The Enforcement Bureau (Bureau) of the Federal Communications Commission (Commission) and CenturyLink, Inc. have entered into a Consent Decree to resolve the Bureau’s investigation into whether CenturyLink violated section 20 1(b) of the Communications Act of 1934, as amended (Communications Act), by placing unauthorized third-party charges on customers’ wireline telephone bills. As part of its investigation, the Bureau received customer complaints about CenturyLink’s third-party billing practices. The complaints alleged that customers had been assessed unauthorized charges on their CenturyLink bills for long distance services from various third-party resellers. Customers also claimed that they had difficulty getting timely refunds for these charges. To resolve this investigation, CenturyLink has agreed to pay a $550,000 settlement amount to the United States Treasury. Additionally, CenturyLink has agreed to discontinue these types of third-party billing arrangements, with limited exceptions, and to implement a process for providing refunds or credits to customers with valid complaints about unauthorized charges. 2. After reviewing the terms of the Consent Decree and evaluating the facts before us, we find that the public interest would be served by adopting the Consent Decree and terminating the referenced investigation regarding CenturyLink’ s compliance with section 201(b) of the Communications Act. 3. In the absence of material new evidence relating to this matter, we conclude that our investigation raises no substantial or material questions of fact as to whether CenturyLink possesses the basic qualifications, including those related to character, to hold or obtain any Commission licenses or authorization.

(Qwest) and CenturyTel, Inc. d/b/a CenturyLink (CenturyLink) (together, Applicants) filed a series of applications pursuant to sections 214 and 310(d) of the Communications Act of 1934, as amended, 47 U.S.C. §§ 214, 310(d), and Section 2 of the Cable Landing License Act, 47 U.S.C. § 35,1 seeking Commission approval for various transfers of control of licenses and authorizations held by Qwest and its subsidiaries from Qwest to CenturyLink. Qwest, a publicly traded Delaware corporation, is a full-service communications provider offering an array of telecommunications and broadband Internet services, including fiber-optic Internet service, digital switched telephone service, private-line dedicated high-speed data connections, switched data networking services, long-distance services, and voice over Internet Protocol (VoIP) services, through its wholly owned operating companies.2 It currently has approximately 10.3 million access lines in 14 states,3 and approximately 3 million broadband customers. And the rollout could come as early as this year. Post said the company expanded the service, called Prism TV, in the first quarter to three new markets: Tallahassee and Orlando, Fla., and Raleigh, N.C. Prism TV, which offers video content over a dedicated Internet network, is available in eight Legacy Centurylink!Embarq markets. Centurylink purchased Embarq in 2009 and completed its acquisition of Denver-based Qwest on April1. Post said the company will continue to expand Prism TV in 2011, ultimately reaching 1 million homes with the service by year's end. However, in response to a question from an analyst, Post said the company does not expect "any additional rollouts in the Centurylink markets" this year. "We'll be evaluating the Qwest markets in the coming months," Post said. "We do think there could be some opportunity there . .. We'll be making those decisions around midyear as far as any additional rollouts of IPTV in any of those markets."
