(a) & (b): Yes, Madam. The details of States/ Union Territories affected by natural calamities like floods, cyclonic storms, earthquakes etc., as reported by the State Governments/ Union Territories in the year 2011-12 alongwith the loss of lives, property and damage to crops are at Annexure-I. (c) to (e): The States of Sikkim, West Bengal, Odisha, Kerala, Uttar Pradesh, Himachal Pradesh, Tamil Nadu and the UT of Puducherry have submitted memoranda for additional central assistance from the National Disaster Response Fund (NDRF) for supplementing their relief efforts. (a) whether the Government proposes to include `frost` in the category of natural calamities; (b) if so, the details thereof; (c) whether the Government has conducted any survey about the losses suffered on account of frost in the country; and (d) if so, the details thereof during each of the last three years and the current year, State-wise?

MINISTER OF STATE IN THE MINISTRY OF HOME AFFAIRS (SHRI MULLAPPALLY RAMACHANDRAN)

(a) & (b): The Government of has constituted a Group of Ministers (GoM) to look into the issue of inclusion of cold wave/frost as an eligible calamity for relief under SDRF/NDRF. The GoM has considered the matter and suggested the constitution of a working group of agricultural scientists/ experts to examine the issue of quantifying the damages caused by cold wave/ frost for assistance as appropriate. Based on the report of the working group a final decision on the issue of its inclusion will be taken.

(c) to (d): This Ministry has not conducted survey about the losses suffered on account of frost in the country.

DISASTER MANAGMENT 13th March, 2012

(a) whether the Government has any proposal to establish a National Disaster and Crisis Management Centre; (b) if so, the details alongwith the proposed functions thereof and the time by which the said Centre is likely to be set up; (c) whether Russia has offered to extend support for setting up of the Centre; and (d) if so, the details thereof?

MINISTER OF STATE IN THE MINISTRY OF HOME AFFAIRS (SHRI MULLAPPALLY RAMACHANDRAN)

(a) & (b): The details of the proposal for establishing a National Disaster and Crisis Management Centre in the Country are being ascertained. (c) to (d): The Russian National Crisis Management Centre carries out operational management of on-duty forces in emergency situations and ensues population warning in case of major accidents and disasters. It further integrates the unified information network of all the structures involved in emergency prevention, forecasting and response. The Russian Emergency and Disaster Management Command Centre (EMERCOM) deploys GLONASS signals. During the visit of the Indian delegation headed by Home Minister, Russia highlighted the need to rapidly concertize cooperation under the Inter Government Agreement on Disaster Management signed in December, 2010 and urged early setting up of the Joint Commission envisaged under it. Russia further offered to help India establish a National Disaster and Crisis Management Centre.

(a) whether a mega mock drill was conducted recently by the National Disaster Management Authority and the Delhi Disaster Management Authority in Delhi; (b) if so, the details thereof; (c) whether the response by the various authorities was not satisfactory; and (d) if so, the corrective steps taken by the Government in this regard? STATEMENT IN REPLY TO PARTS (a) TO (d) OF LOK SABHA STARRED QUESTION No. 83 FOR 20th MARCH, 2012.

(a): Yes, Madam. A mega mock drill for earthquake preparedness was conducted on 15th February, 2012 in Delhi. (b): The Delhi Disaster Management Authority (DDMA), in collaboration with the National Disaster Management Authority (NDMA), conducted a major earthquake preparedness exercise in Delhi several weeks preceding 15th February, 2012. This disaster management exercise comprised activities like workshops, awareness programmes, mock drills, public lectures and multi-media campaign. The exercise culminated in a state wide mega mock drill on 15th February, 2012 at 11.30 AM covering all the 9 districts of Delhi. The exercise was conducted under the supervision of respective Deputy Collectors with the participation of various stake holders in important government buildings, malls, cinema halls, high rise buildings, petrol pumps, CNG depots, hospitals, metro stations etc. falling under their jurisdiction. (c) to (d): The objective was to calibrate and measure the response and timeliness of various emergency support functionaries, so that corrective measures and necessary improvement can be effected. Improvement in this regard is a continuous process.

(a) whether the Government is contemplating to set up a separate force to effectively tackle natural disasters in the country; (b) if so, the details thereof; (c) whether State and District level disaster management plans are in place for implementation in times of disasters; (d) if so, whether the concerned civic and emergency response agencies have been thoroughly briefed on these plans; (e) if so, the details thereof; (f) whether the Government proposes to conduct mock drills to test the preparedness for disaster response in the metro cities as held in Delhi recently; and (g) if so, the details of such drills that have been conducted so far and the findings thereof?

(a) to (b): Government of India has already constituted National Disaster Response Force (NDRF) under Section 44 of the DM Act, 2005 by up-gradation/ conversion of standard battalions of Central Armed Police Force, as a specialist force to deal with the disaster or threatening disaster situation. A total of 10 battalions of NDRF have been raised, out of which 04 battalions have been trained to deal with Chemical, Biological, Radiological and Nuclear (CBRN) calamities besides natural calamities. Based on vulnerability profile of different regions of the country, these specialist battalions have been presently stationed at the various strategic locations all over the country viz. Guwahati (Assam), Kolkata (West Bengal), Mundali (Odisha), Arrakonam (Tamil Nadu), Pune (Maharashtra), Gandhi Nagar (Gujarat), Bhatinda (Punjab), Ghaziabad (Uttar Pradesh), Bihta, Patna (Bihar) and Vijayawada (Andhra Pradesh). (c) to (e): Sections 23 and 31 of the Disaster Management Act, 2005 provides that State Disaster Management Plan for every State and District Disaster Management Plan for every District shall be prepared by State Executive Committee and District Disaster Management Authority respectively and shall be approved by State Disaster Management Authority. The State Disaster Management Plan is required to prepare in accordance with the guidelines laid down by the National Disaster Management Authority (NDMA). The guideline for preparation of State Disaster Management Plans has been issued by NDMA on July 2007 and till date 14 States have prepared draft State Disaster Management Plans. (f) & (g):NDMA undertakes mock exercises in vulnerable Districts and industries on various types of natural and man-made disasters to help the State Governments and District administration in reviewing the adequacy and efficacy of the State and District level Disaster Management Plans and to identify gaps in resources and systems. It is mentioned that this was for the first time that a mega mock drill was conducted in Delhi and it contemplates to undertake similar such mock drills in other vulnerable States.

Memoranda received from the State Government invariably includes requirement for funds for long-term and permanent reconstruction activities, specifically those relating to infrastructure. Assistance for these items is not admissible from SDRF/ NDRF and the funds for these have to be sought separately through Additional Central Assistance, Special Plan Assistance, etc. Hence, there is a variation between the amounts demanded and the amounts released to the States.

DISASTER PREPAREDNESS OF NUCLEAR INSTALLATIONS 27th March, 2012

(a) whether the National Disaster Management Authority (NDMA) has asked all the States having nuclear installations to prepare a plan for development of Export Processing Zone (EPZ) around the nuclear plants; (b) if so, the details thereof; (c) whether mock exercises to look at the offsite nuclear emergency plans were carried out by NDMA in the wake of the Fukushima experience in the country; (d) if so, the details thereof; and (e) the extent to which nuclear installations in the country are safe for the families living in and around such installations?

(a): Yes, Madam. (b) to (d): The existing regulatory requirements with regard to disaster preparedness of Nuclear installation are brought out in the following Atomic Energy Regulatory Board (AERB) documents:- # AERB safety code AERB/SC/S “Code of Pratice on Safety in Nuclear Power Plant Siting.” # Atomic energy (Radiation Protection) Rules, 2004, rule 33, (1). # AERB/SG/EP-2 Preparation of off-site emergency preparedness plan for Nuclear Installation. The AERB/SG/EP-2 covers all aspects of off-site emergency response plans, which the operating organization and state public authorities shall prepare and maintain in full readiness for implementation in the event of off-site emergency at nuclear installations in the country. All the nuclear installations have on-site and off-site emergency preparedness plans as per regulatory requirement. A series of workshop and Mock drills were carried out by National Disaster Management Authority (NDMA) during June to August 2011 in association with the , Nuclear Plant Organizations, District Administration, Atomic Energy Regulatory Board & Department of Atomic Energy, Crisis Management Group in all the State where Nuclear power plants are located. Accordingly, keeping in view the observations made during workshop / Mock drills, the concerned States were requested to prepare a plan for development of the Emergency Planning zone (EPZ) around the Nuclear Power Plants, which will facilitate not only better preparedness to cope with an unlikely event of nuclear emergency but also in winning the confidence of the people around. Mock-exercises were conducted at all the 6 States where Nuclear Power Plants are operating viz; tarapur (Maharashtra), Kalpakkam (Tamilnadu), Narora (Uttar Pradesh), Kokrapar (Gujarat), Kaiga (Karnataka) and Rawatbhata (Rajasthan) during the period June-2011 to August-2011. During the Mock exercises, the need for an enhanced level of preparedness and awareness generation of the community in the event of nuclear emergency were highlighted. Further, as a result of the gaps identified during mock drills the need for revising the existing off-site emergency plans was emphasized and this has been undertaken by NDMA along with other stakeholders. (e): Nuclear plants are sited, designed, constructed, commissioned and operated as per regulatory requirements by AERB. Nuclear plants during normal operation release negligible amount of radioactivity, which contribute to maximum 0.02 mSv exposure to public in a year which is significantly lower than the radiations due to natural background. Safety provisions built into the design of the plant ensures that possibility of accidental release of radioactivity is remote. As further backup the existing emergency plans ensures the safety of the families living in and around the nuclear installations.

The total estimated budget for this project is Rs. 5.97 crore.

(d) if so, the steps taken/proposed to be taken to lessen the response time in case of disaster and the details of preparedness in this regard?

(a) to (d): No Madam, there was no lack of direction/ coordination amongst the various agencies involved in disaster management in the coastal areas in the country during recent earthquake of 11th April 2012 followed by Tsunami threat in the Indonesian sea. A threat assessment about Tsunami was made by the Indian National Centre for Ocean Information Services (INCOIS), based on the earthquake information and pre-run model for the State/ UTs of Andhra Pradesh, Andaman & Nicobar Islands, Goa, Gujarat, Karnataka, Kerala, Lakshadweep, Maharashtra, Odisha, Tamil Nadu and West Bengal. Accordingly, regular advisories were issued by this Ministry to the States/ UTs concerned to take appropriate precautionary measures and to keep close watch and monitor the situation in their areas. Government of India took immediate steps by keeping in readiness 6 teams (233 personnel) of NDRF at Hindon Airport and 6 teams (180 personnel) of National Disaster Response Force (NDRF) at Airport along with necessary equipments for deployment to the areas under Tsunami threat. The teams in other battalions of NDRF were also kept on high alert. Similarly, all the coastal States/ UTs governments activated their respective incident response teams and emergency operation centers and kept close watch on the progress of the incident. Information from the field was collected & analysed from time to time and the situation was monitored at the highest administrative level by Chief Secretaries of States/ UTs.

As such there was no failure on the part of the administration to activate the disaster management plan in the coastal areas in the country.

SUBMISSION OF AUDIT RECORDS BY NGOS 15th May, 2012

The guidelines issued by Government of India for release and utilization of said grant-in-aid outline the broad activities to be under taken by the States which include preparation of Disaster Management plans based on Hazards, Risk & Vulnerability Analysis and setting up/strengthening of emergency operation centres. State Government is required to address the Vulnerability issue of villages in their respective DM Plan. (d): A statement showing the State-wise allocation of Capacity Building Fund for the years 2010-15 given at Annexure.

(c) to (e): The following measures have been taken by the Government of India for effective disaster management:- # In order to strengthen the existing disaster management system, has enacted and notified Disaster Management Act, 2005 on December 26, 2005 to improve and provide for institutional mechanisms for drawing up and monitoring the implementation of the disaster management plans, ensuring measures by various wings of Government for prevention and for mitigating the effects of disasters as well as for undertaking a holistic, coordinated, and prompt response to any disaster situation. # As per the Disaster Manangement Act 2005, the Central Government has constituted the National Disaster Management Authority (NDMA) with the responsibility for laying down the policies, plans, and guidelines for disaster managements. NDMA has already released 16 guidelines and 10 reports on natural as well as manmade disasters and also for preparation of State disaster Management Plans. National Policy on Disaster Management (NPDM) has been issued which covers all aspects of disaster management. # Similarly State Disaster Management Authority and District disaster Management Authority have been set up in the country. # The institutional mechanism of the State Government has been networked with the early warning systems and also with the National Emergency Operation Centre for receiving and dissemination of alerts/advisories/information relating to different natural calamities. # Suitable financial arrangements to meet emergent requirements in disaster situations have been made and the State Disaster Response fund has been constituted for each of the State in the country. # Grant-in-aid for capacity building for disaster response has been allocated to the States for the period 2010-15. # National disaster Response Force (NDRF) which is a specialized Force to deal with the relief and rescue activities during disasters has been constituted and located at different parts of the country for prompt relief and rescue purposes. # Regular mock drills are being organized by the National Disaster Management Authority and the National Disaster Response Force to sensitize and bring awareness to the stakeholders about the natural disasters. # Government of India is implementing National cyclone risk Mitigation Scheme and National School Safety programme – a pilot project. Both these schemes contain structural and non-structural measures to minimize the losses. # All these steps/ measures are expected to improve the existing disaster management practices and reduce the losses & adverse impact of natural calamities in the country.

(a) to (b): The Government of India has not formulated any specific scheme for spreading awareness at village level to mitigate the impacts of natural calamities including earthquake. The Government however is implementing certain schemes which includes the component of awareness to mitigate the impacts of natural calamities including earthquakes like:- 1.National School Safety Programme to promote culture of safety in schools by undertaking Information, Education and Communication activities, promoting non-structural mitigation measures and demonstrative structural retrofitting, at an estimated cost of Rs. 48.47 crore, is under implementation. The Scheme has got awareness component of Rs.8.05 crore. 2. National Cyclone Risk Mitigation Project Phase-I at a cost of Rs.1496.71 crore to minimize the vulnerability to cyclone and making people and infrastructure disaster resilient is under implementation in the States of Andhra Pradesh and Orissa. Its one of the component envisages a framework for dissemination of cyclone warnings and advisories from the authorities to the community and to receive feedback in the event of a cyclone disaster. This two way communication system is meant to reduce the vulnerability of coastal communities by addressing the critical gaps of early warning dissemination in a timely, reliable and efficient manner and providing an opportunity to the community to communicate with the authorities in the event of cyclone emergencies. 3. Strengthening of Fire and Emergency Services has got an awareness component of Rs.4.38 crore. 4. Revamping of Civil Defence set up in the country is with an awareness component of Rs.2.60 crore. 5. Government of India has allocated Capacity Building grant for Disaster Response to the states for the period 2010-15. One of the activities which can be undertaken by the states relates to awareness generation programme of all stakeholders including villagers. 6. NDMA is carrying out awareness generation campaigns on various disasters including earthquake across the country through print and electronic media to prepare the masses during eventualities. The National Disaster Response Force has been conducting Familiarisation and Community Capacity Building and Public Awareness Programmes to spread awareness amongst local community, members of panchayati institutions/ local bodies, NCC, NSS, village volunteers and other government and non-government stakeholders. More than 18 lakh community volunteers and other stakeholders have been trained by NDRF in different parts of the country.

However, in order to tackle the situation in a comprehensive manner in the NCT of Delhi, Delhi Traffic Police have prepared a Traffic Management Plan, which is based on the principles of road safety education, regulation, enforcement and engineering solutions. Based on this Delhi Traffic Police have taken a number of steps to decongest and streamline the traffic in the NCT of Delhi, which include adopting the traffic management measures for removing traffic congestion, ensuring safe and smooth flow of traffic and reduction in road accidents and pollution, closure of cuts to ensure uninterrupted and smooth flow of traffic, construction of slip roads, restriction or movement of slow moving traffic during specific timings, installation of intelligent traffic system, E-enforcement, acquisition of modern enforcement equipments such as Radar Speed Measurement Devices, Interceptors, Breath Analyzers etc

TREES IN NDMC AREA

(a) & (b): No, Madam. New Delhi Municipal Council (NDMC) has informed that concretization of pavement around trees is discouraged and generally kucha space of 6’X6’ is left around the tree. Further, digging near tree for utility services is permitted only in exceptional cases. (c) to (e): The NDMC is taking a number of measures for protection of trees and maintaining greenery in the area, which include providing adequate resources to its Horticulture Department to take care of maintenance and health of trees; purchase of tree ambulance; taking assistance of the Forest Research Institute, Dehradun to take stock of health of trees; taking preventive measures so that trees are not uprooted; planting new saplings; replacing the casualties by grown up saplings as well as by second avenue plantation; permitting open trench, only in exceptional circumstances, etc.

(a) & (b): Disaster Management Act, 2005 mandates the National Disaster Management Authority (NDMA) for laying down guidelines to be followed by the State Authorities in drawing up the State Plan and by the different Ministries or Departments of the Government of India for the purpose of integrating the measures for prevention of disaster or the mitigation of its effect in their development plans and projects. It has no specific mandate for review of the implementation of guidelines. The NDMA however has issued 18 disaster specific guidelines so far. (c) to (d): There is no specific guideline on disaster trauma care. However, NDMA has issued Guideline on “Medical Preparedness and Mass Casualty Management” during October, 2007, which emphasises for institutional strengthening and capacity building for trauma care management. Its salient features include:- # Detailing the role of major stakeholders in Medical Preparedness and Mass Casualty Management (MPMCM) [includes pre-hospital (onsite) care as well]. # Establishment of effective emergency medical response including pre-hospital care and trauma management at the incident site such as establishment of incident command posts and rendering care during the first few “golden hours”. # Transportation of mass casualties during disasters.

# Institutional strengthening (Training of related Human resources). # Capacity building of community in first response, basic life support and initial trauma care. # Networking of critical care facilities at earmarked hospitals and trauma care- with referral linkages. # Hospitals including strategies to make them risk resilient. # Specialised incident – site and hospital capabilities to handle Chemical, Biological, Radiological and Nuclear (CBRN) casualties. # Setting up of trauma centres at regional levels. # Networking of Blood Banks and Laboratory services network. # Psychosocial support and mental health services. # Epidemiological surveillance and Public health measures for containment of disease outbreaks. # Adoption of new technologies used for effective mass casualty management.

(a): The amount of foreign contribution received by Associations registered and Associations that were granted prior permission under the Foreign Contribution (Regulation) Act, 2010 during the last 3 years are given below:- Year Total amount of foreign contribution received 2008-2009 Rs.10993.58 Crore 2009-2010 Rs.10430.59 Crore 2010-2011 Rs.10303.59 Crore

As far as foreign contribution received in 2011-12 are concerned, the same are still under compilation as the last date for submission of annual accounts by the NGOs is 31.12.2012. Similarly, details about the current year cannot be finalized at this stage. State-wise details of foreign contribution received are given at Annexure- ‘A’.

(b) to (d): As regards complaints of misuse of funds, action has been taken from time to time against certain NGOs in case of violations of various types. The steps taken include (i) cancellation of registration of 4349 NGOs, (ii) placing 35 NGOs in ‘prior permission’ category, (iii) freezing accounts of 32 NGOs and (iv) prohibition on 72 NGOs from receiving foreign funds. Action has also been initiated in case of complaints of corruption in the monitoring mechanism.

The Government monitors the receipt and utilisation of foreign contribution received by any ‘person’ including Non-Governmental Organisations in the country in terms of the Foreign Contribution (Regulation) Act, 2010 and the Rules framed under the Act.

The FCRA, 2010 provides for NGOs to receive foreign funds after registration or prior permission. Every application of NGOs for registration or granting Prior Permission is decided with inputs from the concerned security agencies. The NGOs who have been registered/ given prior permission for receiving foreign funds are required to submit annual accounts. These are scrutinized and wherever required, physical inspection is conducted. Based on the findings of the inspection team, appropriate action is taken.

The organizations receiving foreign contribution are required to submit Annual Accounts for each financial year within a period of nine months from the closure of the financial year i.e. by 31st December. Such Annual Accounts are to be submitted in the prescribed format duly audited by a Chartered Accountant. FCRA provides for a reporting mechanism by the recipients of foreign contribution as well as by the Banks.

Steps taken for ensuring filing of annual returns include sending of notices to defaulting organizations, cancellation of registration certificates and inspection of the accounts.

(e): On the basis of the complaints received in the past and enquiries made, 24 cases have so far been referred to CBI and 10 cases have been referred to State Police for investigation.

FIRE SAFETY IN BUILDINGS 14th August, 2013

(a): All the high rise buildings constructed in Delhi authorizedly as permitted by the building sanctioning authority NDMC have clearance from the Delhi Fire Service (DFS) after the enforcement of Delhi Building Bye-Laws,1983. The buildings constructed prior to 1983 were also inspected under the provisions of Delhi Fire Prevention and Fire Safety Act, 1986 and Rules, 1987 and issued NOC after the compliance of the provisions.

(b): On the directions of Honorable Delhi High Court in the matter of Shri B.L Wadhera v/s Govt. of NCT of Delhi, a survey was conducted by DFS and 2377 buildings were identified, which did not have NOC from DFS. Out of these 2377 buildings, 145 buildings were in NDMC area. All these buildings were served notices and action was taken in compliance with the direction of Hon’ble Delhi High Court.

(c) to (e): The Government of Delhi has enacted Delhi Fire Service Act, 2007 and Rules, 2010 which is more comprehensive legislation concerning fire and life safety in high-rise buildings in Delhi and this Act and Rules have come into force with effect from 01.07.2010 and the construction of high rise buildings in Delhi would be better monitored from fire safety point of view.

REPORT OF NIDM AND MCD ON ILLEGAL CONSTRUCTIONS 14th August, 2013

f) the measures taken to check illegal constructions in the NCT of Delhi in future?

(a) & (b): The Commission of Inquiry, constituted by the Government of NCT of Delhi, to look into an incident of collapse of building at Lalita Park, Laxmi Nagar, Delhi on 15th November, 2010, had assigned the National Institute of Disaster Management (NIDM) the vulnerability survey of buildings in Trans-Yamuna area. The Institute conducted the survey of buildings by Rapid Visual Screening and submitted its report to the Commission of Inquiry on 11th August, 2011, which was included as an annexure in the final report of the Commission of Inquiry.

(c) & (d): Whenever any unauthorized construction comes to notice, action is taken against it under the provisions of the Delhi Municipal Corporation Act, 1957. Action taken against the unauthorised constructions during the last three years and the current year in Trans-Yamuna area of Delhi is as under: Number of properties booked for demolition 3250 Number of properties sealed 437 Number of properties demolished 3919

(e): The Municipal Corporation of Delhi (MCD) has informed that during the last three years and the current year (up to 08.08.2012), 16000 complaints have been received regarding unauthorised constructions. However, on the basis of gravity of the allegations made, 475 complaints were taken up for investigation by its Vigilance Department. During the aforementioned period, 395 Engineers of MCD were proceeded against departmentally for allowing unauthorized constructions.

(f): Whenever any unauthorized/illegal construction is noticed, action against it is taken by the Building Department of the respective Zone as per provisions of the Delhi Municipal Corporation Act, 1957. Recently, the infrastructure for detection and control of unauthorized/illegal constructions in Delhi has been revamped. In this context, a number of measures have been taken which include restructuring and strengthening of Central Control Room, Zonal Control Room, Demolition Squad etc.In addition, a Nodal Steering Committee has been set up by the Hon’ble High Court of Delhi to monitor actions against unauthorized/illegal constructions.

IMPLEMENTATION OF DISASTER MANAGEMENT ACT 14th August 2012

(a) to (d): Yes Madam. A Task Force has been constituted on 23rd December, 2011 for review of the Disaster Management Act, 2005 under the Chairmanship of Dr. P.K. Mishra, former Secretary, Department of Agriculture & Cooperation, Ministry of Agriculture, Government of India and presently Chairman, Gujarat Electricity Regulatory Commission, Gujarat. The mandate of the Task Force is as under:- (i) To gather information from States/UTs/other Stakeholders regarding concerns/limitations being faced by the States/UTs in implementation / administration of the Disaster Management Act, 2005. (ii) To study the existing such Acts/best practices on the subject globally and consider its adoption in Indian scenario. (iii) To consult and hold workshops on Regional/National levels to discuss with States/UTs/other Stakeholders regarding the implementation/administration of the Act in the States/UTs and the imperative need, if any, towards amendments in the Disaster Management Act, 2005. (iv) To suggest necessary modifications/amendments, if any, in the Disaster Management Act, 2005 based on suggestions and deliberations with States/UTs/other Stakeholders. The Task Force has circulated the questionnaire for seeking comments/ views of all the stakeholders including the State Governments and Union Territories on DM Act, 2005. It has held consultations with representatives of the State Governments/UT Administrations/State Disaster Management Authorities at Regional Workshops held on 30.4.2012 at Shillong (NE states), 24.5.2012 at Hyderabad (Southern states), 1.6.2012 at Ahmedabad (Western States), 76.2012 at Chandigarh (Northern States) and 11.6.2012 at Bhubaneshwar (Eastern States).It has also held consultations/ discussions with National Disaster Management Authority (NDMA), National Institute of Disaster Management (NIDM), Department of Agriculture & Cooperation, Ministry of Agriculture, Department of Expenditure, Ministry of Finance, National Executive Committee (NEC), Ministry of Home Affairs and NGOs, UN and other International Agencies.

The Task Force is expected to finalize and submit its report to the Government by 30th September, 2012 for appropriate action.

(a) & (b): Yes Madam. The details of losses to lives, livestock, property and crops due to natural calamities including floods, as reported by the State Governments during the last three years and the current year is given at Annexure. (c) & (d): During the current year, State Government of Assam has submitted a memorandum so far. Upon receipt of a memorandum from Government of Assam, an Inter-Ministerial Central Team visited the affected areas from 10th to 12th July 2012 for on-the-spot assessment of damages caused by the flood of 2012. The report of the Team is being processed for placing before Inter-Ministerial Group and High Level Committee (HLC) for consideration. (e) Government of India, in order to strengthen the existing disaster management system has enacted and notified Disaster Management Act, 2005 on December 26, 2005 to improve and provide for institutional mechanisms for drawing up and monitoring the implementation of the disaster management plans, ensuring measures by various wings of Government for prevention and for mitigating the effects of disasters as well as for undertaking a holistic, coordinated, and prompt response to any disaster situation. It is also mentioned that the Schemes for flood control are planned, funded, and executed by the State Governments concerned. The role of the Central Government is of a technical, catalytic and promotional nature. However, a State Sector Scheme of the Ministry of Water Resources Flood Management Programme with an outlay of Rs.8000/- crores has been approved by the Central Government, in November, 2007, for providing Central assistance to the State Governments for critical flood management and erosion control works. All these steps/ measures are expected to improve the existing disaster management practices, mitigation, control, check such recurrence of natural calamities and reduce the losses & minimize the adverse impact of natural calamities including flood in the country.

(a) & (b): No, Madam. NATGRID was set up as an attached Office of the Ministry of Home Affairs with effect from 1.12.2010. Further, Cabinet Committee on Security (CCS) has “in-principle” approved the Detailed Project Report (DPR) of NATGRID on 06.06.2011. Planning Commission has also accorded its ‘In Principle’ approval to the project on 8th July, 2011, as a ‘Central Plan Scheme’ under MHA from 2011-12. CCS approved the DPR on 14-6-2012 for an amount of Rs. 1002.97 crores for implementation of Foundation, Horizon-I and some elements of Horizon-II of the NATGRID Project. Work on the foundation and the first horizon of NATGRID is in progress. (c) to (d): No, Madam. NATGRID is headquartered at New Delhi and no branch / operational centre outside Delhi is envisaged. However, the Disaster Recovery Centre of NATGRID is proposed to be located outside Delhi.

(c) to (d): Following the implementation of recommendation of XIII th Finance Commission with regard to its awards of grant to the States for response and relief, the Government of India taking into account various factors including price rise etc. have recently revised the items & norms of assistance from State Disaster Response Fund (SDRF) and the National Disaster Response Fund (NDRF), on 16th January 2012. STATEMENT IN REPLY TO PARTS (a) TO (d) OF LOK SABHA STARRED QUESTION NO. 233 FOR 28.8.2012

(a) & (b): The Government of India has revised items and norms of assistance from Calamity Relief Fund (CRF) now renamed as State Disaster Response Fund (SDRF) and National Calamity Contingency Fund (NCCF) now renamed as National Disaster Response Fund (NDRF) on 16th January, 2012 in consultation with the State Governments/Union Territories and concerned Central Ministries/Departments. Few proposals for amendment of norms have been received from the State Governments and are under examination.

While no proposal for amendment of norms per-se has been received from Kerala, the State Government (among other States) have been moving proposals to include coastal erosion and lightning strikes in the list of natural calamities eligible for assistance under SDRF. These events, after due examination have not been included in the list of eligible events for purpose of assistance. Kerala and all other States have accordingly been requested to meet the expenditure on these events from out of their own resources. Inclusion of the events like cold wave and frost have, however, been considered eligible by Government of India and have been notified (on 13th August 2012) as eligible events for assistance under SDRF/ NDRF.

(c) to (d): Section 14 and 25 of the Disaster Management Act, 2005 (DM Act, 2005) mandate every State Government for establishing State Disaster Management Authority (SDMA) in the State and District Disaster Management Authority (DDMA) for every district in the State respectively. As per information received from various State Governments and Union Territory administrations all the States and UTs except Gujarat and Daman Diu have established SDMAs and DDMAs under DM Act, 2005. Gujarat State has constituted Gujarat State Disaster Management Authority under the Gujarat State Disaster Management Act, 2003 with effect from 1.09.2003. District Disaster Management Authorities have not yet been established in Gujarat. The Union Territory of Daman and Diu has also established a State Disaster Management Authority and District Disaster Management Authority prior to enactment of DM Act, 2005.

PREPAREDNESS FOR NATURAL CALAMITIES 28th August, 2012

(a) whether the Government in collaboration with the States including Maharashtra has finalised the preparation for dealing with natural calamities including earthquakes;

(b) if so, the details of the said preparation along with the quantum and sources of funds established to meet the relief and rehabilitation works, State‐wise;

(c) whether any coordination has been established between various agencies including weather forecasting agencies for making advance warnings about natural disasters; and

(d) if so, the details thereof?

(a) & (b): Measures taken towards Disaster Management in the country including Maharashtra are integral part of such initiatives taken by the Government of India for preparedness, prevention, mitigation, response, recovery, reconstruction and rehabilitation. Appropriate institutional mechanisms in the form of State Disaster Management Authority and District Disaster Management Authority have been setup in the country to develop appropriate preparedness and response mechanism in disaster situation. These setups have also been networked with the early warning system and also with the National Emergency Operation Centre for receiving and dissemination of alerts/ advisories/ information relating to the natural calamities. Ten battalions of National Disaster Response Force (NDRF) including one Pune, Maharashtra have been deployed throughout the country specifically for relief and response during disaster.

The States have also been encouraged to develop State Disaster Response Force (SDRF).

Financial mechanism in the form of State Disaster Response Fund has been institutionalized for disaster relief and response. A statement showing State-wise allocation for the period 2010-11 to 2014-15 is given at Annexure–I. Further for raising the capacity of the states to meet the disaster situation, a capacity development grant has been allocated for the period of 2010-11 to 2014-15. State-wise allocation of capacity development grant is given at Annexure-II.

(c) to (d): With regard to coordination between various agencies including weather forecasting agencies, it is mentioned that the advance warning is provided by the forecasting agencies of Government of India on real time basis for the impending natural disasters to all the concerned stakeholders for taking appropriate precautionary measures. Forecasting about climate change is pre requisite for taking preparedness measure to respond to the disaster is the most important element of disaster management. For this purpose the Government of India has designated the following offices as the nodal agencies for advance warning of different natural hazards: -

ENVIRONMENTAL CLEARANCE FOR BORDER PROJECT 28th August, 2012

CYCLONE RELIEF TO TAMIL NADU

(a) to (b): In the aftermath of cyclone ‘Thane’ the Government of India released an amount of Rs. 523.977 crore, from National Disaster Response Fund (NDRF) to the State Government for undertaking relief measures in the affected areas of the State. Further, the entire Central share of State Disaster Response Fund (SDRF) amounting to Rs. 231.15 crore has also been released to the State Government.

Financial assistance has also been extended to the Union Territory of Puducherry, by releasing an amount of Rs. 125/- crore for undertaking relief measures in the cyclone ‘Thane’ affected areas of the UT.

As per the scheme of SDRF/ NDRF, the State Government is responsible to ensure that money drawn from the SDRF/ NDRF account is actually utilized for the purposes for which the same has been set up and only on item of expenditure and as per norms approved by the GOI. The State Accountant General is required to monitor the expenditure and Comptroller & Auditor General of India causes audit of SDRF/ NDRF every year in terms of the scheme of the SDRF/ NDRF.

NDMA GUIDELINES IN FIRE FIGHTING 28th August 2012

(a) whether the National Disaster Management Authority (NDMA) has issued any fresh guidelines for firemen and adoption of new technologies for fire fighting; (b) if so, the details thereof and the steps taken by the Government to ensure adoption of new technologies by the State Governments; (c) whether fire stations in the country particularly in cities lacks fire fighting capabilities; (d) if so, the details thereof along with the action taken by the Union Government to assist the State Governments in procuring fire fighting equipments, adoption of new technologies, training etc. ; and (e) if so, the details thereof and if not, the reasons therefor?

(a): Yes, Madam. (b): The National Disaster Management Authority has recently issued guidelines on scaling, type of equipments and training of Fire Services. Fire Services is a State subject and has been included as a municipal function in the XII Schedule of the Constitution of India in terms of Article 243-W. As such, it is the primary responsibility of the State Governments to take necessary action to adopt these guidelines and allocate sufficient resources for strengthening and equipping Fire Services. (c): Yes, Madam. (d) to (e): In view of (b) above, it is for the States to strengthen their Fire Services by procuring fire fighting equipments and to adopt new technologies etc. However, in order to support the State Governments, the Government of India is implementing a Centrally Sponsored Scheme at a cost of Rs. 200 crore for `Strengthening of Fire & Emergency Services in the Country`. The Scheme attempts to fill the existing gaps in the fire fighting and rescue capability through introduction of modern technology such as Advanced Fire Tenders, High Pressure Pump with Mist Technology, Quick Response Team Vehicle, Combi Tools for Search & rescue and capacity building of various stakeholders. In addition, Government of India is also upgrading National Fire Service College, Nagpur at a cost of Rs. 205 crore to strengthen the institutional capacity for meeting the requirement of trained fire personnel. 13th Finance Commission has also recommended an allocation of Rs. 472 crore to the 7 States namely Andhra Pradesh (Rs. 17 crore), Haryana (100 crore), Mizoram (Rs. 20 crore), Odisha (Rs. 150 crore), Tripura (Rs. 15 crore), Uttar Pradesh (Varanasi, Rs. 20 crore) and West Bengal (Rs. 150 crore) for strengthening of Fire & Emergency Services. Government of India has already released 1st installments of the grant of Rs. 124.39 crore to the above mentioned 7 States.

REMOVAL OF HOARDINGS 4th September, 2012

(a) whether the Supreme Court has issued any directives regarding removal of hoardings/advertisements in the National Capital Territory of Delhi;

(b) if so, the details thereof and the reaction of the Delhi Government in this regard;

(c) the role of the Union Government in removing the hoardings/ advertisements along the National Highways passing through Delhi; and

(d) the steps taken/being taken to remove such hoardings?

(a) & (b): Yes, Madam. In its order dated 20.11.1997 in CWP No.13029/85, titled Shri M. C. Mehta Vs. Union of India & Others, Hon’ble Supreme Court directed the civic authorities of Delhi including Delhi Development Authority, the Railways, the police and transport authorities to identify and remove all hoardings which are on road sides and which are hazardous and a disturbance to safe traffic movement. This was reiterated by Hon’ble Supreme Court in their order dated 10.12.1997. Subsequently, in the order dated 12th October, 2007 in the aforementioned Writ Petition, Hon’ble Supreme Court approved an outdoor advertisement policy for the city of Delhi. The said policy provides for guidelines for display of advertisements through different kind of advertising devices, classified into four categories, with certain restrictions, while some of the advertisement modes have not been permitted for display of advertisements. The Municipal Corporation of Delhi (MCD) was directed to implement the policy.

The Hon’ble Supreme Court in their order dated 08.10.2010 directed MCD to consider two reports submitted by Environment Pollution (Prevention & Control) Authority (EPCA) and to place its decision in this regard before the Hon’ble Court. The decision of the Corporation has been submitted to the Hon’ble Court and the matter is sub judice.

(c): As per provisions contained in Section 143 of the Delhi Municipal Corporation Act, 1957 and Section 89 of the New Delhi Municipal Council Act, 1994, no advertisement can be displayed in public view, visible from a public street/public place, in any manner, whatsoever at any place within Delhi, without the permission of the Commissioner of the Delhi Municipal Corporation or the Chairperson of the New Delhi Municipal Council, within their respective jurisdictions. As per extant policy of Ministry of Road Transport & Highways, no advertisement hoardings are permitted on National Highways within the Right of Way except informatory signs of public interest such as hospitals, bus stations, etc. or advertisement of temporary nature announcing local events such as Mela, Flower Show, etc. Under the policy of private sponsorship of road signs and greening of National Highways, the private entrepreneurs are allowed to depict the name/logo of their company in a sign of specified dimension. Instructions are issued to executing agencies from time to time for removal of unauthorised hoardings.

(d): Action against illegal hoardings is a continuous process and the same is taken on regular basis through various administrative and legal instruments. The steps taken by the Delhi Municipal Corporations to discourage display of unauthorised advertisements include launching the Zero Tolerance Campaign for removal of unauthorised advertisements, banners, posters, etc; imposing penalties on unauthorised displays; monitoring new events in the city displaying outdoor advertisements and taking action against them if their displays are found to be unauthorised; etc.

STATIONING OF NDRF 4th September, 2012

(a) whether the National Disaster Management Authority(NDMA) had recommended stationing of National Disaster Response Force (NDRF) teams at the capitals of all the North Eastern States including Sikkim and at Port Blair and Srinagar to tackle earthquake disaster;

(b) if so, the details of these recommendations;

(c) Whether the NDRF teams have been stationed at these cities including Gangtok as recommended by the NDMA;

(d) If so, the details thereof and if not, the reason there for;

(e) whether there was a considerable delay for NDRF teams in reaching the earthquake affected areas of Sikkim during the recent earthquake; and

(f) If so, the details thereof along with the reasons for delay in deployment of NDRF personnel in the said area?

The proposal has been examined in Ministry of Home Affairs in the light of Vulnerability profile of the country as well as air/road connectivity and permanent locations of NDRF teams have been approved for Aizawl (Mizoram), Itanagar (Arunachal Pradesh), Gangtok (Sikkim), Siliguri (West Bengal), Baleswar (Odisha), Portblair (Andaman & Nicobar), (Karnataka), Gandhinagar (Gujarat), Barmer (Rajasthan), Srinagar (J&K), Kangra (Himachal Pradesh), Lucknow (Uttar Pradesh), Varanasi (U.P.),Supaul (Bihar),Hyderabad, Vishakhapatnam (Andhra Pradesh) and Chemical, Biological, Radiological, Nuclear teams of NDRF at Delhi ,Kolkata, and Chennai. These teams will be stationed at the respective locations only after the State Governments/ Union Territory provide suitable land/accommodation to house them.

(e) to (f): There was no delay on the part of NDRF to respond to Sikkim earthquake. Five teams each of NDRF from Hindon airbase and Kolkata moved to Bagdogra on intervening night of 18/19 Sept, 2011 for onward movement to Gangtok. However due to landslide on the road between Bagdogra to Gangtok and also non availability of airlift facilities due to bad weather conditions, there was some delay in further movement of NDRF personnel in the affected areas of Sikkim

(a) & (b): All three Delhi Municipal Corporations conducted tests of drinking water regularly at consumer end individually as well as jointly with Delghi Jal Board (DJB). Drinking water samples are tested for presence of free chlorine and bacteriological examination. During the current year, out of 31122 samples tested for free chlorine, 2319 samples were found unifit & out of 950 samples tested for bacteriological contamination, 337 samples were found unifit.

(c) & (d): The Reports regarding all bacteriologically unfit samples are communicated to DJB for necessary corrective measures and DJB takes action as per the law.

(e): The quality a water is ensured strictly as per standards of BIS 10500-2003 before supplying to the citizens of Delhi. Daily about 400 water samples are collected from the consumer end from various parts of the city. These samples are tested in six laboratories for physico-chemical and bacteriological parameters for ensuring quality.

(a) to (d): The Directorate of Local Bodies, Government of NCT of Delhi has informed that the Horticulture Department of the erstwhile Municipal Corporation Delhi (now North, South and East Delhi Municipal Corporations) had planted 6,39,659 saplings on roads, roundabouts, etc in its jurisdiction during the Commonwealth Games, 2010. The total expenditure incurred in this regard was Rs.2.77 crore. The plantation was maintained by the Corporation and watering was done by using departmental tankers. No additional expenditure was incurred on maintenance. It has further been informed that maintenance was up- to-date and proper till these roads were handed over to the Public Works Department of the Government of NCT of Delhi in February-March, 2012.

(a): During the last three years foreign contribution received by Associations registered and Associations that were granted prior permission under the Foreign Contribution (Regulation) Act, 2010 (FCRA) are given below:-

(b): The names of NGOs whose cases have been referred to Central Bureau Investigation and State Police for investigation are given at Annexure –III and IV respectively.

(c) & (d): The Government monitors the receipt and utilisation of foreign contribution received by any ‘person’ including Non-Governmental Organisations in the country in terms of the Foreign Contribution (Regulation) Act, 2010 and the Rules framed under the Act.

The FCRA, 2010 provides for NGOs to receive foreign funds after registration or prior permission. Every application of NGOs for registration or granting Prior Permission is decided with inputs from the concerned security agencies. The NGOs who have been registered/ given prior permission for receiving foreign funds are required to submit Annual Accounts for each financial year within a period of nine months from the closure of the financial year i.e. by 31stDecember. Such Annual Accounts are to be submitted in the prescribed format duly audited by a Chartered Accountant. FCRA provides for a reporting mechanism by the recipients of foreign contribution as well as by the Banks. These are scrutinized and wherever required, physical inspection is conducted. Based on the findings of the inspection team, appropriate action is taken.

OBJECTION OVER FENCING 27th November, 2012

(a) The State Government of Mizoram has not objected to the construction of fence, road and composite Border Out Posts (BOPs) on Indo-Bangladesh Border. Out of sanctioned length of 349.33 Km. for border fencing, work to the extent of 208.27 Km. has been completed and the balance work is in progress. However, the State Board for Wild Life of Mizoram has objected the proposal for construction of fencing, road and 07 BOPs in 56.53 Km., which falls under Dampa Tiger Reserve (DTR) forest area on Indo-Bangladesh Border.

(b): The proposal for construction of fencing, patrol road and 07 composite BOPs along the DTR has already been permitted by the Hon’ble Supreme Court subject to clearance from Standing Committee of National Board of Wild Life(NBWL). Based on the recommendations of the NBWL, a detailed survey was conducted by BSF along with officials from State Revenue Department, Wild Life and construction agencies on 1.12.2011 and on subsequent dates. The Survey Team had recommended diversion of approximately 1519.17 Hectare of land for construction of fence, road and 07 BOPs. However, State Board for Wild Life have objected to the proposal on the following grounds:-

(i) Fencing will restrict movement of wild animals to and fro Bangladesh.

(ii) Construction of road and fencing disturbs the sanctity of the lone Tiger Reserve of the State.

(iii) Construction of 07 BOPs (with about 33 security personnel in each) inside fencing will significantly undermine the security and habitat of wild animals.

(iv) There is no concrete and reliable report on movement of insurgents/illegal immigrants from Bangladesh through this land stretch within Dampa Tiger Reserve.

(c): The proposal of the State Board for Wild Life of Mizoram was discussed during the 26th meeting of Standing Committee of NBWL on 31.10.2012 under the Chairmanship of the Hon’ble Minister of State(Independent Charge) for Environment and Forest and after deliberations, the agenda was deferred for further evaluation as the project is required to be undertaken to address the issue of national security and protection of wild life.

COMPENSATION UNDER NDRF 27th November, 2012

(d) whether there is any proposal to revise the method of assessment to make it more realistic; and

(a) to (e): No Madam. As per the guidelines on administration of National Disaster Response Fund (NDRF), the relief assistance from NDRF to the affected individuals including farmers is considered on the basis of memorandum submitted by the State Governments for the sector-wise damages caused due to natural calamities to the Central Government. Based on the memorandum an Inter Ministerial Central Team (IMCT) is deputed for making on the spot assessment of the damages in the affected areas. Thereafter report of the IMCT is processed for approval of the High Level Committee.

The financial assistance from NDRF is towards relief & not for compensation of loss. The main objective of the relief fund is to assist the affected persons to start their economic activities again and the relief is by way of gratuitous assistance as an immediate help to overcome the stress.

The expenditure from relief fund is to be incurred in accordance with the items and norms of assistance approved by the Government of India for the notified natural calamities only. As per the revised item & norms of assistance from SDRF and NDRF, which have been circulated on 16th January 2012 and further modified on 28th September 2012, the extant norms inter-alia provide for assistance to the farmers in the form of Agriculture input subsidy for damage caused to crops due to the notified natural calamities only. Further there is no proposal to revise the methods of assessment at present. Details of assistance admissible to Farmers in various sectors for the damage caused due to natural calamities as per extant items & a norm is at Annexure.

(a) whether the Government has taken cognizance of death of innocent children due to fall in bore wells pitches across the country;

(c) the steps taken by the Government to check illegal boring of wells in future?

(a) to (c): There have been some reported incidents of death of innocent children due to fall in bore wells across the country.

As per information provided by National Crime Records Bureau (NCRB), data on death of innocent children due to fall in bore wells is not maintained by NCRB.

As per information provided by Central Ground Water Board information on accidents caused due to open bore wells in various states is not maintained centrally. However, as per the information obtained by the Board from the State Governments, no such incidents have been reported in respect of bore wells drilled by Government agencies.

As per Seventh Schedule, ‘Police’ and ‘Public Order’ are State subjects under the Constitution, and as such the primary responsibility of prevention, detection, registration, investigation and prosecution of crimes, including crimes against children, lies with the State Governments and Union Territory Administrations. However, the Union Government attaches highest importance to the matter of prevention and control of crime against women and children.

The Supreme Court has issued directives in the year 2010 to Chief Secretaries/ Administrators of all the States/ Union Territories to adopt certain measures such as registration of drilling agencies, capping the wells properly, erection of signboards and fencing, filling of pits and channels after completion of drilling operation, filling of abandoned wells by clay/ sand/ boulders/ pebbles etc, Further, the owner of land/premises, before taking any steps for constructing borewell / tubewell must inform in writing in advance to the concerned authorities in the area in this regard. The Supreme Court has also directed that in rural areas, monitoring of the safety status of the borewells / tubewells drilled should be done through village sarpanch and the executive from the Agriculture department and in urban areas through Junior Engineer and the executive from the concerned department of Groundwater/ Health/ Municipal Corporation etc.

COMPENSATION TO FARMERS’ 4th December, 2012

(d) if so, the details thereof and the response of the Government thereto;

(e) whether the Government has put restrictions on number of crops, type of crops to be cultivated and movement of farmers along the border; and

(a) & (b): As per the available records, the land compensation for fencing along Indo-Pakistan Border except Jammu Sector, has been paid by the Government. In Jammu Sector, about 44 feet wide strip of land along 179 km. had been occupied for which compensation has not been paid so far.

(c) & (d): No such demand has been received from the Government of Punjab with respect to land acquired for fencing. However, the Government of Punjab has requested the Government of India to pay annual compensation for loss of income on account of restricted access to their land between international border and border fencing. State Government has been requested to give specific details of the said land along with the ownership details.

(e) & (f): In Punjab, crops like sugarcane, cotton and mustard etc. having height of more than 4 feet are restricted for cultivation ahead of fencing due to security reasons and to have clear observations ahead of fence, maintain vigil on the activities of anti-national elements and Pak Rangers.

Farmers whose lands are ahead of fencing are allowed to cultivate land everyday from 0700 hrs. during summer season and from 0800 hrs. to 1630 hrs. in winter season. However, during harvesting/sowing, due relaxation for opening/closing of fencing gates is given to farmers after consultation with them.

EXPLOITATION OF TRIBALS

(a) whether complaints of exploitation of tribals by the naxalites in tribal areas have been received; (b) if so, the details of such cases reported during the current year, State-wise; and (c) the steps taken by the Government to prevent exploitation of tribals and to provide them security?

(a) & (b): Yes, Madam. Several instances of exploitation of tribal communities by the naxalites has come to the notice of the government. Such instances primarily include sexual exploitation in Maoist camps, which have been disclosed through statements of several surrendered women CPI (Maoist) cadres of Odisha, Maharashtra, Bihar, Jharkhand and other States. This has been widely reported in the media also from time to time. Such instances of sexual exploitation include rape, forced marriage and molestation by senior male CPI (Maoist) cadres. In Chhattisgarh, some surrendered CPI (Maoist) male cadres have disclosed that they were forced by the senior leadership to undergo vasectomy operations as a pre-condition for marriage with women cadres. During an operation launched by the Border Security Force (BSF) in January, 2012 at a naxal hideout in Niliguda forest, PS Podia, District Malakangiri, Odisha, a large number of pregnancy test kits, condoms, contraceptive pills, etc. were recovered. Such recoveries have also been made in other States. There are allegations that women cadres of CPI (Maoist), who become pregnant, are forced to undergo abortion against their will. The surrendered women cadres have also disclosed that even if they are married to male cadres, they are not allowed to give birth to children since the senior leadership of the CPI (Maoist) feel that it impairs their fighting capability and mobility. Further, forced recruitment of children from families of poor and marginalized segments of the society by the Maoists has also come to notice. In order to instill a sense of fear in their areas of dominance, the naxals also kill civilians after branding them as police informers. Out of 5745 civilians killed by the Maoists since 2001, the overwhelming majority are tribals. The Maoists have in reality killed thousands of innocent Adivasis, whose cause they profess to espouse. This tragic reality is glossed over by the Maoist Front organizations and their apologists in towns and cities who have launched a propaganda war against the Indian state.

(c): The aforesaid problem has to be seen in the overall context of the LWE insurgency. The Central Government closely monitors the LWE situation and supplements the efforts of the State Governments over a wide range of issues, both on the security and development fronts. These measures include deployment of Central Armed Police Forces (CAPFs), help to State Governments towards capacity building of State Forces and implementation of a wide range of development schemes in LWE affected States. The State Governments initiate legal action when they receive complaints of exploitation of tribals, under the relevant provisions of law. As regards forced recruitment of children, the matter was brought to the notice of the National Commission for Protection of Child Rights (NCPCR), which is implementing ‘Bal Bandhu Project’ in areas of civil unrest. In order to prevent exploitation of tribals, the Government of India also issues advisories to the State Governments from time to time. The Union Government has recently advised the State Governments to consider facilitating vasectomy reversal operations of willing Maoist cadres who were forcibly sterilised. The Government has also enacted the Scheduled Tribes and other Traditional Dwellers (Recognition of Forest Rights) Act, 2006 to recognize and vest the forest rights and occupation in forest land in forest dwelling scheduled tribes and other traditional forest dwellers, who have been residing in such forests for generations, but whose rights could not be recorded. The Ministry of Tribal Affairs have issued comprehensive guidelines to the State/UT Governments for expeditious recognition of forest rights. The Ministry of Environment and Forests has also written to the Chief Ministers of all States to treat bamboo as a minor forest produce and respect the rights accrued to communities as per the aforesaid act.

CLEARANCE FOR RURAL ROADS 11th December 2012

ASSISTANCE FOR CYCLONE MITIGATION 11th December, 2012

(a): Yes, Madam.

(b) & (c): The total cost of National Cyclone Risk Mitigation Project (NCRMP) (PHASE‐I) is Rs. 1496.71 crore out of which Rs. 1198.44 crore are to be provided by the World Bank as an Adaptable Programme Loan and the balance Rs. 298.27 crore is to be contributed by the states of Andhra Pradesh and Odisha. The project envisages to strengthen the structural and non‐structural cyclone mitigation efforts to reduce the cyclone risk and vulnerability with the following principal components.

(i) Last Mile Connectivity for dissemination of Cyclone warnings,

(ii) Structural and Non‐Structural Measures. Structural measures such as multipurpose cyclone shelters, roads to habitation and cyclone shelters, bridges and Saline embankments work. Non‐structural measures such as Shelter Belt Plantation and Capacity building of the community,

(iii) Technical Assistance for Cyclone Hazard Risk Mitigation, Capacity Building and knowledge Creation,

(iv) Project Management and Implementation Support.

The Government of India has so far released Rs. 187.10 crore to provide relief to the cyclone affected areas out of which Rs. 72.80 crore has been utilized by the State Governments of Andhra Pradesh and Odisha.

(a): The Government monitors the receipt and utilisation of foreign contribution received by any ‘person’ including Non‐Governmental Organisations in the country in terms of the Foreign Contribution (Regulation) Act, 2010 and the Rules framed under the Act.

(b): The FCRA, 2010 provides for NGOs to receive foreign funds after registration or prior permission.Every application of NGOs for registration or granting Prior Permission is decided with inputs from the concerned security agencies. The NGOs who have been registered/given prior permission for receiving foreign funds are required to submit annual accounts. These are scrutinized and wherever required, physical inspection is conducted. Based on the findings of the inspection team, appropriate action is taken.

The organizations receiving foreign contribution are required to submit Annual Accounts for each financial year within a period of nine months from closure of the year i.e. by 31st December. Such Annual Accounts are to be submitted in the prescribed format duly audited by a Chartered Accountant. FCRA provides for a reporting mechanism by the recipients of foreign contribution as well as by the Banks.

Steps taken for ensuring filling of annual returns include sending of notices to defaulting organizations, cancellation of registration certificates and inspection of the accounts.

(c) & (d): In order to make the activities of the NGOs transparent, the Government has displayed or uploaded lists of associations in the following categories on the website of the Ministry of Home Affairs:

(1) Association whose cases referred to Central Bureau of Investigation

(2) Associations whose cases referred to State Police for investigation

(3) Associations prohibited from receiving foreign contribution

(4) Associations placed under prior permission category

SECURITY TO HYDRO POWER STATIONS 11th December, 2012

(a) to (d): The Government continues to receive from time to time inputs regarding threats to vital installations in the country, which include dams, hydropower plants etc. These inputs are promptly shared with the State Governments/Union Territory Administrations concerned, as the State Governments are primarily responsible for ensuring security of these installations.Security agencies also carry out periodic security audit and make recommendations for strengthening security. Advisories, based on these recommendations,are also issued from time to time to the State Governments. Central Armed Police Forces (CAPFs) are also deployed in many of these installations for providing fool-proof security.

(a) & (b): Yes Madam. The Empowered Group of Ministers conducted a review on 21st December, 2011 on the status of the rehabilitation work carried out for the families affected by Tsunami in the Country. It was directed that the State Governments of Tamil Nadu and Puducherry may prepare a new Disaster Risk Reduction Project which could include a majority of the unfinished works of Emergency Tsunami Reconstruction Project (ETRP) besides new initiatives/ mitigation measures since the World Bank could not extend the closing date of ETRP beyond 31st December, 2011. These States may approach the World Bank for fresh assistance. The State Government of Kerala is required to take steps to overcome the legal difficulties and expedite the completion of the pending works.

(c): The details of works undertaken and the funds allocated and utilized for the Rehabilitation Work are given in Annexure-I and Annexure-II respectively.

THREAT TO NUCLEAR PLANTS 18th December, 2012

(a) whether the intelligence agencies have expressed apprehensions of terrorist attacks on the nuclear power plants in the country; (b) if so, the details thereof; and (c) the steps taken for the safety of nuclear power plants?

(a) to (c): The Government continues to receive from time to time inputs regarding threats to vital installations including nuclear power plants in the country. These inputs are promptly shared with the authorities concerned including the Department of Atomic Energy. Central Industrial Security Force(CISF) has been deployed to secure all the Nuclear Powers Plants in the Country for providing fool-proof security. Departmental security personnel are also deployed by the Management of the installations to assist CISF.

Security agencies also carry out periodic security audits and make recommendations for strengthening security. Advisories, based on these recommendations and other inputs, are also issued from time to time to the authorities concerned including the Department of Atomic Energy.

(a) whether the National Institute of Disaster Management (NIDM) documents disasters occurring in the country; (b) if so, the number of recorded landslides that have occurred in the State of Sikkim in the last three years, area‐ wise; (c) whether any case studies have been prepared on better crisis management during landslides; (d) if so, the details and outcome thereof; and (e) the number of capacity building trainings held for Sikkim for the purpose since the inception of NIDM?

(a): Yes, Madam. National Institute of Disaster Management(NIDM) has documented some of the major disasters that occurred in the past. From 2011, the Institute has started compiling and publishing India Disaster Report, documenting major disasters.

(b): NIDM has not carried out documentation of Landslide in Sikkim.However, the Landslide associated with the Earthquake of September, 2011 has been included in the documentation report of Sikkim Earthquake 2011.

(c) & (d): NIDM has not prepared any case studies on crisis management during landslides. However, the Geological Survey of India (GSI) carries out Landslide Hazard studies and submits its report to the local authorities for implementation of the recommendations.

(e): NIDM conducts training programmes on mitigation and management of landslides which includes post disaster response and relief. The NIDM in collaboration with centre for Disaster Management, G B Pant Institute of Himalayan Environment and Development, Sikkim has conducted 8 training courses in Sikkim since its inception for Capacity Building, which were attended by 359 participants. Lal Bahadur Shashtri National Academy of Administration (LBSNAA) in collaboration with NDMA conducted training programme for State Civil Service Officers promoted to IAS during 2.4.2012- 4.4.2012. The training covered areas like (i) case study on Sikkim earthquake (ii) disaster management.

(a) whether the Kosi Flood tragedy of 2008 was declared a national calamity and a special package was allocated to the State of Bihar; (b) if so, the details thereof; (c) the details of the relief measures adopted by the State Government of Bihar including deployment of boats in relief and rescue missions; and (d) the measures taken by the Union Government to have a permanent solution for floods in Kosi river?

(a) & (b): There is no provision in the schemes of Calamity Relief Fund (CRF)/ now notified State Disaster Relief Fund (SDRF) and National Calamity Contingency Fund (NCCF)/ now notified National Disaster Response Fund (NDRF) for declaring a calamity as a “National Calamity”. However, in case of a calamity of ‘severe nature’, the assistance to the concerned State Government is provided at national level in the form of logistic and financial support in order to meet the situation effectively.

There was no special package allocated to State of Bihar. However, for immediate relief, Government of India approved an amount of Rs. 497.35 crore from NCCF subject to the adjustment of 75 % balance available in the CRF account of the State for the instant calamity. In addition, an amount of Rs. 117.21 crore has been recommended by HLC as additional financial assistance over and above the extant norms for the families in dire need of immediate sustenance as well as operation of relief camps for the period over and above specified in the CRF norms. Further Rs. 2273.15 crore has also been allocated by concerned Central Ministries for repair, reconstruction/ rehabilitation in their respective sectors in the context of Kosi flood 2008.

(c): As per information received from the State Government of Bihar, relief measure, adopted by the State Government are given at Annexure-I

(d): The measures taken by Union Government to have permanent solution for floods in Kosi river is given at Annexure-II.

Annexure-II

Statement showing measures taken towards permanent solution for floods in Kosi river

1. To advise on Kosi beach closure works, Government of Bihar constituted a Kosi Breach Closure Advisory Team (KBCAT) on 26.8.2008 under the Chairmanship of Shri N. Sanyal, Retired Engineer-in-chief, Government of Bihar and former Chairman, Ganga Flood Control Commission. The team visited the site on 31.8.2008 and suggested certain remedial measures to close the breach and to restore the breached section. All these works have been completed and the eastern afflux bund has been restored to its original section on 31.5.2009 with 100% central assistance. MOWR has provided Rs. 115 crores as 100 % Grant-in-aid to the Government of Bihar for re-construction of the breached portion of Eastern Afflux Bund of Kosi Barrage in Nepal.

2. In addition, Kosi High Level Committee, constituted by the Government of Bihar under the chairmanship of Chairman, Ganga Flood Control Commission also inspected the flood protection works on river Kosi from 11-14.10.2008 and made certain recommendations for the works to be executed before flood season of 2009. All the works recommended by KHLC have also been completed on 30.6.2009.

3. A high dam in Nepal on Saptakosi is under joint investigation of India and Nepal. Cost of investigation is 100 % borne by Govt of India.

4. The maintenance of the Kosi barrage, canal systems and afflux bunds and all other flood protection works on river Kosi in and around Kosi barrage is entrusted with the Government of Bihar. The Government of India has been reimbursing the expenditure incurred on actual basis to the State Government, since 1992 for the maintenance of works in Nepal portion.

5. Government of Bihar has also undertaken the works of “Raising and Strengthening of Kosi embankments” with a estimated cost of Rs.339.39 Cr with central assistance (centre share: Rs 254.54 Cr) under Flood Management Programme (FMP) – a state sector scheme under central plan.

6. The Central Water Commission has a network of hydrological observation sites on river Kosi at Birpur, Baltara, and Kursela. During the high flood situation, Central Water Commission regional office, Patna issues flood forecasts to the local administration for taking appropriate remedial measures. During floods, water levels are observed on hourly basis and forecasts are issued twice in a day depending upon the flood situation. The Central Water Commission regional office, Patna has already set up its control room and started functioning since 15th June 2009.

7. Government of Bihar has also set up a control room to monitor the flood situation in the State. It has constituted nine Flood Fighting Task Groups to keep close surveillance along the embankments during flood season. A Task Group is set up for river Kosi.

8. Further, the State Government has been advised to stock required materials in sufficient quantity like boulders, sand bags, etc. at site to meet emergent situations.

9. One officer from Ganga Flood Control Commission, Patna has been deputed at Kosi barrage to monitor the safety of the embankments and afflux bund and inform to the Control Rooms in case of any emergency situation.
