The Board of Supervisors of the County of Black Hawk, in the State of Iowa, met in regular adjourned meeting at the Courthouse in Waterloo, County Seat of said County, at nine o’clock (9:00) a.m., pursuant to law, to the rules of said Board, and to adjournment. The meeting was called to order and on roll call there were present: Linda Laylin, Tom Little, Frank Magsamen, Chris Schwartz and Craig White, Chair. Absent: None.

RECEIVE PROJECT UPDATES FROM DEPARTMENT HEADS/ELECTED OFFICIALS. County Engineer Cathy Nicholas said all county roads are open, and motor graders are out filling potholes, as frost boils are softening gravel roads. She said she would give an update at the March 20 meeting on her five-year DOT plan and on the East Bennington Road bridge project. Laylin asked her about a letter that was going to Dewar residents. Nicholas said she sent about 55 letters out and gotten no responses. She noted that the county would like to clean out its ditches but some of the ditches are owned by the railroad and all she can do is ask them to clean them.

Schwartz moved the following resolution seconded by Magsamen. BE IT HEREBY RESOLVED that the LOWEST REASONABLE BID received from PDCM, Waterloo, IA, for Black Hawk County Insurance and Risk Management services with a bid of $35,000 each year for the duration of three (3) years be approved and for the chair to sign the contract, conditional to the receipt of the certificate of insurance as recommended. Board Administrative Aide Dana Laidig said she sent requests for proposal to three companies that the Iowa Communities Assurance Pool (ICAP) listed as affiliated with them, and a few other companies that had bid on the county’s insurance in the past, since anyone can become affiliated with ICAP (which was a bid requirement), and that PDCM had the low bid. She said PDCM is offering the same services it currently provides. Little said that the bid is less than the $43,000 that is currently charged by PDCM. Magsamen moved the following resolution seconded by Schwartz. BE IT HEREBY RESOLVED that the LOWEST REASONABLE BID received from KW Electric, Waterloo IA, for the Proposed Courthouse Lighting Project with a bid of $204,242.00 be approved and for the chair to sign the contract, conditional to the receipt of the performance bond and certificate of insurance as recommended by Rory Geving, Maintenance Superintendent. Geving said this was the lower of the two bids received. He noted that the ceiling tile bid would have put the entire project $74,000 over budget, but with this bid being about $40,000 under, if other aspects of the project stay on budget, the bottom line would be about $34,000 over budget. He said that the Pinecrest interior lighting project is budgeted at $54,000, and he would not do that project this fiscal year if the money is needed for the courthouse project. He thought the project would be complete by August 30, and energy savings, aside from the rebate, may amount to $10,000 a year. AYES: Laylin, Little, Magsamen, Schwartz, White. NAYS: None. Laylin moved the following resolution seconded by Magsamen. BE IT HEREBY RESOLVED that the CHANGE ORDER for the Pinecrest Generator Project in the amount of $1,772.00 for the integration of generator operations into the building management system and for the removal of an existing main breaker be approved as recommended by Rory Geving, Maintenance Superintendent. Geving said the integration project would allow checking for alarms on the Pinecrest HVAC system from other buildings, so staff wouldn’t be needed at Pinecrest as often. He said the original main breaker isn’t compatible with the breaker for the generator, so he is replacing the original breaker, which will also conform with the Fire Department’s wish that there be only one means of cutting power. He said the contract for the project is $107,750, to which the $1,772 would be added, the total budget is $160,000, and the Health Department is contributing a $20,000 grant. Magsamen moved the following resolution seconded by Laylin. BE IT HEREBY RESOLVED to approve the AGENCY AGREEMENT ADDENDUM between Black Hawk County and Marcus and Millichap regarding potential dual agency, with the understanding that dual agency is not approved at this time. Project Attorney Eric Johnson said this addendum is required by state law, and that it would be up to the county whether it would allow Marcus and Millichap to represent both the county and a potential buyer in the bidding process. He advised against permitting it at this time. AYES: Laylin, Little, Magsamen, Schwartz, White. NAYS: None. Resolution adopted.

Laylin moved the following resolution seconded by Magsamen. BE IT HEREBY RESOLVED that the REAL ESTATE AGENCY RELATIONSHIPS DISCLOSURE between Black Hawk County and Marcus & Millichap detailing the type of representation with the agent that exists be approved. Magsamen moved the following resolution seconded by Schwartz. BE IT HEREBY RESOLVED that the TAXES DUE AND PAYABLE of the submitted persons, as indicated, including special assessments, and rates or charges, including interest, fees and cost, in accordance with the provision of §427.9 of the Code of Iowa, be suspended and that future property taxes on property owned by the persons will be suspended for such time as the persons remains the owner of the parcels, and during the period the persons receives assistance as described in §427.9 of the Code of Iowa. AYES: Laylin, Little, Magsamen, Schwartz, White. NAYS: None. Resolution adopted.

Magsamen moved the following resolution seconded by Laylin. BE IT HEREBY RESOLVED to approve the release of the Country View RFP as recommended by Susan Deaton, County Finance Director. Project Attorney Eric Johnson asked for questions and comments from the Board. Laylin wondered if requiring a purchaser to maintain the current building would be wise if the company wished to build a new facility, or if a local purchaser would have facilities already in the area. Johnson said Marcus and Millichap believes based on their experience that a purchaser spending the amount needed (minimum bid is $5.5 million) would think it prudent to keep the current facility up and running, and the county is relying on the broker’s experience. Magsamen asked if the wording would admit of a reconstruction on the current site. Johnson said yes, that would be in the spirit of the agreement. Laylin asked if Marcus and Millichap would alert the county if potential bidders indicated that the minimum bid is too high. Johnson said he assumed that if no bids were coming in and Marcus and Millichap surmised that it was because the minimum was too high, they would alert the county. AYES: Laylin, Little, Magsamen, White. NAYS: Schwartz. Resolution adopted.

ANY REPORTS OR INFORMATION FROM THE BOARD. Schwartz said the Iowa Policy Project was providing information on the implications of the new tax bill later that day at the Waterloo Public Library.
