EMPLOYMENT AND SOCIAL POLICY

– Guidelines for employment 2005-2008

TheCouncilagreedonageneralapproachtotheproposalforaDecisiononGuidelinesforthe EmploymentPoliciesoftheMemberStates(20052008).

Thegeneralapproachcoveredthefollowingguidelines:

• Implementemploymentpoliciesaimingatachievingfullemployment,improvingqualityand productivityatwork,andstrengtheningsocialandterritorialcohesion;

• Promotealifecycleapproachtowork;

• Ensureinclusivelabourmarket,enhanceworkattractiveness,andmakeworkpayfor jobseekers,includingdisadvantagedpeople,andtheinactive;

• Improvematchingoflabourmarketneeds;

• Promoteflexibilitycombinedwithemploymentsecurityandreducelabourmarketsegmentation, havingdueregardtotheroleofthesocialpartners;

• Ensureemploymentfriendlylabourcostdevelopmentsandwagesettingmechanisms;

• Expandandimproveinvestmentinhumancapital;

• Adapteducationandtrainingsystemsinresponsetonewcompetencerequirements.

TheseguidelinesshouldguideMemberStates'employmentpoliciesinaddressingthefollowing threepriorities:

– Theneedtoattractandretainmorepeopleinemployment,increaselaboursupplyandmodernise socialprotectionsystems;

– Theneedtoimprovetheadaptabilityofworkersandenterprises;

– Theneedtoincreaseinvestmentinhumancapitalthroughbettereducationandskills

Followingtheguidelinesissuedbythe2005SpringEuropeanCouncil,theproposalforaDecision onemploymentguidelinesisoneoftheelementsoftheproposalforIntegratedGuidelinesfor GrowthandJobs.TheoutcomeoftheCouncil'sproceedingswillbesubmittedtotheJuneEuropean Councilforapproval.TheIntegratedGuidelinesforGrowthandJobswillserveasthebasisforthe nationalreformprogrammestobesubmittedbyMemberStatesbyAutumn2005.

TheEmploymentCommitteeandtheSocialProtectionCommitteedeliveredtheirJointOpinionon 13May2005 (8986/05). TheEuropeanParliamentdelivereditsopinionon26May2005andthe EconomicandSocialCommitteegaveitsopinionon31May2005.TheCommitteeoftheRegions hasnotyetdelivereditsopinion.

Proposedlegalbasis:Article128(2)oftheTreatyobligationtoconsulttheEuropeanParliament, theEconomicandSocialCommittee,theCommitteeoftheRegionsandtheEmployment Committee.

– Railway workers - agreement by social partners

TheCouncilreachedpoliticalagreementonadraftDirectiveintendedtogiveeffecttoan agreementconcludedinJanuary2004bythesocialpartners(CommunityofEuropeanRailwaysand theEuropeanTransportWorkers'Federation)oncertainaspectsoftheworkingconditionsof mobileworkersassignedtocrossborderservicesintherailwaysector 1.

TheDirectivewillbeformallyadoptedataforthcomingCouncilmeeting.Austria,Slovakiaandthe UnitedKingdomstatedthattheyintendedtoabstainattheformaladoptionoftheact.

Inviewofconcernsexpressedbydelegationsregardingtheimpactofcertainaspectsofthis Directive,particularlyinthecontextoftheliberalisationoftherailwaysector,theCommission agreedtoreporttotheCouncil,beforethedatelaiddownforthetranspositionoftheDirective 2,on theeconomicandsocialimpactofthisagreementandtotakethenecessarymeasuresintheeventof anewagreementbetweenthesocialpartners.

TheAgreementcovers,inparticular,dailyandweeklyrest,breaks,drivingtime,recordsofworking hoursandprovisionsforfutureevaluationandfollowup.Itshouldbestatedthatinmattersofsocial policy,Article139(1)oftheTreatygivesthesocialpartnersatCommunitylevelthepossibilityof enteringintoadialoguewhichmayleadtocontractualrelations,includingagreementswhichcanbe implemented,atthejointrequestofthesignatoryparties,byaCouncilDecisiononaproposalfrom theCommission.On8February2005theCommissionpresentedaproposalforaDecision (6364/05),attachingtheagreementconcludedbythesocialpartners.

TheCouncilreachedpoliticalagreement 1oneachofthedraftRegulationsamendingthe Regulationsestablishing:

– aEuropeanAgencyforSafetyandHealthatWork 2( 9121/05 );

– aEuropeanFoundationfortheImprovementofLivingandWorkingConditions 3( 9119/05 ).

ThedraftRegulationsareessentiallyaimedatmakingtheoperationoftheseagenciesmore efficient,particularlyinthecontextofEUenlargement.

TheEuropeanParliamentdelivereditsopinionon28April2005.

TheRegulationswillbeformallyadoptedataforthcomingmeetingoftheCouncil.

European Agency for Safety and Health at Work (Bilbao)

MostamendmentsproposedbytheEuropeanParliamentwerewelcomedbytheCouncilandare includedinthetext.

TheAgency'smaintasksare:

• tocollectanddisseminateinformationintheMemberStatesinordertopassitontothe Communitybodies,MemberStatesandinterestedparties;

• topromoteandsupportcooperationandexchangeofinformationandexperience;

• tosupplytheCommissioninparticularwiththeinformationitneedstoprepareandevaluate legislationandmeasuresintheareaofsafetyandhealthatwork.

Incarryingoutitsactivities,theBilbaoAgencydevotesparticularattentiontosmalland mediumsizedenterprises.

TheAgency'smaincharacteristicisitsinformationnetworkofnationalfocalpoints.Throughthat networktheAgencycooperatescloselywiththecompetentnationalauthoritiesinMemberStates andtheresearchcentresdesignatedtocoordinateandtransmittheinformationforandfromthe Agency.

TheAgencyhasatripartiteAdministrativeBoardmadeupofrepresentativesofgovernments, employers'organisationsandemployees'organisations.TheCommissionisalsorepresentedonthe AdministrativeBoard.

TheaimofthislegislativeproposalistostrengthenthestrategicroleoftheAdministrativeBoard, whileassigningmoreadministrativetaskstotheexistingBureauandrecognisingitsroleofficially.

TheCommissionproposalaimedatamendingtheinitialRegulationtoenabledecisionstobetaken byanabsolutemajoritywithintheAdministrativeBoardwasadoptedbytheCouncilwiththe followingexceptions:decisionsinthecontextoftheannualworkprogrammeandthosewith budgetaryrepercussionsforthenationalfocalpointsalsorequiretheconsentofthemajorityof membersofthegovernmentsrepresentatives'group.

European Foundation for the Improvement of Living and Working Conditions (Dublin)

ThetasksoftheFoundationaretodevelopandtopursueideasontheimprovementoflivingand workingconditionsinthemediumandlongterminthelightofpracticalexperienceandtoidentify factorsleadingtochange.

TheFoundationhasatripartiteAdministrativeBoardmadeupofnationalrepresentativesof governments,employers'organisationsandemployees'organisations.Inaddition,theCommission isrepresentedontheBoard.

TheaimofthisproposalistostrengthenthestrategicroleoftheAdministrativeBoardwhile assigningmoreadministrativetaskstotheexistingBureauandrecognisingitsroleofficially.

ProvisionshavebeenincludedtoextendtheapplicationoftheStaffRegulationsofOfficialsofthe EuropeanCommunitiestothestaffoftheFoundation.HithertotheFoundationhashaditsownStaff Regulations.

– Working time

TheCouncilexaminedanamendedproposalforaDirectivesubmittedbytheCommissionon 31May2005( 9554/05 ),theaimofwhichistoamendDirective2003/88/EContheorganisationof workingtime 1,followingtheopiniondeliveredbytheEuropeanParliamentatfirstreadingon 11May2005( 8725/05 ).

TheaimoftheCommissionproposalistoimprovelegalcertaintywithregardtoregulatingworking time,particularlyinthelightofthecaselawoftheCourtofJusticerelatingtoinactiveperiodsof oncalltimeincertainprofessions,particularlythemedicalprofession. 2

ThemainamendmentswhichtheproposalforaDirectivewillintroduceintoDirective2003/88/EC concern:

– extendingthereferenceperiodforcalculatingmaximumweeklyworkingtimeto12months;

– introducingdefinitionsof"oncalltime"and"inactiveperiodsofoncalltime";

– conditionsforapplyingtheoptoutfromtheprovisionsrelatingtomaximumweeklyworking time.

FollowingtheCouncil'sdiscussions,thePresidentdrewthefollowingconclusionsinanoral statement:

– MostMemberStateshavenothadtimetolookindetailattheamendedproposalassubmittedby theCommissionon31May.Ithasthereforenotbeenpossibletoarriveatfinalconclusions today.

– Themainpointunderdiscussionwastheoptout.Therearetwoextremepositions:ontheone handthoseMemberStateswhicharecallingforfreedomofchoice,stressingtheneedfor economicgrowthandhenceaskingfortheoptout,andontheotherthosewhichfeelthat extendingthereferenceperiodforcalculatingweeklyworkingtimetooneyeargivesenough flexibilitytomakeitpossibletoenvisageadefiniteendtotheoptout.Betweenthesepositions therearemanyvariations.Thedelegationshavealsoexpressedtheirwillingnesstofindaviable compromise,inviewoftheurgencyoffindingaCommunitysolutiontothequestionofhowto treatinactiveperiodsofoncalltime,followingtheCourtofJusticejudgmentsintheSIMAPand JAEGERCases.

– ThePresidentnotedthatasolutionacceptabletoboththeCouncilandtheParliamentmight depend,interalia,onfurtherconsiderationoftwotypesofproblem:firstly,problemsinthe healthsectorandsecondlyproblemsarisingfromthefactthatinmanyMemberStates employeeshadseveralworkcontractssimultaneously.

– ThePresidenttooknoteoftheCommission'swillingnesstotakeaccountofthesetwoaspectsby fixingatimelimit,initsamendedproposal,fortheoptout,butonewhichcouldbeextended. However,manydelegationsexpresseddoubtsabouttheabsenceofobjectivecriteriafor extendingthetimelimitandstressedtheneedtotakeadecisionwhichwouldrespectMember States'interests.ThePresidentalsonotedthattheCommissionwaswillingtolookfora compromise.

– Inviewoftheproblemoflackoftimecoupledwiththepoliticalwilltocontinuethedebate,the CouncilinstructedCorepertomonitorthediscussionsandinformtheCouncilaccordingly.

Legalbasis:Article137(2)–codecisionprocedurewiththeEuropeanParliamentandqualified majorityrequiredforaCouncildecision.

– Economic migration

TheCouncilheldanexchangeofviewsonthe Green Paper on an EU approach to managing economic migration (5436/05), submittedbytheCommissionon14January2005,andinparticular onitsimplicationsfortheworkingofdomesticlabourmarkets,inthecontextoftheEuropean employmentstrategy.

TheGreenPaperconcernsadmissionproceduresfortheeconomicmigrationofthirdcountry nationals.Itproposesanumberofoptionswithaviewtotheprogressiveintroductionofa Communitylegislativeframework,inaccordancewithanactionplanwhichtheCommissionisdue tosubmitthisyear.TheactionplanwouldfollowonfromtheadoptionoftheHagueProgramme, whichlaidthefoundationsforprogresswithintheframeworkoffreedom,securityandjustice.

TheaimofthediscussionwastoenabletheCommissiontosoundoutdelegations'initialreactions tothequestionsaskedintheGreenPaper.

Discussioncentredonthefollowingthreetopicsinparticular:

– possibleCommunitymeasures(forexampleminimumstandards,acceleratedadmission procedureswhenthereisashortageoflabourinaparticularsector,improvingtheEURES system,etc.)foraccessbythirdcountrynationalstodomesticlabourmarkets,alsotakinginto accounttheneedforflexibilityinviewofthediversityofnationalsituations;

– thepossibilityofadoptingasectoralapproachtotheadmissionofthirdcountrynationalsto domesticlabourmarketswiththeaimofpromotingaccessbycertaincategoriesofmigrants accordingtoneeds;

– theneedforbettercoordinationofproceduresrelatingtoimmigrationandaccesstothelabour marketontheonehandwithmeasuresforthesocialintegrationofthirdcountrynationalsinthe hostcountryontheother.

Duringthediscussion,delegationsacknowledgedthatthesubjectofmigrationwarrantedactionat EUlevel,insofarasallEuropeanUnionStateswereaffectedwhenthirdcountrynationalsentereda MemberState.However,actionshouldfullyrespecttheprincipleofsubsidiaritybysettinga commonframeworkforsomeaspectswhilenotencroachingonMemberStates'responsibilityfor managingmigratoryflows.

Intheirremarksthedelegationsbroachedsubjectssuchas:definingthelimitsbetweenthoseaspects whichshouldberesolvedatCommunitylevel(forexample,databasesonlabourmarket requirements)andthosewhichitwouldbebettertoresolveatnationallevel;theneedforflexible solutionswhichshouldtakeintoaccountthespecificcharacteristicsoftheMemberStates(for examplethedifferentdemographictrendsinthevariousMemberStates);theneedtoensurethat therewasnoCommunitynationalpreparedtofillajobbeforeofferingittoathirdcountrynational, andtheneedformigrationpolicytogohandinhandwithmeasuresforintegratingmigrants.

Moreover,anumberofdelegationspointedoutthatfreedomofmovementforworkershadnotyet beenachievedwithintheEuropeanUnion.

TheCommissionannouncedthatitwouldtaketheseremarksintoaccountwhendrawingupits actionplan.

– European Institute for Gender Equality

PendingreceiptoftheEuropeanParliament'sopinion,theCouncilarrivedatageneralapproachon adraftRegulationestablishingaEuropeanInstituteforGenderEquality.

TheCommissionsubmitteditsproposalinaccordancewiththeconclusionsoftheEuropean Councilon17and18June2004(paragraph43). 1

TheaimoftheCommissionproposal( 7244/05) istoestablishaninstitutetogivetechnicalsupport totheCommunityinstitutionsandtheMemberStates,inparticularasregardsthecollection, analysisanddisseminationofdataandcomparablestatisticsandthedevelopmentofmethodological toolsforintegratinggenderequalitypolicies.

TheInstitutewillhavetheaimsofhelpingtopromoteandstrengthengenderequality,helpingthe Communityinstitutionstofightalldiscriminationonthegroundsofgenderandincreasing awarenessofissueslinkedwithgenderequalityamongEuropeanUnioncitizens.

ThedecisionontheseatoftheInstitutewillbetakenatintergovernmentallevel.Interested delegationshavesubmittedtheirapplications.

– Beijing Platform for Action - Council conclusions

TheCounciladoptedthefollowingconclusions:

"THECOUNCILOFTHEEUROPEANUNION,

Recognisingthat: genderequalityisafundamentalprincipleoftheEuropeanUnionenshrinedintheECTreatyand oneoftheobjectivesandtasksoftheCommunityandthatmainstreamingequalitybetweenwomen andmeninallitsactivitiesrepresentsaspecificmissionfortheCommunity;

Reaffirmingthat: thefullenjoymentofallhumanrightsbywomenandgirlsisaninalienable,integralandindivisible partofuniversalhumanrightsandisessentialfortheadvancementofwomenandgirls,peaceand development;

Consideringthat:

1. followingtheUN’sFourthWorldConferenceonWomeninBeijingin1995,theMadrid EuropeanCouncil(15to16December1995)requestedanannualreviewofthe implementationintheMemberStatesoftheBeijingPlatformforAction;

2. since1999,setsofquantitativeandqualitativeindicatorshavebeendevelopedby subsequentPresidenciesinsomeofthe12criticalareasofconcernintheBeijingPlatform forAction,namely:1999Womeninpoliticaldecisionmaking;2000Womeninthe economy(reconciliationofworkandfamilylife);2001Womenintheeconomy(onequal pay);2002Violenceagainstwomen;2003Womenandmenineconomicdecision making;2004Sexualharassmentattheworkplace.EachyeartheCouncilhasadopted conclusionsontheseindicators;

3. thereportoftheLuxembourgPresidencyoftheCounciloftheEuropeanUnionpresented attheEuropeanConferenceheldinLuxembourgon2and3February2005onthe implementationoftheBeijingPlatformforActionandtheoutcomedocumentsofthe23rd specialsessionoftheGeneralAssemblyoftheUnitedNations(Beijing+5),undertookan analysisofprogressmadewithintheEuropeanUnion,ofnationalmechanisms,their methodsandtoolsandidentifiedobstaclespreventingthefullrealisationofgenderequality aswellasthemajorremainingchallenges;

4. theEuropeanParliamentresolutionof10March2005 onthe"Followupofthefourth WorldConference–PlatformforAction(Beijing+10)"andtheopinionoftheEuropean EconomicandSocialCommitteeof9February2005on"Beijing+10:Reviewofprogress achievedinthefieldofgenderequalityinEuropeandindevelopingcountries";

5. thecommondeclarationadoptedon4February2005bytheEUministersresponsiblefor genderequalitypoliciesasthebasisforfutureEuropeanstrategies;

6. thepoliticaldeclaration,adoptedon4March2005,duringthe49thsessionofthe CommissionontheStatusofWomenontheimplementationoftheBeijingPlatformfor Actionandtheoutcomedocumentsofthe23rdSpecialSessionoftheGeneralAssemblyof theUnitedNationsin2000,whichreaffirmstheDeclarationandPlatformofActionof Beijing,

1. ACKNOWLEDGEStheconclusionsofthereportoftheLuxembourgPresidencyon "ProgressmadewithintheEU"followingtheBeijingPlatformforActionandtheoutcome ofthePresidencyconferenceontheReviewoftheimplementationoftheBeijingPlatform forActionheldon2and3February2005inLuxembourg;

REAFFIRMSitsstrongsupportfor,andcommitmentto,thefullimplementationofthe goalsandobjectivessetandthecommitmentsmadeintheDeclarationandPlatformfor ActionoftheFourthWorldConferenceonWomen,theBeijing+5PoliticalDeclaration andOutcomeDocumentofthe23rdSpecialSessionoftheGeneralAssemblyofthe UnitedNations;

5. REAFFIRMSthecommitmenttothepromotionofgenderequalityandwomen's empowerment,includingthroughdevelopmentcooperationandpartnership,andrecognises thatgenderequalityandwomen’sempowermentareoffundamentalimportanceforthe achievementofsustainabledevelopmentandtheeradicationofpoverty;

6. EMPHASISEStheneedtotakeconcretestepsbothtoimplementgendermainstreaming andinsupportofspecificactionstoachievegenderequality;

7. ENCOURAGESMemberStatesandtheCommissiontodevelopmethodsandtoolsfor gendermainstreaming,suchasgenderbudgeting,genderauditandgenderimpact assessmentasapriorityforthefutureandtofurtherdevelopgenderexpertiseandgender training;

8. UNDERLINEStheimportanceofenhanceddialogueandcooperationwithcivilsociety andthesocialpartners;

9. INVITESMemberStatesandtheCommission,inconnectionwithactivitiesunderthe programmeforequalitybetweenwomenandmen,theworkofthefutureEuropean InstituteforGenderEqualityandotherCommunityactivities,tocontinuetofocusonthe criticalareasofconcernmentionedintheBeijingPlatformforAction;

10. INVITESMemberStatesandtheCommissiontosupport,encourageanddisseminate research;tocontinuetoimprovethecollectionandcompilationoftimely,reliable, comparabledatadisaggregatedbysexonthemultiplefactorsthataffectthefullenjoyment bywomenoftheircivil,political,economic,socialandculturalrights,includingtheirright todevelopment,andonviolationsthatareparticulartowomenandgirls;todisseminatethe findingsandtousedatathuscollectedtosettimeboundtargetsandtoassessthe implementationofthehumanrightsofwomen;

11. INVITESMemberStatesandtheCommissiontostrengtheninstitutionalmechanismsand tocreateaframeworktoassesstheimplementationoftheBeijingPlatformforActionin ordertocreateamoreconsistentandsystematicmonitoringofprogress;

12. INVITEStheCommissiontoincludetheassessmentofrelevantindicators,developedfor thefollowupoftheimplementationoftheBeijingPlatformforAction,initsannualreport totheSpringEuropeanCouncil;

13. CONFIRMSthemissionofthehighlevelgroupongendermainstreamingestablishedby theCommissiontofollowuptheBeijingPlatformforActionintheCouncilandtoensure gendermainstreaminginCouncilformations;

14. STRESSEStheimportanceofstrengtheningthelinkbetweentheimplementationofthe ConventionontheEliminationofallformsofDiscriminationagainstWomenandits OptionalProtocol,theBeijingPlatformforAction,theCairoProgrammeofAction,the CopenhagenDeclarationandActionProgramme,theMillenniumDeclarationandthe MillenniumDevelopmentGoalsandemphasisestheneedtoadopt,atEuropeanlevel,a coherentapproachtowardsthesedifferentobjectiveswhicharereinforcedmutually;

15. URGEStheMemberStatesandtheCommissiontoensurethattheBeijingDeclarationand PlatformforActionandtheCairoProgrammeofActionarefullyintegratedintothe preparationfor,andtheoutcomeof,theMillenniumSummitinSeptember2005. Moreover, agenderperspectiveshouldbefullytakenintoaccountduring thehighlevel reviewoftheMillenniumDeclarationandintegratedthroughthesevenstrategicpriorities identifiedinthe MillenniumProjects inordertoempowerwomenandmeetthe MillenniumDevelopmentGoals."

HEALTH

– Medicinal products for paediatric use

PendingreceiptoftheEuropeanParliament'sopinion,theCouncilheldapolicydebateonthe proposalforaRegulationonmedicinalproductsforpaediatricuse( 13880/04 )withaviewtofurther examinationofthetext.

Thedebatefocusedonthefollowingtwoquestions:

– extensionofthevalidityofthesupplementaryprotectioncertificate,asawayofencouraging investmentinpharmaceuticalproductsforpaediatricuse;

– allowingpublicaccesstodataonpaediatricclinicaltrialsinordertoavoidunnecessary paediatricclinicaltrials.

Duringthedebate,particularemphasiswasplacedontheimportanceofencouragingresearchin thisfieldandimprovingaccesstopaediatricmedicines,inviewoftheneedtoproducemedicines adaptedtothespecificphysicalandpsychologicalcharacteristicsofchildren.

Thedelegationsrecognisedtheincentivevalueofameasureextendingtheprotectioncertificate. Someofthem,however,wantedtodiscusstheproposalfurther,inparticularthelengthofthe extension 1andthedateonwhichtheimpactofthemechanismwouldbereviewed,giventheless positiveeffectsthatsuchameasuremightalsoproduce(e.g.delayintheplacingonthemarketof genericmedicines).

Delegationsweregenerallyinfavourofmakingtheresultsofclinicaltrialsmorewidelyavailable, asthiswouldhelptoavoidunnecessaryclinicaltrials,butfurtherdiscussionwasneededto establish,inparticular,howwidelyavailablethiswouldmean.

TheproposalwasdrawnupfurthertotheCouncilResolutionofDecember2000 2,inwhichthe Commissionwasinvitedtomakeproposalsforthedevelopmentofclinicalresearchsothat medicinalproductsfullyadaptedtothespecificneedsofchildrenwouldbeavailableontheEU market.Itisestimatedthat5090%ofmedicinalproductsusedinpaediatricmedicinehavenever beenspecificallystudiedorauthorisedforuseinthatagegroup.

Themainobjectiveoftheproposalistoimprovechildhealthwhileremovingobstaclesto intracommunitytradeinpaediatricmedicinalproducts.

Theaimsareasfollows:

• toensurethatthemedicinalproductsusedtotreatchildrenhavebeenthesubjectofhighquality research;

• toensurethatthosemedicinalproductsaredulyauthorised;

• toimproveinformationontheuseofmedicinalproductsintendedspecificallyforchildren; whileavoidingunnecessaryclinicaltrialsonchildren.

Tothatend,theproposalcontainsacombinationofobligationsandincentives.Themainobligation isthatapaediatricinvestigationplanmustbesubmittedaspartoftheprocedureforobtaining marketauthorisation,whileincentivesareprovidedthroughtheextensionofexclusiverightsand theintroductionofanewtypeofmarketauthorisationforgenericmedicines,thePUMA.

TheproposedsystemcoversmedicinalproductsforhumanusewithinthemeaningoftheDirective ontheCommunitycoderelatingtomedicinalproductsforhumanuse.

TheproposalalsointroducessomeamendmentstotheRegulationcreatingasupplementary protectioncertificateformedicinalproducts 1,theDirectiveontheCommunitycoderelatingto medicinalproductsforhumanuse 2andtheRegulationlayingdownproceduresfortheauthorisation andsupervisionofmedicinalproducts 3,allmadeinfullcompliancewiththeEUclinicaltrials Directive 4.

– Nutritional claims

TheCouncilreachedunanimouspoliticalagreementonadraftRegulationonnutritionalandhealth claims 1whichmaybeusedinthelabelling,presentationandadvertisingoffoods.

TheEuropeanParliamentdelivereditsopinionon26May2005.ThetextofthedraftRegulation willbeformallyadoptedbytheCouncilasa common position afterfinalisationintheofficial languages,thenforwardedtotheEuropeanParliamentforitssecondreading.

Thefoodindustryhasrespondedtoincreasedconsumerinterestintheinformationappearingon foodlabelsbyhighlightingthenutritionalvalueofproductsthroughclaimsintheircommercial communication(labelling,presentationandadvertising).

Inordertoavoidmisleadingconsumersandtoensuretheproperuseofclaimsasamarketingtool, thedraftRegulationintendstoallowonlyclaimswhichareclearandmeaningfultotheconsumer, subjecttocertainconditions.Thepersonmarketingthefoodshouldbeabletojustifytheuseofthe claim.

ThedraftRegulationcoversfoodstobedeliveredassuchtothefinalcustomerorsuppliedto restaurants,hospitals,schools,canteensandotherlargescalecaterers.

TheCommissionhasproposed( 11646/03 )Communityharmonisationofrulesinordertoensurea highlevelofconsumerandpublichealthprotection,whileremovingobstaclestotheproper functioningoftheinternalmarketandtothefreemovementoffoodsarisingfromthecoexistence ofdifferentnationallaws.

Proposedlegalbasis:Article95oftheTreatycodecisionprocedurewiththeEuropeanParliament andqualifiedmajorityrequiredforaCouncilDecision.

– Vitamins, minerals and other substances added to food

TheCouncilreachedpoliticalagreement,byaqualifiedmajority 1,onadraftRegulationonthe additionofvitaminsandmineralsandofcertainothersubstancestofood.

TheEuropeanParliamentdelivereditsopinionatfirstreadingon26May2005.Thetextofthedraft RegulationwillbeformallyadoptedbytheCouncilasa common position afterfinalisationinthe officiallanguages,thenforwardedtotheEuropeanParliamentforitssecondreading.

ThedraftRegulationaimstoharmonisethenationalrulesontheadditionofnutrients(vitamins, mineralsandcertainothersubstances)tofood,whileensuringthatfoodstuffsonsalearesafeand properlyandclearlylabelledsothatconsumerscanmakeaninformedchoice,andthattheydonot presentanyriskforpublichealth.Harmonisationwasalsodeemednecessarytofacilitatethefree movementoftheseproductswithintheCommunity.Thetextliststhevitaminsandmineralsthat maybeaddedtofoods,aswellastheformsandconditionsinwhichtheymaybeadded.

TheprovisionsofthedraftRegulationdonotapplytothefoodsupplementscoveredby Directive2002/46/EC 2anddonotaffectthespecificprovisionsonfoodsforparticularnutritional uses,novelfoodsandfoodingredients,foodadditivesandflavouringsandauthorisedoenological processes.

– Action programme for health and consumer protection

TheCouncilheldadebateonthehealthaspectsoftheproposalforaDecisionestablishinga programmeofactioninthefieldofhealthandconsumerprotection(20072013)( 8064/05 ).

TheproposalforaprogrammeofCommunityactioninthefieldofhealthandconsumerprotection 20072013providesthatthefutureactionsoftheEUinthefieldofPublicHealthwillfocusonfive objectives:

– toprotectcitizensagainsthealththreats;

– topromotepoliciesthatleadtoahealthierwayoflife;

– tocontributetoreducingtheincidenceofmajordiseasesintheEU;

– tocontributetothedevelopmentofmoreeffectiveandefficienthealthsystems,and

– tosupporttheobjectivesabovebyprovidinghealthinformationandanalysis.

Thedebatefocusedonwhethertheseobjectivescorrespondedtotheexpectationsofthe HealthMinisters.

ThedebategavedelegationsanopportunitytostatetheirinitialreactionstotheCommission proposalwhichbringstogether,inasingleintegratedprogramme,theobjectivespursuedbythetwo publichealthandconsumerprotectionprogrammescurrentlyinplace 1.

Delegationsalsostressedtheneedtoenhancetheaddedvalueofthecommonactionsinthisarea, pointing,inparticular,thatitwouldbeusefultoimprovecooperationbetweenMemberStates' healthsystemsandtoimprovethewayinwhichcrossborderhealththreats(pandemics)were addressed.

TheCouncilheldanexchangeofviewsontheproblemofcombatingobesity,afterwhichitadopted thefollowingconclusions:

5. RECOGNISESthemajorandgrowingcontributionofunhealthylifestylestotheburdenof asignificantnumberofchronicdiseases;

8. NOTESWITHCONCERNtheriseinobesityprevalenceratesthroughouttheEuropean Union,andparticularlyamongchildren,aswellasthenegativeconsequencesthereoffor cardiovascularhealthandtype2diabetesamongstothers;

9. RECOGNISEStheimportanceofaddressinginequalitiesthatmayexistwithinMember Statesregardingobesity,dietandphysicalactivity;

10. RECOGNISESthatobesityisamulticausalconditionwhichrequiresacomprehensive preventiveapproach,includingmultistakeholdereffortsatlocal,regional,national, Europeanandgloballevels;

11. RECOGNISESthatitisnecessarytoensuretheinvolvementofallstakeholdersinorderto buildupsocialawarenessfortheimportanceofhealthydietsandphysicalactivity, particularlywithregardtochildren,andtocounteractmisleadingformsofadvertising;

12. WELCOMEStherecentlaunchbytheCommissionoftheEuropeanPlatformforAction onDiet,PhysicalActivityandHealthasanimportantstepforwardinthisregard,whichis expectedtocontributetopursuinghealthynutritionandphysicalactivitiesandtohalting currentobesitytrendsthroughdeterminedactionbythestakeholdersrepresentedinthe Platform,andENCOURAGESMemberStatestolaunchasappropriateinitiativeswithin thecontextoftheiroverallnationalstrategyandtoworkinsynergywiththeEuropean Platform;

13. STRESSEStheimportanceofstrengtheninglinksbetweeneffortstopromotehealthydiets andphysicalactivityandotherCommunitypolicies,suchastheagriculture,transport, environment,culture,educationandconsumerpolicyareas.Wheneverneworrevised Communitylegislationwithanimpactonnutritionandphysicalactivityisprepared, synergiesshouldbesoughtwiththeobjectivespursuedthroughhealthpolicymeasures. Moreover,addressingtheobesityepidemicandpromotinghealthydietsandphysical activityshouldbemainstreamedintotheagendaofotherrelevantCouncils;

14. RECOGNISESthatphysicalactivityisconsideredtobeanintegralpartofahealthy lifestyleandthatlearningtoenjoysportandphysicalactivityatschoolandduringleisure time,aswellasstartingeducationabouthealthylivingatanearlyageisofutmost importance;

15. WELCOMESinthiscontexttheCommission'sintentiontopresentaGreenPaperon nutrition,physicalactivityandhealthlaterthisyear,andtopreparefor2006aCommission Communicationintegratingtheresultsofthepublicconsultationexerciseinitiatedwiththe GreenPaper;

16. CALLSUPONtheMemberStatesand,whereappropriate,theEuropeanCommissionto conceiveandimplementinitiativesaimedatpromotinghealthydietsandphysicalactivity, including:

(1) enablingcitizenstomakehealthydietarychoices,andensuringthathealthydietary optionsareavailable,affordableandaccessible;

(2) fosteringcitizens'knowledgeontherelationshipbetweendietandhealth,energy intakeandoutput,ondietsthatlowerriskofchronicdiseases,andonhealthychoices offooditems;

(3) ensuringthatconsumersarenotmisledbyadvertising,marketingandpromotion activities,andthatespeciallythecredulityofchildrenandtheirlimitedexperience withthemediaisnotexploited;

(4) enablinghealthprofessionals,includingdietaryexperts,aswellasother professionalshavingarecognisedqualificationinthisfield,togive,onaroutine basis,practicaladvicetopatientsandfamiliesonthebenefitsofoptimaldietsand increasedlevelsofphysicalactivity,aswellascontributetotheexchangeofbest practicesinthisfield;

(5) encouragingstakeholderswhoareinapositiontosupportthepromotionofhealthy diets(e.g.foodproducers,foodprocessors,retailers,caterers)totakeinitiativesto thisend,forexamplethroughvoluntaryactionoragreements;

(6) mainstreamingofnutritionandphysicalactivityintoallrelevantpoliciesatlocal, regional,nationalandEuropeanlevels,suchaspoliciesaimedatreducingthe harmfuleffectsofexcessivealcoholconsumption,aswellascreatingthenecessary supportingenvironments;
