19. Review of Decisions

The Chair of Committee II reported that the transfer of the texts of Decisions 14.5 and 13.14 to 13.17 into Resolution Conf. 11.1 (Rev. CoP14) as contained in document CoP15 Com. II. 12 had been accepted. Similarly, Committee II had agreed to transfer text of Decision 14.18 into Resolution Conf. 12.11, as contained in document CoP15 Com. II. 11. It had also agreed by consensus to the proposed revision of Decision 14.61 outlined in Annex 2 of document CoP15 Doc. 19, and to that of Decision 14.79 outlined in Annex 1 of the same document.

The Chair further reported that it had been agreed to retain Decisions 14.73, 14.76 and 14.82-14.85, and to revise Decision 14.74, as outlined in document CoP15 Com. II. 26. The Committee had accepted the deletion of Decisions 10.2 (Rev. CoP11), 14.8, 14.75 and 14.78. A replacement for Decision 14.78, as proposed by the Secretariat, had been accepted with amendments, as reported in summary record Com. II. Rep. 13. It had been also agreed to extend Decisions 14.138 and 14.144 for reporting at CoP16. These conclusions were adopted.

The Chair of Committee II reported that the proposed deletion of Decision 14.81 had been rejected by a vote (24 yes, 46 no and 9 abstentions).

He further reported that it had been agreed to maintain all the Decisions in Annex 3 of document CoP15 Doc. 19. Additionally, it had been agreed to extend Decisions 13.93 (Rev. CoP14) and 14.100 for reporting at CoP16. He stated that questions had been raised about a number of Decisions where justification for deletion had not been clear, which the Secretariat had clarified. The Committee had noted that the amendment to Resolution Conf. 4.6 (Rev. CoP13) would require a justification to be provided for proposals to delete Decisions at future meetings.

The recommendations in Annex 3 of document CoP15 Doc. 19 were adopted.

CoP15 Plen. 4 (Rev. 2) – p. 1 20. National laws for implementation of the Convention

The Chair of Committee II reported that a working group had considered the proposed amendments to Resolution Conf. 8.4 (Rev. CoP14) and the draft decisions in document CoP15 Doc. 20. The revised versions were provided in document CoP15 Com. II. 24 and had been accepted by consensus. This document was adopted.

21. National reports

The Chair of Committee II reported that the draft revisions of Decisions 14.37 and 14.38 contained in document CoP15 Doc. 21 Annex 1 had been agreed, with amendments to Decision 14.37 recorded in document CoP15 Com. II. Rec. 7, and that the final text incorporating the amendments was contained in document Com. II. 15. Egypt considered that guidelines to facilitate synergy between Multilateral Environment Agreements (MEAs) should be developed and believed it to be the right time to instigate national reporting on all MEAs. Document CoP15 Com. II. 15 was adopted.

22. Reporting on trade in artificially propagated plants

The Chair of Committee II reported that the draft revisions of Decisions 14.39, 14.40 and 14.41 had been accepted with amendments. The final text incorporating those amendments was contained in document CoP15 Com. II. 16. This document was adopted.

23. Standard units of reporting for agarwood-producing taxa

The Chair of Committee II reported that the recommendation of the Secretariat in document CoP15 Doc. 23 had been accepted by consensus. If adopted by the Conference of the Parties, the Secretariat would issue a revision for the Guidelines for the preparation and submission of annual reports to take this decision into account. The document was adopted.

24. Enforcement matters

The Chair of Committee II reported that the two draft decisions contained in document CoP15 Doc. 24 Annex 1 had been accepted by consensus. The draft decisions were adopted.

25. Proposed revision of Resolution Conf. 11.3 (Rev. CoP14) on Compliance and enforcement

The Chair of Committee II reported that the draft revision of Resolution Conf. 11.3 (Rev. CoP14) contained in document CoP15 Doc. 25, with amendments suggested by the Secretariat in its written comments in the document, had been accepted by consensus. The final agreed text was in document CoP15 Com. II. 25. This was adopted.

26. Review of Significant Trade in specimens of Appendix-II plant species

The Chair of Committee I reported that two draft decisions regarding Cistanche deserticola, Dioscorea deltoidea, Nardostachys grandiflora, Picrorhiza kurrooa, Pterocarpus santalinus, Rauvolfia serpentina and Taxus wallichiana had been accepted by consensus. These draft decisions were contained in document CoP15 Com. I. 10 which was adopted.

27. Introduction from the sea

The Chairman of Committee II reported that the Committee had considered and accepted revisions of Resolution Conf. 14.6 and Decision 14.48, which were contained in document CoP15 Com. II. 35. Saint Vincent and the Grenadines did not agree that the State of introduction should be the Port State. With no further comments, the document was adopted.

28. Ranching and trade in ranched specimens

The Chairman of Committee II informed delegates that draft amendments to Resolution Conf. 11.16 (Rev. CoP14) included in the Annex to document CoP15 Doc. 28 and had been accepted by consensus, as had two draft decisions on this matter found in document CoP15 Com. I. 17, and these were adopted.

The Chairman of Committee I reported that his Committee had accepted a draft definition of the term ‘ranching’, as outlined in paragraph B of the Comments from the Secretariat in document CoP15 Doc. 29 and had accepted by consensus its inclusion in Resolution Conf. 11.16 (Rev. CoP14). It had also accepted an amendment to the definition of source code ‘R’ in Resolution Conf. 12.3 (Rev. CoP14), the wording of which was recorded in document CoP15 Com. I. 17. Two draft decisions in document CoP15 Com. I. 17 had also been accepted. These were adopted.

30. Electronic permitting

30.1 Electronic permitting toolkit

The Chairman of Committee II informed delegates that the Committee had considered three draft decisions contained in the Annex to document CoP15 Doc. 30.1, and these had been accepted with amendments. The final text was presented in document CoP15 Com. II. 33, which was adopted. He noted that the meeting had already considered item 30.2 under agenda item 18.

31. Purpose codes on CITES permits and certificates

The Chairman of Committee II indicated that the Committee has considered the draft revision of Decision 14.54 prolonging the terms of reference of the working group on purpose codes. The Committee had agreed to the document, with amendments, and the final text was presented in document CoP15 Com. II. 32, which was adopted.

32. E-commerce of specimens of CITES-listed species

The Chairman of Committee II reported that the draft decisions in Annex 1 of document CoP15 Doc. 32 had been accepted by consensus. A draft revision of Resolution Conf. 11.3 (Rev. CoP14) had been accepted with amendments, as contained in document CoP15 Com. II. 28. These were adopted.

33. Transport of live specimens

The Chairman of Committee II reported that it had agreed to delete Decisions 14.158 and 14.159. He reported that the Committee had accepted by consensus the draft decisions presented in document Com. II. 13, and these were adopted.

35. Standard nomenclature

The Chairman of Committee I reported that draft revisions to Resolution Conf. 12.11 (Rev. CoP14), Resolution Conf. 9.24 (Rev. CoP14) and Resolution Conf. 11.1 (Rev. CoP14), in addition to three draft decisions on standard nomenclature, had all been accepted by consensus. These were found in document CoP15 Com. I. 1, with further amendments recorded in summary records CoP15 Com. I. Rec. 10 and CoP15 Com. I. Rec. 12. These were adopted.

36. Identification of CITES-listed corals in trade

The Chairman of Committee II reported that the draft decisions proposed by the United States of America as amended by the Secretariat had been accepted, as had the recommendation to delete Annex 1 of Notification to the Parties No. 2003/020. This was adopted.

37. Identification of worked specimens of black coral (Antipatharia) and parts thereof in trade

The Chairman of Committee II informed the meeting that the proposed amendments to Resolution Conf. 12.3 (Rev. CoP14) in Annex A of document CoP15 Doc. 37 had been agreed, as had the decision in Annex B (as amended) which was reported in summary record CoP15 Com. II. Rec. 10. He noted that the amended text would be incorporated in a revision of that Resolution contained in document CoP15 Com. II. 41. The draft decisions and draft revised resolution were adopted.

The Chairman of Committee II informed the meeting that this document had been noted. This was confirmed.

39. Using the taxonomic serial number (TSN) in international wildlife trade data: a role for CITES

The Chairman of Committee II reported that Canada had withdrawn their request for the adoption of a draft resolution but that three substitute draft decisions had been accepted with amendments. The final were presented in document CoP15 Com. II. 34, which was adopted.

40. Personal and household effects

The Chairman of Committee II reported that the draft revision of Decision 14.64 outlined in the Annex to document CoP15 Doc. 40 had been accepted by consensus. This was adopted.

41. Applications to register operations that breed Appendix-I animal species in captivity for commercial purposes

41.1 Consideration of operations subject to an objection and 41.2 Request from the regarding Birds International

The Chair of Committee II reported on documents CoP15 Doc. 41.1 and CoP15 Doc. 41.2, explaining that the request to register a commercial captive-breeding operation in the Philippines with regard to several species of parrot under agenda item 41.1 had been considered together with a request for the same breeding operation under agenda item 41.2. There had been considerable discussion of the objections to the registration which had then been rejected by a vote, with 24 Parties in support, 20 against and 30 abstaining. Also under agenda item 41.1, a request had been considered from the United States for the inclusion in the register of a commercial falcon breeding operation that had been subject to an objection. This had been accepted by a vote, with 46 Parties in support, 7 against and 21 abstaining.

The Philippines, supported by , on behalf of the and its Member States, requested that discussion of document CoP15 Doc. 41.2 be opened. The United States, supported by the Plurinational State of Bolivia objected to this, noting that, if the discussion were opened, it should only be in relation to paragraph 2. a) of the document. The Plurinational State of Bolivia felt that the document had already been addressed in Committee II with clear objections by Parties as illustrated with the vote. They questioned whether the Rules of Procedure allowed for opening discussion of the document in plenary session. The Secretariat confirmed that the Rules of Procedure allowed for the opening of debate, with two Parties being allowed to speak in support, two against, and then a vote on the opening, which required a third of the votes.

A vote was taken, with 62 Parties in support of opening discussion of document CoP15 Doc. 41.1, and 52 against (see Annex 1). Reaching the one-third majority required, the document was opened for consideration by the participants.

The Philippines withdrew the request to include Amazona barbadensis and Ara ambigua in the Secretariat’s Register for Birds International Inc., in light of objections raised in Committee II.

The Chair clarified that the debate had only been opened with regard to document CoP15 Doc. 41.1 and that CoP15 Doc. 41.2 had not been opened for debate.

The Plurinational State of Bolivia, Colombia, Ecuador and Peru, supported by Suriname and ProWildlife, reiterated comments made during the meeting of Committee II, and questioned the validity, precision and accuracy of some of the documents submitted in the applications. They noted that, as range States of some of the species under consideration, especially Ara macao, the proponent had not coordinated with them regarding in situ conservation measures and were unaware of the Memorandum of Understanding between the proponent and the several range States mentioned in the document.

CoP15 Plen. 4 (Rev. 2) – p. 4 Israel spoke against the applications, noting that there was no evidence that the captive-breeding operation had contributed to improving the conservation status of wild populations, as recommended in Resolution Conf. 12.10 (Rev. CoP14).

The United States expressed concern about the quality of the documents submitted. They added that the Philippines, being a Party to the Convention that had not entered a reservation on that species, should not have allowed the import of Ara macao, listed in Appendix I, from Suriname, for primarily commercial purposes.

Noting comments made by the range States of Ara macao, Philippines withdrew its request for the inclusion of this species in the Register of captive-breeding operations. They clarified that the parental stocks were pre-Convention specimens that did not always have the precise documentation that had become compulsory after the Philippines became a Party to CITES. They stated that their efforts to contact South American range States between CoP14 and CoP15 had gone unanswered but that they were already cooperating with Indonesia. Indonesia supported the application for the captive-breeding operations for the species originating from .

The Philippines sought to divide its application for registration, so that each species be decided on separately. They then withdrew this request and sought a single vote on the registration of the species Cacatua sulphurea abboti, C. s. citrinocristata, C. s. sulphurea and C. moluccensis. The Chair put this to a vote and, with 66 in favour, 37 against and 30 abstentions, the applications were rejected (see Annex 2).

The Chair clarified that the vote had rejected paragraph 2 a) of document CoP15 Doc. 41.1. Regarding paragraph 2 b) of the document, the recommendation of Committee II was adopted.

The recommendation by Committee II to reject document CoP15 Doc. 41.2 was confirmed.

41.3 Request from the United States of America regarding Richard W. Anderson 41.4 Request from the United States of America regarding Stephen C. Brown and 41.5 Request from the United States of America regarding Frank Metallo

The Chair of Committee II reported that the requests for the inclusion of three commercial falcon- breeding operations in the Secretariat’s Register contained in documents CoP15 Doc. 41.3, 41.4, 41.5 had all been accepted in Committee II. These were adopted.

42. Great apes

The Chair of Committee II reported that the two draft decisions contained in document CoP15 Doc. 42 had been accepted by consensus. Liberia commented that the discussion in Committee II had focussed on gorillas and that there had been no discussion regarding other great apes such as chimpanzees that occur in their region, or on habitat destruction. Noting the comments from Liberia, the draft decisions in document CoP15 Doc. 42 were adopted.

43. Asian big cats

43.1 Report of the Secretariat

The Chair of Committee II reported that the four draft decisions contained in document CoP15 Doc. 43.1 Addendum had been accepted by consensus. These were adopted.

43.2 Proposed revision of Resolution Conf. 12.5 on Conservation of and trade in tigers and other Appendix-I Asian big cat species

The Chair of Committee II reported that, following long discussions and the revision of the proposals by a working group, Committee II had accepted a draft decision and a draft revision of Resolution Conf. 12.5. These were recorded in document CoP15 Com. II. 31 and were adopted.

44.1 Monitoring of illegal trade in ivory and other elephant specimens

The Chair of Committee I reported that a draft revision of Decision 13.26 (Rev. CoP14) concerning the Action plan for the control of trade in African elephant ivory and a draft revision of Resolution Conf. 10.10 (Rev. CoP14) on Trade in elephant specimens had been accepted by consensus and that these could be found in document CoP15 Com. I. 18. These were adopted.

44.2 Monitoring of illegal hunting in elephant range States

The Chair of Committee I reported that document CoP15 Doc. 44.2 (Rev. 1) had been noted by Committee I. The document was noted.

45. Rhinoceroses

45.1 Report of the Secretariat

The Chair of Committee II reported that the draft decisions contained in document CoP15 Doc. 45.1 Addendum had been accepted in Committee II with the amendments recorded in summary record CoP15 Com. II. Rec. 8. The final text was presented in document CoP15 Com. II. 27 and was adopted.

45.2 Revision of Resolution Conf. 9.14 (Rev. CoP14) on Conservation of and trade in African and Asian rhinoceroses

The Chair of Committee II reported that a working group had presented a draft decision and a draft revision of Resolution Conf. 9.14 (Rev. CoP14) in document CoP15 Com. II. 29. These had been accepted with the amendments recorded in summary record CoP15 Com. II. Rec. 12.

Viet Nam objected to being mentioned in paragraph b) of the draft decision directed to the Secretariat in document CoP15 Com. II. 29. They reiterated their commitment to combating illegal trade in rhinoceroses and had instituted management measures at the national level.

Document CoP15 Com. II. 29, with the amendments recorded in summary record CoP15 Com. II. Rec. 12, was adopted.
