SAGE knowledge http://dx.doi.org/10.4135/9781412959193.n19 Cesare Beccaria was an Italian Enlightenment philosopher, politician, and economist whose celebrated book On Crimes and Punishments condemned the use of torture, argued for the abolition of capital punishment, and advocated many reforms for the rational and fair administration of law. Beccaria's ideas about legal and penal reforms, which influenced intellectuals and statesmen throughout Europe and in North America, inspired many significant reforms in the last decades of the 18th century and the first decades of the 19th century. Beccaria influenced the British philosopher Jeremy Bentham who, along with Beccaria, produced the foundational ideas of the Classical School of Criminology. Many of the reforms that Beccaria advocated remain aspirations for contemporary systems of legal justice, including punishment proportionate to the severity of the crime and [p. 74 ↓ ] the development of a system of published laws and legal procedures applied equally to all without interference by the particular interests of rulers, judges, or clerics and without providing favorable treatment to individuals of higher social, political, or economic status. -

Angiolini) I. The spirit of the eighteenth century was focused on the individual happiness. That happiness corresponds to the demand that was put forward by most Enlight enment philosophers to humanize the criminal code in order to advocate the greatest possible mildness in penal punishment. This humanisation of the penal system was conceivable, and conceptually attractive, during the Enlightenment, because for merly every alleviation of the prevail punishments, with which the highest being, God was attacked by the delict, was a matter to reconcile. That would have meant the human intervention into the penal power of God, and effectively, a weakening of God's rule. Important changes in the area of criminal law came to fruition only through the cooperation of philosophers and rulers and the corresponding seculari sation of many social and political areas by enlightened rulers such as Friedrich 11, Joseph 11 and Catharine lP. One cannot overestimate the close connections between Enlighteners and indi vidual monarchs. The Age of Enlightenment Overview Students will explore the Age of Enlightenment through a Power Point presentation and class discussion. Students will then further explore this period of history and its prominent figures by designing a dinner party for 12 Enlightenment thinkers. This project will encourage students to learn more about the period and the philosophers associated with it, as well as synthesize what they have learned while utilizing higher order thinking, group work skills, and creativity. Essential Questions • What was the Age of Enlightenment/Age of Reason and what led to this shift in thought? • Who were the prominent historical figures during the Age of Enlightenment and in what ways were they similar and/or different in their philosophies? • What impact did the Age of Enlightenment have throughout various countries on society, culture, politics, etc.? • How did the Enlightenment philosophers influence American government? The Understanding of Cruelty in Western Philosophy and Some Reflections on Personhood FILOZOFIA 65, 2010, No 2, p. 170 Almost daily, we read and hear of car bombings, violent riots and escalating criminal activities. Such actions are typically condemned as “cruel” and their “cruelty” is ta- ken as the most blameworthy trait, to which institutions are obliged, it is implied, to respond by analogously “cruel but necessary" measures. Almost daily, we read and hear of tragic cases of suicide, usually involving male citizens of various age, race, and class, whose farewell notes, if any, are regularly variations on an old, well- known adagio: “Goodbye cruel world.” Additionally, many grave cruelties are nei- ther reported nor even seen by the media: people are cheated, betrayed, belittled and affronted in many ways, which are as humiliating as they are ordinary. Yet, what is cruel? What meaning unites the plethora of phenomena that are reported “cruel”? How is it possible for cruelty to be so extreme and, at the same time, so common? This essay wishes to offer a survey of the main conceptions of cruelty in the history of Western thought, their distinctive constants of meaning being considered in view of a better understanding of cruelty’s role in shaping each person’s selfhood. Keywords: Cruelty – Evil – Liberalism (of fear) – Pain – Person(hood) Richard Rorty claimed famously that ‘liberals are the people who think that cruelty is the worst thing we do.’2 With this statement, he intended to set himself squarely amongst the pro- ponents of that ‘liberalism of fear’ which Judith Shklar had been establishing as a recognised liberal strand since the early 1980s. -

In Adam Smith's Invisible Hands: Comment on Gavin Kennedy

Klein1 ABSTR A C T In preface, I should tell the reader that Professor Gavin Kennedy and I met and hit it off at the January 2009 International Adam Smith Society conference held at Balliol College, Oxford, commemorating the 250th anniversary of The Theory of Moral Sentiments. There Gavin and I discussed whether this Journal, of which I am editor, might publish his essay along with a dissenting opinion. As we went forward, we agreed that I would author the dissent. I am grateful to Gavin for his valuable instruction and cooperation in the shared aim of producing an exchange on the phrase invisible hand in Smith’s writings. The Journal invites Gavin to rejoin and conclude the exchange in a future issue. Peter Minowitz (2004, 411) concludes his essay, “Adam Smith’s Invisible Hands” with the following words: “Centuries after Smith’s death, we are still struggling to fathom a two-word phrase that stands out in a thousand-page book.” Such struggling has been misplaced, according to Professor Gavin Kennedy. Abstain from the struggling, for the two-word phrase is an incidental metaphor in Smith’s writings; it deserves no currency as tag for the prosaic workings of markets, even less for rarified workings untrue to Smith. In his erudite, plain-spoken, challenging essay, Gavin suggests that the metaphor had no very special significance; that its occurrence in the Astronomy differs irreconcilably from that in The Theory of Moral Sentiments and Wealth of Nations.
