INTRODUCTION 1. The Commission has before it for consideration: (i) license renewal applications from the above-listed radio stations in Texas; (ii) a timely filed Petition to Deny by the Texas State Conference of Branches of the NAACP and its various local, branches (collectively "NAACP") against the license renewal KGNC-FM©s call sign was changed from KMLT(FM) effective November 2, 1992. 879 applications of the above-listed radio stations; p (iii) oppositions filed by the licensees; and (iv) the licensees© responses to staff letters of inquiry. II. BACKGROUND 2. NAACP alleges that the challenged stations violated our Equal Employment Opportunity (EEO) Rule and policies. Accordingly, it requests that we conduct an investigation of the employment practices of the stations pursuant to Bilingual Bicultural Coalition on Mass Media, Inc. v. FCC. 595 F.2d 621 (B.C. Cir. 1978) (Bilingual) and designate the renewal applications for hearing. The licensees deny NAACP 1 s allegations and request unconditional renewals. III. PLEADINGS 3. Standing. The licensee of Stations KGNC/KGNC-FM argues that the declaration under penalty of perjury filed by NAACP regarding these stations is insufficient to establish standing because the President of the Amarillo Branch does not demonstrate that he is a resident within the service area of the stations.

Nerone, Chair and Director of Research Associate Professor Michelle Renee Nelson Associate Professor Christian Edward Sandvig Professor Daniel Toby Schiller ii ABSTRACT The interaction of policy and technological development in the era of “convergence” is messy and fraught with contradictions. The best expression of this condition is found in the story behind the development and proliferation of digital audio broadcasting (DAB). Radio is the last of the traditional mass media to navigate the convergence phenomenon; convergence itself has an inherently disruptive effect on traditional media forms. However, in the case of radio, this disruption is mostly self-induced through the cultivation of communications policies which thwart innovation. A dramaturgical analysis of digital radio’s technological and policy development reveals that the industry’s preferred mode of navigating the convergence phenomenon is not designed to provide the medium with a realistically useful path into a 21st century convergent media environment. Instead, the diffusion of “HD Radio” is a blocking mechanism proffered to impede new competition in the terrestrial radio space. HD Radio has several critical shortfalls: it causes interference and degradation to existing analog radio signals; does not have the capability to actually advance the utility of radio beyond extant quality/performance metrics; and is a wholly proprietary technology from transmission to reception.

Washington, DC 20554 Re: MM Docket No. 00-244 Dear Ms. Dortch: Yesterday, Jack Goodman, Karen Kirsch and the undersigned of NAB; Brian Madden of Leventhal, Senter & Lerman; and Greg Masters and Chris Robbins of Wiley Rein & Fielding met with Susan Eid and Alex Johns to discuss the definition of radio markets. We made the following points: · Due to the scattered location and widely varying signal strength of radio stations, any method of defining radio markets will produce a certain number of anomalies. The current market definition method has produced only a small number of anomalies in comparison to the large number of radio transactions since 1996. The current method is also stable in operation, well understood by the industry, and accurately identifies the stations that potentially compete against each other for listeners and advertisers. Adopting a revised market definition will only create a different and unpredictable set of anomalies. · The Commission lacks the authority to alter its radio market definition at this juncture. Because Congress in 1996 addressed local radio ownership limits and did not change the Commission’s well-established interpretation of what constitutes a radio market, then that interpretation should, under existing court precedent, be regarded as the interpretation intended by Congress. Certainly the Commission should not alter its market definition to cut back on the level of local radio consolidation expressly approved by Congress in 1996. · The Commission should not adopt Arbitron radio markets, for a variety of reasons.

Ernie Wesolowski of the NRC reports that about 30 people attended, all of them members of both clubs. Off to your left are two photos that I was able to find of convention attendees. Sorry but I can’t put names to the bodies in the pictures, but I think the guy in the Hawaiian shirt is Frank Merrill. Ernie (red hat, I think) sent over two photos of the Omaha antenna farm. These are located on the inside back cover. This convention could very well turn out to be the last convention, so I hope those who went enjoyed it.
