O R D E R Sri C.Suryanarayana, R/o Hyderabad filed 2nd appeal dated 30-04-2019 which was received by this Commission on 30-04-2019 for not getting the information sought by him from the PIO / O/o The Divisional Engineer-Operation, TSSPDCL, Paradise Division, Opp: Jaya Laxmi Towers, Near Musheerabad X Roads, Secunderabad-500020 and 1st Appellate Authority / O/o The Superintending Engineer-Operation Circle, TSSPDCL, Secunderabad Circle, Diamond Point, Sikh Village, Hyderabad-500009. The brief facts of the case as per the appeal and other records received along with it are that the appellant herein filed an application dated 11-02-2019 under Sec.6(1) of the RTI Act, 2005, before the PIOTSIC seeking the following information: The Public Information Officer through letter No. DEE/OP/City- V/PRD/Sec’bad/JAO/ADM/D.No.5210/2019 dated 26-02-2019 furnished reply to the appellant. Since the appellant did not receive the information from the Public Information Officer, he filed 1st appeal dated 04-04-2019 before the 1st Appellate Authority requesting him to furnish the information sought. As per the records enclosed it is noticed that the 1st Appellate Authority had failed to hear the case and pass appropriate orders on the 1st appeal filed before him. As the appellant did not get information from the Public Information Officer, he preferred this 2nd appeal before this Commission requesting to arrange to furnish the information sought by him. The 2nd appeal was taken on file and notices were issued to both the parties for hearing on 09-01-2020. On 09-01-2020 the case is called. The appellant is present. The Public Information Officer, N. Laxmi Narayana, Divisional Engineer-Operation, TSSPDCL, Secunderabad is present. Heard the appellant, Public Information Officer and perused the records. The appellant submitted that he did not receive the sought information from the Public Information Officer. The Public Information Officer submitted that vide Lr. No. DEE/Op/City-V/ PRD/Sec’bad/JAO/Adm/D.No.5674/2019 dated 23-08-2019 the appellant was informed that the sought information is not traceable. He also submitted that the matter relates to 1992 and their office has been shifted thrice. The Commission observed “not traceable” is not an exemption under RTI Act and the same cannot be accepted. The Commission directs the Public Information Officer to thoroughly verify and furnish the sought information to the appellant within one month from the date of receipt of a copy of this order and submit compliance report to the Commission. With the above direction, the appeal is closed.
