Introduction The Nature Conservation Act 1992 (NC Act) provides a legislative basis for the conservation of nature. The NC Act aims to achieve the conservation of nature, while allowing for the involvement of Indigenous people in the management of protected areas, through an integrated and comprehensive conservation strategy for the whole of the state. It provides the framework for research; community education; dedicating, declaring and managing protected areas; and protecting native wildlife and its habitat. The NC Act also provides for the making of subordinate legislation including regulations, notices and conservation plans. Under section 139 of the NC Act, the chief executive must, within four months after the end of each financial year, give to the Minister a report on the administration of this Act during the year. The Minister must lay a copy of the report before the Legislative Assembly within 14 sitting days after its receipt by the Minister.

Nature Conservation Act 1992—departmental administrative responsibilities During the reporting period, the NC Act was jointly administered consistent with the Administrative Arrangements Order (No. 3) 2015, Administrative Arrangements Order (No. 1) 2016, Administrative Arrangements Order (No. 2) 2016, Administrative Arrangements Order (No. 3) 2016, Administrative Arrangements Order (No. 1) 2017 and Administrative Arrangements Order (No. 2) 2017, as follows: • The Department of Environment and Heritage Protection (EHP) is responsible for the dedication and declaration of protected areas (including nature refuges), protection of native wildlife and its habitats and providing for the ecologically sustainable use of protected wildlife and nature refuges. • The Department of National Parks, Sport and Racing (NPSR), through the Queensland Parks and Wildlife Service (QPWS), is responsible for the custody and management of the protected area estate (excluding nature refuges) and forest reserves. • The Department of Agriculture and Fisheries (DAF) is responsible for demonstrated and exhibited native animals. This report complements information provided in the annual reports of these agencies.

Nature Conservation (Administration) Regulation 2006 The Nature Conservation (Administration) Regulation 2006 contains the administrative matters applicable to the Nature Conservation (Protected Areas Management) Regulation 2006, the Nature Conservation (Wildlife Management) Regulation 2006 and conservation plans made under the NC Act. The Regulation was amended eight times in 2016–17.

The Regulation 2017 reclassification of species was as a result of the scientific (SL No. 67 of 2017) assessment and recommendations of the Species Technical Committee.

Protected areas Amendments to the NC Act effective from 1 July 2016 reversed a number of changes made to the Act and other legislation by the previous government in 2013–14. These latest amendments: • reinstated the national park (scientific), conservation park and resources reserve classes of protected area • removed the ability to declare special management areas (scientific) due to the reinstatement of the national park (scientific) class • removed the regional park class and reinstated these areas as either conservation parks or resources reserves.

The protected area classes, as stated in section 14 of the NC Act, are: • national parks (scientific) • national parks • national parks (Aboriginal land) • national parks (Torres Strait Islander land) • national parks (Cape York Peninsula Aboriginal land) • conservation parks • resources reserves • nature refuges • coordinated conservation areas.

All classes of national parks are areas with outstanding natural and cultural values and represent the highest level of protection under the NC Act. National parks (scientific) also contain exceptional scientific values that lend themselves to research and scientific purposes, and are managed to protect these values and allow some manipulation of habitat for threatened wildlife and control of threatening processes. National parks are managed to permanently preserve and protect their natural and cultural values and provide educational and recreational opportunities, while ensuring that any uses are nature-based and ecologically sustainable. There are currently no national parks (Aboriginal land) or national parks (Torres Strait Islander land) but these areas are intended to represent areas that should also be managed in accordance with any Aboriginal traditions or activities or Island customs respectively in the area. National parks (Cape York Peninsula Aboriginal land) are also to be managed in accordance with any Aboriginal tradition or activities relating to the area. Conservation parks are generally smaller than national parks and their conservation values may not be as significant. Conservation parks are managed to permanently conserve and present the area’s natural and cultural values to the greatest possible extent, as well as to provide educational and recreational opportunities in a way that is consistent with these values and is sustainable. Resources reserves allow for the controlled use of the area’s natural and cultural values such as mining, quarrying or timber extraction but must be managed to ensure the area is maintained predominantly in its natural condition. Nature refuges are areas of high conservation significance generally owned by private individuals and companies, which are predominantly entered into through a voluntarily agreement. They are managed to conserve the area’s significant natural and cultural resources and provide for its controlled use as well as the interests of the landholder. There are two coordinated conservation areas that overlay multiple tenure types, which are managed in a coordinated manner by the various landholders. They are managed to conserve the area’s natural and cultural values and to provide for the interests of the landholders. Table A details the status of protected areas, including changes during 2016–17.

Special management areas (SMAs) controlled action Under the NC Act, SMAs (controlled action) can be declared by the chief executive over national parks to allow special management actions to occur. An SMA (controlled action) allows for the manipulation of an area’s natural or cultural resources for recovery purposes, or the continuation of a lawful existing use, where the use is consistent with maintaining the area’s natural and cultural values. As at 1 July 2016, the total area of national parks subject to SMAs (controlled action) was 51,013 hectares. Three new SMAs (controlled action) were declared in 2016–17. As the three new SMAs (controlled action) completely overlapped existing SMAs (controlled action), the total area remained at 51,013 hectares as at 30 June 2017.

Protected area authorities Sections 34–38, 42AD–42AEA and 42AN–42AP of the NC Act deal with the granting of authorities for the use of national parks, national parks (Cape York Peninsula Aboriginal land), Indigenous joint management areas, conservation parks and resources reserves. Sections 37 and 38 include provision for leases issued under the Land Act 1994 and continuing authorities under the repealed National Parks and Wildlife Act 1975. Under these provisions, leases and authorities can, in specific circumstances, be issued for purposes that include but are not limited to ecotourism, communications, electricity infrastructure, water extraction and grazing.

The Nature Conservation (Protected Areas Management) Regulation 2006 provides for activities to be undertaken on protected areas by permit, authority or agreement. The Nature Conservation (Administration) Regulation 2006 outlines the administrative matters relating to the grant, amendment, suspension, cancellation, surrender and replacement of relevant authorities and the requirements applying to carrying out activities under a relevant authority provided for by the Nature Conservation (Protected Areas Management) Regulation 2006. A summary of information relating to protected area authorities during 2016–17 is provided in Table B. There were no internal reviews or appeals to the Queensland Civil and Administrative Tribunal related to protected area authority decisions during 2016–17. Additional information relating to the administration of selected camping permits, and commercial activity agreements and permits in 2016–17 is provided in Table C. Under section 39B of the NC Act, the chief executive may, before the interest is created, require a person seeking an interest in land in a protected area to give the chief executive an environmental impact statement (EIS) for the use, or a stated use, of the land under the interest. No EISs were required or considered under this provision during 2016–17. Under section 174A of the NC Act, the chief executive may, by gazette notice, approve or make codes of practice for protected areas or forest reserves. No codes of practice under the Act for protected areas and forest reserves were current during 2016–17.

Trustees Section 31 of the NC Act provides that a conservation park or resources reserve may be placed under the management of trustees. Trustees are listed in schedules 1 and 2 of the Nature Conservation (Protected Areas Management) Regulation 2006. There was one new trustee appointed during 2016–17, namely the Wetlands and Grasslands Foundation as trustee of Wongaloo Conservation Park.

Commercial activity agreements The Nature Conservation (Protected Areas Management) Regulation 2006 provides for authorised activities to be allowed on protected areas. Part 3 of the Nature Conservation (Administration) Regulation 2006 outlines the process for consideration of commercial activity agreements on protected areas. The 98 commercial activity agreements in force during 2016–17 are listed in Table D.

Conservation agreements for nature refuges Section 45 of the NC Act allows the State to enter into conservation agreements with landholders to assist in the conservation of land and wildlife. The 13 conservation agreements (nature refuges) executed during 2016–17 are listed in Table E.

Forest reserves The NC Act allows for the dedication of forest reserves as protected areas. There were no changes to the status of forest reserves during 2016–17, as indicated in Table F.

Management statements and management plans Sections 111–119B of the NC Act outline the process for preparing management statements and management plans for protected areas. A management statement is generally required for all protected areas. However, a management plan may be prepared instead of a management statement, or to replace an existing management statement, if the Minister is satisfied that this is appropriate in the circumstances, having regard to the importance of the area’s natural or cultural resources and values; significant threats or public interest concerns relating to those resources and values; and any proposed commercial or recreational uses and opportunities for the area, and how those uses would be managed. As at 30 June 2017, 79 protected area management plans covering 104 protected areas were approved by the Governor in Council (Table G). Protected areas with approved management statements as at 30 June 2017 are listed in Table H—including four national parks (scientific), 207 national parks, 17 national parks (Cape York Peninsula Aboriginal Land), 189 conservation parks and 40 resources reserves.

As at 30 June 2017, 100% of national parks, 98% of conservation parks and 86% of resources reserves had a management instrument (management plan or management statement) in place (excluding joint management areas). This enabled improved management, including health, fire, pest and visitor management, and provided direction on emerging and contemporary matters. Four new national parks (Cape York Peninsula Aboriginal Land) were dedicated in 2016–17. These are yet to have management planning instruments completed. Consistent with NPSR's policy of having management planning instruments in place for new national parks and protected areas within one year of dedication, management statements will be completed for these parks.

Wildlife and habitat conservation

Wildlife licences, permits and other authorities Under the NC Act, licences, permits or other authorities are required for the taking and use of protected wildlife, to ensure that use is ecologically sustainable and wild populations are protected. Summaries of information relating to wildlife licences and wildlife permits are detailed in Table I and Table J. Under section 174A of the NC Act, the chief executive may, by gazette notice, approve or make codes of practice for protected wildlife. A summary of the 11 wildlife codes of practice and guidelines in effect during 2016–17 is provided in Table K. Under section 100B of the NC Act, the Minister may enter into a captive breeding agreement for protected wildlife. A summary of the four captive breeding agreements in effect during 2016–17 is provided in Table L.

Critical habitats and areas of major interest Under section 175(j) of the NC Act, the Governor in Council may make regulations with respect to the use or development of land, and activities, in an area identified as, or including, a critical habitat or an area of major interest. No critical habitats or areas of major interest were determined during 2016–17.

Declarations Chapter 8, part 5 of the Nature Conservation (Wildlife Management) Regulation 2006 provides for special management declarations for marine . No special management declarations were made during 2016–17.

Interim conservation orders Part 6 of the NC Act allows for interim conservation orders to be made for the conservation, protection or management of threatened or near threatened wildlife, a critical habitat, an area of major interest, or a protected area. Two interim conservation orders were issued during 2016–17 for the protection of the night parrot at Brighton Downs and beach stone-curlew at Pelorus Island.

Administration

Conservation officers The responsible Minister may appoint an employee of EHP, NPSR or DAF; an officer of the public service; a police officer; or another appropriately qualified person to be a conservation officer. Conservation officers possess a range of investigation, compliance and enforcement powers supporting the implementation of the objectives of the NC Act. Departmental records indicate a total of 134 officers were newly appointed or reappointed under the NC Act during 2016–17. No Land and Sea Rangers (non-public service employees) were newly authorised to exercise powers under section 151 of the NC Act (Conservation officer may require name and address).

Offences and prosecutions Enforcement of the NC Act is a major activity for EHP and NPSR, to ensure the protection and conservation of Queensland’s natural environment. EHP’s Litigation Branch finalised four prosecutions on behalf of EHP and NPSR in 2016–17, resulting in penalties totalling $15,500 and $3,068.58 in costs. Additional information on enforcement activities for protected area and wildlife matters is provided in Table M and Table N respectively.

16/08/2016 Nature Conservation The defendant engaged an arborist to undertake Convicted and $1,500 Act 1992—section 88C pruning activities on a flying fox roost. The fined $5,000 activities commenced on two occasions despite the presence of flying foxes in the trees. The No conviction defendant pleaded guilty to one offence of recorded disturbing flying foxes in a flying fox roost.

21/11/2016 Nature Conservation The defendant was intercepted in possession of a Convicted and - Act 1992—section number of protected animals. Two animals were fined $8,500 62(1) unlawfully obtained from a protected area.1 A search of the defendant’s residence also revealed No conviction Nature Conservation 12 offences of an administrative and record- recorded (Administration) keeping nature. Regulation 2006— The defendant sections 58 and served one 125(b)(ii) day and nine hours imprisonment for failing to appear on these charges, which the Court took into account when sentencing.

01/03/2017 Nature Conservation The defendant was charged with taking two - - Act 1992—sections animals from a protected area, and a number of 88(2) and 88(5) other record keeping offences. Charges were withdrawn on 1 March 2017. 1 Offences relating to a protected area under the Nature Conservation Act 1992 are usually included in Table M.
