Sealed tender in printed tender forms as specified are invited for the following work from eligible resourceful contractors as per particular below and will be received by the Assistant Engineer, Haldia Highway Sub- Division , P.W. (Roads) Directorate and will be opened by him or any other officer empowered by him at any time half an hour after the receipt tenders on the same day in front of the tenderers or their authorised representatives unless otherwise mentioned by another notice.

The earnest money in the shape of Bank Draft of any Nationalized Bank in favour of the Executive Engineer, Highway Division, P.W. (Roads) Directorate or any other method approved by the Government must be deposited along with the tender. The tender documents and other relevant papers may be seen by the intending tenders during Office hours in the office of the Assistant Engineer, Haldia Highway Sub- Division P.W. (Roads) Directorate. If the tendered rate is found higher, a table bid will be under taken automatically to lower down the rate amongst the participant tenderer. Contractors/tenderers are requested to present themselves at the time of opening the tender and to participate the bid to be called for immediately after opening the tender if necessary.

1. The applicant intending for the permission of obtaining tender papers should have to present personally. No authorized representative would be eligible to obtain such permission in absence of the petitioner himself or his legal authorized person processing registered power of attorney registered constituent attorney duly approved by the P.W (Roads) Directorate. 2. Assistant Engineer, Haldia Highway Sub- Division , P.W. (Roads) Directorate posses the sole right and authority to issue eligibility certificate to the candidates whose candidature is acceptable to him. No challenge in such respect of issue would not be allowed and would be acceptable by law. 3. Canvassing as regards to the issue of tenders and related to such tender process in any form would reject the candidature of the participant without assigning any reason. 4. The intending tenderers will apply for eligibility in their printed pad and have to obtain previous permission from the Assistant Engineer ,Haldia Highway Sub- Division , P.W.(Roads) Directorate for obtaining tender papers to participate in the tender. The intending tenderers should apply supporting with attested copies of certificates related to credentials, experience, time bound performance along with the application within the due specific time mentioned. 5. Intending tenderers will have to produce a copy of Trade license with valid original PAN Card , Certificate of current I.T.Return , VAT Registration and Professional Tax with Challan update, having a credential of 40% of similar nature of completed work commencing on or after 01/04/2010 will have to produce if necessary in original for the eligibility to apply as an enlisted contractor and also for his entitlement to get the tender documents as regards to the work in question. Self attested photo copy of such all documents shall be submitted along with the petition proposed for the issuance of tender papers . 6. Even after submission of tender, the tender will not be taken into consideration during evaluation, if the papers submitted by any agency in support of eligibility is found to be baseless/false in the event of verification from the concerned authority. 7. In case of non-participation in the tender in any shape will be dealt severely for making an attempt towards disruption of competitive spirit of tender and non-participant may be disallowed to participate in 3 (three) nos. consecutive N.I.T. 8. The applicant must inspect the site of work and get acquainted with site conditions. All factors relating to facilities available and problems to be faced during work should be taken into account all such factor before quoting rate. 9. Labour Co-Operative Societies have to be produced credential of similar nature of work value of which atleast 40% of the estimated amount put to tender in a single job executed commencing on or after 01/04/2010. 10. In case any unscheduled holiday on the date and time limit as per clause No. 7,8,10 the next working day will be treated as schedule / prescribed date for the same purpose upto the same time limit as notified earlier. 11. A cess of 1% of the cost of construction works will be deducted from the bills of the contractors and remit the amount so collected to the “W.B. Building and Other Construction Workers Welfare Board” as notification no. 1182 IR dt.20.09.2005 of the Labour Department. 12. S&P Contractor should have valid contractor’s Trade License of Corporation or Municipality. 13. Tender Inviting Authority reserving his discretion in issuing tender paper to the intending tenderers for any group of the choice of tender inviting authority, other than the group applied for by the intending tenderers in order to have proper competitive in all groups. No challenge to this affect shall be entertain by the tender inviting authority. 14. If any contractors fails to starts the work within 15 (fifteen) days from issuing date of Work Order/ Formal Tender the Work Order will be cancelled and relevant classes of the contract shall deemed to have executed by the tendering authority. No litigation to this effect shall be entertain by the tender inviting authority, this is incorporated to deliver time bound Public Works.

15. Tender Inviting Authority reserves the right to issue corrigendum towards the estimated amount and eligibility of contractors in case of any revision, three days in advance to the date of application under certain unavoidable circumstances. 16. The Co-Operative Societies have to submit the latest audit report of Co-Operatives, copy of Bye Laws (1st page and last page) ,Minutes of last general body meeting, registration certificate of reserved unemployed Engineers Co- operative , jurisdiction along with application for participation in tender. 17. Declaration regarding current litigation, debarring / explaining of Tenderer / Abandonment of work by tenderer during last 5 (five) years. 18. No arbitration to the work will be admissible as per order no. 3370-A dated 20.03.1987, Rule 19 of PWD rule 1987. 19. All the tenderers are requested to be present as the time of opening the tenderers in the above mentioned date and time. No representative will be allowed to participate in table bid if required after opening of tender. No further claim will be entertained for his absence in table bid. P.T.O

20. Consumption statement of machineries/ materials to be considered with PWD, PWD (Rds.) guidelines. In case any item is not covered by PWD, PWD (Roads) guidelines may be considered with the form no. 2911 (ii). 21. The undersigned will have sole discretion to decide the eligibility of the contractors on the basis of his submitted documents and reserves the right to refuse any explanation to contractors for the in eligibility after scrutiny. 22. The Assistant Engineer, Haldia Highway Sub-Division, P.W.(Roads) Directorate reserves to right to accept or reject the lowers or other offer without assigning any reasons whatsoever. 23. In the event of non-availability of fund, all tenderers will be cancelled. 24. Tender Inviting authority reserves his right to rectify / replace / substitute any rate of the priced schedule put to tender in case of any in-advertent / typographical mistake both in figure as well as in words prior to execution of Formal Tender. 25. All required materials (except Bitumen) and machineries are to be supplied and procured by the agency as per terms and condition of the N.I.T., all the clauses and additional conditions incorporated in West Bengal Form 2911(ii) in connection with the issue of Departmental Materials and Machinery will not be applicable in this contract. 26. Deduction of tax shall be as per provision of section 40 of the W.B. VAT Act, 2013 with from 01.08.2013 as follows:- i) For payment to works contractors who are declares registered under W.B.V.A.T. Act 2013 3% rate ii) For payment to works contractors who are not registered under W.B.V.A.T. Act 2013 5% rate The Rate prevailing in PWD, PWD (Roads) Schedule of Rates shall be the guiding criteria for such rectification.

Note: Work Order may be issued for deposit work after allotment of fund from the competent authority.

Agreement: The Successful tenderer on receipt of letter of acceptance will execute Formal agreement with the Department, in W.B. Form No. 2911(i) / (ii) after purchasing the same along with tender document with fees as mentioned in the annexure. . Failure to execute the formal tenders within 7 (seven) days may be treated forfeited of initial earnest money. Work Order will be issued after formal agreement.
