Now at this time the above entitled matter coming on for consideration

by the State Engineer, and it appearing that all evidence and testimony has been taken

in the above entitled proceeding, and the State Engineer having carefully considered

all of such evidence and testimony and the engineering data and information gathered

in accordance with law, and being now fully advised in the premises, makes and orders

to be entered of record in his office the following

1.

'l'hat on the 11th day of .Junuary, 1924, there was filed in the office

of the State J];ngineer a petition signed by ]'red w. ]'alconer and others, requesting a

determination of the relative rights of the various claimants to the use of water

from Imnaha River and its tributaries.. That the otate Engineer thereupon fixed a

time for the making of the necessary surveys and examinations, and the beginning and

taking of such testimony as would enable him to determine the rights of ·the various

claimants to the use of water fram said stream, as provided by law.

That a notice was prepared by the state :i::ng:l.neer setting forth a date when he or his assistants would begin an investigation of the flow of said stream and

its tributaries, antl the ditches diverting water therefrom; and said notice was publish-

ed ln two issues of 'l'he .Joseph Herald, a nev1apaper published weekly at .Joseph, llallowa

County, Ore[pn, e.nd of general circulation in said county; said two issues being those

of .July 26 and l~U13Ust 2, 1928; and said notice was also published in two issues of

the :B~nterprise Heoord Chieftain, a newspaper published weekly at Enterprise, Wallowa

County, , and of general circulation in said county; said two issues being

those of .July 26 and August 2, 1928; the date of t.'l-le last publication of the notices

in each case being more than ten days prior to the date fixed for the beginning of the measurements of said stream by the State Engineer, as provided by law.

That the time when the State Engineer or his assistants should begin the examinations of said stream and its tributaries was set for August 10, 1928. That

IMNJUIA RIV.dR - 1 - at the time so specified, duly qualified assistants of the State ineer did proceed to make an examination and surveys of said stream and its tributaries,

and of' the ditches and canals diverting water therefrom, and of the lands irri­

gated by the waters of said stream and its tributaries; which observations and measurements were reduced to writing and macle a mao~ ter of record in his office.

And the State Engineer did cause to be prepared a set of maps or plats, on a

scale of rreasurement of four inches to the mile, showing with substantial accu­ racy the course of said stream and its tributaries, the location of the various ditches diverting water therefrom, and the number of acres of land which had been irrigated in each legal subdivision; blue prints of said maps being now on file and a part of the record herein.

That after said examination and measurements were completed, a notice was prepared by the State near setting forth a time and place certain when he would begin the taking of t&stimony (statements and proofs of claim) as to the rela­ tive rights of the various claimants to the use of the waters of said stream and its tributaries; and said notice was published in two issues of ~e Joseph Herald, a newspaper published weekly at Joseph, Wallowa County, Oregon, and of general circula­ tion in said county, said two issues being those of April 18 and 25, 1929; and said notice was also published in two issues of the Bnte~prise Record Chieftain, a news­ paper published weekly at Enterprise, Wallowa County, Oregon, and of general circula­ tion in said county, said two issues being those of April 18 amd 25, 1929; the date of the last publication of said notice in each case being more than thirty days prior to the date fixed for the beginning of the tak of testimony by the State Engineer, as provided by law.

That on the l?th day of April, 1929, the State Engineer did send by registered mail to each person, fir.m or corporation claiming a right to the waters of said stream, or any tributary thereof, and to each person, f'ir.m or corporation coming or being in possession of land bordering on or having access to said stream, or its tributaries, insofar as the names of said claimants, owners, firms or corpora­ tions could be reasonably ascertained, a notice similar to the published notices as described in Paragraph 4, setting forth a time and place when the State Engineer would commence the taking of testimony (statements and proofs of claim) as to the

tributaries. And the State Engineer did enclose with each of said notices a

blank for.m upon which claimants or persons in possession could present in writ-

ing all the particulars necessary for the determination of his rights to the

waters of said stream, under oath.

6.

That the times and places when and where the said State Engineer

or his duly authorized assistants should attend and take the testimony of the

various claimants were fixed as follows; to-wit:

On Tuesday, June 4, 1929, at the Grange Ball, at Imnaha, Oregon.

On Wednesday and Thursday, June 5 and 6, 1929, in the Circuit Court Roam of the County Court Bouse at Enterprise, Oregon.

And for a period of 30 days, beginning with Monday, June 10, and ending with Tuesday, July 9, 1929, at the office of the State Engineer in the Capitol Building at Salem, Oregon.

That during the period so specified, claims to the use of the waters

of Imnaha River and its tributaries were filed by the following parties, to-wit:

That upon the completion of the taking of said testimony (claims) the State Engineer did on tne lOth day of July, 1929, give notice by registered mail to each of the various claimants to the use of the waters of said stream, that at the times and places named in said notice, to-wit: ImMAHA RIVER - 6 - On Tuesday, July 23, 1929, at the Grange Hall, above Imnaha' oregon.

On Wednesday, July 24, 1929, at the County Court House at Enterprise, Oregon.

From Thursday, July 29, until August 9, 1929, inclusive, (Sundays and holidays excepted), at the office of the State Engineer in the Capitol Building, Salem, Oregon.

That said notice did also state the rein the county in which the

determination of the State Engineer in said proceedings would be heard by the

Circuit Court of the State of Oregon, to-wit: Wallowa County. That a duly author-

ized representative of the State Engineer did, in accordance with said notice,

keep said testimony and claims open to public inspection at the timssand places

aforesaid.

That the Imnaha River is a non-navigable, perennial stream, rising

in the in Wallowa County and flowing northeasterly into the

Snake River; that the waters of said stream and its tributaries are used to a

limited extent for the irrigation of narrow strips of lands, small in area, and

commonly designated as "shoe-string ranches". The lands are arid and irrigation

is necessary for the raising of profitable crops.

10. That at the time the testimony and proofs of claims were open to

public inspection at the Grange Hall above Imnaha, Oregon, namely: on July 23,

1929, the following stipulation was filed:

"R. A. Barton, party of the first part, and Chas.Orader, James Estes,

Albert Morgan, and Jay H. Stanley, party of the second part, do hereby make the

following stipulation, without contest, in settlement of certain differences a-

rising in connection with the acreage claimed by R. A. Barton, in Section 22,

T. 3 S. R. 48 E.

The party of the first part hereby agrees to have 1.8 acres in the smfNEt, and 4.6 acres in the NEt SEt of Section 22, T. 3 s.R.48 E.W.M., stricken from his proof, more particularly described as Statement and Proof of Claim No. 2,

filed June 4, 1929, for and in consideration of the right to enlarge the Park

Irrigation Ditch to the extent that it will carry additional water as allowed by

State Engineer's Pennit, for the above described acreage, and for a supplemental right to irrigate 5 acres in swt sw} Section 14, 3 acres in NWZNW! of Section 23,

... ,,,_, ,.,.' ,___,.,_i ·'; all of Township 3, s. R. 48 E. w. M., and that such right is subject to the filing of an application with the State Engineer, and tne completion of the en­

larganent before water is to be diverted to any of the above described acreage;

and the parties of the second part, being the Park Irrigation Company, organized

as a corporation under the laws of Oregon, are owners of the Ditch known as the

Park Irrigation Ditch; do hereby agree that the party of the First part can en­

large said Park Irrigation Ditch to the extent above mentioned, provided that he

first apply to tne State Engineer for a pennit. And they fUrther agree that the

acreage above described can be irrigated from said ditch after enlargement."

The provisions of the above stipulation are recognized herein and the

said R. A. Barton may acquire a ditch right through the Park Irrigation Ditch 'for

the irrigation of 1.8 acres in the SE:fNEi, and 4.6 acres in the NEi SE,t, Sec. 22,

and for a supplemental supply for the irrigation of 5 acres in the SWi b'W:if Sec. 14,

and 3 acres in the NWit NWt Sec. 23, all in Tp. 3 s. R. 48 E. W. M., provided that said R. A. Barton secure a parmi t from the State Engineer for the irrigation of

said acreage and to enlarge said Park Irrigation Ditch to such an extent that it

will carry sufficient water for the irrigation thereof.

11.

That a decree of the Circuit Court of the State of Oregon for Wallowa County

wherein W. G. Miller was plaintiff and Katherine J'. Fisk and R. M. Fisk defendants was

filed in this proceeding which said decree affects the lands tabulated herein under the

names of w. G. Miller and Katherine J'. Fisk; that by the provisions of said decree

plaintiff was awarded prior and first use of the waters of the stream known as Schleur

Creek for irrigation, domestic and household use upon his lands as against the rights

of the defendants and that the use of the waters of said stream by the defendants is

limited to the use for household and stock use except as to the overflow or surplus water of said stream. The decree does not determine any definite quantity of water

to be diverted, but simply provided the plaintiff shall have tbe use of the waters of

said creek in the irrigation of his orchard, crops of hay and grain and garden pro­

ducts and for household and domestic use upon hie lands. In accordance with the pro­

visions of said decree the right of W. G. Miller is prior to that of·Katherine ··J.

Fisk and the quantity of water obtained under said rignts shall be governed by the

provisions of Paragraph 13 hereof.

12.

·That Ebner Brumbach filed a statement and proof of claim for 3.5 acres in

the NE-:f SW:f, 4.5 acres in the NWi;- SEl and 3 acres in the SE:i- sw-l;-, Sec. 20,T.2 N.R.48,E.W.M.,

IMNAHA RIVER - 8 - and in addition thereto claims an inchoate right for the irrigation of 8 acres in

the S&~ SWf Sec. 20, same township and range; that in such claim he states that

5 acres were irrigated the first year or in 1893, 2 acres the second year or in

1894, 2 acres the third year or in 1895 and 2 acres the fourth year or in 1896,

for a total of 11 acres.

It appears that 33 years have passed between the time of reclaiming the lands to the filing of the statement and proof of claim in these proceedings and

that the claimant herein has failed to exercise that degree of diligence to entitle him to a water right far the said 8 acres and said claimant can only acquire rights

to the use of said waters of Indian Creek for this acreage by securing a State Engineer's

Fermi t.

13. That the soil of the lands irrigated along the Imnaha River and its tribu­ taries is composed largely of a decomposed basaltic deposit and underlain with gravel, and the principal crops produced are alfalfa, grain, hays, and garden truck or diversi­ fied crops; that owing to the character and kind of crops raised, nature of the soil, the return seepage from irrigated lands, the method and use of the waters of said stream and the climatic conditions prevailing in the vicinity of said lands, a large head of water is required. Because of the wide difference in character of soil and climate between the lands along the Imnaha River and its tributaries and those in the

Wallowa Valley irrigated from Big and Little Sheep Creeks and their tributaries, the duty of water for each may be fixed independently of each other.

In the decree determining the relative rights of the various users of water from Wallowa River and its tributaries, the duty of water for the lands in the Wallowa

Valley, including some of the lands involved in this proceeding was fixed after exten­ sive and careful investigations as to the quantity of water needed. It is believed that the acre-foot limitation as fixed in the Wallowa River decree is a reasonable duty for these lands in the Wallowa Valley irrigated from tributaries of the Imnaha

River and therefore the same limitation used in said Wallowa River decree will be fixed in these findings, with an additional limitation as to the head or rate of flow.

The right to the use of water for irrigation purposes in the Imnaha water shed as herein recognized shall entitle the owners thereof to the diversion of a quantity of water which may be applied to a beneficial use upon the lands to which such water is appurtenant, PROVIDED, that the quantity of water diverted shall not exceed three-eightieths of one oubio foot per second per acre of land irrigated, and not to exeeed one and one-half acre feet per acre during any period of·30 days during the irrigation season.

That the right to the use of water for irrigation fran the tributaries of the

3:t1 IMNAHA RIVER - 9 - Imnaha River on lands within the Wallowa Valley shall not exceed one-fortieth of one

cubic foot per second per acre of land irrigated prior to July 31st of each year, and

not to exceed one-eightieth of ana cubic foot per second per acre for the remainder

of the irrigation season, and a further limitation of one and one-half aore feet per

acre during any period of 30 days prior to JUly 31st of each year and thereafter not

to exceed one acre foot per acre for the remainder of the irrigation season.

That the maximum quantity of water to which the owners of such lands are

entitled to divert for the irrigation thereof is accordingly so fixed and determined,

subject to the use of water by rotation as hereinafter. provided; provided that in no

case shall more water be applied to said lands than can be beneficially used thereon,

and suCh water to be measured at the point of diversion of the appropriator's individual

diteh from the river or other channel from which diversion is made, excepting the water

dive~ted over the divide into Wallowa Valley, such water shall be measured near the north line of Section 19, T. 3 s. R. 46 E., W. Mo In case the water flowing in the channel of the stream sinks or fails to flow

down the channel so as to be of benefit to an appropriator ijaving the rignt to its use,

the water master shall allow the diversion thereof by the next appropriator in order

of priority who can make a beneficial use of such water. 'rhe irrigation season of the Imnaha River and its tributaries is hereby

fixed as the period from April 1st to October 15th of each year.

14.

The rights to the use of water for stock and domestic purposes as herein

recognized, shall entitle the owners thereof to the diversion of not to exceed one-

tenth of ana cubic foot per second for each one thousand head of stock, measured at

the place of use; provided that at no time shall more water be diverted for such

purposes than is reasonably necessary for such purposes, and to prevent the ditches

and channels used for such purposes from being completely frozen. The rights herein

recogniZed for stock and domestic purposes shall continue throughout the year and shall have preference over, and shall be superior to, rignts for irrigation purposes at all

times; provided, that the use of water for stock purposes shall be restricted to the

ditches and channels now in use for such purposes, and that all water users shall so

far as practicable provide stock watering holes or ponds into which stock water may

be diverted periodically.

15. The water master of the district in which Imnaha River and its tributaries

ar6 situated, may arrange sudl system or systems of rotation as may be best applicable

to the conditions arising from time to time in the distribution of water on such stream.

IMNAHA RIVER w 10 - When two or more appropriators agree between themselves as to a system of rotation, the water master shall distribute water to them in accordance with such agreement, provided that in so doing he does not interfere with the rights of other appro- priators.

16. That the rights to the use of water for irrigation purposes hereby con- firmed are appurtenant to the lands herein described, and the rights of use of the waters of said Imnaha River and its tributaries by virtue of such rights are limited and confined to the irrigation of the lands described herein to the extent of said lands herein set forth, and the priorities of right herein confirmed confer ~ right of use of the waters of said river and its tributaries on any lands other than those specified tracts to which such rights are herein set forth as appurtenant, and each and every person shall be and hereby is prohibited, restrained and enjoined from diverting and using water from said river on suoh other lands without lawful permit first obtained from the State Engineer.

17. That except as otherwise determined herein, the order of the rights of the respective appropriators of the waters of sand Imnaha River and its tributaries, and in which order they are entitled to divert and use the said water shall be and is ac- cording to the date of the relative priority of the rights as herein set forth and determined, and the first in order of time according to the date of relative priority shall be and is the first in order of right, and so on down to the date of the latest right, and those having prior rights are entitled to divert and use the waters of said river and its tributaries when necessary for beneficial use in coimection with U"eful · the irrigation of their respective lands or other/and beneficial purposes for which they are decreed the right of use, at all times against those having subsequent rights without let or hindrance, and whenever the water is not required by the appropriator having a prior right to its use for the purpose for which said water was appropriated, he must and shall permit it to flow down the natural channel of the stream as it was wont to flow 1n its natural course without hindrance or diversion thereof, and those having subsequent rights are entitled to the use of such water and to divert the same to the extent of their rights of appropriation according to the order of priority of their rights; and at all times the waters shall be beneficially, economically and resonably used without waste by thooe having a right to the use of such water, and no rights of appropriation are hereby confirmed to divert a greater quantity of water than such appropriator can beneficially use for the purpose to which the water is to be put.
