Approval of the application would allow the Tribe to adopt, review, and revise water quality standards pursuant to Section 303(c) of the CWA and to certify that discharges comply with those water quality standards pursuant to Section 401 of the CWA, for all surface waters within the Red Lake Reservation and on certain tribally held trust lands outside the Reservation. In accordance with Title 40 of the Code of Federal Regulations (C.F.R.) §131.8(c)(2)-(3), EPA is requesting comments from the State of Minnesota on the Tribe’s assertion of authority to regulate surface water quality on the lands described above. In addition to this written notice, EPA will issue a public notice in the Bemidji Pioneer and the Red Lake Nation News. The trustees compose the governing authority of a state agency known as the Office of Hawaiian Affairs, or OHA. The agency administers programs designed for the benefit of two sub- classes of Hawaiian citizenry, “Hawaiians” and “native Hawaiians.” State law defines “native Hawaiians” as descendants of not less than one-half part of the races inhabiting the islands before 1778, and “Ha- waiians”—a larger class that includes “native Hawaiians”—as descend- ants of the peoples inhabiting the Hawaiian Islands in 1778. The trust- ees are chosen in a statewide election in which only “Hawaiians” may vote. Rhode* This article explores the leadership challenges that arose in the wake of the 2020 COVID-19 pandemic and the widespread protests following the killing of an unarmed Black man, George Floyd. Lawyers have been key players in both crises, as politicians, general counsel, and leaders of protest movements, law firms, bar associations, and law enforcement agencies. Their successes and failures hold broader lessons for the profession generally. Even before the tumultuous spring of 2020, two-thirds of the public thought that the nation had a leadership crisis. The performance of leaders in the pandemic and the unrest following Floyd’s death suggests why. The article proceeds in three parts. Part I explores leadership challenges during the COVID-19 pandemic and the missteps that put millions of lives and livelihoods as risk. It begins by noting the increasing frequency and intensity of disasters, and the way that leadership failures in one arena—health, environmental, political, or socioeconomic—can have cascading effects in others. Discussion then summarizes key leadership attributes in preventing, addressing, and drawing policy lessons from major crises. Particular attention centers on the changes in legal workplaces that the lockdown spurred, and which ones should be retained going forward. Analysis also centers on gendered differences in the way that leaders addressed the pandemic and what those differences suggest about effective leadership generally. Part II examines leadership challenges in the wake of Floyd’s death for lawyers in social movements, political positions, private organizations, and bar associations.

Donald Trump is the most recent example of a U.S. president who has constructed his own successful business empire before his political life. At state level, successful business figures have turned into politics and won governorship in different states. For example, Rick Scott, the 45th governor of Florida, was the owner of Hospital Corporation of America and a venture capitalist, and Kevin Stitt, current governor of Oklahoma, was the founder, chairman and CEO of Gateway Mortgage Group. These candidates have successful executive experience as business leaders, while many of them have little or no experience in public offices prior to their governor tenure. Their professional career path distinctively contrasts with “conventional” career politicians who typically hold law degrees, start their career from legal affair positions, and climb up the political ladder gradually. State governors are key actors in the budgeting process of the states. Governors are responsible for budget development and recommendation, in which promote their policy preference. Besides, they have line-item veto power on the state budget.

The Revolutionary generation’s hostility to executive power contributed to a weak governor system that carried over into the 19th and 20th centuries, until the Constitution was thoroughly revised in 1947.
