RESOLUTION AND FINDINGS: Staff recommends that the State Coastal Conservancy adopt the following Resolution pursuant to Sections 31251-31270 of the Public Resources Code: “The State Coastal Conservancy hereby authorizes: 1) the acceptance of three million dollars ($3,000,000) from the State Water Resources Control Board (SWRCB) for implementation of Phase 2 of the Malibu Lagoon Restoration and Enhancement Plan; 2) the disbursement of an amount not to exceed three million six hundred thousand nine hundred dollars ($3,600,900) to

California Department of Parks and Recreation (DPR) for implementation of Phases 1 and 2 of the Malibu Lagoon Restoration and Enhancement Plan; and 3) the disbursement of an amount not to exceed five hundred forty-eight thousand nine hundred dollars ($548,900) to the Resource Conservation District of the Santa Monica Mountains (RCDSMM) for monitoring, final design and permitting of the Malibu Lagoon Restoration and Enhancement Plan. This authorization is subject to the condition that prior to the disbursement of any funds to either DPR or RCDSMM, the Executive Officer of the Conservancy shall review and approve each entity’s work program, including scope of work, budget and schedule, and the names of any contractors to be used to conduct its project.”
Staff further recommends that the Conservancy adopt the following findings: “Based on the accompanying staff report and attached exhibits, the State Coastal Conservancy hereby finds that: 1. The proposed project is consistent with Chapter 6 of Division 21 of the Public Resources Code Sections 31251-31270. 2. The proposed project is consistent with the Project Selection Criteria and Guidelines adopted by the Conservancy on January 24, 2001. 3. The Conservancy, as a responsible agency, has independently reviewed and considered the Final Environmental Impact Report (EIR) (Exhibit 5) and finding of overriding considerations (Exhibit 6) adopted by DPR on April 4, 2006 and finds that the project, as mitigated, avoids, reduces or mitigates all but one of the potential significant environmental effects of the project, possible temporary noise impacts. The Conservancy further finds that there are overriding considerations of great public benefit from the project as fully described in the attached and incorporated by reference Exhibit 6 to the accompanying staff recommendation which make this unmitigable possible temporary noise impact “acceptable” pursuant to 14 California Code of Regulations Section 15093(c).”
PROJECT SUMMARY:
Staff recommends the Conservancy authorize the acceptance of a grant of $3,000,000 from the State Water Resources Control Board for implementation of Phase 2 of the Malibu Lagoon Restoration and Enhancement Plan and the disbursement of up to $3,600,900 to California Department of Parks and Recreation (DPR) and $548,900 to the Resource Conservation District of the Santa Monica Mountains (RCDSMM) to implement the Malibu Lagoon Restoration and Enhancement Plan (Plan).
Two grants, including the $3 million grant being accepted under this authorization, were awarded to the Conservancy by the State Water Resources Control Board and provide the bulk of the funding for the disbursements under this authorization. The remaining funds ($680,000) to be disbursed are Conservancy funds. (See “Project Funding”, below).

When implemented, the Malibu Lagoon Restoration and Enhancement Plan will restore and enhance the ecological structure and function of Malibu Lagoon as well as improve visitor experience through access and interpretive improvements. Restoring wetland functions and improving circulation will increase the capacity of the system to assimilate pollutants, resulting in improved water quality within the Lagoon, and protecting beneficial uses for wildlife within the Lagoon and in adjacent nearshore coastal waters.
The Plan has two phases. Phase 1 includes relocation and redesign of the existing Malibu State Park parking lot to maximize available wetland habitat area and provide water quality benefits through the implementation of Best Management Practices (BMPs) at a new parking lot location. Biological and water quality monitoring will be conducted as part of Phase I to ascertain effects of the project on water quality. The existing parking lot, which is located at the northern portion of the project site, will be demolished and relocated closer to the park entrance and adjacent to Pacific Coast Highway (PCH) in the northwestern portion of the project site. The parking lot relocation will allow for more ground surface area, approximately 2 acres, for wetland habitat restoration. The new parking lot design incorporates runoff treatment controls, including permeable surfaces and a low impact stormwater treatment system, and the design includes a staging area to enhance existing educational and recreational uses of the site (see Exhibit 3). The current number of parking spaces will be maintained and new interpretive displays and panels will be installed. Phase 1 construction is planned occur between November 2006 and January 2007.
Phase 2 of the Plan will occur at the Lagoon and includes additional biological and water quality monitoring, final restoration construction drawings, permitting, and construction of public access and resource enhancements to increase circulation and improve habitat in the Lagoon. Phase 2 encompasses two primary components: Salt Marsh Enhancement (the western arms) and East Lagoon Restoration (adjacent to the Adamson House). The goals of the Salt Marsh Enhancement are increased tidal flushing, improved water circulation, increased holding capacity and reduced predator encroachment. The East Lagoon Restoration goals are regrading the lagoon to restore typical salt marsh hydrology, creating nesting islands for sensitive bird species and creating channel connections to the lagoon. Construction activities at the Lagoon would primarily involve earthwork to be coupled with non-native species removal and enhancement of native/wetland vegetation.
The existing boathouse channel (eastern channel) would be deepened and recontoured to create a new avian island along the bank of the Adamson House grounds. This would create additional mudflat habitat and promote additional water circulation around the new island. The main channel will remain substantially “as is.” The western edge of the main lagoon at the interface with the western arms complex would be reconfigured in the form of a naturalized slope to provide a degree of separation between main lagoon and west channel system. Within the western arms complex, a new channel would be created along the southern edge of the west lagoon to replace the three existing channels and create a single main entrance and exit for water conveyed into and out of the west lagoon. This channel may be optimized to overlie an existing channel to minimize the impact to existing habitat and will be designed to enable a future

connection to the “golf course” parcel.1 The new single channel would be located at the south end of the Lagoon and aligned to maximize tidal circulation and minimize sediment laden storm flows in the west portion of the Lagoon.
In addition, the Plan proposes to enhance visitor experience through improvements to access and interpretation. The existing trail along the perimeter of the western arms complex would be improved for use as the primary beach access trail. Some of the additional features of the plan include interpretive nodes located near the parking area, restroom facilities near entry parking circle, enhanced access to the Lagoon with interpretive signage and graphics and a combination viewing and interpretive area near the southwest perimeter to enable passive interaction without disturbance.
Final design, construction drawings, and permitting for Phase 1 is currently underway, supported by a combination of Coastal Conservancy funds ($250,000) authorized on October 31, 2002 and a Proposition 13 grant from the SWRCB in the amount of $825,000 (see Exhibit 4). SWRCB has also awarded a grant in the amount of $3,000,000 to the Coastal Conservancy to implement Phase 2 of the Plan. The development of the Plan has been a collaborative process among the Conservancy and its partners. The development of the Final Malibu Lagoon Restoration and Enhancement Plan, which included very comprehensive stakeholder involvement, was managed by our nonprofit partner, Heal the Bay. The environmental review, permitting and biological and water quality monitoring are being managed by the RCDSMM. The RCDSMM will continue work during Phase 2 managing the biological and water quality monitoring and the development of the final restoration plans and construction drawings. DPR, as the landowner, will manage the implementation of the parking lot relocation and the Lagoon restoration and enhancement.
Southern California has lost more than 90% of its historic coastal wetlands. The highly urban setting of Southern California significantly limits coastal wetland creation, restoration and enhancement opportunities. Malibu Lagoon is the largest coastal wetland in the Santa Monica Bay region and it presents a unique coastal wetland restoration opportunity. The restoration of this habitat is invaluable due to the overwhelming loss of coastal wetlands in southern California to date. As discussed below, restoration of Malibu Lagoon has long been a priority of the Coastal Conservancy. This project is specifically identified in the Southern California Wetland Recovery Project’s (WRP) Regional Strategy and is on the WRP’s Work Plan as a Tier 1 priority project.
Site Description: Malibu Lagoon lies at the end of the 110-square mile Malibu Creek watershed, the second largest watershed draining to Santa Monica Bay. The lagoon is a coastal estuary with a direct link to a very heavily used public swimming and surfing beach. Malibu Lagoon State Beach is immediately adjacent to the Lagoon, and just downcoast is Surfrider Beach, one of the most popular surfing beaches in Southern California (Exhibit 2). Surfrider

Beach is world renowned as a surfing and recreational destination, and receives approximately 1.5 million visitors every year.
Existing land uses on the project site are primarily recreational and supportive of open space and habitat preservation. Onsite amenities include a parking lot, which drains directly into the lagoon, walking and beach access trails through the lagoon, a grass picnic area, and portable restroom facilities. This project will improve the recreational and educational amenities onsite and enhance the visitor’s experience while restoring and protecting the sensitive Lagoon habitat.
Malibu Lagoon occupies approximately 31 acres and provides habitat for two federally listed endangered species, the tidewater goby and steelhead trout. The Lagoon also plays host to an abundance of avian species and is a critical stop-over for migrating birds along the Pacific flyway. Water within the Lagoon needs to circulate to remain of suitable quality for use as aquatic habitat. The project will serve to improve circulation within the Lagoon and promote habitat suitability for threatened and endangered species by increasing the available slough channel refugia habitat with sandy bottom for tidewater gobies and providing increased isolation of island habitats for seasonal snowy plovers and least tern use.
Under Section 303(d) of the 1972 Clean Water Act, states are required to develop a list of water quality-limited segments for waters that do not meet water quality standards, establish priority rankings for waters on the list and develop action plans to improve water quality. The SWRCB has developed a list of the State’s impaired waters called the 303(d) list. Malibu Lagoon is cur- rently 303(d) listed as impaired for benthic impacts, pathogens, nutrients/eutrophication, swim- ming restriction, and shellfish harvesting advisory. The enhanced circulation and water quality at the Lagoon will improve these conditions over the existing situation. For example, increased circulation and water exchange will improve temporal and spatial frequency of oxygenated water contact with surface sediments, thus increasing organic matter decomposition and increasing the transformation of ammonia to nitrate. This, in turn, will facilitate the permanent loss of nitrogen, the limiting nutrient, from the Lagoon through denitrification and reduce its supply to the pri- mary producer communities.
Project History: The Malibu Lagoon Restoration effort has a history of collaboration and extensive stakeholder participation. For the past decade the staff of the Coastal Conservancy has been working closely with local stakeholders and partners to develop plans for restoring Malibu Lagoon. The Coastal Conservancy funded the Lower Malibu Creek and Lagoon Resource Enhancement and Management Report, completed in 2000, and supported a subsequent process for identifying implementation options.
In October 2002, the Conservancy funded the first phase of a restoration feasibility analysis. Subsequently, Conservancy staff, working with its project partners, successfully sought grant funds from the State Water Resources Control Board (SWRCB) for Coastal NPS funds for final Malibu Lagoon Restoration planning and partial implementation. A portion of the SWRCB Coastal NPS funds, in addition to Conservancy funds, resulted in development of a preferred alternative with the benefit of comprehensive stakeholder participation and a technical advisory panel evaluation, the Plan and final environmental review. The Plan was prepared by Moffatt & Nichol in association with Heal the Bay (June 2005) for DPR and the Coastal Conservancy. The

Final EIR was completed and certified by DPR in early April of this year (Exhibit 5). Currently, final design, construction drawings and permitting for Phase 1 are underway, using a combination of Conservancy and SWRCB funds. If approved Phase 1 implementation is scheduled to commence November 2006. The Coastal Conservancy secured Prop 50 funds in April 2005 for Phase 2 of the Plan. The second phase of construction would begin after completion of the Phase 1 parking lot construction in 2007 and be completed by March 2008.
In addition to the participation of the Conservancy in establishing a restoration plan for Malibu Lagoon, the Conservancy is a project partner in several important coastal resource protection projects in the Malibu Creek Watershed, including the eradication of non-native invasive plant species, the restoration and enhancement of riparian resources, and the elimination of barriers to fish passage to support the re-establishment of southern steelhead in the Malibu Creek Watershed.

The SWRCB has provided a grant to the Conservancy for Phase 1 using funds from the Safe Drinking Water, Clean Air, Watershed Protection and Flood Control Protection Act of 2000 (Proposition 13) for projects that protect and restore the water quality and environment of coastal nearshore waters, consistent with the state’s Non-Point Source Pollution Control Plan.
The SWRCB has provided a grant to the Conservancy for Phase 2 using funds derived from the Water Security, Clean Drinking Water, Coastal And Beach Protection Act of 2002 (Proposition 50) for water quality and water protection programs, specifically for restoration and protection of Santa Monica Bay.
The anticipated source of Conservancy funds is an appropriation to the Conservancy from the Water Security, Clean Drinking Water, Coastal and Beach Protection Act of 2002 (Proposition 50). Consistent with the purposes of this funding source, the proposed project would be carried out in accordance with the provisions of the Conservancy’s enabling legislation and would in- volve the protection and restoration of coastal wetlands and enhancement of water quality at public beaches.
As indicated, the Wildlife Conservation Board (WCB) is expected to fund the balance of Phase 2 of the Plan. The WCB funding request will be considered at a public meeting Fall 2006.
CONSISTENCY WITH CONSERVANCY'S ENABLING LEGISLATION:
Chapter 6 of Division 21 of the Public Resources Code (Sections 31251-31270) authorizes the Conservancy to award grants to public agencies for the enhancement of significant coastal natural resources. Protecting wetland and related riparian resources within Malibu Lagoon is essential to ensuring the sustainability of the coastal ecosystem of the Malibu Creek Watershed.
Consistent with Public Resources Code Section 31252, the area proposed for resource enhancement has been included in the Malibu Local Coastal Plan and the Santa Monica Bay Plan, as well as the Malibu Creek Watershed Action Plan as an area requiring public action to address a resource problem, in this case coastal water quality and habitat degradation. Consistent with Public Resources Code Section 31253, the Conservancy may provide up to the total cost of any coastal resource enhancement project. The Conservancy funds are leveraged with funds provided by the SWRCB and Wildlife Conservation Board, as well as the in-kind services of the DPR.
CONSISTENCY WITH CONSERVANCY’S STRATEGIC PLAN GOALS & OBJECTIVES:
Consistent with Goal 5 Objective A, the proposed project will increase Coastal Resource Conservation by the restoration of wetland and riparian lands that will protect, restore, and enhance biological diversity in coastal areas. Objective A directs staff to preserve, restore, and enhance important coastal habitats including coastal wetlands and coastal stream corridors. The proposed project contains significant natural resources.

Consistent with Goal 6 Objective A, the proposed project will improve water quality, habitat, and related coastal habitats within a priority coastal watershed, developing projects that preserve and restore coastal watersheds.
CONSISTENCY WITH CONSERVANCY'S PROJECT SELECTION CRITERIA & GUIDELINES:
The proposed project is consistent with the Conservancy's Project Selection Criteria and Guidelines adopted January 24, 2001, in the following respects:
Required Criteria
1. Promotion of the Conservancy’s statutory programs and purposes: See the “Consistency with Conservancy’s Enabling Legislation” section above. 2. Consistency with purposes of the funding source: See the “Project Financing” section above. 3. Support of the Public: The proposed project has widespread community and agency support. The Plan has multiple agency involvement, including federal, state, regional, and local. In addition, the project is supported by community nonprofit organizations and members of the general public. Letters of support are attached as Exhibit 7. Additional letters will be hand-carried to the meeting. 4. Location: The proposed project would benefit wetland habitat resources and water quality within the coastal zone of the Malibu/Santa Monica Mountains area. The Malibu State Park parking lot lies in the City of Malibu’s LCP area. The Malibu Lagoon lies entirely within Coastal Commission retained jurisdiction. 5. Greater-Than-Local Interest: The location of the Lagoon at the terminus of a priority watershed is significant both locally and statewide. The Lagoon represents an important coastal wetland resource hosting both avian and aquatic species of important statewide and regional ecological significance, including two federally listed endangered species, the tidewater goby and steelhead trout, and it is a critical stop-over for migrating birds along the Pacific flyway. In addition, world-renowned as a surfing and recreational destination, adjacent Surfrider Beach receives approximately 1.5 million visitors every year.
Additional Criteria
7. Urgency: Malibu Lagoon is currently 303(d) listed (State’s list of impaired water bodies pursuant to Section 303(d) of the Clean Water Act) as impaired for benthic impacts, pathogens, nutrients/eutrophication, swimming restriction, and shellfish harvesting advisory. The enhanced circulation and water quality at the Lagoon will improve these conditions over the existing situation. Further, the SWRCB funding for the implementation of this project expires March 2007 and March 2008 for Phases 1 and 2 respectively; thus, approving the grant now is essential to allow for completion of the restoration project before the expiration of the funding source. 8. Resolution of more than one issue: The Plan addresses coastal resource protection, habitat quality and species protection, water quality, watershed resource protection, and also will enhance the visitor’s recreational and educational experience.

9. Leverage: See the “Project Financing” section above. 12. Readiness: The Coastal Conservancy along with DPR and its partners have been working since 2002 on the development of the Plan, completing environmental review, securing permits and preparing final design plans. If approved, Phase 1 will be constructed this fall. With these aspects in place, once the proposed funds are approved, the project partners are ready to begin monitoring and implementation of the both phases of the Plan. 13. Realization of prior Conservancy goals: See the “Project History” section above. 15. Cooperation: The Plan involves the cooperation of federal, state, local, regional agencies, as well as interested stakeholders and members of the general public.
CONSISTENCY WITH COASTAL ACT & LOCAL COASTAL PROGRAM POLICIES:
The Commission certified the Malibu LCP on September 13, 2002 and adopted a map of the post-LCP certification jurisdiction as part of that action. The Malibu Lagoon is entirely within the area designated as permanent jurisdiction of the Coastal Commission. Therefore, the Coastal Act is the standard of review for permits and plans in this area and the Commission is the decision making body. The Malibu State Park parking lot lies within the LCP jurisdiction, therefore the City of Malibu will issue a coastal permit for Phase 1, the relocation of the lot. The LCP contains specific policies for Malibu Lagoon. The Commission treats LCPs as guidance for its decision-making within its area of permanent jurisdiction. Both phases of the project must be reviewed and approved by the City and Commission for consistency with the LCP and Coastal Act, respectively. This process additionally assures LCP and Coastal Act conformity.
Policy 2.17 states that “recreation and access opportunities at existing public beaches and parks shall be protected, and where feasible, enhanced as an important coastal resource.” The Plan includes improvements to access onsite and enhances the visitor’s experience with the addition of interpretive nodes. Policy 3.45 addresses the effects of new development. Consistent with this policy, the project is designed to minimize landform alteration, reduce polluted runoff into the lagoon and ocean, and improve plant and animal life at the Lagoon.
In addition, policy 3.91 states that “new development within or adjacent to wetlands shall include evidence of preliminary approval from California Department of Fish and Game, U.S. Army Corps of Engineers, U.S. Fish and Wildlife Service, and other resources management agencies, as applicable.” Consistent with this policy, all relevant resource agencies were invited to participate and some participated in the stakeholder process to develop the Plan. In addition, the RCDSMM has consulted all of the named agencies directly on the Plan, including onsite meetings. Phase 1 does not require approvals from those agencies as the parking lot does not lie within an area containing sensitive resources. All required approvals will be obtained prior to implementation of Phase 2.
The LCP maps specifically identify Malibu Lagoon as an Environmentally Sensitive Habitat Area (ESHA) and a Marine Resource. The Land Use Plan (LUP) also includes two specific policies for lagoon protection.
Policy 3.92 states that a “lagoon management plan should be developed for Malibu Lagoon, in consultation with all applicable resource management agencies.” The Plan goes far toward

The Plan includes a detailed monitoring plan, which defines a program of field observations and monitoring to be undertaken prior to, during and following implementation. Specific monitoring tasks and decision-points are specified to feed into an adaptive management framework to ensure long-term restoration integrity and success. The monitoring plan will be used to assess floral and faunal assemblages, protect existing habitat, minimize impacts during restoration activities and document resource changes for application in future adaptive management programs. The monitoring to be undertaken will provide a substantial amount of the data needed for a lagoon management plan, including the following six of the ten study topics specifically identified by LUP Policy 3.93: Biological study of the Lagoon habitat, including identification of all rare, threatened, and endangered species. Lagoon hydrology; Water quality sampling study; Measures to protect endangered species; Water quality protection and enhancement measures; Monitoring plan to monitor the management area to evaluate the health of the wetland, assess adverse impacts resulting from breaching or water level management, and identify project corrections. The Plan is therefore consistent with that policy.
The project area is immediately adjacent to a historic site and could potentially contain archaeological or paleontological resources. Policies 5.61 and 5.62 mandate mitigation for potential adverse impacts, coordination with appropriate agencies to identify archeologically sensitive areas and data protection. All applicable mitigation and monitoring measures are proposed in the EIR and will be incorporated during construction activities.
The Plan is consistent with the planning and management policies contained in Sections 30230, 30231, and 30233(a)(7) of the Public Resources Code. Section 30230 states “Marine resources shall be maintained, enhanced, and where feasible, restored. . . . Uses of the marine environment shall be carried out in a manner that will sustain the biological productivity of coastal waters and that will maintain healthy populations of all species of marine organisms adequate for long-term commercial, recreational, scientific, and educational purposes.” Section 30231 states “The biological productivity and the quality of coastal waters, streams, wetlands, estuaries, and lakes appropriate to maintain optimum populations of marine organisms and for the protection of human health shall be maintained and, where feasible, restored. . . .” Section 30233(a)(7) states, “The diking, filling, or dredging of open coastal waters, wetlands, estuaries, and lakes shall be permitted in accordance with other applicable provisions of this division, where there is no feasible less environmentally damaging alternative, and where feasible mitigation measures have been provided to minimize adverse environmental effects and shall be limited to the following: . . . (7) Restoration purposes. . . .” Consistent with these policies, this project would restore and enhance the resources of Malibu Lagoon, sustain its biological productivity. In addition, the Plan includes a water management component that would implement Best Management Practices for the drainage from the parking lot and public use areas which will enhance water quality in the lagoon. Circulation within the lagoon would be closely monitored and evaluated to ensure sustained optimum populations of marine organisms subsist in the Lagoon and surrounding waters. Consistent with Section 30233, the EIR has identified the least environmentally

damaging feasible alternative and feasible mitigation measures to minimize adverse environmental effects. Restoration of the lagoon, is a specifically permitted use under Section 30233(a)(7). For these reasons, the Plan is consistent with the policies of the Coastal Act.
Further, the Plan is consistent with Section 30240, which speaks to protection of Environmentally Sensitive Habitat areas (ESHAs), as its direct aim is to improve the habitat area overall. The Plan will have a beneficial effect on the existing LCP-designated ESHA onsite and sensitive areas surrounding the lagoon.
COMPLIANCE WITH CEQA:
The DPR, as the lead agency under the California Environmental Quality Act (CEQA), adopted the Final EIR for the Malibu Lagoon Restoration and Enhancement Plan on April 3, 2006. The DPR filed its Notice of Determination (NOD) on April 4, 2006. No challenges to the DPR’s determination of the project’s environmental effects were made. The Final EIR, including the NOD, is attached as Exhibit 5.
The Conservancy acts as a responsible agency under CEQA for this project pursuant to 14 Cal. Code of Regulations §15096.
The EIR identifies the project’s possible significant impacts, which are:
Construction activities could result in significant impacts to southern steelhead trout and tidewater goby; Construction activities could result in disturbance to California brown pelican, western snowy plover, Heermann’s Gull, elegant tern and California Least Tern; Construction of the proposed project could result in impacts to prehistoric site Humaliwo (CA-LAN-264) or the historic Adamson House grounds and ancillary structures; Potential exists for ground-disturbing activities to damage previously unidentified buried cultural resources sites; Release of construction-related sediment from access roads, staging areas, ground- disturbing activities, and stock piling during Phase I and Phase II construction into the lagoon could affect water quality.
The EIR finds that these potential significant impacts are reduced to a less-than-significant or insignificant level through the implementation of feasible mitigation measures, such as, separa- tion of construction activities from the portion of the lagoon where sensitive fish species would occur; fish salvage efforts for any water disturbances or movement; reflooding of the lagoon in a manner that minimizes disturbance of the lagoon salinity stratification and substrate and the re- lease of sediment; use of block netting and barriers to exclude adult gobies, migratory steelhead, and other fish from the work areas; on-site monitoring by a USFWS-approved fisheries biologist during any construction or habitat disturbance activities; timing of construction activities to avoid the breeding season of sensitive species; cultural resources excavations undertaken prior to any ground-disturbing activities; cultural resources monitoring during any ground disturbing activities adjacent to identified cultural resource areas; and implementation of Best Management Practices (BMPs) to control discharge of construction-related pollutants to surface waters. The EIR finds that one potentially significant impact cannot be avoided through implementation of feasible mitigation measures or feasible environmentally superior alternatives. The construction of the proposed project would result in temporary increases in ambient noise levels on the project site and its vicinity on an intermittent basis. However, the DPR determined that this impact is outweighed by the public benefits of the proposed Malibu Lagoon Restoration and Enhancement Plan Consequently, the DPR made a statement of overriding considerations that there is substantial evidence in the record that the project’s one unmitigable adverse environmental effect is “acceptable” in light of the many public benefits of the project, pursuant to Section 15093(c) of the California Code of Regulations (see Exhibit 6).
Pursuant to its responsibilities under 14 California Code of Regulations, Section 15091, Conservancy staff has independently reviewed the DPR’s Final EIR, concurs in the DPR’s finding and therefore recommends that the Conservancy, as a responsible agency, find that the project, as mitigated, will not have a significant effect on the environment, with the exception of the project’s potential significant effect of temporary increases in ambient noise levels. With respect to the project’s potentially significant and unmitigable effect of temporary increases in noise levels, Conservancy staff recommends that the Conservancy concur with the DPR’s statement of overriding considerations as fully described in the attached Exhibit 6, pp 32-34 and find that this potential impact is outweighed by the public benefits of the proposed restoration project. Upon approval, staff will file a Notice of Determination for the project.

PROJECT SUMMARY: Staff recommends the Conservancy authorize disbursement of up to $300,000 to Heal the Bay to prepare a final restoration plan and develop site plans for Malibu Lagoon, using a portion of funds provided by the State Water Resources Control Board. This would be the first phase of a final lagoon restoration funded by the SWRCB in the total amount of $825,000, which requires a matching funds contribution from the Coastal Conservancy in the amount of $150,000. The Coastal Conservancy previously approved funding for the final pre-project planning last year, and currently Heal the Bay is managing consultant services to prepare final project alternatives in advance of preparing a final restoration plan.
The Coastal Conservancy, working with its community nonprofit partner, Heal the Bay, and the lagoon owner, California Department of Parks and Recreation, is implementing a final lagoon restoration plan using funds provided by the SWRCB. SWRCB granted funds to the Conser- vancy to finalize restoration planning and begin restoration implementation. This authorization will allow for the final restoration planning. The proposed project would involve plans to restore and enhance the lagoon and adjacent creek riparian habitat resources of Malibu Lagoon. Restor- ing wetland functions and improving circulation will increase the capacity of the system to as- similate pollutants, resulting in improving water quality within the lagoon, and protecting the beneficial uses for wildlife within the lagoon and in adjacent nearshore coastal waters. Site Description: Malibu Lagoon is a coastal estuary with a direct link to a very heavily used public swimming and surfing beach. Malibu Lagoon State Beach is immediately adjacent to the Lagoon, and just downshore is Surfrider Beach, one of the most popular surfing beaches in Southern California. Malibu Lagoon drains the 110-square mile Malibu Creek watershed, the second largest watershed draining to Santa Monica Bay. Project History: For the past decade the staff of the Coastal Conservancy has been working closely with local stakeholders and partners to develop plans for restoring Malibu Lagoon. The Coastal Conservancy funded the Lower Malibu Creek and Lagoon Resource Enhancement and Management Report, completed in 2000, and supported a subsequent process for identifying implementation options. In January 2003, the Conservancy funded the first phase of a restoration feasibility analysis (Exhibit 3). In the past year, Conservancy staff, working with its project partners, successfully sought grant funds from the State Water Resources Control Board (SWRCB) for Coastal NPS funds for final Malibu Lagoon Restoration planning. The SWRCB has committed $825,000 to implement the program and the Conservancy is required to provide a $150,000 match. The proposed authorization would support the completion of this planning process, resulting in development of a preferred alternative and final environmental review and

project permitting. Implementation of the Lagoon Restoration Program, using the remaining SWRCB grant funds and the Conservancy matching funds of $150,000 will be the subject of a future Conservancy staff recommendation.
In addition the participation of the Conservancy in establishing a restoration plan for Malibu Lagoon, the Conservancy is a project partner, and/or project funder, in several important coastal resource protection projects in the Malibu Creek watershed, including the eradication of non- native invasive plant species, the restoration and enhancement of riparian resources, and the elimination of barriers to fish passage to support the re-establishment of southern steelhead in the creek watershed.
PROJECT FINANCING:
SWRCB $825,000 Coastal Conservancy $150,000
The SWRCB has provided a grant to the Conservancy for this program using funds derived from the Safe Drinking Water, Clean Air, Watershed Protection and Flood Control Protection Act of 2000 (Proposition 13) for projects that protect and restore the water quality and environment of coastal nearshore waters, consistent with the state’s Non-Point Source Pollution Control Plan.
The Conservancy’s contribution to the proposed project is anticipated to be funded through funds allocated to the Coastal Conservancy from the Habitat Conservation Fund (HCF). The Habitat Conservation Fund can be used for the acquisition, enhancement or restoration of wet- land, riparian and related coastal habitats. The restoration of wetlands to protect coastal natural resources and implement the state’s Non-Point Source Pollution Prevention Program is consis- tent with the purposes and requirements of these funding sources.
CONSISTENCY WITH CONSERVANCY'S ENABLING LEGISLATION: Chapter 6 of Division 21 of the Public Resources Code (Sections 31251-31270) authorizes the Conservancy to award grants to nonprofit organizations for the enhancement of significant coastal natural resources. Protecting wetland and related riparian resources within Malibu La- goon is essential to ensuring the sustainability of the coastal ecosystem of the Malibu Creek wa- tershed. Consistent with Public Resources Code Section 31252, the area proposed for resource enhance- ment has been included in the Malibu Local Coastal Plan and the Santa Monica Bay Plan, as well as the Malibu Creek watershed Action Plan as an area requiring public action to address a resource problem, in this case coastal water quality and habitat degradation. Consistent with Public Resources Code Section 31253, the Conservancy may provide up to the total cost of any coastal resource enhancement project. The Conservancy funds are to be leveraged with funds provided by the SWRCB and in-kind services of the California Department of Parks and Recrea- tion.

CONSISTENCY WITH CONSERVANCY’S STRATEGIC PLAN GOALS & OBJECTIVES: Consistent with Goal 5 Objective A, the proposed project will increase Coastal Resource Con- servation by the restoration of wetland and riparian lands that will protect, restore, and enhance biological diversity in coastal areas. Objective A directs staff to preserve, restore, and enhance important coastal habitats including coastal wetlands and coastal stream corridors. The proposed project contains significant natural resources. Consistent with Goal 6 Objective A, the proposed project will improve water quality, habitat, and related coastal habitats within a priority coastal watershed, developing projects that preserve and restore coastal watersheds.
CONSISTENCY WITH CONSERVANCY'S PROJECT SELECTION CRITERIA & GUIDELINES:

The project will entail refining and evaluating alternatives for correcting circulation and grading problems that remained after fill was removed from the lagoon by the California Department of Parks and Recreation in the 1980s. Correction of these im- pairments to the lagoon habitat were identified as top priorities

by the Malibu Lagoon Task Force (MLTF) of the Malibu Creek Watershed Advisory Council, the stakeholder planning group for the watershed. The MLTF recommendations are based on the Lower Malibu Creek and Lagoon Resource En- hancement and Management study (Lagoon Study), which the MLTF conducted with Conservancy funding to identify con- ceptual alternatives for restoration and enhancement actions throughout the lower watershed. The project will also imple- ment the Santa Monica Bay Restoration Project’s (SMBRP) Bay Restoration Plan (the Bay Plan), which made restoring Malibu Lagoon one of its primary objectives and was approved by the Conservancy in August 2001. The project design process will take into account factors that limit potential lagoon enhancement, including persistent high water levels and low salinities in the lagoon brought on by in- creased use of imported water upstream, surface and subsur- face inflows of polluted water, controversies over artificially breaching the lagoon berm, and concern over beach closures and health problems associated with people using the Bay wa- ters adjacent to the lagoon. These factors are the subject of other projects already underway. A technical advisory commit- tee will be established among the managers of these projects to coordinate work, avoid duplication of effort, and identify common interests and beneficial synergies. The project site lies entirely within the State-owned area oper- ated by DPR as Malibu Lagoon State Beach. Since DPR does not have sufficient staffing or funding available to conduct the project, it has asked the Southern California Wetlands Recov- ery Project (SCWRP) and the Conservancy for assistance. Po- tential matching funds have already been identified for imple- mentation, and the Conservancy’s timely funding of the planning phase would catalyze progress towards a successful enhancement. The SCWRP Board of Governors has included the project in its Work Plan. DPR has also arranged to work with Heal the Bay (HTB), a private nonprofit organization, to manage the project. HTB was founded in 1985 to work to improve the health and safety of Santa Monica Bay and southern California coastal waters gen- erally. It has a long and extensive record of scientific, techni- cal, and management involvement with the problems and op- portunities of Malibu Creek and Lagoon. It has carried out large-scale water quality studies and long-term monitoring programs, and has successfully managed Conservancy grants in the past.

STAFF DISCUSSION: Project Description: The project would provide up to $250,000 to Heal the Bay (HTB) to prepare feasibility studies, preliminary design and engineering plans, environmental documents, and an imple- mentation program for the enhancement of Malibu Lagoon and to coordinate this work with other projects and study programs affecting the lagoon to implement the Santa Monica Bay Res- toration Plan, adopted by the Conservancy in August 2001. At Site A1 (Exhibits 3 & 4), the project’s objectives are to in- crease tidal flushing in the wet season, improve water circula- tion, increase water holding capacity in the dry season, reduce predator encroachment, and improve the function and value of salt marsh habitat. The design would take into account integrat- ing any potential future acquisition of adjacent sites to enlarge the Lagoon. Enhancement planning for the Site A4 (Exhibits 3 & 4) would evaluate how best to increase salt marsh acreage at this site and establish nesting habitat, including the possibility for re- grading to encourage establishment of salt marsh hydrology, create a nesting island for least terns and snowy plovers, and develop channel connections to the lagoon. The project design for both sites will take into consideration potential impacts to endangered species such as the tidewater goby that have returned to the site. The project’s management structure will also serve to integrate a number of other studies currently underway in and around the lagoon to develop an im- plementation plan that responds to these multiple objectives in a coordinated way. HTB is an appropriate organization to conduct these studies. HTB has a long and extensive record of scientific, technical,

and management involvement with the problems and opportu- nities of Malibu Creek and Lagoon. It has carried out large- scale water quality studies and long-term monitoring programs, and has successfully managed Conservancy-funded projects in the past. Site Description: Malibu Lagoon, at the mouth of the 105-square-mile Malibu Creek Watershed, was historically one of the most diverse and productive habitats in the Los Angeles region. As the terminus of one of the largest sub-basins of the 414-square-mile land area that drains into Santa Monica Bay, Malibu Lagoon his- torically covered a much larger area than it does today. Over the last seventy years, encroaching development in Malibu has reduced the size of the lagoon and associated seasonal wet- lands and upland habitat. Malibu Lagoon State Beach, owned and operated by DPR, contains a portion of the historical la- goon, including both project sites. Site A1 is 16.1-acre section at the western edge of the lagoon, bordered by Malibu Colony, the barrier beach, an access road, and the State Beach parking lot. In the 1920s and 30s the site contained wetlands, but a portion of this habitat was filled to accommodate construction of roads and houses and Malibu Colony. The construction of a levee to prevent flooding in Malibu probably caused further degradation by depriving the wetlands of a consistent water source. Later Caltrans used the site as a depository for fill. By the 1970s, the site was com- pletely filled and occupied by a baseball field. In 1983, DPR undertook a restoration of Malibu Lagoon that included removal of baseball fields, removal of fill and exotic shrubs, and the excavation of tidal channels for the creation of mudflat and upland habitat. A walkway was also constructed between the parking lot and the barrier beach. The resulting constructed topography is unlike natural southern California salt marshes within coastal lagoons. Instead of being low and

flat, the partially restored salt marsh is characterized by ele- vated islands and peninsulas that do not support a typical or abundant complex of salt marsh vegetation. The relatively steep sides of these islands offer only a narrow intertidal sur- face area that is subject to the ebb and flow of water when the mouth is open. The broad flat tops of the islands are essentially non-marsh dry land. Thus there is presently far less wetland habitat value and function within this given area of the lagoon than was historically available. The existing tidal creeks also differ from those in more natural lagoon salt marshes, with relatively straight channels in an “H” configuration, rather than meandering channels with a series of branches. The back channels of the lagoon have poor circula- tion and low dissolved oxygen. Large algal blooms appear in the dry season, further depleting the oxygen. Site A4 on the eastern bank of the lagoon includes 1.2 acres. It is bordered by a palm grove, the Adamson House (a national historic site), and the beach. It has been disturbed in the past by construction and periodic dredging, and presents an opportu- nity for enhancing salt marsh, least tern, and snowy plover habitat. The lagoon as a whole experiences an unusual water regime. As a result of development and importation of water into the watershed, dry-weather flows have increased. This fills the la- goon to a higher water level than natural, and causes a number of complications. The unnatural accumulation of water in the lagoon is thought to raise groundwater levels beneath Malibu Colony and the Civic Center area, causing septic system fail- ures and runoff of pathogen-laden water into the lagoon. The large volume of water trapped in the lagoon eventually leads to a catastrophic failure of the berm. When the lagoon empties suddenly, endangered tidewater gobies present in the lagoon are beached or flushed out to sea. Rapid changes in salinity also result, detrimentally impacting other lagoon fauna. High fresh water levels also inhibit the development of salt marsh vegetation. Other programs are currently underway to address these issues, and enhancement planning for this project will take these conditions into account
Project History: After years of mounting evidence of the degradation of the water quality and habitat values of Santa Monica Bay and its sub-watersheds, the State of California and the U. S. Environ- mental Protection Agency (US EPA) included Santa Monica Bay in the National Estuary Program (NEP) in May 1988.

The Santa Monica Bay Restoration Project (SMBRP) took on the task of developing a long-range plan to return the Bay’s eco- systems and watersheds to productive health. In 1995, the State of California and the U.S. EPA approved the Santa Monica Bay Restoration Plan to include 250 specific action areas focused on habitat conservation, enhancement and restoration, pollution prevention and treatment control, and assessment, education, and monitoring. The Malibu Creek Watershed was singled out for special priority attention as a pilot project, and restoring Malibu Lagoon became one of the Plan’s primary objectives. In August 2001, the Conservancy also adopted the Bay Restoration Plan. As a step toward implementing that Plan, the Lower Malibu Creek and Lagoon Resource Enhancement and Management re- port was prepared for the Malibu Lagoon Task Force (MLTF) of the Malibu Creek Watershed Advisory Council with Conser- vancy funding. That report, and the recommendations adopted by the MLTF, identified reconfiguring and restoring the pro- ject’s two sites as among the watershed’s very highest priority needs. DPR proposed the current project to the Southern Cali- fornia Wetland Recovery Project (SCWRP), and the SCWRP Governing Board adopted it as part of its Work Program. The Conservancy has in the past funded, and is currently fund- ing, several projects in the Malibu Creek watershed, including water quality treatment projects and studies in the surrounding urban area of Malibu, the Rindge Dam removal feasibility study, a project to assess removal of other fish passage barriers in the watershed, and continued acquisitions to complete the multi-year restoration plan for Cold Creek, a tributary to Mal- ibu Creek.
PROJECT SUPPORT: In addition to the active participation by DPR and HTB, the proposed study has the support of a number of elected officials, agencies and nonprofit organizations, including State Senator Sheila Kuehl, Assemblywoman Fran Pavley, Los Angeles County Supervisor Zev Yaroslavsky, public agencies, includ- ing the Regional Water Quality Control Board, Santa Monica Bay Restoration Project, and many other environmental and community groups. Exhibit 5, Letters of Support, will be mailed separately and/or hand-carried to the Conservancy meeting.

CONSISTENCY WITH CONSERVANCY'S ENABLING LEGISLATION: Chapter 6 of Division 21 of the Public Resources Code (Sec- tions 31251-31270) provides for the Conservancy’s participa- tion in a program of coastal resource enhancement. The pro- posed authorization would facilitate the study and possible enhancement of wetlands in Malibu Lagoon that have become degraded due, in part, to urban development. The proposed feasibility study may also lead to the enhancement of the natu- ral and scenic character of the area, and the ability of the wa- tershed to support tidewater gobies and other endangered spe- cies. The proposed project is therefore consistent with Section 31251, under which the Conservancy may award grants to nonprofit or- ganizations for projects that seek to remedy loss of natural and scenic values because of natural or human-induced events. Public Resources Code Section 31252 specifies that “[a]ll areas proposed for resource enhancement by a state agency, local public agency, or nonprofit organization shall be identified in a certified local coastal plan or program as requiring public ac- tion to resolve existing or potential resource protections prob- lems or shall be so identified in other local plans which the commission determines to be consistent with the policies and objectives of Division 20 (commencing with Section 3000).” The Coastal Commission certified a Local Coastal Program (LCP) for the City of Malibu on September 13, 2002. As dis- cussed in greater detail below in the section on “Consistency with the Local Coastal Program” the LCP contains two policies that directly apply to Malibu Lagoon, essentially directing that a lagoon management plan be developed for the lagoon in con- sultation with all applicable resource management agencies. This project would help carry out those policies, and is there- fore consistent with the LCP. Public Resources Code Section 31253 provides that the Conservancy “may provide up to the total cost of any coastal re- source enhancement projects. . . .” Consistent with this section, staff is recommending that the Conservancy authorize funds to continue the process of enhancing the resources of Malibu La- goon.

CONSISTENCY WITH CONSERVANCY'S PROJECT SELECTION CRITERIA & GUIDELINES: The proposed project is consistent with the Conservancy's Pro- ject Selection Criteria and Guidelines adopted January 24, 2001, in the following respects:
Required Criteria Promotion of the Conservancy’s statutory programs and purposes: As indicated above, the proposed project is consis- tent with Chapter 6 of Division 21 of the Public Resources Code (Sections 31251 et seq.), which provides for the Coastal Conservancy’s participation in coastal resource enhancement projects. Consistency with funding source: The proposed funding source is an appropriation to the Conservancy pursuant to Sec- tion 5096.650(b)(1) of the California Clean Water, Clean Air, Safe Neighborhood Parks and Coastal Protection Act of 2002 (Proposition 40) which allocates bond funds to the Conser- vancy for the purposes of Division 21, the Conservancy’s ena- bling legislation. Support from the Public: The proposed project has commu- nity and agency support, as demonstrated by the letters of sup- port that are attached to this staff recommendation as Exhibit 5. Additional letters will be hand-carried to the Conservancy’s meeting. Location: The proposed project is intended to determine the feasibility of restoring lagoon and wetland habitat resources of Malibu Lagoon that have been adversely impacted by devel- opment and human-induced changes within the lagoon and its watershed. Need: The financial support and participation of the Conser- vancy are critical for the success of this project. DPR’s re- sources for planning and designing habitat enhancements are inadequate to move this project forward in a timely manner. At the same time, potential matching funds have been identified for implementation of habitat improvements. The Conser- vancy’s contribution would bridge the gap and catalyze pro- gress towards a successful enhancement. Greater than Local Interest: Malibu Lagoon contains the tidewater goby, a species that has been designated as endan- gered under the federal Endangered Species Act. The project would help protect that recovering species. The proposed en-

hancement would provide additional habitat for two other en- dangered species, the least tern and the snowy plover. The la- goon itself is a state park that, because of its location, has not only statewide, but national significance.
Additional Criteria Resolution of More Than One Issue: The project will address habitat quality, water quality, and public recreation (current impacts on water-contact sports), as well as impacts to tidewa- ter goby, a federally-listed threatened species. Leverage: As identified in the Conservancy-funded Lower Malibu Creek and Lagoon Resource Enhancement and Man- agement report prepared for the Malibu Lagoon Task Force, the proposed project is an integral element of a multi-faceted program of restoring the wetland and riparian habitat resources of Malibu Creek, Lagoon and watershed. The project’s man- agement structure will play a central role in integrating other projects and studies affecting the lagoon that are currently underway. The work that will be accomplished under this project could be the key to releasing more than $2,100,000 of matching funds for implementation ($1,250,000 of County of Los Angeles Proposition “A” funds allocated to implementing a water level control project at the lagoon, and $825,000 of Proposition 13 funds being recommended as a construction grant to the Conservancy by State Water Resources Control Board (SWRCB) staff, a leverage factor of better than 14 to 1. Realization of Prior Conservancy Goals: The Coastal Con- servancy has been involved in resource protection, enhance- ment, and restoration projects within the Santa Monica Bay watershed for more than a decade, including projects focused on the remaining coastal wetlands within the Bay. As discussed in the Project Summary and Project History sections above, the project stems from the findings of the Lower Malibu Creek and Lagoon Resource Enhancement and Management study which the Malibu Lagoon Task Force conducted with Conservancy funding. The Lagoon study itself was a direct outgrowth of the SMBRP’s Bay Restoration Plan, which made developing an enhancement program for Malibu Creek a priority. The Con- servancy Board formally adopted the Bay Restoration Plan as the overall enhancement plan for the area in August 2001. Im- plementation of this project will contribute to the fulfillment of this Conservancy goal. Cooperation: The Santa Monica Bay Restoration Project, Malibu Creek Watershed Advisory Council, and Malibu La-

goon Task Force are all cooperative ventures involving a broad range of interested and affected stakeholders including private industry, citizens, environmental groups, and local, regional, state, and federal agencies. This project is a direct result of their efforts, and an important milestone reinforcing their con- tinued cooperation and success.
CONSISTENCY WITH THE COASTAL ACT: The proposed project would be consistent with the planning and management policies contained in Sections 30230, 30231, and 30233(a)(7) of the Public Resources Code. Section 30230 states “Marine resources shall be maintained, enhanced, and where feasible, restored. . . . Uses of the marine environment shall be carried out in a manner that will sustain the biological productivity of coastal waters and that will maintain healthy populations of all species of marine organisms adequate for long-term commercial, recreational, scientific, and educational purposes.” Section 30231 states “The biological productivity and the quality of coastal waters, streams, wetlands, estuaries, and lakes appropriate to maintain optimum populations of ma- rine organisms and for the protection of human health shall be maintained and, where feasible, restored. . . .” Section 30233(a)(7) states, “The diking filling, or dredging of open coastal waters, wetlands, estuaries, and lakes shall be permitted in accordance with other applicable provisions of this division, where there is no feasible less environmentally damaging al- ternative, and where feasible mitigation measures have been provided to minimize adverse environmental effects and shall be limited to the following: . . . (7) Restoration purposes. . . .” Consistent with these policies, this project would develop a plan specifically designed to restore the resources of Malibu Lagoon, sustain its biological productivity, and maintain opti- mum populations of marine organisms in the Lagoon and sur- rounding waters. Consistent with Section 30233, the project will identify the least environmentally damaging feasible alter- native and feasible mitigation measures to minimize adverse environmental effects. While at this time the project consists of planning only, its ultimate objective, restoration of the lagoon, is a specifically permitted use under Section 30233(a)(7). For these reasons, the project is consistent with the policies of the Coastal Act.
CONSISTENCY WITH LOCAL COASTAL PROGRAM POLICIES: Assembly Bill 988 added Section 30166.5 to the Coastal Act, requiring the Coastal Commission to certify a Local Coastal

Program (LCP) for the City of Malibu by September 15, 2002. The Commission certified the LCP on September 13, 2002 and adopted a map of the post-LCP certification jurisdiction as part of that action. The project is entirely within the area designated as permanent jurisdiction of the Coastal Commission. There- fore, the Coastal Act is the standard of review for permits and plans in this area and the Commission is the decision making body. Nevertheless, the LCP does contain specific policies for Malibu Lagoon. The Commission treats LCPs as guidance for its decision-making within its area of permanent jurisdiction. The LCP maps specifically identify Malibu Lagoon as an Envi- ronmentally Sensitive Habitat Area (ESHA) and a Marine Re- source. The Land Use Plan (LUP) also includes two specific policies for lagoon Protection. Policy 3.92 states that “[l]agoon breaching or water level modification shall not be permitted until and unless a management plan for the lagoon in question is approved by the City and certified by the Coastal Commis- sion as an amendment to the LCP, unless it can be demon- strated that there is a health or safety emergency, there is no feasible less environmentally damaging alternative, and all fea- sible mitigation measures will be implemented to minimize ad- verse environmental effects. Policy 3.93 states that a “lagoon management plan should be developed for Malibu Lagoon, in consultation with all applicable resource management agen- cies.” The project is the first phase of developing precisely such a plan in precisely such a manner. The project does not include lagoon breaching or water level modification at this time, but it will provide a substantial amount of the data needed for such a lagoon management plan, including the fol- lowing six of the ten study topics specifically identified by LUP Policy 3.93: Biological study of the lagoon habitat, including identifica- tion of all rare, threatened, and endangered species. Lagoon hydrology. Water quality sampling study. Measures to protect endangered species. Water quality protection and enhancement measures. Monitoring plan to monitor the management area to evalu- ate the health of the wetland, assess adverse impacts result- ing from breaching or water level management, and identify project corrections.

This project provides for baseline planning and analysis, and the development of a coordination structure among the agen- cies and organizations carrying out projects affecting Malibu Lagoon. This initial work will define further studies required to develop a comprehensive and effective plan for restoring Malibu Lagoon, including developing a work plan that in- cludes studies of water level management. Staff expects to re- turn to the Board for authorization of such an expanded work plan within a year. This project provides for the necessary pre- cursor work that will lead to addressing all the studies specified by LUP Policy 3.93, and is therefore consistent with that pol- icy. Consistency with the LCP is also assured through the stake- holder/TAC process. Commission and City of Malibu staff were members of the MLTF, which directed the Lower Malibu Creek and Lagoon Resource Enhancement and Management study, and based upon that study, made recommendations that led to this project. Commission and City staff will again be asked to join the stakeholder/TAC Committee for this project. Further, under the provisions of LUP Policy 3.92, a lagoon management plan would require an LCP amendment, and any implementation of the plan in the future would require a coastal development permit. Both of these actions must be re- viewed and approved by the City and Commission for consis- tency with the Coastal Act. This process additionally assures Coastal Act conformity.
COMPLIANCE WITH CEQA: The proposed project is statutorily exempt from the provisions of the California Environmental Quality Act (CEQA) under 14 Cal. Code of Regulations Section 15262 in that it involves only project feasibility analyses and studies for possible future ac- tions. Additionally, the proposed project is categorically ex- empt from CEQA under Section 15306 as it involves the col- lection of data and resource evaluation activities which do not result in a serious or major disturbance to an environmental re- source. Staff will file a Notice of Exemption upon approval of the project.

PROJECT LOCATION: Malibu Lagoon is a 31-acre shallow water embayment located within Malibu Lagoon State Beach at the terminus of the Malibu Creek Watershed, the second largest watershed draining into Santa Monica Bay. Malibu Lagoon empties into the Pacific Ocean at Malibu Surfrider Beach and is generally located south of the intersection of Pacific Coast Highway and Cross Creek Road in the City of Malibu, within Los Angeles County.
PROJECT DESCRIPTION: The Malibu Lagoon Restoration and Enhancement Plan (Plan) presents a comprehensive and adaptive management approach to restore and enhance the ecological structure and function of Malibu Lagoon, improve lagoon and coastal water quality, and enhance visitors’ experience through improvements to access and interpretive displays. The Plan includes a water management component, a habitat and access plan, and a comprehensive long-term monitoring plan to ensure restoration goals are being achieved. The Plan was selected out of a range of alternatives for its ability to achieve restoration goals while minimizing short-term impacts to the existing system. The restoration goals for the lagoon consist of: increased tidal flushing; improved water circulation; improved coastal water quality; increased holding capacity; reduced predator encroachment; restoration of typical salt marsh hydrology; increased wildlife habitat; creation of a nesting island for least terns and western snowy plovers; creation of channel connections to the lagoon; and integration of public access with habitat protection. Major physical components of the Plan consist of: a relocated parking lot and staging area; implementation of Best Management Practices to minimize impacts of storm water runoff; slope improvements to the western edge of the lagoon; improvements to the existing boat house channel; and the creation of a new channel along the southern edge of the west lagoon.
This is to advise that the California Department of Parks and Recreation has approved the above project and has made the following determinations regarding the above described project: 1. The project will not have a significant effect on the environment. The project will have a significant effect on the environment. 2. An Environmental Impact Report was prepared for this project pursuant to the provisions of CEQA. A Negative Declaration was prepared for this project, pursuant to the provisions of CEQA. 3. Chapter 1 Introduction
Purpose of the EIR
The purpose of this Environmental Impact Report (EIR) is to inform agency decision makers and the public about the anticipated significant environmental effects of the proposed project, potential measures to mitigate these significant effects, and reasonable alternatives that could reduce the significant environmental impacts of the proposed project to less-than-significant levels.
This chapter describes the proposed project, the Malibu Lagoon Restoration and Enhancement Plan (plan or project). Provided below is an overview of the proposed plan, plan background, the California Environmental Quality Act (CEQA), and the scope and framework of the EIR. The Proposed Plan
The California Department of Parks and Recreation (DPR), the Resource Conservation District of the Santa Monica Mountains (RCDSMM), and California State Coastal Conservancy (Coastal Conservancy), with input from the Lagoon Restoration Working Group (LRWG) and the Lagoon Technical Advisory Committee (LTAC), are proposing a restoration and enhancement plan for the Malibu Lagoon (lagoon) at Malibu Lagoon State Beach in the City of Malibu (City). The intent of the proposed plan is to restore and enhance the natural structure and function of the lagoon ecosystem, including water quality, circulation, habitat, and biodiversity, and to enhance public access and education opportunities.
The proposed plan proposes to decrease polluted runoff and increase circulation within the lagoon, thereby improving the quality of water and minimizing the effects of eutrophication. To enhance lagoon habitat, the plan would change the lagoon configuration and improve slopes and drainages, replant native species, and remove non-native species. The plan proposes to relocate and renovate the parking lot, enhance public access, and erect educational displays to better the visitors’ experience. An ongoing monitoring plan will be implemented to evaluate, record, and analyze existing and changing ecological conditions of the lagoon using physical, chemical, and biological parameters. allow DPR, the RCDSMM, the Coastal Conservancy, the LTAC, and other agencies and stakeholders to assess the progress toward restoration goals, and to adaptively manage lagoon function and health. Background
The 31-acre lagoon is located at the mouth of the Malibu Creek Watershed at Surfrider Beach along the northern shore of Santa Monica Bay within Malibu Lagoon State Beach. Its ecological significance as one of the last remaining coastal wetlands within Santa Monica Bay adds to the interest in developing a restoration and enhancement plan to improve the lagoon’s conditions. The lagoon represents an important coastal wetland resource hosting both avian and aquatic species of important statewide and regional ecological significance.
The lagoon has experienced major changes in recent history due to nearby development and other human activities. Currently a fraction of its historical size, the lagoon is experiencing degraded conditions due to inflow of nutrient and pollutant rich water from urban runoff and storm drainage, urban encroachment, limited circulation, effluent from wastewater treatment, and invasion by non-native plant species.
Since 1929, when Caltrans used the site as a dump during the construction of the Pacific Coast Highway (PCH), continual urban development surrounding the Malibu Lagoon has reduced its size and degraded the quality of its water and habitats.1 The construction of Rindge Railroad line, Pacific Coast Highway Bridge, commercial and residential development, parking lots, and a baseball field decreased the area of the lagoon. Urban runoff, increased sedimentation, increased freshwater flows, and invasion of non-native species have degraded the conditions of the lagoon as well.
A previous effort to restore the lagoon was initiated by the DPR in 1983. The 1983 restoration included the creation and revegetation of three channels with native salt marsh plants and the construction of boardwalks to allow public access. Another restoration effort occurred in 1996 when the California Department of Transportation adopted a restoration plan to mitigate the Malibu Lagoon/PCH bridge replacement. The plan included a goby habitat enhancement plan, revegetation of native species (to restore impacts from the bridge construction), and removal of non-native species.
By the 1980s, the ecological functioning and health of the lagoon had declined. Since the late 1980s, an ongoing community effort has been organized to assess lagoon health and develop restoration plans. In the late 1990s, the Coastal Conservancy funded a study by UCLA, which identified restoration goals for the Malibu Lagoon Task Force. This led

to the preparation of the Malibu Lagoon Restoration Feasibility Study and Final Alternatives Analysis, prepared under a grant from the Coastal Conservancy. After a year of facilitated discussion and consideration among the LRWG, the LTAC, DPR, and the Coastal Conservancy, the resulting recommendation was Alternative 1.5, the Modified Restore and Enhance Alternative for the restoration design, which embodied the restoration goals with the least amount of impacts to the existing lagoon ecosystem (refer to Figure 3-3 in Chapter 3).
The Plan proposed by DPR, RCDSMM, the Coastal Conservancy, and along with the LRWG and the LTAC, seeks to design and implement a restoration and enhancement program, including long-term monitoring and adaptive management for the lagoon. Overview of CEQA
CEQA requires that all state and local government agencies consider the environmental consequences of projects over which they have discretionary authority before taking action on them. The purpose of this focused EIR is to inform agencies and the public of significant environmental effects associated with the proposed project, describe and evaluate reasonable alternatives to the project, and propose mitigation measures that would avoid or reduce the project’s significant effects.
In accordance with Section 15121(a) of the State CEQA Guidelines (California Administrative Code, Title 14, Division 6, Chapter 3), the purpose of an EIR is to serve as an informational document that will
inform public agency decision makers and the public generally of the significant environmental effect of a project, identify possible ways to minimize the significant effects, and describe reasonable alternatives to the project.
This EIR evaluates the direct, indirect, and cumulative impacts of the proposed project and alternatives in accordance with the provisions set forth in CEQA and the State CEQA Guidelines. It will be used to address potentially significant environmental issues and recommend adequate and feasible mitigation measures, where possible, that could reduce or eliminate potentially significant environmental impacts. Per CEQA, DPR is the Lead Agency in association with the Coastal Conservancy and RCDSMM. This EIR reflects the independent judgment of DPR and is intended to comply with CEQA and the State CEQA Guidelines (see Public Resources Code, §21100; State CEQA Guidelines, §§15120-15132).
