Guidance note on the appropriate ballot annex for grammar schools converting to status

June 2015 Introduction: Removing selection

In converting to academy status any of the 164 designated grammar schools must remain subject to the same provisions for removing selection as they were subject to as a maintained school:

• parents must be able to ballot for the removal of selection; and • the school itself must be able to remove selection.

The annexes on this site enable this to occur.

As with maintained grammar schools, wholly selective remain subject to an AREA, STAND-ALONE or GROUPED ballot on the same terms as set out in schedules 1 to 3 of the Education ( Ballots) Regulations 1998 (as amended).

The following sections set out which annex is appropriate for which school.

Only schools designated under those regulations and as set out in this guide will have these annexes as part of their funding agreements.

Preparing the funding agreement

When adding the annex to a funding agreement, lawyers/schools will need to follow the following process.

On the contents page of the funding agreement or SFA, under the ‘annex’ heading add:

‘Process for Removing Selection’

Number it ‘9’ if it is added to the SFA and ‘11’ if it is added to the single- funding agreement.

At the end of the single funding agreement or SFA, add the annex.

Schools designated as grammar schools which must adopt one of the ballot annexes on conversion to academy status.
