1.1 04/01262/NID: : Site to North of and Invercloy Car Park

North Ayrshire Council Roads Services have applied for a change of use from open space to form an extension to an existing car park on a site to the north of Invercloy Car Park, Brodick. An objection has been received from Arran Civic Trust, c/o John Roberts, 3 Glen Place, Brodick.

The Sub Committee, having considered the terms of the objection, agreed to support the application, subject to referral to the Scottish Ministers and subject to the following conditions, unless the Scottish Ministers issue a direction in response to the referral:-

1. That no development shall take place until there has been submitted to, and approved by, Council as Planning Authority, a scheme of landscaping, which shall include details of species, planting densities, soil treatment and aftercare. Thereafter, any scheme which may be approved shall be implemented and maintained to the satisfaction of North Ayrshire Council as Planning Authority.

2. That, prior to the commencement of the development, the treatment of the boundary shall be agreed in writing with North Ayrshire Council as Planning Authority.

Page 1 1.2 04/01298/PP: Brodick: Seascape

Miss Linda Johnstone, Seascape, Brodick has applied for planning permission for the erection of a detached dwellinghouse at that address.

The Planning Services Manager requested that the Sub Committee disregard the first ground for refusal referred to in Appendix 2 to the report.

The Sub Committee agreed to refuse the application on the following grounds:-

1. That the proposed development is contrary to Policy ENV1A of the adopted Local Plan which requires that replacement houses must be wholly equivalent to an acceptable conversion or rehabilitation. The proposed two storey replacement house is both out of scale and character with the existing timber lodge house.

2. That the design of the proposed house is contrary to the aims and objectives of the Council's approved Rural Design Guidance for Arran by reason of its scale and design.

1.3 04/01155/PP: : Site to East of Elim

J & W Ritchie, Elim, Whiting Bay have applied for planning permission for the erection of a detached dwellinghouse, formation of a new access and parking spaces on a site to the east of that address.

The Sub Committee agreed to grant the application, subject to the following conditions:-

1. That, prior to the commencement of the development, the applicant shall submit for the written approval of North Ayrshire Council as Planning Authority samples of the proposed external finishes to be used.

2. That, prior to the occupation of the house, 2 car parking spaces shall be provided within the site, and 2 replacement parking spaces shall be provided for Elim, all in accordance with the plans hereby approved and to the satisfaction of North Ayrshire Council as Planning Authority.

3. That the first 2 metres of the access, measured from the heel of the footway shall be hard surfaced in order to prevent deleterious material being carried onto the carriageway and designed in such a way that no surface water shall issue from the access onto the carriageway.

1.4 04/00856/PP: : Land Adjacent to Kinloch Court

John Thomson Construction, have applied for planning permission for the erection of 2 detached dwellinghouses, the formation of associated access and car parking on land adjacent to Kinloch Court, Blackwaterfoot, Arran. An objection has

Page 3 The Sub Committee, having considered the terms of the objection, agreed to refuse the application on the following ground:-

1. That the proposed development is contrary to Policy RES3 of the adopted Isle of Arran Local Plan, in that approval of the development would be contrary to the low cost and special needs housing requirement identified within the recently adopted Local Plan and would have a significant detrimental affect on the provision of such housing on Arran.

2. // Local Plan Area

2.1 05/00120/PP: Ardrossan: 71 Princes Street

Cunninghame Housing Association Ltd, 82 - 84 Glasgow Street, Ardrossan have applied for planning permission for the demolition of an existing building and the erection of a two storey replacement building with associated car parking and disabled access ramp at 71 Princes Street, Ardrossan. An objection has been received from JAS Campbell and Co. Solicitors, 57 Dockhead Street, Saltcoats on behalf of CASA Properties.

The Sub Committee, having considered the terms of the objection, agreed to grant the application subject to the following conditions:-

1. That the first 10 metres of driveway shall be 5.5 metres wide and hard surfaced in order to prevent deleterious material from being deposited onto the public road.

2. That, prior to the commencement of the development, the applicant shall submit for the written approval of North Ayrshire Council as Planning Authority details of proposals for the provision of refuse storage facilities, which shall be provided prior to the commencement of the use.

3. That demolition and construction works shall only take place between the hours of 08.00 and 18.00, Monday to Friday, 09.00 and 16.00 on Saturday and not at all on Sundays, unless North Ayrshire Council as Planning Authority gives written consent to any variation.

4. That there shall be no burning of materials on site.

5. That, should the presence of significant unsuspected contamination arise during the development of the site, the matter shall be brought to the attention of North Ayrshire Council as Planning Authority. Thereafter, an investigation strategy as agreed by North Ayrshire Council as Planning Authority shall be implemented and any necessary remediation works carried out prior to any further development being carried out on the site.

6. That, prior to the commencement of the development hereby approved, details of a scheme to treat the surface water arising from the site in accordance with the principles and practices contained in CIRIA's "Sustainable Urban Drainage Systems

Page 4 Design Manual for and Northern Ireland 2000" shall be submitted to, and approved by, North Ayrshire Council as Planning Authority. Thereafter, any scheme which may be approved shall be fully implemented prior to the completion of the development and maintained thereafter to the satisfaction of North Ayrshire Council as Planning Authority.

7. That, prior to the commencement of the development, plans shall be submitted illustrating finished floor levels, for the prior written approval of North Ayrshire Council as Planning Authority.

2.2 04/01233/PP: Saltcoats: 11 - 17 Gladstone Road

McLaughlin Construction, Park Road, Ardrossan have applied for planning permission for the erection of 23 flatted dwellings with associated roadway, parking and soft landscaping at 11 - 17 Gladstone Road, Saltcoats. An objection has been received from D. Evans of 69 Raise Street, Saltcoats.

The Sub Committee agreed, subject to the applicants entering into a Section 75 Agreement, or other suitable arrangement deemed appropriate by the Council to provide a financial contribution to the Council for the provision of play facilities in the local area, to grant the application subject to the following conditions:-

1. That, prior to the commencement of the development, the applicant shall submit for the written approval of North Ayrshire Council as Planning Authority full details of (i) the proposed external finishes, (ii) the proposed bin stores, and (iii) the proposed car port canopy.

2. That the parking spaces shall be designed in such a way that no surface water shall issue onto the adjacent carriageway.

3. That, prior to the commencement of the development hereby approved, details of a scheme to treat the surface water arising from the site in accordance with the principles and practices contained in CIRIA's "Sustainable Urban Drainage Systems Design Manual for Scotland and Northern Ireland 2000" shall be submitted to, and approved by, North Ayrshire Council as Planning Authority. Thereafter, any scheme which may be approved shall be fully implemented prior to the completion of the development and maintained thereafter to the satisfaction of North Ayrshire Council as Planning Authority.

4. That the bin stores approved under condition 1 and all walls and fences shall be provided to the satisfaction of North Ayrshire Council as Planning Authority prior to the occupation of any of the flats hereby approved.

5. That no development shall take place until there has been submitted to, and approved by, North Ayrshire Council as Planning Authority a scheme of landscaping, which shall include details of species, planting densities, soil treatment and aftercare and shall include indications of all existing trees and hedgerows on the land and details of any to be retained, together with measures for their protection in the course of the development.

That all planting, seeding or turfing comprised in the approved details of landscaping shall be carried out in the first planting season and seeding seasons following the occupation of the buildings or the completion of the development, whichever is the sooner; and any trees or plants which, within a period of five years from the completion of the development die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of a similar size and species, unless North Ayrshire Council as Planning Authority gives written consent to any variation.

7. That, prior to the occupation of any of the dwellinghouses and where Council adoption of open space areas is not to be pursued, there shall be submitted for approval of North Ayrshire Council as Planning Authority, details of the proposed factor or management agency and a landscape management plan, including long term design objectives, management responsibilities and maintenance schedules for all open space areas. The landscape management plan shall be carried out as approved and the agreed agency shall only be changed with the consent of the majority of householders and the agreement of North Ayrshire Council as Planning Authority.

8. That no construction works shall take place until a series of tests for ground contamination have been carried out in accordance with a method approved by the Planning Authority and remediation work considered necessary by the Planning Authority as a result of these tests has been carried out to their satisfaction.

3. Garnock Valley Local Plan Area

3.1 04/01091/PP: : Dipple Road: Redheugh House

Harlequin Homes (Scotland) Limited, 10 Clydeholm Road, Glasgow have applied for planning permission for the erection of 7 dwellinghouses and the re-positioning of a play area (amendment of previous consent 01/00315/PP) at Redheugh House, Dipple Road, Kilbirnie. Thirteen letters of objection have been received together with a petition of objection containing the signatures of fifteen residents of Redheugh Estate (the majority of whom submitted individual letters of objection), as listed in Annex 1 to the report.

The Sub Committee, having considered the terms of the objections, agreed to refuse the application on the following grounds:-

1. That the proposed development would be contrary to Policies HOU1, HOU6, ENV2 and TOU10 of the Adopted Garnock Valley Plan and the Development Control Statement of the Finalised North Ayrshire Local Plan (excluding Isle of Arran) in that, by reason of its scale, siting, design and appearance, the proposed development would result in the loss of an area of open space within the grounds of Redheugh House and have a potential adverse impact on trees on neighbouring land which are protected by a Tree Preservation Order which would be detrimental to the character and environmental quality of the area.

That the proposed 3 houses on the western part of the site would be situated on an established flood plain which would be contrary to Policy INF7 of the Adopted Garnock Valley Local Plan and INF6 of the Finalised North Ayrshire Local Plan (excluding Isle of Arran) in that development of this part of the site would increase the risk of flooding elsewhere.

3.2 04/01182/PP: : Over Hessilhead Farm

Mr Alan Dunn, Kirkfield House, , , has applied for planning permission for alterations to an existing farmhouse, conversion, alterations and extension to redundant farm outbuildings to form 4 dwellinghouses and the formation of a new road junction, access road and associated car parking at Over Hessilhead Farm, Beith.

The Sub Committee agreed to grant the application, subject to the following conditions:-

1. That the proposed junction access with the public road shall be at right angles to the public road and shall be 5.5 metres wide for the first 15 metres, with 6 metre radii kerbs.

2. That a turning area shall be provided within the confines of the site in order that refuse vehicles can enter and leave the site in a forward gear.

3. That the first 6 metres of the access shall be hard surfaced in order to prevent deleterious material being carried onto the carriageway and designed in such a way that no surface water shall issue from the access onto the carriageway.

4. That the presence of any significant unsuspected contamination which becomes evident during the development of the site shall be brought to the attention of Environmental Health. Thereafter, a suitable investigation strategy as agreed with North Ayrshire Council shall be implemented and any necessary remediation works carried out prior to any further development taking place on the site, all to the satisfaction of North Ayrshire Council as Planning Authority.

5. That effluent disposal arrangements shall comply with the current code of practice BS6297:1983, subject to satisfactory percolation testing, to the satisfaction of North Ayrshire Council as Planning Authority.

6. That, prior to the commencement of the development hereby approved, details of a scheme to treat the surface water arising from the site in accordance with the principles and practices contained in CIRIA's "Sustainable Urban Drainage Systems Design Manual for Scotland and Northern Ireland 2000" shall be submitted to, and approved by, North Ayrshire Council as Planning Authority. Thereafter, any scheme which may be approved shall be fully implemented prior to the completion of the development and maintained thereafter to the satisfaction of North Ayrshire Council as Planning Authority.

Page 7 3.3 05/00043/PP: Dalry: 14 Garnock Street

Scott McKendrick, 14 Garnock Street, Dalry has applied for planning permission for an amendment to planning permission No N/04/00853/PP to incorporate basement storage and an enlarged terrace/garden at that address. An objection has been received from Elizabeth Wallace, 10 Garnock Street, Dalry.

The Sub Committee, having considered the terms of the objection, agreed to grant the application subject to the following conditions:-

1. That, prior to the commencement of the development, the applicant shall submit for the written approval of North Ayrshire Council as Planning Authority (i) exact details/samples of the proposed external finishes; and (ii) details of proposals for the erection of a screen along the edges of the enlarged terrace/garden, which approved screen shall be erected prior to the commencement of the use of the garden/terrace and be maintained thereafter all to the satisfaction of North Ayrshire Council as Planning Authority.

2. That there shall be no external storage of materials, nor shall any materials be stored within the area identified as car hardstanding on the plans hereby approved.

3. That, prior to the commencement of the development, the applicant shall submit for the written approval of North Ayrshire Council as Planning Authority exact details of the proposed bin storage arrangements.

4. That no plant or machinery shall be installed or used and no process shall be carried out from the premises which would detract from the amenity of the area by reason of noise, vibration, smell, fumes, smoke, soot, dust or grit.

5. That the occupation of the dwellinghouse hereby approved shall be limited to the owner of the workshop, or a person employed in the business and any person residing with him or her.

6. That, prior to the occupation of the dwellinghouse or commencement of the use of the workshop hereby approved, vehicular access to the site shall be provided with a drop kerb footway crossing to be formed as detailed in Sections 5.2 and 10.8 (and fig. 10.16) of the Road Development Guidelines, to the satisfaction of North Ayrshire Council as Planning Authority.

7. That, prior to the commencement of the development, details of proposals for the disposal of foul drainage and surface water from the development, shall be submitted for the written approval of North Ayrshire Council as Planning Authority exact details of proposals for the disposal of foul drainage and surface water from the development.

3.4 04/00987/PP: Beith: Barrmill, Balgray Road: Former Station Goods Yard

Henry Boot Barrmill Ltd, The Henry Boot Building, Glasgow Road, Baillieston,

Page 8 Glasgow have applied for planning permission for the erection of 46 dwellinghouses comprising 26 detached, 8 semi-detached, 12 terraced and the formation of associated access road, car parking spaces and landscaping/SUDS solution at the former Station Goods Yard, Balgray Road, Barrmill, Beith. An objection has been received from Jean Gilbert, Eastview, 13 Balgray Road, Barrmill.

The Chief Development Control Officer advised the Sub Committee of an amendment to Condition 2 referred to in Appendix 1 to the report.

The Sub Committee, having considered the terms of the objection, agreed to grant the application subject to the following conditions:-

1. That, prior to the commencement of the development, a revised site plan showing road humps repositioned, a visitor car parking bay repositioned, the depth of visitor car parking bays being 2.5 metres and an alternative servicing arrangement for the bulk LPG tank, all as shown on the enclosed extract from the site plan, shall be submitted for the written approval of North Ayrshire Council and implemented thereafter.

2. That, prior to the erection of any dwellinghouses, the recommendations detailed in the Remediation Statement contained within the supplementary letter from Seven Design Group dated 11 March 2005 shall be fully implemented to the satisfaction of North Ayrshire Council as Planning Authority. All areas of contamination on site, as identified in the submitted report under Part IIA of the Environmental Protection Act 1990, shall be removed to a licensed waste facility unless an alternative remediation measure, acceptable to Environmental Health, is agreed in writing with North Ayrshire Council as Planning Authority. On completion of the proposed remedial works, the applicant shall submit a verification report and certificate, verified by a suitably qualified Environmental Consultant, for the written approval of North Ayrshire Council as Planning Authority.

3. That the presence of any significant unsuspected contamination which becomes evident during the development of the site, shall be brought to the attention of Environmental Health. Thereafter, a suitable investigation strategy, as agreed with North Ayrshire Council, shall be implemented and any necessary remediation works carried out prior to any further development taking place on the site, all to the satisfaction of North Ayrshire Council as Planning Authority.

4. That, prior to the commencement of the development, the applicant shall satisfy North Ayrshire Council as Planning Authority that a scheme for the disposal of foul sewage and surface water from the site has been agreed with Scottish Water.

5. That, prior to the commencement of the development hereby approved, details of a scheme to treat the surface water arising from the site in accordance with the principles and practices contained in CIRIA's "Sustainable Urban Drainage Systems Design Manual for Scotland and Northern Ireland 2000" shall be submitted to, and approved by, North Ayrshire Council as Planning Authority. Thereafter, any scheme which may be approved shall be fully implemented prior to the completion of the development and maintained thereafter to the satisfaction of North Ayrshire Council as Planning Authority.

Page 9 6. That, prior to the commencement of the development, the applicant shall submit for the written approval of North Ayrshire Council as Planning Authority details or samples of the proposed external finishes.

7. That the treatment of the boundary enclosures or plot divisions shall be agreed in writing with North Ayrshire Council as Planning Authority prior to the commencement of any works.

8. That no development shall take place until there has been submitted to, and approved by, North Ayrshire Council as Planning Authority a scheme of landscaping, which shall include details of species, planting densities, soil treatment and aftercare and shall include indications of all existing trees and hedgerows on the land and details of any to be retained, together with measures for their protection in the course of the development.

9. 3.5 04/01250/PP/04/01251/LBC: Beith: 2 - 6 Reform Street

Heritage Buildings Preservation Trust, c/o Mr R McCallum, 14 Finlay Rise, Milngavie, Glasgow have applied for planning permission and listed building consent for alterations and the change of use of a public house to form 3 flats, the erection of an external access stair to the rear and the installation of railings to the front at 2 - 6 Reform Street, Beith.

The Sub Committee agreed (a) to grant planning application 04/01250/PP subject to the following conditions:-

1. That, notwithstanding the submitted details, the proposed railings for the front elevation indicated on drawings Nos.G1050 L(20) 10 and 11 and G1050 1A(34) 01 are not approved.

That, prior to the commencement of any works, details of a car parking area, to be formed on land to the west of the application site, shall be submitted for the approval in writing of North Ayrshire Council as Planning Authority. Prior to the occupation of any of the flatted dwellinghouses hereby approved, any such details which may be approved shall be implemented and thereafter maintained, to the satisfaction of North Ayrshire Council as Planning Authority. and (b) to refer listed building consent application 04/01251/LBC to Historic Scotland, and to grant listed building consent, subject to the following condition, unless Historic Scotland issue a direction in response to the referral:-

1. That, notwithstanding the submitted details, the proposed railings for the front elevation indicated on drawings nos. G1050 L(20) 10 and 11 and G1050 1A(34) 01 are not approved.

4. Irvine/ Local Plan Area

4.1 05/00006/PP: Irvine: Riverside Business Park: 6 Brewster Park

VIP Imports Direct, 16 Foundry Wynd, Kilwinning have applied for planning permission for the change of use from an office and industrial (Classes 4 and 5) to storage and distribution (Class 6) with ancillary offices at 6 Brewster Park, Riverside Business Park, Irvine.

The Sub Committee agreed to refuse the application on the following grounds:-

1. That the proposed storage and distribution use would be contrary to industrial policy IND 1(b) of the Adopted Irvine/Kilwinning Local Plan and Policy IND 2(a) of the Finalised North Ayrshire Local Plan (excluding Isle of Arran), in that it would prejudice the policy objective of maintaining Riverside Business Park as a location for inward investment and the development of high amenity business and industry.

2. That, due to the availability of premises in the Irvine/Kilwinning area for storage and distribution uses, there is no need for the proposed use in this location.

4.2 05/00050/PP: Irvine: Kilwinning Road: Site of former Redburn Hotel

John Dickie Homes Ltd, Burnfield Avenue, Thornliebank, Glasgow have applied for planning permission for an amendment to planning permission No. N/04/00035/PP to provide 4 additional flats by increasing blocks 1 and 7 to three storeys and re-positioning block 1 on the site of the former Redburn Hotel, Kilwinning Road, Irvine. Objections have been received from Dr & Mrs M Venugopal No. 20, Mr & Mrs Cowan No. 19, J. A. Forsyth, No. 21, J. Withers, No. 17, Mr & Mrs J Maher, No. 22, P. M. Thorpe, No. 16 and Mr & Mrs Graeme & Elizabeth Bingham No. 14, all of Fairways, Irvine.

Page 11 The Sub Committee, having considered the terms of the objections, agreed to refuse the application on the following ground:-

1. That the proposed development would be contrary to Policy HOU5 of the Adopted Irvine and Kilwinning Local Plan and the Development Control Statement of the Finalised North Ayrshire Local Plan (excluding Isle of Arran) in that the proposed increase to the height of blocks 1 and 7 would not be in keeping with the scale of the existing adjoining developments and would be detrimental to the character and visual amenity of the area as a consequence.

4.3 04/01069/PP: Kilwinning: The Torranyard: Bungalow No. 3

Miss Morrison, Bungalow No. 3, The Torranyard, Kilwinning has applied for planning permission for the erection of a single storey extension to the side and rear of a semi-detached dwellinghouse at that address.

The Sub Committee agreed to refuse the application on the following ground:-

1. That the proposed extension would be contrary to Housing Policy 10 of the Adopted Irvine/Kilwinning Local Plan and the Development Control Statement in the Finalised North Ayrshire Local Plan (excluding Isle of Arran) due to the inappropriate scale, design, siting and external finish of the extension in relation to the existing house and as the proposed development would significantly detract from the character and amenity of the area.

4.4 04/01279/PP: Irvine: Kilwinning Road: Site to East Golf Course

Councillor Rae declared an interest in the following item of business and took no part in the discussion thereon.

MM02 Ltd, Craig House, Mason Street, Motherwell have applied for planning permission for the erection of 15m high flexicell 2 telecommunications column and associated equipment and meter cabinets on a site to the east of the Golf Course, Kilwinning Road, Irvine.

The Planning Services Manager referred to the inclusion of a further proposed condition in addition to that contained in Appendix 1 to the report.

The Sub Committee agreed to grant the application subject to the following conditions:-

1. That, within six months of the equipment becoming obsolete or redundant, it must be removed and the site reinstated to the satisfaction of North Ayrshire Council as Planning Authority.

2. That a minimum footway width of 1.4 metres shall remain between the telecommunications column and associated ground-based equipment and cabinets hereby approved, and the edge of the carriageway, to the satisfaction of North

James Watt College, North Ayrshire Campus, Lauchlan Way, Kilwinning have applied for planning permission for the erection of an extension to the side and rear of the college, the erection of an extension to the front and the formation of associated parking at that address. Objections have been received from Mrs P McCrindle, No. 17 and Mrs R McGeachie, No. 19, both Woodburn Avenue, Kilwinning.

The Planning Services Manager referred to proposed amendments to the Section 75 agreement, and Condition 2 as contained in Appendix 1 to the report and the proposed inclusion of two additional conditions.

The Sub Committee, having considered the terms of the objections, agreed (a) to refer the application to the Scottish Ministers, as required by the Town and Country Planning (Notification of Applications)(Scotland) Amendment Direction 2003; and (b) subject to a Section 75 agreement being entered into to secure (i) the linking of three sets of traffic signals and (ii) the provision of an all-weather pitch within the grounds of Kilwinning Academy, to grant the application subject to the following conditions, unless the Scottish Ministers issue a direction in response to the referral:-

1. That, prior to the occupation of the extension hereby approved, or by a later date to be agreed in writing with Sportscotland and North Ayrshire Council as Planning Authority, a floodlit synthetic grass all-weather pitch, of minimum dimensions 97.5m by 61m, shall be provided within the grounds of Kilwinning Academy. The location, dimensions and specification of this pitch shall be agreed in writing with North Ayrshire Council as Planning Authority, in consultation with Sportscotland, prior to its formation.

2. That, prior to the occupation of the proposed development, the A738 (T) Byres Road/A737 (T) Dalry Road/A737 Howgate traffic signalled junction timings shall be reviewed and modified to be linked and time phased with the two existing traffic signal installations at A737 Howgate/B799 Almswall Road/A737 Lauchlan Way and A737 Lauchlan Way/college access.

3. That no part of the development shall be occupied until a Travel Plan has been submitted to, and approved in writing by, North Ayrshire Council as Planning Authority in consultation with Scottish Executive Enterprise, Transport and Lifelong Learning - Trunk Roads - Network Management Division. The Travel Plan shall identify the measures to be provided, the system of management, monitoring, review, reporting, and the duration of the Plan.

4. In addition to Condition 2 above that, prior to the occupation of the extension hereby approved, the three sets of traffic signals (Kilwinning College, Howgate/Lauchlan Way and Howgate/Dalry Road) shall be linked, in a controlled and integrated way using a SCOOT UTC system, as explained in Appendix A to the planning consent. No works shall take place within the site until the design and

Page 14 installation proposals for the SCOOT system have been agreed with North Ayrshire Council Roads Services and all agreements are in place, to the satisfaction of North Ayrshire Council as Planning Authority.

5. That, prior to the commencement of the development, a revised layout plan shall be submitted for the written approval of North Ayrshire Council as Planning Authority, showing a left turn only exit lane on to Lauchlan Way provided from the east car park of the college, and showing the proposed internal mini roundabout omitted. Thereafter, any such details which may be approved, shall be implemented on site to the satisfaction of North Ayrshire Council as Planning Authority.

6. That the internal one way system, past the loading bay, shall be reversed to allow vehicles from the west car park to utilise the proposed left turn exit at the east car park, and the existing road along the frontage of the college shall remain as two way, to the satisfaction of North Ayrshire Council as Planning Authority.

7. That Keep Clear markings or equivalent shall be provided within the college access road to ensure that the SCOOT system loops are kept clear at all times, to the satisfaction of North Ayrshire Council as Planning Authority.

8. That the presence of any significant unsuspected contamination which becomes evident during the development of the site shall be brought to the attention of Environmental Health. Thereafter, a suitable investigation strategy, as agreed with North Ayrshire Council, shall be implemented and any necessary remediation works carried out prior to any further development taking place on the site, all to the satisfaction of North Ayrshire Council as Planning Authority.

9. That, prior to the commencement of the development hereby approved, details of a scheme to treat the surface water arising from the site in accordance with the principles and practices contained in CIRIA's "Sustainable Urban Drainage Systems Design Manual for Scotland and Northern Ireland 2000" shall be submitted to, and approved by, North Ayrshire Council as Planning Authority. Thereafter, any scheme which may be approved shall be fully implemented prior to the completion of the development and maintained thereafter to the satisfaction of North Ayrshire Council as Planning Authority.

10. That the external materials on the proposed extension shall match those on the existing college building, to the satisfaction of North Ayrshire Council as Planning Authority.

11. That, prior to the commencement of the development hereby approved, details of the external lighting shall be submitted to, and approved in writing by, North Ayrshire Council as Planning Authority. Thereafter, any such details, which may be approved, shall be implemented on site to the satisfaction of North Ayrshire Council as Planning Authority.

12. That no development shall take place until there has been submitted to, and approved by, North Ayrshire Council as Planning Authority a scheme of hard and soft landscaping, which shall include details of species, planting densities, soil treatment and aftercare and shall include indications of all existing trees and hedgerows on the

Page 15 land and details of any to be retained, together with measures for their protection in the course of the development.

That all planting, seeding or turfing comprised in the approved details of landscaping shall be carried out in the first planting season and seeding seasons following the occupation of the buildings or the completion of the development, whichever is the sooner; and any trees or plants which, within a period of five years from the completion of the development die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of a similar size and species, unless North Ayrshire Council as Planning Authority gives written consent to any variation.

5. North Coast and Cumbraes Local Plan Area

5.1 04/01172/PP: : 16 Newhaven Grove

Mr and Mrs A Clare, 16 Newhaven Grove, Largs have applied for planning permission for the erection of a single storey extension to the rear and formation of a balcony at the second storey level of a detached dwellinghouse at that address. An objection has been received from J. Riddell, 18 Newhaven Grove, Largs.

The Sub Committee, having considered the terms of the objection, agreed to grant the application subject to the following conditions:-

1. That, prior to the occupation of the extension hereby approved, a 2m high fence shall be erected along the common boundary with 18 Newhaven Grove as indicated in Drawing No. PL01A and, thereafter, maintained, all to the satisfaction of North Ayrshire Council as Planning Authority.

2. That, prior to occupation of the first floor balcony hereby approved, the screen on the south elevation, as indicated in Drawing No. PL01A, shall be erected and, thereafter, maintained, all to the satisfaction of North Ayrshire Council as Planning Authority.

5.2 04/01118/PP: Isle of Cumbrae: Millport: Golf Road: Site to the North and East of Penmachrie

R. Stewart, Mid-Kirkton, Millport has applied for planning permission for the erection of 3 dwellinghouses in a courtyard, the formation of associated access and car parking on a site to the north and east of Penmachrie, Golf Road, Millport. Objections have been received from W. Duncan, 5 Ellis Street, Kilmarnock and J. and E. Young, Penmachrie House, 21 Golf Road, Millport.

A site familiarisation visit was undertaken by the Planning Sub Committee in respect of the application.

The Local Member expressed a different view from Roads Services regarding the inadequate nature of the access serving the development, and referred to a previous approval for a carrier's yard. He viewed the site as logical infill with a low visual impact and considered that the development would meet a local demand. In support of this, he referred to recent Scottish Executive guidance on appropriate

Page 17 development in rural areas. He subsequently stated that an alternative access from an adjoining development could be secured by the applicant. He expressed the view that, in the light of (a) the fact that the site was on the edge of the settlement boundary proposed in the Replacement North Ayrshire Local Plan; (b) the lack of visual impact from the development; (c) the demand for local housing; (d) the opportunity for safe road access; and (e) recent guidance being more supportive of appropriate development in rural areas, the application should be determined favourably as a justified departure from the Development Plan.

Council Munn, seconded by Councillor Barr, moved that the Sub Committee refuse the application on the grounds contained within Appendix 2 to the report.

As an amendment, Councillor Hill, seconded by Councillor Rae, moved that the Sub Committee approve the application.

On a division, there voted for the amendment 3 and for the motion 2 and the amendment was declared carried.

Accordingly, the Sub Committee, having considered the terms of the objections, agreed to grant the application, subject to the applicant entering into a Section 75 agreement to secure an alternative safe and adoptable access to the site.

Amendment to Item 5.2

At its meeting held on 5 April 2005 the Council agreed to remit item 5.2 above back to the Planning Sub Committee for further consideration.

5.3 05/00013/PP: West Kilbride: : Site to the North of 9 Ardrossan Road

McTaggart Construction, Tod House, Templand Road, Dalry have applied for planning permission for the erection of 7 flats (amendment to previous consent 04/00345/PP) on a site to the north of 9 Ardrossan Road, Seamill, West Kilbride. An objection has been received from Mr and Mrs J Cosgrove, 8A Ardrossan Road, Seamill and representations have been received from V W Currie, No. 1A and J. Campbell, No. 5A, both Ardneil Point, Seamill.

The Local Member expressed the view that the increased density of the flats would result in a loss of amenity to occupiers of the development.

The Sub Committee, having considered the terms of the objection and representations and having heard the local member, agreed (a) to refuse the application; and (b) that appropriate grounds of refusal be submitted to the Council for approval.

Amendment to Item 5.3

At its meeting held on 5 April 2005 the Council agreed to remit item 5.3 above back to the Planning Sub Committee for further consideration.

Objections have been received from L. J. Crawford, 22 Ritchie Street, West Kilbride Community Initiative Ltd, 86 Main Street, Mr and Mrs McPherson, Opus Couture, 23 Ritchie Street, West Kilbride Amenity Society, 20 Well Street and David Hutchison, 56 Main Street, all West Kilbride.

Page 19 The Sub Committee, having considered the terms of the objections, agreed to grant the application subject to the following conditions:-

1. That, prior to the commencement of the development, the applicant shall submit for the written approval of North Ayrshire Council as Planning Authority samples of all external roofing materials.

2. That, prior to the demolition of the property, a report detailing the scheduling of works shall be submitted to, and approved in writing by, North Ayrshire Council as Planning Authority. The schedule of works, which shall include details of the timing of the demolition and redevelopment hereby approved, shall be implemented to the satisfaction of North Ayrshire Council as Planning Authority. No demolition works shall take place until immediately prior to the commencement of building works.
