M-19-489 CITY HALL: DECEMBER 5, 2019 BY: COUNCILMEMBER GIARRUSSO SECONDED BY: COUNCILMEMBER BANKS BE IT MOVED BY THE CITY COUNCIL OF THE CITY OF NEW ORLEANS, That the City Planning Commission is hereby directed to conduct a public hearing to consider amendments to Ordinance No. 4,264 M.C.S., amended by Ordinance No. 26,413 M.C.S., as amended, the Comprehensive Zoning Ordinance of the City of New Orleans, to amend Section 21.6.N Fences and Walls to include height requirements for fences in Lake Terrace (bounded by Lake Ponchartrain, the London Avenue Outfall Canal, Robert E. Lee Boulevard, and Bayou St. John) as follows: (i) Front Yard: One and One-Half (1.5) feet; (ii) Side Yard and Rear Yard: Five (5) feet. SUBSTITUTE NO. R-19-490 CITY HALL: DECEMBER 5, 2019 BY: COUNCILMEMBER MORENO (BY REQUEST) SECONDED BY: COUNCILMEMBER BANKS WHEREAS, the Louisiana Watershed Initiative was formed in order to coordinate statewide floodplain management efforts through a watershed management approach in response to the 2016 Great Floods and in preparation for future storm and flood events. This coordination includes outreach with local communities to build support for watershed region management approaches that can more effectively address mounting water risks statewide; and WHEREAS, coordination among Orleans Parish and its regional partners within Watershed Region No. 8 is critical to reducing flood risk and preserving the health, safety, and welfare of the residents of Orleans Parish; and WHEREAS, the Louisiana Watershed Initiative has requested applications for participation in a Regional Capacity Building Grant Program, which may enable the provision of technical assistance to Orleans Parish and its regional partners if awarded, thereby furthering immediate watershed management and flood risk reduction goals; NOW THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE CITY OF NEW ORLEANS, That the Council hereby grants the Regional Planning Commission permission to submit a Regional Capacity Building Grant Program application on behalf of Orleans Parish and the other parishes in Watershed Region No. 8, and to serve as the coordinating entity and financial officer for Region No. 8 in conjunction with the State of Louisiana Watershed Initiative. NO. R-19-497 CITY HALL: DECEMBER 5, 2019 BY: COUNCILMEMBERS MORENO, WILLIAMS, BANKS, GISLESON PALMER, BROSSETT AND NGUYEN A RESOLUTION expressing support for the Louisiana State Legislature to introduce and pass legislation to allow local governments to grant tax exemptions on feminine hygiene products and diapers. WHEREAS, the City of New Orleans is committed to protecting the ability of local governments to make decisions about local-level taxation on products, especially those that should be exempt from sales tax by placing them in the category of necessity; and WHEREAS, members of the New Orleans legislative delegation have announced their intention to champion legislation that would end local taxes on feminine hygiene products and diapers; this legislation is similar to a bill championed by State Senator JP Morrell during the 2019 legislative session which advanced through the Senate but ultimately failed to become law; and WHEREAS, if passed at the state level, the New Orleans City Council intends to move forward with an ordinance to create a local tax exemption for these items in Orleans Parish; and WHEREAS, access to menstrual products is a matter of dignity and equity and we must have laws in place that acknowledge menstruation is a natural biological process that affects half of all humans during their lifetime; feminine products should be affordable and accessible to all and the imposition of state sales taxes can further impede access by adding to the cost of these products; and WHEREAS, a number of countries around the world have already stopped taxing menstrual products because of the unfair financial burden it puts on women including Ireland, Colombia, India, Kenya, Canada, and Australia; and WHEREAS, in the United States, women end up spending an estimated $150 million plus a year on the sales tax for these items according to Period Equity, the nation’s first law and policy nonprofit organization fighting for menstrual equity; and WHEREAS, currently, 33 states still apply state sales taxes on feminine products including Louisiana; and WHEREAS, Louisiana already exempts items it deems necessities - groceries, utilities, and prescription drugs - from state sales taxes; as such, taxing feminine products and diapers imposes a lopsided cost on women and families; and WHEREAS, taxing feminine products is a discriminatory economic burden; many in the United States and right here in Louisiana are forced to make the terrible choice between buying food or feminine products or diapers for their children; and WHEREAS, those individuals who are unable to afford feminine products are at risk of stigmatization, infection, and even missed days of school and work; and WHEREAS, according to the National Center for Children in Poverty at the Columbia University Mailman School of Public Health, for nearly one in five American teenagers who live in poverty, the lack of menstrual products can lead to lost educational opportunity; and WHEREAS, individuals experiencing housing instability can be further at risk due to issues surrounding access to menstrual products due to affordability or availability at all shelters; this can increase likelihood of infection caused by using feminine products for longer than recommended; NOW THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE CITY OF NEW ORLEANS, That the Louisiana State Legislature should introduce and pass legislation to allow local governments to grant tax exemptions on feminine hygiene products and diapers. The Interim Zoning District is to be in effect for a period of one (1) year and is subject to extension as provided by Section 3-126 of the City Charter. Applications to appeal this IZD shall be submitted to the Executive Director of the Vieux Carré Commission, whose staff shall review and make recommendations relative to the appeal within sixty (60) days of receipt of a complete application, utilizing the following review standards: 1. Is the requested appeal compatible with the surrounding structures in terms of height, mass, and lot coverage? 2. Would the requested appeal adversely affect the existing development patterns on the subject blockface(s)? 3. Do special conditions and circumstances exist that are peculiar to the land or structure involved and are not generally applicable to other lands or structures in the same district? The special conditions do not result from the actions of the applicant or any other person who may have had an interest in the property. Every appeal shall be made on the forms provided by the City, and shall be accompanied by the payment of the appropriate filing fee, and the data required in such form. The Executive Director of the Vieux Carré Commission may request from the appellant or applicant such additional information and data as may be required to fully advise the Council, whether such information and data is called for by the official forms or not. R-19-501 CITY HALL: DECEMBER 5, 2019 BY: COUNCILMEMBER NGUYEN SECONDED BY: COUNCILMEMBER BROSSETT WHEREAS, the New Orleans City Council initially established a Food Policy Advisory Committee via Resolution No. R-07-203, to improve the health and wellbeing of residents through recommending policies and services to increase availability of healthy food options; and WHEREAS, Tulane University’s Prevention Research Center at the School of Public Health and Tropical Medicine supports the Food Policy Advisory Committee and works with committee to secure funding for the committee and its work; and WHEREAS, since the panel’s initial inception, research continues to indicate that New Orleans communities with the least access to affordable, healthy foods suffer the highest rates of health- related issues stemming from poor nutrition; and WHEREAS, the highest incidences of diet-related diseases disproportionately affect lower- income neighborhoods; and WHEREAS, poor nutrition, particularly among children, can lead to a host of physical, behavioral, and developmental risks that can affect their long-term health, cognitive ability, mental development, academic performance, and in turn, their future; and WHEREAS, proper nutrition has proven to be an effective strategy in building healthy families and assuring greater success in education and employment; and WHEREAS, there is a critical need to increase access to nutritional foods for low-income children and families; and WHEREAS, every dollar spent locally on food, returns two to four times as much money into the local economy; and WHEREAS, food and farming are important sectors of the New Orleans economy, which creates community jobs, opportunity, and increased personal wealth; NOW THEREFORE BE IT RESOLVED, That the Council of the City of New Orleans, hereby re-establishes the Food Policy Advisory Committee for one year from date of adoption, representing diverse interests and including representatives from agriculture, public health, retail, and food distribution/food access, as determined by New Orleans Food Policy Advisory Committee Steering Committee to provide recommendations and advise to the City Council on healthy food and farming initiatives that will address the lack of access to healthy food within New Orleans. The relationship between Council and Committee shall be reassessed and reviewed annually to determine productivity and value of the groups. The applicant shall include a note on amended site plans stating that all temporary inmate housing, including the 400 bed modular units known as the Temporary Detention Center (“TDC”), will be removed and/or closed upon the opening of a permanent facility and/or unit for the housing of male and female inmates classified with acute and sub-acute mental health conditions. latter of 1) the completion of the contemplated Phase III facility containing, among other common spaces, an eighty-nine (89) bed facility for male and female inmates classified with acute and sub-acute mental health conditions, and 2) a reduction in the current inmate population housed in Phase II of the Orleans Justice Center (“OJC”) to a level that allows segregated housing wings for (a) work-release inmates; and (b) inmates actively serving as trustees on the kitchen staff. a. The applicant shall ensure that at no time shall the aggregate inmate population of the Orleans Justice Center complex, including without limitation, those held in Phase II, Phase III and in the TDC, and in the permanent facility or unit for the housing of male and female inmates classified with acute and sub-acute mental health conditions exceed 1,4381,250 inmates and 1,731 beds, and that all inmates (male, female, and juvenile) except those classified with acute and sub-acute mental health conditions, those participating in the work-release program and those actively working on the kitchen staff, shall be detained in Phase II of the OJC, which shall continue to provide a variety of programming aimed at reducing recidivism including but not limited to medical care, educational services, including GED preparation, vocational and job training. b. The applicant shall demolish or decommission and not detain any inmates in any of the following existing Orleans Parish Prison facilities, unless other appropriate action is taken by the Mayor and/or City Council that is consistent with their authority: i. House of Detention; ii. the Community Correctional Center; iii. Conchetta; iv. Broad Street; v. South White Street; vi. Templeman V; and vii. the original Temporary Housing Units (Tents). The original Orleans Parish Prison connected to the Criminal Courts building (OPP) shall only be used as a daily holding facility to transfer inmates to and from court while awaiting a trial or hearing. c. Building 1 and Building 2 of the 400-bed modular Temporary Detention Center (“TDC”) shall be renovated in accordance with the submitted plans to temporarily accommodate male and female inmates classified with acute and sub-acute mental conditions. Building 1 and Building 2 shall be permitted to continue to accommodate these inmates until the opening of a permanent facility and/or unit for the housing of male and female inmates classified with acute and sub- acute mental health conditions. such time that the Phase III Facility currently being contemplated by the City of New Orleans receives a certificate of occupancy from the Department of Safety and Permits. Once the inmates housed in Building 1 and 2 of the TDC have been transferred to the permanent facility and/or unit for the housing of male and female inmates classified with acute and sub-acute mental health conditions Phase III Facility, Applicant shall demolish or decommission Buildings 1 and 2 of the TDC and they shall not be used to house any inmates within the OJC. d. Applicant shall be permitted to use Building 3 and Building 4 of the Temporary Detention Center (“TDC”) to house only two (2) distinct classes of inmates, namely: i. those inmates participating in any work-release program, where they are released from the OJC secured complex into the general public during the day and return to the OJC Complex overnight; and ii. those inmates that are serving as trustees in the Orleans Justice Center kitchen where they have access to items which may be used as weapons. At no time shall the total number of inmates housed in Building 3 and Building 4 exceed one hundred and fifty (150) (a maximum of one hundred twenty (120) for work release and a maximum of thirty (30) for kitchen detail), and at all times the total aggregate number of inmates housed in Buildings 3 and 4 shall count toward the 1,4381,250 maximum inmate population count established in subsection (a) hereof.” BE IT FURTHER MOVED, that a copy of the report of the City Planning Commission and of this motion be forwarded to the City Attorney’s Office for the preparation of an ordinance to effectuate the request.
