This report must be published within six months of the election and must include the results for each voting station.

The Member for Fort Whyte, Mr. Hugh McFadyen, resigned his seat on July 31, 2012.

Pursuant to Order in Council number 331/2012, the Deputy Chief Electoral Officer issued the writ of election to the Fort Whyte Returning Officer, Rita Serbin, on August 3, 2012. Nominations were set to close on August 20, 2012 and the by- election was directed to take place on September 4, 2012.

The boundaries of the electoral division were the same as in the 2011 provincial general election. These were established in 2008 under The Electoral Divisions Act, based on the Report of the 2008 Electoral Divisions Boundaries Commission. A map showing the electoral division and voting areas is included in this report.

Pursuant to section 73 (1) of The Elections Act, the Deputy CEO was directed to use the final list for Fort Whyte from the 2011 provincial general election as the preliminary list for the by-election. This was initiated through Order in Council number 332/2012. Voter Registration

When an election is called less than one year after the call of the last election, use of the final voters list from the previous election may be ordered. This was the first time since the office of the CEO was established that an existing list was used. As a result, there was no enumeration period and revision took place from August 6 through 19. To inform those Fort Whyte voters already on the list about the upcoming by-election, voter enumeration cards were delivered prior to revision to the 14,532 voters on the preliminary list.

During revision, 983 names were added. An additional 45 were sworn on during advance and 232 on election day. An eligible voter must take the required oath and produce the required identification to swear on to the voters list. There were a total of 15,792 names on the final voters list for the Fort Whyte by-election.

Nominations for the by-election closed at 1:00 pm on August 20 with five candidates being nominated. The following table shows the nominated candidates and the registered political party which endorsed each of the candidates. CANDIDATE AFFILIATION

Voting

Election day voting took place from 7:00 am to 8:00 pm at 54 voting stations in 17 different locations. In addition to regular voting on election day, Manitoba voters were able to vote at advance locations, through homebound, and absentee voting opportunities and at institutional voting stations.

Absentee Voting

Any qualified voter who will be away from their electoral division during advance voting and on election day may take advantage of absentee voting in the returning office prior to the opening of advance voting. During the Fort Whyte by-election, eight voters utilized absentee voting.

Advance Voting

Advance voting stations are established to allow voting before election day. During the by-election, advance voting was held from Saturday, August 25 to Saturday, September 1 at two locations within the division. Those utilizing advance voting in Fort Whyte increased to 1,579 ballots cast from 1,218 cast during the general election in 2011. This was an increase of 28% from the 2011 election. Of the total ballots cast, 24% were cast during the week of advance voting.

Homebound Voting

As in all elections, homebound voting was available for voters who were unable to go to the voting location because of a disability. This method of voting is also available to the caregivers of these voters. The number of people utilizing this voting opportunity was five (0.1% of the total votes cast).

Voting in Institutions

The Elections Act allows for institutional or moving voting stations for health care facilities and correctional institutions. One institutional voting station went to The Sharon Home (Simkin Centre).

Personal Security Protection Since June of 1995 The Elections Act provides for people to have their name and other personal information either obscured or omitted from the voters list in order to protect the voter’s personal security. During the Fort Whyte by- election there were no personal security voters.

Standing of Parties

The results of this by-election did not change the standings of the parties in the Legislative Assembly. The standings for the five registered political parties remain as they were following the 40th Provincial General Election held on October 4, 2011.
