MINUTES OF THE MEETING May 22, 2018

The Plymouth Conservation Commission held its regularly scheduled meeting on Tuesday, May 22, 2018 at the Plymouth Town Hall, 26 Court Street, Ropewalk Meeting Room, Plymouth, MA 02360.

Present: Gerre Hooker; Chair, Sarah Trainor; Vice-chair and Commissioners, Robert Cunha, Frank Drollett and Brendan Murphy

Absent: Bruce Howard and Karen Edwards

The Conservation Planner, Richard Vacca and the Administrator, Krista Lewis, were also present.

ADMINISTATIVE ITEMS: MISCELLANEOUS Public Health Director, Dr. Nate Horwitz-Willis, and Zac Basinski from Bracken Engineering discussed with the Commission septic systems on coastal banks, their impact and innovative technologies.

OPEN HEARING BEGINS (Continued from April 24, 2018) 7:00 PM John Crane and Michele Morris, 120R Drew Road and 52 Fuller Farm Road, Parcel ID 088-000- 015A-000 and 088-000-017-000. A Notice of Intent to maintain three ground water monitoring wells, within the resource of Great South Pond. Engineer, Bill Shaw, was present to represent the Applicant for the three ground water monitoring wells. Bill explained the installation of the wells and how they were no longer needed and will be removed without heavy equipment. Randy Galletti, 122R Drew Road, inquired about the current violation on the Crane/Morris property. Sarah explained the Commission does not deal with violations at these hearings. Frank Silvia, 152 Long Pond, asked what the monitoring wells were for. Bill explained they were being used for the testing of nitrates in the water.

Sarah motioned to deny the NOI for failure of meeting performance standards. Required removal of the wells, submission of restoration plan and the Conservation Planner be in attendance during removal of the monitoring wells. Denied unanimously 7:12 PM

A Notice of Intent to lift a single-family dwelling, expand with an addition, upgrade a septic system, remove a revetment, add material to and replace a lawn area suitable for nesting Northern Redbellied Cooters, construct a wildlife management pond/shelter, and construct a raised dike/driveway, in the Buffer Zone of Great South Pond. Engineer, Bill Shaw, was present to represent the Applicant for the Notice of Intent. Homeowner, John Crane, spoke to the Commission in detail on his history with protecting and preserving the Northern Redbellied Cooters. John requested to construct a pond in the wetland to create habitat for these turtles. Gerre asked Bill to break down the removing of the revetment, material to replace the lawn area, shelter and driveway. Gerre asked Bill if the stream is perennial or interminette Bill told the Commission it does not show characteristics of a stream or river. Chapter 91 license was not necessary. Brendan and Sarah expressed their concerns over the DEP comments and the amount of work being done within the wetland area. 4,500 square feet of wetlands will be disturbed and 14,000 square feet of wetland would be replaced. Gerre opened the hearing to public comment. Scott Kenneth, 48 Fuller Farm Road, and Frank Silvia, 162 Long Pond Road, both expressed their concern that this project could cause more flooding to their homes. Anita and Randy Galletti, 122R Drew Road, questioned the work within the wetland and its distance to the property line.

Sarah motioned to continue the meeting until June 19th at 7:15 PM. Continued unanimously 8:04 PM

(Continued from April 24, 2018) 8:04 PM Mark Rano, 101 Bettencourt Road, Parcel ID 096-000-063-001. A Notice of Intent to demolish an existing house, construct a new single-family house with associated amenities and utilities in the Buffer Zone of Bordering Vegetated Wetlands and Bordering Land Subject to Flooding of Kings Pond. This project is subject to review by Natural Heritage and Endangered Species Program and MESA. A letter from Natural Heritage had been received. Sarah motioned to approve Unanimously approved 8:05 PM

8:05 PM Claire Bumpus, 21 Bumpus Road, Parcel ID 098-000-049B-002. A Request for Determination of Applicability to upgrade a septic system in the Buffer Zone of Bordering Vegetated Wetlands of . Kevin Flaherty was present to represent the Applicant for the Request for Determination of Applicability to upgrade a septic system. Frank asked what the impact was to the locus well and surrounding wells and how it is monitored. Kevin explained a well water test is required through Title V for the locus well but only once during installation. Sarah motioned to approve a Negative Determination of Applicability. Approved unanimously 8:10 PM

ORDERS OF CONDITIONS: Plymouth Rod & Gun Club, Inc., Walter Fray, President, 225 South Meadow Road, Parcel ID 108-000- 023-000. A Notice of Intent to reconstruct the clubhouse building serviced by a new water supply well and upgraded septic system, in the Buffer Zone of Bordering Vegetated Wetlands of Fresh Meadow Pond. Sarah motioned to issue the Orders of Conditions Approved unanimously 8:13 PM

Lighthouse Point LLC, Brian McLaughlin, 61 Hedge Road, Parcel ID 006-000-062J-000. A Request for an Amended Order of Conditions for DEP File #SE57-2841, in order to raise the retaining wall 4 feet in the Buffer Zone of Coastal Bank, Coastal Beach, and Land Subject to Coastal Storm Flowage. Sarah motioned to issue the Orders of Conditions Approved unanimously 8:14 PM

NEGATIVE DETERMINATION OF APPLICABILITY: Ted Bubbins, Parks and Forestry Superintendent, 255 Water Street (Nelson Park) Parcel ID 010-000- 031-000 & 012-000-057-000. A Request for Determination of Applicability to repave rubber surface with concrete pavement, fill and cap catch basin, redirect drainage from splash pad, and place straw wattles for erosion control between the project and the Buffer Zone, Plymouth Harbor. Sarah motioned to issue the Negative Determination of Applicability Approved unanimously 8:15 PM

EXTENSION PERMITS: ADM Agawam Development LL, Off Wareham & Agawam Rd, Parcel ID 117-000-000A-0003; 118-000- 001-001. Redbrook water line construction located off Wareham Road and Agawam Road. Sarah motioned to issue the Extension Permit Approved unanimously 8:16 PM
