinction to modern communications mediums — especially the internet. It is also proposed to set some boundaries on this discussion, thereby establishing which issues warrant closer analysis, and which issues do not.
