Health Services Forum Cllr Kennedy submitted that at present there are no representatives from either the Donegal or Glenties Municipal District sitting on the Health Services Forum and that constituents in both these Districts should be represented. She asked that this matter be considered as to how it might be resolved.

Mobile Phone Coverage in Donegal Cllr Kennedy referred to the ongoing poor mobile phone coverage at a number of locations in Donegal and asked that the matter be raised again with Vodafone.

Ms. B McBrearty asked that Members submit an e-mail listing the particular areas that have poor coverage to herself or Enda Monaghan so that the Head of Information Systems, Mr. Brian Boyle may discuss with Vodafone given they are the Council’s Service provider.

Report in Local Paper Cllr Conaghan expressed his concern at a recent report in a local paper which outlined that a local Councillor had advised that there was little point in submitting motions at MD level. He wanted to put on record that he resents the particular article and confirmed that it was not making reference to him.

Housing Services

Progress reports on Grants, Loans, Casual Vacancies, and Social Housing Support Programme, Tenant Purchase Scheme 2016 and Housing Assistance Payments. Members noted the update reports on Grants, Loans, and Casual Vacancies, Tenant Purchase Scheme 2016, Housing Assistance Payments and Social Housing Support Programme as circulated with the Agenda and presented by Ms. B McBrearty. Ms. McBrearty also gave a verbal update on progress in relation to the reports since they were issued.

Members noted that there is a public consultation by the Department in relation to the Tenant Purchase Scheme 2016 of which Members had been informed.

Members also noted there are new regulations were being introduced for private rented dwellings. It was also noted that the Council has increased activity in its inspection regime.

A number of comments / queries were dealt with as follows;-

In response to a query from Cllr Campbell Ms McBrearty confirmed that the inspections are being carried out by within existing staff resources. In addition a fee is recoupable from the Department for each inspection undertaken. 2

Cllr O’Neill welcomed the CALF units in Ballyshannon. In response to a query Ms. McBrearty confirmed the AHB is responsible for the development, that tenants are nominated by the Council who pay a differential rent to the AHB and that it is responsible for the tendering process. There is currently no tenant purchase scheme available to tenants of Approved Housing Bodies.

MDD/19/17 ROADS / TRANSPORTATION SERVICES REPORT

2017 – 2019 Multi-Annual Restoration Improvement Programme – MD Donegal On the proposal of Cllr Jordan, seconded by Cllr O’Neill, the 2017 – 2019 Multi-Annual Restoration Improvement Programme as presented by Mr. Mc Sweeney was agreed.

MD Donegal - 2017 Restoration Maintenance On the proposal of Cllr O’Neill, seconded by Cllr Campbell the 2017 Restoration Maintenance Programme as presented by Mr. M. Sweeney was agreed.

Footpaths Cllr O’Neill requested that a substantial amount of the roads discretionary funding be set aside for footpath repairs and referred in particular to areas in Ballyshannon. He submitted that within Town Centres in the Municipal District there is a need for massive investment in footpath restoration. Mr. M Sweeney advised Members that if discretionary funding is diverted to footpaths it would involve cuts to other works e.g. street cleaning, drainage etc.

Following a discussion it was agreed that a survey of the footpaths in the Towns in the Municipal District would be compiled with a view to quantifying the costs required to bring the footpaths up to a satisfactory standard. Thereafter priority to be given to maximising funding from other sources and consideration would be given to developing a multi annual programme which would depend the availability of funding.

Super’s Turn, Dunkineely Cllr Kennedy advised that following works by Telecommunications Company at Super’s Turn the crash barrier was covered and now required attention. She also asked that the ‘dangerous bend’ sign be reinstated at the location. Mr. M Sweeney confirmed he would follow up these matters.

Parking in Killybegs – Department of the Marine In response to a request that a meeting be arranged between the Roads Department and the Department of the Marine to discuss parking in Killybegs, Mr. M Sweeney undertook to do so.

Public Lighting Ballyshannon Area In response to a request from Cllr O’Neill that Airtricity repair a number of public lights at different locations in the Ballyshannon Area, Mr. M Sweeney undertook to raise the matter with Airtricity.

Trees at public lands at Assaroe View, Ballyshannon Mr. M Sweeney advised that he would investigate the matter of dangerous trees at Assaroe View as raised by Cllr O’Neill. He confirmed that he would make arrangement to make the trees safe if located on public lands, however, if on private lands he would contact the landowner to do so.

MDD/20/17 PLANNING CONTROL REPORT

Mr. Gerard Kellett, Assistant Planner, Planning & Economic Development was in attendance to deal with planning matters. He noted the reports as circulated with the Agenda. He also informed Members he would circulate an update report on Unfinished Estates to Members via e-mail shortly as referred to in the presentation circulated.

A number of other planning matters were dealt with as follows;-

ESB Fence in Ballyshannon Cllr O’Neill again raised his ‘ongoing concerns’ in relation to the ESB Fence in Ballyshannon. He advised that the RNLI had recently undertaken a resource drill in the river and submitted that a video highlighted the difficulty with the height of the fence.

He brought to the attention of the meeting correspondence to the Planning Office from the Council’s Water Safety Officer highlighting concerns with the height of the fence. He also brought attention to a report by an Executive Planner which outlined that all the planning conditions in relation to the application had not been adhered to i.e. the landscaping had not been completed

In response, Mr. G Martin informed Members that this matter had to be dealt with as constructively as possible. Following the previous Municipal District meeting, he had discussed the matter with the Senior Planner. He submitted that the Council has a particular role as a Planning Authority and the Senior Planner had advised that all of the Planning Conditions had been materially complied with.

He further confirmed that the ring buoys were positioned on the bridge independently, in conjunction with input from Irish Water Safety representatives locally.

In addition to this he advised Members that the ESB had to have due consideration for the health and safety of its employees and that this may be the primary reason for the area having to be fenced in the manner in which it was. 4

Cllr O’Neill did not accept this, he submitted that the ESB did not own the lands at the ‘tailrace’; had fenced same so that they could sell off the facility; that they had not dealt with the Health & Safety concerns; that the landscaping conditions had not been complied with. He re-iterated that he did not accept that the planning conditions had been complied with.

Mr. Martin again advised that the Senior Planner confirmed that the planning conditions had been substantially complied with. Cllr O’Neill would not agree and expressed a view that this response reflected incompetence. Mr Martin responded indicating that he could not accept any such suggestion as it was unfounded and that it was not appropriate to call a Senior Planner incompetent. Cllr. O’Neill was also asked by Cllr Campbell to withdraw the remark. Cllr O’Neill clarified that it was the Senior Planner’s opinion in this matter, of substantial compliance with the planning conditions that was incompetent.

Mr. G Martin suggested that a bi-lateral meeting be arranged with the Senior Planner and Cllr O’Neill which Mr. Martin would facilitate to clarify matters.

Mr. G Martin re-iterated his offer to facilitate a bi-lateral meeting with relevant staff and Cllr O’Neill to clarify the matter.

Cllr Conaghan submitted that this matter would be best dealt with as suggested by Mr. Martin, by facilitating a meeting with the relevant officials and confirmed the need for all Members and Officials to work together as it was only by discussion that the matters will be resolved.

Cllr Campbell enquired if there had been an official complaint made to the Planning Authority in relation to the ESB Fence as if there was the matter would go through the normal unauthorised development process. He submitted that the Members’ role in relation to Planning is of a policy nature, rather than involvement in the decision making process which he believed is not for Members.

In conclusion, it was accepted by Cllr O Neill that Mr. Martin would facilitate a meeting of relevant Council Officials and Cllr O’Neill to clarify matters at an early date.

Approach Roads to Towns Cllr Kennedy asked that Mr. G Kellet examine the approach road to Killybegs on the shore side as it requires attention. Mr Kellett advised Members he would be available to attend if the arrangements are made.

Derelict Sites in Town Centres Cllr O’Neill raised the matter of the site of the Millstone Hotel located in Ballyshannon owned by an Approved Housing Body He advised that he is not satisfied with the response of the AHB to cleaning up the site which in turn which detracts from the properties in this area of the Town. He asked that Donegal County Council take immediate steps to fulfil its obligations under the Derelict Sites Act, 1990 by adding the site to the Register of Derelict Sites and charging an annual levy. He also requested that the Council Compulsorily Purchase the site of the levy is not paid.

Mr. G Martin informed Members he would bring this matter to the attention of the Planning Service and provide update at next meeting.

MDD/21/17 COMMUNITY AND DEVELOPMENT REPORT

Members noted the Activity Report circulated with the Agenda and presented by Mr. B McLaughlin in relation to the following activities:

Mr. B McLaughlin informed Members that a number of the time capsules are still awaited from the Youth Council.

Development Fund Initiative, 2017 Mr. B McLaughlin circulated the Development Fund Initiative 2017 Donegal MD list as agreed at the earlier workshop.

On the proposal of Cllr Conaghan, seconded by Cllr Campbell, Members agreed the Donegal MD allocation of €120,000.00 for 2017 as set out over the page.

A number of comments / queries were dealt with as follows;-

Funding for Abbey Centre, Ballyshannon Cllr O’Neill welcomed an announcement of €164,000.00 for the Abbey Arts Centre in Ballyshannon and commended the management committee for their work and dedication.

Equipment at the Mall Park, Ballyshannon Cllr O’Neill asked that an inspection and subsequent repair works be carried out of exercise equipment in the Mall Park. Mr. B McLaughlin confirmed he would bring this matter to the attention of Mr. Eamonn Boyle.

MDD/22/17 ENVIRONMENT SERVICES REPORT

Mr. Suzanne Bogan, Waste Awareness Officer presented the report circulated with the Agenda dealing with the following updates:

• Green Schools • Smoky Coal • Tidy Towns Amenity Grant • Anti-Litter Campaigns • Bikes 4 Africa • Enforcement Figures • Public Conveniences

Ms. Bogan also updated Members on matters arising from the previous meeting as follows;-

Bring Banks, Ballyshannon Ms. S Bogan informed Members that the Rock Site in Ballyshannon had been assessed and is not considered suitable for Health and Safety Reasons for the location of bring bank facilities. She confirmed that the Council is looking for an alternative site in Ballyshannon.

Cllr O’Neill submitted that the Market Yard site in Ballyshannon may not be suitable for extending the bring bank facility as there is development due in this part of the town.

Bring Banks, Malinbeg Ms. S Bogan advised Members that the proposed site in Malinbeg has been assessed and is suitable. The Environment Section is awaiting confirmation from the service provider that they can provide the service. Members will be kept informed of progress in relation to this matter.

Circus Posters Ms. S Bogan informed Members that a number of fines had been issued in respect of the removal of posters to two Circuses, one of which had paid. She informed Members that the Council will continue to follow up with the Circuses if they return to the return to the County in 2017.

A number of comments / queries were also dealt with as follows:

Public Toilets in Ballyshannon Cllr O’Neill queried if there was any update in relation to the toilets following a recent inspection and requested that they be upgraded for the 2017 visitors’ season. Ms. S Bogan advised Members she would provide an update on this matter at the next meeting.

Request for Portaloos for Rowing Clubs Cllr Jordan advised that he had a request for the Council to provide portaloos at a number of locations where Rowing clubs train. In response Ms. S Bogan requested that a list of the requested locations be provided and she would have the matter followed up for consideration.

Reporting of Environmental/Litter Pollution Cllr Campbell referred to an article in the “Catchments Newsletter” in relation to the reporting of pollution online. He queried if there is a system of feedback to complainants on the outcome of complaints. Ms. S Bogan informed Members she would include the promotion of the online system for reporting litter/pollution as part of the 2017 campaign and will also refer the query in relation to feedback to complainants to headquarters for follow up.

MDD/23/17 DISCUSSION ON REQUEST TO SEEK FUNDING TO EXTEND FOOTPATH FROM DONEGAL TOWN TO KILLYMARD

On the proposal of Cllr Jordan, seconded by Cllr conaghan the following motion was adopted;-

"I am asking this Municipal District to seek the necessary funding to extend the footpath from Donegal Town to Killymard School”.

Members were advised;-

“Funding in excess of €200,000.00 would be required to extend a footpath by 900m between Donegal Town to the school at Killymard. In order for these works to progress the Members will need to agree onn a source of funding for same.

The Members are aware that in the last few years DCS money has being used as a source of funding to upgrade existing footpaths but the amounts available are quite small when each engineering area 9

is considered. Therefore given the state of our existing footpath network I recommend that any monies that are available to spend on footpaths should be spent on upgrading the existing network before we consider constructing new sections of footpaths such as the one proposed.

Note that in the recent past the roads office has received requests for footpath extensions in Ballyshannon, Laghey, Frosses, Dunkineely, Kilcar, Carrick, and Glencolumbkille but unfortunately none of these can be advanced until such time as the necessary funding is available .”

Cllr Jordan in speaking to his motion submitted that the motion speaks for itself and referred to a petition submitted to the previous Roads /Transportation Area Manager in this regard. He advised there are 225 pupils attending Killymard National School and that while an active lifestyle is encouraged in schools it is not safe for the children attending this school to walk due to the lack of a footpath. Cllr Jordan advised that there is agreement from the relevant landowners to provide the land free of charge. He submitted that the Council should proceed to Part VIII Planning for the footpath and proceed to fence off the land.

Cllr Conaghan in supporting the motion submitted it would be helpful if the land is guaranteed and noted that there are pressures on the Council’s resources for footpaths.

Mr. M Sweeney informed Members that the cost of the footpath would be approximately €200,000.00 and that all towns in the District are looking for similar extensions to footpaths and that all such requests are subject to availability of funding. He informed Members he would proceed and speak with the relevant landowners and if there is agreement, the Council could proceed to fence off the land and prepare the Part VIII Planning in order that the project would be ready to go in the event that funding becomes available.

MDD/24/17 DISCUSSION ON REQUEST TO ADVANCE ON TALKS AND PLANS WITH TII IN RELATION TO THE ROAD FROM DUNKINEELY THROUGH TO KILLAGHTEE

On the proposal of Cllr Kennedy, seconded by Cllr Conaghan the following motion was adopted;-

"I am calling on this MD of Donegal to advance on talks and plans with the TII in relation to the road from Dunkineely through to Killaghtee and on to Bruckless for safety of pedestrians and cyclists on the roadsides”.

Members were advised;-

“Subject to adoption of this motion the Roads Office will advance talks with the TII.”

In speaking to her motion, Cllr Kennedy submitted that there are a lot of walkers and cyclists on the road from Dunkineely through to Killaghtee and that the community here have been looking for the works to be carried out on this road for a long time. She requested that the Council meet with TII to try to progress the matter.

Cllr Conaghan in supporting the motion submitted there is a particularly bad area where there is a dip in the road.

Mr. M Sweeney informed Members he would arrange to meet with the TII and inform Members of the outcome of the same.

MDD/25/17 Correspondence received – Water & Communities Office Ms. B McBrearty briefed Members in relation to the Water & Communities office and the booklet circulated explaining the functions of the office. She also circulated the Catchments Newsletter – Issue 4: Winter 2016. She explained that the Local Authority Waters and Community Office had been established as a result of the European Union (Water Policy) Regulations 2014. She advised Members that Mr. Jimmy McVeigh who is working on this matter is based in Donegal PSC and is available to meet with Members if they wish.

MDD/26/17 Date of next meeting

Members agreed the next Municipal District meeting would be held on Tuesday the 14th March, 2017 commencing at 11.30 am as per Standing Orders.

Members also agreed to hold a workshop on the morning of the March meeting (14/3/2017) to commence at 10.30 am to discuss the feedback from the public consultation in relation to the Lough Eske Junctions .

1. Draft 2017-2019 Multi-Annual Restoration Improvement Programme Mr. Mark Sweeney, Area Manager, Roads / Transportation introduced Mr. Peter Kane to who has taken up the position of Roads Area Engineer covering the Donegal area. He confirmed that Mr. D Gillespie is now covering the Killybegs area as Mr. Freney has transferred into water capital.

Members welcomed Mr. Kane to the Area and expressed their good wishes to Mr. Freney thanking him for all his work in the area.

Mr. M Sweeney presented the Draft 2017-2019 Multi-Annual Restoration Improvement Programme, as circulated with the Agenda.

Following a discussion, on the proposal of Cllr Conaghan, seconded by Cllr Kennedy, Members confirmed their agreement to the programme as presented noting that it would be brought to the MD Meeting for formal adoption.

2. Draft 2017 Roads Restoration Maintenance – Regional Roads Mr. M Sweeney presented the Draft 2017 Roads Restoration Maintenance – Regional Roads as circulated with the Agenda. A number of comments / queries were dealt with at the workshop

On the proposal of Cllr Conaghan, seconded by Cllr Jordan, Members confirmed their agreement to the draft programme as circulated, noting that it would be brought to the MD Meeting for formal adoption.

3. Members Development Fund Initiative 2017 Mr. B McLaughlin outlined the application process followed for the Development Fund Initiative 2017. On the proposal of Cllr Conaghan, seconded by Cllr ONeill, Members agreed to accept the list from Cllr McEniff as submitted on his behalf by Cllr Conaghan in his absence. Following a lengthy discussion Members agreed the DFI allocation for 2017 noting that it would be brought to the MD meeting for formal adoption.

4. Memorial in honour of the late Mr. James White (former TD and Hotelier) Ms. B McBrearty asked Cllr O’Neill if he had a chance to discuss the matter of the memorial with the late Mr. James White’s family. He advised that he had and they are to revert to him shortly.

5. Delegation from MD Donegal to Meet Minister for Transport Cllr Kennedy referred to the arrangements for a delegation from the MD of Donegal to meeting with the Minister for Transport, Mr. Shane Ross TD. On the proposal of Cllr Conaghan, seconded by Cllr Jordan it was agreed that the purpose of the delegation would be to discuss both Fintra and Tirconaill Bridges. It was further agreed that all Members of the MD could attend the meeting which is due to be held at 3.30 pm on the 27 th February 2017. It was also noted the Mr. John G McLaughlin, Director of Service would meet with the Members prior to the delegation.

6. Access to Tullan Strand Mr. G Martin briefed Members on the updated position on the access to Tullan Strand. He advised that the documentation outlining the preferred access route would come before the Members in due course.

A number of comments / queries in relation to this matter were dealt with at the workshop.

Additions to the Record of Protected Structures – Phase 1

1.0 Introduction

At the Full Pleanary Council meeting of 31st January, 2017 a strategy for a three-phased approach to a programme of additions to the Record of Protected Structures was discussed arising largely as a result of recommendations received from the Minister for additions to be made to the Record (*). It was decided that decisions on additions to the Record of Protected Structures were to be taken at a Municipal District Level (as provided for under Section 131A of the Local Government Act, 2001 and Schedule 14A, Part 2). It was further agreed that workshops would be held in advance of Municipal District meetings to discuss in detail the proposed Phase 1 additions.

This report now provides details to Members in relation to the proposed Phase 1 additions for their area(s). The additions for each area are comprised of two sub- groups:

a. structures falling within Tier 2 Local Area Plan towns in each area- ballyshannon, Donegal Town and Killybegs in the case of Donegal MD; and

b. a small number of other properties in each MD area, located outside the Tier 2 Local Area Plan Towns but the subject of longstanding requests to the Council to have them considered for addition.

There are 102 proposed additions for the town of Ballyshannon, Donegal Town and Killybegs. Furthermore, there are three structures in the remainder of the Donegal MD area that has been proposed for addition.

The details of these structures are set out in Appendix 1 of this document. There is a photo and location map together with the NIAH Ref number, the name and address, a description of the structure together with the individual rating and importance values of each structure.

Footnote (*) The Minister is using this NIAH process as the mechanism to make recommendations to Donegal County Council concerning the inclusion in its Record of Protected Structures of particular structures or specific parts or features thereof as per her entitlements under Section 53 of the Planning & Development Act. The Minister is recommending that only ‘National’ and ‘Regional’ buildings for addition to the Record of Protected Structures and it is the decision of Donegal County Council as to whether they would like to add any structures on the NIAH list that have a ‘local’ rating.

2.0 Composition of Built Heritage in Donegal MD

There are 685 NIAH Structures in Donegal Municipal District. A portion of these are on the RPS already.

3.0 Additions to the Record of Protected Structures

The Phase 1 additions to the Record of Protected Structures consists of:

1) National and regional rated structures contained on the National Inventory of Architectural Heritage located within Tier 2 Local Area Plan towns of a) Ballybofey & Stranorlar b) Ballyshannon c) Bridgend d) Carndonagh e) Donegal Town f) Killybegs

2) A total of 14 other structures which are of national and regional rating contained on the National Inventory of Architectural Heritage located outside the Tier 2 Local Area Plan for which the Council is in receipt of requests for the structures to be added to the Record of Protected Structures.

There are three Tier 2 Local Area Plans that fall within the Donegal Municipal District, namely Ballyshannon, Donegal Town and Killybegs. The table below outlines the recommended additions in each Tier 2 local Area Plan town. There are 102 structures in total within the Donegal MD Tier 2 Towns.

As mentioned above it is intended to consider the addition of a small number of other structures located outside the Tier 2 Local Area Plan but for which the Council is in receipt of requests for the structures to be added to the Record of Protected Structures. There are 14 in total and 3 of these are located within the Donegal Municipal District.

1) In total the additions for the Donegal Municipal District amounts to 105 structures which are laid out in a table in Appendix 1 and the 105 structures are made up as follows: a) Proposed additions in Ballyshannon = 52 b) Proposed addition in Donegal Town = 35 c) Proposed additions in Killybegs = 15 d) Proposed 3 additions requested by the public =3

Project Description/Activity Donegal Town Hub - The broad elements to this Development Hub are Enterprise Development, Retail Strategy and Tourism ------CEDRA - Following the success of the Certificate in Marine Tourism and Seafood Fundamentals course that was delivered in 2016, as part of the Donegal Costal Trail Project, the course is now open for applications for 2017 with the next course due to start on 1 st February 2017. This part time course has been developed by LYIT’s School of Tourism for people working in the marine tourism and seafood sector. The Certificate in Marine Tourism and Seafood Fundamentals is funded by Údarás na Gaeltachta and Donegal County Council. As the course is fully funded, it is free of charge for participants and offers a recognised academic qualification on completion and opportunities to progress to further education.

Donegal’s Atlantic Coastal Trail is an innovative food and marine tourism project focused on marine leisure and seafood experiences, which will advance rural, coastal and island economic development in County Donegal. The goal of this project is to raise awareness of the excellent marine leisure and seafood opportunities on the Donegal coast and islands and to encourage local communities to experience our own marine leisure activities and seafood coast that is right on our doorstep and perhaps unexplored. The inclusion of the islands adds an additional unique element to the project where visitors can experience something different and unexplored. The project will help local marine leisure activity providers, restaurants and pubs to work together to bundle their offering and create experiential packages that can be enjoyed by locals and visitors alike. This will reduce seasonality by offering experiences that are available all year long.

Donegal’s Atlantic Coastal Trail is promoting the further development of tourism along the coast of Donegal on the Wild Atlantic Way is funded under the Department of Agriculture, Food and the Marine Commission for the Economic Development of Rural Areas scheme (CEDRA), Donegal County Council and Údarás na Gaeltachta.

Cool Route Project funded under the Northern Periphery & Arctic programme 2014-2020.

Donegal County Council is a project partner on the Cool Route project. Other project partners include Glasgow Caledonian University, Royal Cork Yacht Club, Derry City Council, Port Authority Torshavn Faroe Islands, Blue Seas Marinas Scotland, Western Norway Research Institute and associated partners Donegal Tourism, the Irish Cruising Club and Sail Scotland.

The project merges all aspects of the practical logistics and business potential to establish a bi-directional yacht cruising route along the offshore areas of the Northern Periphery Area, stretching from the South of Ireland, to the UK (Northern Ireland and Western Scotland) on onwards to Norway.

Donegal County Council is responsible for the Communications Work-package of the project.

Sliabh Liag – Interpretative Strategy – the explicit intentions of Donegal County Council are that this strategy would:

• Develop Sliabh Liag as a flagship tourism destination along the Wild Atlantic Way. • To protect and promote the natural and built environment at Sliabh Liag. • To improve the visitors experience at Sliabh Liag, encouraging visitors to stay longer at Sliabh Liag and its hinterland.

It was intended that, with the seed funding supplied during those three years, many of the funded community based events would grow and eventually develop independently beyond the lifetime of the initiative.

Donegal County Council has not been advised about any further community funding scheme.

Donegal PPN will also provide representatives onto the Tourism Forum.

The purpose of Donegal County Council’s Tourism Forum is to serve as a forum for consultation, discussion and recommendations on matters affecting tourism in the County. The forum has a role in collaborative measures that can enhance the overall efforts to address key issues that affect how we market and promote the county. The forum also seek s to influence decisions within new areas of product development and share both knowledge and experiences amongst its members which ultimately assists in the promotion of the county.

Progress to date within WILDSEA Europe the last two WILDSEA Europe is a project based on the creation of a months/quarter 4 - sustainable wildlife watching tourism route across Spain, inclusive of current status Ireland, Northern Ireland, Croatia and Italy. The website www.wildsea.eu has now had over 37k visits since it was launched and an online marketing campaign to promote the website is underway. Several experience providers in Donegal have now taken part in online training sessions and are now actively using the online booking system associated with the Wildsea.eu website. More training is planned in the coming weeks.

WILDSEA Divers A new project is in development as a continuation of the Wildsea Europe project. This new project focuses on diving as a niche watersports activity in the partner regions across Europe. MalinWaters Following the meeting with MalinWaters partners in December 2016, partners are in the process of being invoiced for 2017 financial contributions for the continuation of marketing activity as set out in the Marketing Plan for 2017.

A Facebook advertising campaign is ongoing with over 10,970 likes on the MalinWaters Facebook page. New content is published on a regular basis. @sailmalinwaters has 914 followers on Twitter.

11 applications for MalinWaters festivals and events funding have been received from all regions. The deadline for submissions is 28 th February 2017. Marine tourism activity provider’s listings are being updated on MalinWaters.com on a regular basis.

National Geographic Following Donegal being named coolest place on the planet an invitation was extended to the Managing Director and Publisher of National Geographic Mr. Matthew Jackson to visit Donegal on 7 th and 8 th February. Mr. Jackson had the opportunity to discuss future marketing activities and to meet with key representatives from the tourism sector in Donegal.

Marine Sector Newsletter Several newsletters aimed at the marine tourism sector have been sent out to over 200 contacts on the marine tourism sector database. This e-newsletter contains digital tips, funding information and other useful news relevant to the sector.

Donegal Tourism Ltd – Trade Website New content has been added to the Donegal Tourism Ltd trade website with information on recent activities of Donegal Tourism Ltd. This website is available at www.countydonegaltourism.com and features sections such as news, events (tourism conferences etc), useful downloads, resources, digital tips and much more. There is also a Facebook page where the trade can keep up to date with latest news from the tourism sector at www.facebook.com/donegaltourism

Cruise Tourism Donegal County Council in association with Donegal Tourism Ltd are working towards the development of the cruise tourism sector in Donegal with both Killybegs and Greencastle promoted as cruise ports of excellence on the Wild Atlantic Way.

Donegal County Council and Donegal Tourism Ltd are working closely with Visit Inishowen and the Killybegs Information Centre to continue to develop this sector.

Draft designs for flags and promotional materials for Greencastle have been sent for approval and are currently being further developed.

CEDRA – Donegal’s Atlantic Coastal Trail A second run of funding has been obtained to continue to develop the CEDRA funded project entitled the ‘Donegal Atlantic Coastal Trail’. This funding comes from the Department of Food, Agriculture and Marine and is a continued partnership between Donegal County Council and Údarás na Gaeltachta, who have both provided additional match funding.

The Tourism College LYIT has commenced the Marine Tourism Marketing and Seafood Fundamentals course in January 2017 at full capacity following the success of the course in the previous year.

A further initiative under the CEDRA funding is coming soon and involves Transition Year students at two secondary schools who will be provided with experience and guidance in terms of marine tourism opportunities for their future career.

Fanad Lighthouse Donegal Tourism Ltd has delivered a new online booking engine and website for Fanad Lighthouse and this has been delivering bookings since the lighthouse opened so that online accommodation bookings can be facilitated. The Fanad Lighthouse website is performing very well. Facebook.com/fanadlighthouse and has over 4064 likes. @fanadlighthouse on Twitter has 713 followers.

Sliabh Liag Donegal Tourism Ltd set up and is managing the Sliabh Liag online profile until such time as a manager has been appointed to the Visitor Centre and this will be handed over with training provided. The Sliabh Liag Experience Facebook page is growing from strength to strength with over 5058 likes on the page. The Facebook page is www.facebook.com/sliabhliagexperience. The website www.sliabhliag.com is also performing well. Sliabh Liag has been awarded a Certificate of Excellence on TripAdvisor. @visitsliabhliag on Twitter has 223 followers. BIM FLAG Programme Information on FLAG funding from BIM has been circulated. The deadline for submission of applications is 16 th March 2017. Further calls for applications will be made later in the year.

Project Targets for the WILDSEA Europe Project next bi-monthly/quarter Work is ongoing on the continued recruitment of experience 1 reporting period providers in Donegal to get listed on Wildsea.eu. Webinars and online one to one training sessions continue to assist them in making the most of their listings and the online booking engine. Marketing activities to promote the www.wildsea.eu website platform are ongoing.

Wildsea Divers An application for EU EASME funding will be submitted in March 2017 for the WILDSEA Divers project in which Donegal County Council will be a partner. This project is a follow on to the successful WILDSEA Europe project and builds on the work already done as part of that project including the further development of the website platform www.wildsea.eu

Lonely Planet Talks are underway with the Marketing Team that represents the Lonely Planet brand to discuss a range of advertising and marketing opportunities to promote Donegal.

Promotional Events 2017 Planning for attendance at promotional events in 2017 is ongoing including for example attendance at SeaFest in Galway 2017, the Northern England Boat Show/Merseyside River Festival etc. MalinWaters Marketing Activity Further activities to promote the MalinWaters brand across a range of marketing platforms including e-mail, display, PPC, content, SEO and more will be ongoing in Q2 and Q3. More detailed reports will be available in Q3 on the results of the marketing activity.

Support of Marine Festivals and Events 11 applications for MalinWaters festivals and events funding have been received from all regions and will be jointly assessed by MalinWaters partners following the deadline for submissions on 28 th February 2017.

FLAG BIM Funding The first batch of FLAG funding applications will be assessed in Q2 following the deadline for submissions on 16 th March 2017. Further calls for funding applications will be made later in the year.

Sliabh Liag Project Work will continue on updating the content on the Sliabh Liag website. The TripAdvisor, Facebook and Twitter pages will continue to be maintained by Donegal Tourism Ltd.

Fanad Lighthouse Developments Donegal Tourism Ltd continues to provide support and maintenance for the www.fanadlighthouse.com website.

Marine Tourism Newsletter Further updates will be sent out to over 200 marine tourism contacts via the e-mail newsletter.

CEDRA Marketing activity in relation to Donegal’s Atlantic Coastal Trail will be prepared for promotion of the region as part of the 2017 marketing campaigns from Donegal Tourism Ltd.

Joy Harron of Donegal Tourism Ltd will be lecturing the students at Killybegs Tourism College LYIT in Q2 on marine tourism fundamentals and digital marketing tips.

Cruise Tourism Collaboration on cruise tourism as part of the MalinWaters consortium will be explored including potential membership of Cruise Europe, Cruise Scotland. Work on the Greencastle Cruise Tourism supports including production of new flags and a presentation folder is ongoing. Advertisement of Donegal as a cruise destination of excellence is planned for several key cruise publications on world-wide cruise markets.

Cruise Survey MalinWaters A survey of MalinWaters partners in relation to cruise tourism is planned. This survey will gather information on key ports, attractions etc. in each region with a view to producing a more detailed online and offline representation of the MalinWaters cruise tourism offering. This can then be promoted to a range of cruise operators and handling agents around the world.

Cruise Ireland Membership of Cruise Ireland is ongoing and marketing activities are planned in relation to this marketing association to cover Donegal. Representation at key cruise tourism promotional events will raise awareness of cruise tourism in Donegal.

Marine Tourism Seminar Following the success of the 2016 Marine Tourism Seminar, another will be planned for 2017 and will be likely to take place in Q3. An application for funding to the Marine Institute to cover some of the costs of a Marine Tourism Seminar is currently being completed.

Gaeltacht and the Islands Work is underway to develop a plan for the promotion of the Gaeltacht and islands as part of the overall marine tourism strategy.

Welcome Sign A new welcome sign in English and Irish languages is being produced for the entrance area to Donegal Airport by Donegal Tourism Ltd in association with Donegal County Council.

with key travel professionals, proved to be a wonderful platform to promote our tourism offering to potential Scottish holidaymakers.

Also in attendance, as an invited guest, was one of Donegal’s favourite sons and resident of Glasgow, International Football Legend Packie Bonner, who proudly flew the Donegal flag.

Holiday World Show

Donegal has been extensively promoted over two weekends at the Holiday World Shows in Belfast and Dublin.

The Dublin Holiday World Show saw over 43,000 people making their way to the RDS in Dublin and over 22,000 in Belfast Titanic Exhibition Centre.

This is the second year running that a combination of Donegal Tourism staff, tourism organisations and local businesses have joined forces to take part in the Holiday World Show and let people know just what Donegal has to offer.

Attendees at the Holiday World Exhibition were pleasantly surprised with the value for money and quality of accommodation within the county and Donegal Tourism staff were on hand to inform potential holiday makers of some of the many accolades that Donegal had recently received, including being named as the National Geographic Traveller’s “Coolest Place on the Planet 2017”, listed as the “Most Beautiful County in Ireland” by the popular website ‘”Ireland Before You Die” winner in the ‘Ireland’s Hidden Gem’ category in the inaugural Irish Independent 2017 Reader Travel Awards and the exposure from the filming of Star Wars at Malin Head.

Donegal Tourism is kicking off our domestic campaign with an advertisement on TV3, 3Be and 3e on the 13 th March. We are currently getting the production of the video ready. This video will highlight that Donegal has been awarded the National Geographic award for 2017 and also highlight the Wild Atlantic way in Donegal. A schedule of dates has be sent to all councillors in advance of this being aired.

Managing Director and Publisher of the National Geographic Visits Donegal

Donegal Tourism Ltd and Donegal County Council were delighted to welcome Mr. Matthew Jackson the Managing Director and Publisher of National Geographic to County Donegal on 7th and 8th February.

Mr. Jackson enjoyed two days of touring Donegal and visited many places including Sliabh Liag, Glenveagh National Park, the Gaeltacht region and many more.

The visit of Matthew Jackson from National Geographic Traveller to Donegal is only the beginning; this is the first step in building a strong relationship between Donegal and the world famous National Geographic brand. We have discussed many opportunities to work together and we look forward to showcasing Donegal to a worldwide audience.

Discussions around the possibility of more collaboration between Donegal Tourism Ltd and National Geographic took place and the team will be working with closely with National Geographic in the coming weeks to develop an exciting marketing campaign.

Green Golf Travel

Donegal teamed up with Green Golf Travel to share a stand in a Munich Golf Event on the 24 th to 26 th February 2017. Green Golf Travel promoted Donegal Tourism and Donegal as a golfing destination distribute Donegal brochures and maps to visitors to the stand. There is expected to be in excess of 40,000 golfers at this event and Donegal is the only Irish stand at this trade show. Donegal was the only county in Ireland represented at this event and as a result bookings have commenced for 2017 golfing holidays in Donegal. Project Targets for the Donegal Airport nominated for the most scenic landing in next bi-monthly the World reporting period An independent panel of travel industry experts and influencers have chosen this year’s shortlist of 36 global airports, and Donegal Airport has been nominated.

Donegal tourism are working closely with Donegal Airport to help promote this. The airport that receives the most consumer votes will win the coveted top spot. Donegal Airport reached 7th in the world last year.

French and German Advertising Donegal Tourism has created a 30 second advertisement in French and German and is launching this advertisement online to the French and German market.

The campaign includes Donegal 30-second ad highlighting Donegal, as well the Wild Atlantic Way in Donegal targeting the important ‘culturally curious’ audience. The ads will be advertised on various French and German websites along with Youtube – encouraging potential holidaymakers to put Donegal on their holiday ‘wish-list’ for 2017.

France and Germany is one of the top four markets for tourism to Ireland.

Greening Donegal

Donegal tourism is working with the trade to green landmarks in Donegal. A radio campaign with highland radio is kicking off in early March to encourage people to get involved.

This is the third year that Donegal Tourism has undertaken 'Greening Donegal' and it has grown from strength to strength, with lots of new buildings taking part every year.

With Donegal named as the Coolest Place in the World in 2017, this year we want to put Donegal firmly on the map when it comes to St. Patrick’s Day Greening!

We would encourage everyone in Donegal to come together to green local landmarks, attractions, heritage sites and any other places or buildings that would look great in green! By working together we can make Donegal the Greenest County in Ireland for 2017.

Project The Donegal Age Friendly Strategy is a 3 year plan which aims to make Description/Activity Donegal a great place to grow old in. The implementation of the strategy is overseen by the Age Friendly Alliance, a stakeholder committee chaired by the CE of Donegal County Council Budget (if € applicable)

Progress to date Older Persons Council Executive within the last quarter The last meeting was held on Monday 20 th February, where Greg Price of the HSE quality improvement division gave a presentation on the “Listening to Older People” national report which has been compiled from feedback received from older people on their experiences with the health services. This feedback was based on listening meetings between the HSE and older people which were held in six local authority areas in 2015 including Donegal.

The themes Identified in the listening report were:

1- Poor communication between healthcare staff and patients

2- Lack of respect and compassion for older people 3- Poor hygiene in acute hospitals 4- Long waiting times in outpatients departments and inconsiderate appointment scheduling 5- Lack of hot meals in emergency departments 6- Delays in arrival of ambulances 7- Need for more GP’s in rural areas 8- Support groups for carers valuable 9- More home help hours needed 10- Inadequate public transport to hospitals Mr Frank Morrison, Head of Social Care CHO1 and Ms Gwen Mooney, Service Manager, Older Peoples Services also attended this meeting to discuss Health Matters for Older People in Donegal.

Older Persons Health and Wellbeing day out with GAA The Donegal Older Persons Council Executive which was established last year continue their work to help make County Donegal a better place to grow old in. This work assists in the implementing of Donegal County Councils Age Friendly Strategy. A big part of our strategy are things called social inclusion and social participation, what that means is that people, as they grow older, are still given chances to take part in activities they would have done when they were younger, to make sure older people don’t get too used to the idea of staying at home, therefore, a Health and Wellbeing day out for Older people was organised by the GAA Health and Wellbeing committee in Partnership with the Older Persons Council, Donegal County Council . This event took part on Sunday the 26 th of February at the Dublin and Donegal Game in Ballybofey, which also celebrated the 25 th anniversary of Donegal beating Dublin to win an all Ireland Final in 1992. Forthy Older People were individually identified by the GAA Clubs, taking into consideration the importance of social inclusion and social participation for those who are living in isolated areas and invited them to reception in the Villa Rose where they got to meet some of the 1992 team and the Sam Maguire Cup. The older people were then taking to their seats and enjoyed the atmosphere of the Dublin V’s Donegal game. Days like this is of huge benefit to an older person and it’s something the Council was delighted to get the chance to have been involved in.

Project The Pride of Place Competition is hosted by Cooperation Ireland under Description/Activity its Local Authority Programme which highlights the Local Authorities

commitment to supporting active community groups who undertake initiatives to improve their communities and regions. Entry is by way of council nomination followed by interview on a county basis. Each local Authority may nominate groups in up to a maximum of five categories in all and one entry only in any individual category. This year there are five population categories, three single issue categories with designated themes, a housing estate category, an Island and coastal communities category and an urban neighbourhoods category making eleven categories in total. The last three categories are not population specific. Each local authority may nominate groups up to a maximum of five categories in all, and one entry only in any individual category.

Progress to date within Recreation Grant 2016 : the last two months/quarter 4 - Sli Cholmcille €7,385 maintenance and upgrade of this route. Some inclusive of current maintenance work has been done and the route was inspected on status November 2016. Any issues identified will be addressed as soon as we

receive the report from the National Trails Office including representations

made about part of the route at Carrick opposite the National school.

The Colmcille Drum loop and tower loop were also inspected.

We are also finalising the routes for proposed local walks in and around

Kilcar with the support of DFI Funds to be agreed February. Materials are

ordered and trail head sign for the village is being designed.

The Hiking Europe project continues where Service providers along the route can submit their details for inclusion in marketing the area which will promote the Bealach na Gaeltachta as a Hiking destination. Anyone interested can click on

Repair works was also carried out at Slieve League where the wooden fencing was upgraded at the viewing area.

Other proposed projects include: The upgrading of the existing walks and trails to an acceptable standard to meet the requirements of the National Trails Office.

Stop Food Waste Challenge - Get Involved!

In 2016 the Council ran a successful Stop Food Waste Challenge with the Mevagh Resource Centre. Any interested community groups or Tidy Towns groups are asked to make contact with the possibility of facilitating a SFW Challenge in their area. On average each household throws out between €700 - €1000 worth of food each year. The Challenge is run over 4 - 5 weeks for 1 hour once a week in a local community setting. Coastal Management

Marram Grass Transplanting - Friday 24 th , February, Carrickfinn Beach, County Donegal. On Friday 24 th , February, a section of the Carrickfinn beach dune which had suffered erosion and subsequent blow-out was replanted with marram grass. On the day up to 30 volunteers participated in very threatening weather conditions. They had braved the elements and travelled from as far as Malin, Bundoran and Stranorlar, as well as the local region. Such was the enthusiasm of the volunteers that the entire affected dune area was replanted, giving it much needed support. In time, it is hoped that the work undertaken will assist the dune to recover and rebuild.

Thanks are due to the Carrickfinn Trust for facilitating this initiative, the support of the Donegal Airport, An Taisce, and all the volunteers on the day for their enthusiasm. Straw bales initially buried at the foot of Volunteers harvest the marram grass for the damaged dune. replanting.

Schedule of Municipal District Works (SMDW)

1.0 Background

1.1 Section 58 of the Local Government Reform Act 2014 amends Section 103 of the Local Government Act 2001, inserting a new section (Section 103A), (extract attached) regarding the preparation of a Schedule of Municipal District Works in respect of maintenance and repair for each Municipal District.

1.2 Circular LG27/2014/Fin/21/2014 dated 31 st December 2014, (copy attached) provides further detail in relation to the operational application of this relatively new principle within the Municipal District.

2.0 Primary Issues of Consideration

2.1 The Schedule of Municipal District Works is a relatively new concept that details a plan of repair and maintenance work in each of the respective Municipal Districts and in respect of a number of local service areas. The requirement to prepare a Schedule of Municipal District Works first arose for the financial year 2015.

2.2 The preparation and adoption of the Schedule of Municipal District Work is mandatory, is required to be prepared under the direction of the Chief Executive and requires consideration by the Municipal District and adoption by resolution, with or without amendment, by the members of each Municipal District.

2.3 Whilst it is intended in future years that the Schedule of Municipal District Works is to be prepared and completed broadly in parallel or very soon after the adoption of the Annual Revenue Budget, a deadline date of the 31 st March is being applied for the adoption of this resolution in respect of 2017, as was the case in 2016 and 2015 (as per Circular LG27/2014/Fin/21/2014). It is anticipated that further direction will be provided in future years in relation to the form and content of the Schedule of Municipal District Works.

2.4 The members must have due consideration to the adopted revenue budget (essentially requiring that the schedule as adopted and the expenditure associated with that must be within the parameters of adopted Revenue budget for the County as a whole).

2.5 Should the Schedule not be adopted by the members, the Schedule of Municipal District Work reverts to the full council for the elected members consideration and adoption with or without amendment but in line with subsection 4 of Section 103A.

3.0 Rationale

3.1 The principle of the SMDW is in line with stated objectives incorporated in various government policy documents associated with Local Government Reform.

3.2 It is expected that as the concept embeds that the prospect of additional and wider ranges of activities may be considered for incorporation into the overall schedule.

4.0 Practical Applications - 2017

4.1 This is the third year of the application of this new concept. An approach has been taken to apply a limited number of works areas and to include areas of strategic importance at Municipal District level in the Schedule of Municipal District Works. In this context various aspects of housing maintenance and repair; road maintenance and repair; beach management and maintenance; and litter management have been incorporated.

4.2 The schedule as presented to the Municipal District members does not report on, or represent, all aspects of local expenditure and as such it is expected that as the principle of the SMDW matures over subsequent years that further areas can be incorporated as required. It is proposed that this matter be kept under review by the Corporate Policy Group of the Council and their advice and direction be sought in relation to same.

4.3 It should be noted that in certain instances budgets are held locally e.g. roads maintenance areas whilst others are held centrally e.g. beach management. The rationale and logic for same will be presented at each workshop / meeting where the schedule will be considered but considerations relating to value for money, efficiency, synergies and contingency capacity are all areas that are reflected in instances where budgets may be held centrally for the provision of services locally.

5.0 Further Information

5.1 Also included for your information is a schedule of the discretionary development funds that are available to you through the Development Fund Initiative (monies which were allocated as part of the budget 2017 allocation process) and, furthermore, a schedule of available monies per electoral area in respect of the members development funds, a sum in the amount of €6,350 which is available for allocation by each individual elected member.

6.0 Required

6.1 In line with section 103A of the Local Government Act 2001 (as amended) that the members consider the Schedule of Municipal District Works as presented.

6.2 That the members resolve with or without amendment but within the parameters of available adopted budget the schedule as presented, be adopted in line with the suggested resolution wording as presented.

(1) As soon as may be following the adoption of the local authority budget, a schedule of proposed works of maintenance and repair to be carried out during the financial year in each municipal district shall be prepared under the direction of the chief executive, having regard to the availability of resources, in the manner, format and within the timescale that may be prescribed by regulations made by the Minister.

(2) A schedule prepared for the purposes of subsection (1) shall be considered by the municipal district members concerned and be adopted by resolution, with or without amendment by it, within such time limit and in accordance with such conditions and requirements as may be prescribed by the regulations made by the Minister.

(3) In making an amendment under subsection (2) the municipal district members shall have due regard to the local authority budget adopted in accordance with section 103(9).

(4) If the schedule prepared for the purpose of subsection (1) is not adopted by the municipal district members in accordance with subsection (2) and any regulations made under that subsection, then the local authority concerned shall consider that schedule and by resolution adopt it with or without amendment (having due regard to the local authority budget adopted in accordance with section 103(9)) within such time limit as may be prescribed by the regulations made by the Minister.

Dear Chief Executive, Schedule of Municipal District Works (SMDW)

Legislative provisions 1. Section 58 of the Local Government Reform Act 2014 inserts a new section 103A in the Local Government Act 2001 providing that, following the adoption of the annual budget, a schedule of proposed works of maintenance and repair to be carried out during the financial year in each municipal district shall be prepared, for adoption by the municipal district1 members. The SMDW is, in effect, a plan of works that prioritises and apportions the use, within each municipal district, of funding provided in the overall local authority revenue budget for particular purposes. In the case of local authority areas which do not have municipal districts, while the requirements in this circular relating to the SMDW per se do not apply, it is considered that it would be good practice to prepare a schedule of works in any event to identify where works will be prioritised in the local authority area during the year.

2. The relevant extract from the 2001 Act is attached in the Appendix to this circular. The main elements of this provision are as follows: -

 Preparation and adoption of the SMDW is a mandatory requirement.  The SMDW must be prepared under the direction of the Chief Executive.  The SMDW is to be prepared as soon as may be following the adoption of the annual budget, for consideration and adoption by resolution, with or without amendment, by the municipal district members.  If not adopted by the municipal district members, the SMDW reverts to the full council for the elected members consideration and adoption, with or without amendment.

By virtue of being adopted at district level, the SMDW represents an important enhancement of subsidiarity in local government. The provision is fundamentally important to the new system of governance at sub-county level, giving effect to measures set out in the Government’s Action Programme for Effective Local Government, Putting People First, which indicated, in particular, that: -  matters to be decided at municipal district level would include decisions in relation to local facilities and amenities and determination of priorities and programmes of works or services in the area, within global funding allocations decided by the overall county council /city and county council or the use of locally generated revenue (paragraph 6.5.2);  provision would be made for the adoption by members at municipal district level of programmes/plans setting out priorities for works, services or activities within their functional remit that are contained within, or specific to, the district and expenditure in respect of matters that are appropriate for decision locally, within the overall budgetary and policy framework (paragraph 6.5.9); and  wide discretion would be given to members at municipal district level insofar as priorities in matters decided at that level are concerned (paragraph 6.7.1).

The scope for widening the extent of reserved functions of elected members would be pursued fully and a number of new measures set out in the programme would add important new functions to the range of powers of elected members (paragraph 11.5.2); to this end, the adoption of the SMDW is among the most important new reserved functions introduced by the Reform Act 2014.

Guidance on preparation and adoption of SMDW 4. The legislation provides that the Minister may make regulations outlining the manner, format, conditions, requirements and timescale for the preparation, consideration and adoption of the SMDW. Further consideration will be given to the possible need for regulations under section 103A of the 2001 Act. Pending the possible making of regulations, interim guidelines are being provided on the preparation, amendment and adoption of the SMDW for the year 2015, as follows: -

(a) While the legislation provides that the SMDW be prepared as soon as may be following the adoption of the annual budget, it is considered reasonable, in the first year of its operation, to allow adoption of the SMDW by 31 March 2015, in order to allow for appropriate arrangements to be made and to afford members adequate time to familiarise themselves with this important new function. This will also enable account to be taken of more definitive details of Government maintenance grants for roads, housing, etc. (b) The SMDW in respect of each municipal district should be formulated on the basis of the amount of funding provided for maintenance and repair in the annual budget of the local authority in respect of each relevant service division (e.g. housing, roads, amenities, street cleaning, drainage work, burial ground maintenance, etc.), subject to any variations arising subsequent to adoption of the budget, for example, in relation to funding levels from State grants. Classification of items in the budget should largely determine what works and related expenditure are included in the SMDW but insofar as it may be necessary to make judgments in particular instances, it is considered that the term “maintenance” can include not only maintenance of the physical condition or fabric of items, but also more operational type matters such as grass cutting or tree pruning. (c) Within the level of funding available, details of the SMDW should be prepared on the basis of identified needs (taking account of relevant factors, for example, in the case of housing, age profile of stock) and priorities throughout the local authority area and taking due account of requirements in relation to standards and frequency of maintenance work. This should be informed by details of relevant requirements which were considered in the formulation of the overall local authority budget. It will also be relevant to have regard to the pattern of works and expenditure in previous years. It is emphasised that adoption of the SMDW per se cannot involve revision of the adopted budget. (d) It is essential to maximise return on investment by avoiding dilution of expenditure which could result from spreading allocations too thinly across the local authority and the constituent municipal districts each year. This could be minimised by taking a multi-annual approach where possible in the preparation of the SMDW. (e) Maximising value for money, overall effectiveness, and return from investment should also be a key objective in prioritising works and allocating available funding within each municipal district, along with the need to ensure appropriate balance in the allocation of resources as between urban and rural areas in the district. Apportionment of funding on a thematic basis within the district over the life of the council could help to this end. For example, specific housing estate(s) in one location could be prioritised for refurbishment in year one, with a commitment to undertake works in another area in subsequent years. Similarly, where an overall local authority maintenance programme is drawn up for a particular purpose (say windows and doors in local authority dwellings) which might need to extend over a number of years, the required works would be reflected in relevant annual SMDWs. (f) Any maintenance type functions, for example, grass cutting, planting or other maintenance of open spaces, that are carried out by means of specific purpose grants for such purposes to community groups such as tidy towns committees can be provided for, as appropriate, through the SMDW. (g) The GMA, which is a budgetary element providing funding for discretionary expenditure at municipal district level to be decided by the elected members in respect of each municipal district, is separate from the “strategic” budgetary funding for maintenance and repair, the utilisation of which is to be determined in the SMDW. However, it is open to the municipal district members to apply GMA funding to supplement maintenance and repair funding otherwise available in the overall budget. (h) It is suggested that the resolution for adoption of the SMDW be worded so as to be flexible enough to allow for possible emergencies or reallocation of funding from scheduled works that cannot, for some reason, proceed. Any such re-allocation of funding should, as always, be within the overall budgetary framework and could be notified to the members as part of the Monthly Management Report. Account should be taken of any such changes in the preparation of the following year’s SMDW. (i) Section 134A of the 2001 Act provides that, in preparing the Service Delivery Plan, account shall be taken of any local authority plan, statement, strategy or any other document. Accordingly, the SMDW should, ideally, be prepared and adopted in advance of the annual Service Delivery Plan. If this is not feasible in the context of the time frame allowed for 2015, the preparation of the annual Service Delivery Plan should, at least, be informed by proposals for the SMDW. 5. The following conditions and requirements shall apply in relation to any amendments to the SMDW, as prepared under the direction of the chief executive, being considered by the municipal district members under section 103A (2) and (3) of the 2001 Act: - (a) Any proposed amendments to the SMDW must take account of

 the need to confine overall expenditure on works of maintenance within the total amount provided in the adopted local authority budget for such purposes;  actual requirements and priorities for relevant works within the district and prioritisation of the use of funding available to the district for particular purposes having regard to such requirements and priorities;  the most effective use of available resources;  requirements and priorities for funding in respect of works to which the SMDW relates during the entire term of office of the council so as to prevent dilution and ineffective use of funding by spreading it too thinly across the local authority/district each year;  other factors/criteria set out in these guidelines;  compliance with the regulations and guidelines regarding the performance of functions by municipal district members as provided in S.I. 231 of 2014 and circular LG10/2014, including the need for consistency with overall local authority policy and avoidance of duplication;  any views in relation to proposed amendments provided by the chief executive.

(b) If the municipal district members decide not to adopt the SMDW or propose to make an amendment to the SMDW which would result in the total expenditure in respect of works included in the schedule in respect of a particular service division exceeding that envisaged in the schedule as prepared by the chief executive, the latter shall submit a report to the local authority indicating that the SMDW has not been adopted in accordance with subsection (2) of section 103A and the local authority shall adopt the SMDW in accordance with subsection (4) of section 103A. (c) Pending a decision on the adoption of the SMDW by the municipal district members or the local authority, as the case may be, works or services may be undertaken in accordance with the schedule as prepared by the chief executive. Failure to adopt, or delay in adoption of, the SMDW in respect of a particular district by the municipal district members or the local authority, as the case may be, will not affect the validity of the SMDW adopted by the municipal district or the local authority, as the case may be, in respect of another district in the local authority area. Accordingly, where the SMDW has been adopted by the members for a particular municipal district, it cannot be revisited by the plenary Council even in the event that the SMDW for another district is referred back to it because of failure of the members for that district to adopt. (d) In the event of a decision by the municipal district members or the local authority, as the case may be, not to adopt the SMDW or to make an amendment to the SMDW which would result in the total expenditure in respect of works included in the schedule exceeding that envisaged in the schedule as prepared by the chief executive, only such works or services to which the SMDW relates as are considered by the chief executive to be essential shall be undertaken pending the adoption of the SMDW within the level of expenditure envisaged in the schedule as prepared by the chief executive.

6. Specific procedures (beyond the requirements in the legislation) or a definitive format for the SMDW, are not being prescribed at this time. The procedures and structures already applied by most authorities for non-statutory agreement of annual road works programmes at area committee level should provide a relevant analogy and a template that can be adapted for the statutory SMDW process. It is understood that some authorities intend to have non-statutory consultations with the municipal district members on the SMDW early in 2015, which could be helpful in advance of formal adoption. It should also be noted that it is a matter for the executive to determine the most appropriate and effective operational and organisational arrangements to implement the measures decided by the municipal district members in the adoption of the SMDW.

7. A copy of this circular, which is available on the SharePoint system, should be given to each elected member. In view of its importance to their role at municipal district level, all necessary support should be provided to the members in the performance of their functions in relation to the schedule of municipal district works.

Background

It is proposed that Clean-Ups and Beach Maintenance will be centrally managed to give maximum flexibility to respond to priorities in a countywide context. Examples where this is relevant include instances of large scale dumping being more prevalent in one area than another, and similarly with unexpected maintenance/repair work at individual beaches. As a consequence it is difficult to suggest that an MD has discretion for the expenditure. However, we do clearly provide for indicative expenditure on an area-by-area basis as set out in the schedule circulated. The basis of allocation will be kept under review.

A specific and discretionary allocation of €15,000 per Municipal District has been provided for in the adopted budget 2017 to assist tidy towns groups. 2017 Budget Distribution ‐ 9 Feb 2017 Roads Areas Division

Budget Distribution 2017 Notes: 1 TII allocations must be spent in accordance with the NRA Memorandum on Road Grants. 2 TII allocations announced to date do not contain any allocation for High Collision Locations or Crash Barrier repairs. It is expected that funding under these headings will be announced by TII aimed at specific locations on the national road network in the coming months.

3 The TII HD28 allocations are aimed at specific locations to be identified by TII on the national road network. These locations have yet to be confirmed by TII and the funding has been held centrally pending receipt of this clarification.

4 DTTAS allocations must be spent in compliance with DTTAS Circular RW1/2017 and the Memorandum on Non‐national Road Grants.

5 Winter maintenance budget is weather dependent and will be supplemented as necessary from the OR Contingency Reserve.

6 DTTAS Circular RW1/2017 permits LAs to use up to 15% of their initial Discretionary Grant for Local Improvement Schemes (LIS). Elected Members at Municipal District level may provide for an LIS programme in their SMDW on this basis if they wish.

7 DTTAS Circular RW1/2017 permits LAs to use up to 7.5% of their Restoration Improvement (RI) and Restoration Maintenance (RM) funding for Community Involvement Schemes (CIS). Elected Members at Municipal District level may provide for a CIS programme in their SMDW on this basis however it is recommended that RM monies are not used for this purpose.

8 It was noted in the Budget Book that there was a need to advance the design work on certain bridges and it is expected that additional Council OR funding will be made available for this purpose in Qtr 3 of 2017. It is proposed that funding for advanced design for any project will be made up of 50% County OR: 35% Roads OR: 15% MD Contribution. €50,000 has been set aside centrally to fund the Roads OR contribution.

9 Workforce Planning has resulted in increased staffing costs for outdoor work gangs. DCC Road Maintenance Own Resources have been increased by €518,976 for 2017 to compensate. €450,000 of this increase is proposed to be retained centrally for targeting at RSS areas where staffing costs cannot be met from existing maintenance funding. Roads Management will liaise with MDs to examine existing maintenance funding v’s staffing commitments.

10 As per 2015 & 2016 €657,000 has been allocated to those MDs now incorporating former Town Councils (FTC) to replace the FTC OR allocations made previously. This has been distributed according to the amounts of OR allocated by the TCs in 2014.

11 As per 2015 & 2016 specific provision has again been made in the Council's Budget 2017 for Street Sweeping. In previous years street sweeping was funded from roads general maintenance monies and only the former Town Councils made specific allocation. As such Donegal, Inishowen & Letterkeny MDs have received a specific amount for street sweeping and the remainder has been included in Roads OR. MDs may provide for street sweeping from their Roads OR as normal in accordance with their individual preferences.

12 Parks and Open Spaces budget provision for 2017 has been distributed in the same manner as 2015 & 2016 which was based on 2013 expenditure under this heading.

13 CLÁR funding has been made available for 2017 with a requirement for 20% matching funding by the Council. The matching funding has been taken from the local road maintenance OR budget for each MD relative to the amount of CLÁR funding provided.

14 Moville Green has been separately budgeted as per historic commitments. A separate allocation has also been made in the 2017 Budget towards the management of Barrack Hill, Carndonagh.

15 It is expected that Roads Own Resources funds will continue to be spent as normal as per the following breakdown from Budget Book 2017:

Please also note the requirement that the Schedule of Municipal District Works be adopted by formal resolution (copy wording attached).

It is appropriate that I draw your attention to sections 5 (a) and 5 (b) of the circular, specifically the following elements:

• 5 (a) states that “Any proposed amendments to the SMDW must take account of the need to confine overall expenditure on works of maintenance within the total amount provided in the adopted local authority budget for such purposes”

• 5 (b) states that “If the municipal district members decide not to adopt the SMDW or propose to make an amendment to the SMDW which would result in the total expenditure in respect of works included in the schedule in respect of a particular service division exceeding that envisaged in the schedule as prepared by the chief executive, the latter shall submit a report to the local authority indicating that the SMDW has not been adopted in accordance with subsection (2) of section 103A and the local authority shall adopt the SMDW in accordance with subsection (4) of Section 103A.”

Signed off Garry Martin by: Response: In 2015 the Council issued rate demands to the value of €31,044,313 and collected €24,716,771 in respect of over 5,400 properties throughout the County. The corresponding figures for the year 2016, to include a full report on the breakdown on the irrecoverable rates, will be presented to the Elected Members at the March Council meeting in accordance with Section 26 of the Local Government (Financial Procedures and Audit Regulations) 2015. The amount collected from commercial rates provides 23% of the annual revenue budget expenditure of €135,063,846 in 2017 to provide and maintain public services on a countywide basis. The monies collected from rates are not restricted to be spent in the location or area in which they are collected and for this reason the Council has never had the need to carry out an analysis of the amounts billed and collected on a Municipal District or, as requested in this instance, a sub Municipal District basis. The Council regrets, therefore, that the information requested is not available in the format sought.
