  • Jewish Law in the Beit Midrash of Hasidism
Jewish Law in the Beit Midrash of Hasidism Levi Cooper* Hasidism – the movement, its leaders and adherents, its ethos and religious message – is often cast in shades of antinomianism or anomianism, suggesting that hasidic masters and their faithful disciples either flouted Jewish law or ignored it. According to this line, the hasidic attitude towards halakhah was not improvised, temporary, or provisional; rather, the disdainful attitude was ideological and systemic. In the following, I argue for a recalibration of this dominant narrative. My argument is rooted in the reality that – contrary to the widespread assumption – hasidic masters from the earliest days of the nascent movement were embedded in the world of halakhah and active in the legal realm. This aspect of Hasidism has yet to be fully explored. In order to banish the existing myth, I will first provide an account of the prevalent depiction: Where does it come from and how widespread is it? Unpacking this popular * This study has been awarded the 2020 prize for best legal history article by the Israeli History and Law Association. The study was conducted while I had the privilege of being an Academic Visitor at the Faculty of Law, University of Oxford. I am grateful for this opportunity, for the gracious assistance afforded me in the Bodleian Libraries during my visit, and to my host Professor Joshua Getzler. I had the opportunity to present portions of this research in various forums and am grateful for the feedback I received: Faculty of Law, Bar-Ilan University; Department of Jewish Thought, Ben-Gurion University of the Negev; The Research Project on Galician & Bukowinian Jewry; Faculty of Law, The Hebrew University of Jerusalem; Buchmann Faculty of Law, Tel Aviv University.

This is particularly true of the period of the Achronim. I would like to apologize to the reader for any omissions of any Rabbanim or any seforim or any other details about any specific Rabbanim, which might be perceived in some way as disrespectful. Such omissions are exclusively due to the currently incomplete status of this project. In particular, G-d forbid any error or omission should be perceived as a judgement value on my part on who should and should not be included. The objective is to be as comprehensive as possible in the spirit of “/vbnn kyck ihruj ic v,t tku /rundk vftknv lhkg tk” (It is not your duty to complete the task but you are not free from trying, Avot 2:16). Please note that the Index of Rabbanim, the Index of Acronyms and other Appellations of Rabbanim, and the Index of Names of Seforim are supposed to match exactly the basic information in the Biographical Notes and will be updated simultaneously with the Notes. • Jewish Divorce Refusal in New York and Toronto
A Socio-Legal Investigation of 'Get' Jewish Divorce Refusal in New York and Toronto: Agunot Unstitching the Ties that Bind Yael C.B. Machtinger A DISSERTATION SUBMITTED TO THE FACULTY OF GRADUATE STUDIES IN PARTIAL FULFILLMENT OF THE REQUIREMENTS FOR THE DEGREE OF DOCTOR OF PHILOSOPHY GRADUATE PROGRAM IN SOCIO-LEGAL STUDIES YORK UNIVERSITY TORONTO, ONTARIO July 2017 © Yael C.B. Machtinger, 2017 Abstract This dissertation, focusing on religion, law, and socio-legal storytelling, is a comprehensive, qualitative study of Jewish divorce (get) refusal and the first comparative study between Toronto and New York, cities with the largest and most diverse Jewish populations in their respective countries. Since the 1980s and early 1990s, there have been slow socio-legal developments around get refusal in New York and Canada as well as heightened awareness and advocacy in New York, coupled with denial of the persistence of the phenomenon in Toronto. Sally Falk Moore noted of a different legal pluralist context, “Innovative legislation and other attempts to direct change often fail to achieve their intended purposes…new laws are thrust upon going social arrangements in which there are complexes of binding obligations...” (Moore, 744). Despite the increased visibility of get refusal in the media, much of the work being done, both social and legal, continues to perpetuate a gap between legal and social realities within Jewish communities as well as silences, particularly in Toronto. At least in part, this is due to unforeseen forces, specifically the power of normative cultural practices. Drawing on interviews inspired by oral history and ethnography, and archival sources to get a ‘thick description’, this dissertation contributes to women’s historiography of marriage and examines the overlapping legal norms of Jewish and civil laws, making some key contributions.

Jewish history may be lying around in your basement. Don't let it be lost to the world. he Orthodox Jewish Archives, which was struck by a damaging fire last year, has completed renovation of its physical facilities, and has embarked on a worldwide search Tto rebuild and expand its holdings. The destruction of archival material in the blaze was, fortunately, not as extensive as originally thought. TO ORDER: CALL 718.259.1223 New at TU Publications! TO ORDER: CALL 718.259.1223 Foreword Each time we produce an updated Publications catalogue, we do so with much joy as well as a sense of angst because of the fact that there are constant updates, especially regarding new materials that have either been created by Publications or newly adopted by us for distribution. That fact renders the catalogue marginally obsolete not long after it has been re- leased. At the same time, this is precisely our goal: to relentlessly update materials and to provide the over 10,000 classrooms serviced by Torah Umesorah with the latest in learning mate- rials. The period since the last catalogue was printed has been historic. It saw the relocation of the main offices of Torah Umesorah from Coney Island Avenue to our own beautiful home on Foster Avenue (corner of Ocean Parkway) in Brook- lyn. It has also witnessed the addition of a number of new di- visions and projects to serve the chinuch community. Additionally it has been a time for rethinking some of the objectives of the Publications Department to service schools more efficiently. Dozens of new products have come on board to enable the opening of additional vistas for mechanchim and mechanchos. I would like to express my gratitude to my illustrious col- leagues in Torah Umesorah – with particular thanks to Rabbi Dovid Nojowitz, TU’s Menahel, and Rabbi Zvi Bloom, the or- ganization’s executive director, as well as to the entire staff of the Publications Department: this catalogue is the result of our collective efforts.
