NOTICE OF OPPOSITION

Cartier International A.G. (“Opposer”), a corporation organized and existing under the

laws of Switzerland, located and doing business at Hinterbergstrasse 22, Postfach 61, 6312

Steinhausen, Switzerland, believes that it will be damaged by the issuance of a registration for

the mark CARTIER MANSION, applied for in Application Serial No. 86/503,160, and therefore

opposes the same. As grounds for the opposition, Opposer, by its attorneys Fross Zelnick

Lehrman & Zissu, P.C., alleges as follows:

1. Opposer and its predecessors in interest and licensees have used the mark

CARTIER and marks inclusive thereof (collectively, the “CARTIER Marks”) in connection with a variety of goods and services since long prior to any date on which the Applicant may rely. In

addition, from a period long prior to any date on which Applicant may rely, Opposer has used

the CARTIER MANSION name and mark to identify its iconic retail store in midtown

Manhattan.

2. Through long and extensive use, advertising and promotion, the CARTIER Marks

and the CARTIER MANSION mark have become extremely valuable and symbolize a reputation and goodwill belonging to Opposer exclusively.

{F1789984 1 } 3. In addition to the common law rights accruing to Opposer in the CARTIER

Marks and the CARTIER MANSION mark, Opposer owns numerous federal registrations for

the CARTIER Marks, including the following:

a. U.S. Registration No. 411,240 for use of the mark CARTIER in connection with,

inter alia, “articles of jewelry for personal wear and for precious-metal ware” in International

Classes 8 and 14, registered on January 9, 1945;

b. U.S. Registration No. 411,975 for use of the mark CARTIER in connection with

“watches and clocks and wrist watches with wrist straps and bracelets attached for securing the same on the wrist of the wearer, and traveling clocks and watches with covers of leather, fabric

and the like for protecting them while traveling” in International Class 14, registered on February

13, 1945;

c. U.S. Registration No. 413,802 for use of the mark CARTIER in connection with

“pocketbooks and shopping bags, wallets, billfolds, key cases, card cases, brief cases,

photograph cases, leather clock cases, traveling cases, overnight bags, both fitted and unfitted,

purses and pocketbooks” in International Class 18, registered on May 15, 1945;

d. U.S. Registration No. 897,537 for use of the mark CARTIER in connection with,

inter alia, “retail jewelry store services” in International Class 35, registered on August 25, 1970;

and

e. U.S. Registration No. 1,459,285 for use of the mark CARTIER in connection with

“scarves” in International Class 25, registered on September 29, 1987.

4. The foregoing registrations are valid and subsisting, and serve as evidence of

Opposer’s exclusive right use the CARTIER Marks in commerce on or in connection with the

goods and services identified in the registrations, as provided by Section 33(a) of the Lanham

Act, 15 U.S.C. § 1115(a). Many of the foregoing registrations have become incontestable

{F1789984 1 } 2 pursuant to Section 15 of the Lanham Act, 15 U.S.C. § 1065, and therefore serve as conclusive proof of Opposer’s exclusive right to use the CARTIER Marks in commerce on or in connection with the goods and services listed in those registrations, as provided by Section 33(b) of the

Lanham Act, 15 U.S.C. § 1115(b).

5. Printouts from the United States Patent and Trademark Office’s online databases reflecting the above registrations are attached as Exhibit A.

6. Furthermore, as stated above, Cartier’s well-known store in midtown Manhattan has long been referred to as the Cartier Mansion, as shown by the third-party websites describing it as such, attached as Exhibit B. As a result, consumers have come to associate the name

“Cartier Mansion” exclusively with Opposer and its goods and services, and Opposer owns considerable goodwill in that mark.

7. On information and belief, the owner of the application at issue is Cartier

Mansion, Inc. (“Applicant”), a corporation with the address of 409 East Ludington, Michigan

49431.

8. On January 14, 2015, Applicant filed Application Serial No. 86/503,160 (the

“Application”) to register the mark CARTIER MANSION (“Applicant’s Mark”) for use in connection with “hotel, motel, restaurant, bar and catering services” in International Class 43 based on a first use in commerce of October 10, 2010.

9. Applicant’s claimed date of first use is long after Opposer’s date of first use of its

CARTIER Marks, long after the date the CARTIER Marks first were registered by Opposer in the U.S. Patent and Trademark Office in connection with a variety of goods and services and long after Cartier established common law rights in the mark CARTIER MANSION.

10. Upon information and belief, Applicant had actual knowledge of Opposer’s prior rights to and interest in the CARTIER Marks and the CARTIER MANSION mark before

{F1789984 1 } 3 adopting, using, or seeking to register Applicant’s Mark. At a minimum, as a matter of law,

Applicant was on constructive notice of Opposer’s rights in its CARTIER Marks based on

Opposer’s registrations therefor.

11. The registration of Applicant’s Mark would be inconsistent with Opposer’s prior rights in its CARTIER Marks and its CARTIER MANSION mark, as well as inconsistent with

Opposer’s statutory grant of exclusivity of use of its registered marks, and would destroy

Opposer’s investment and goodwill in its marks.

CLAIM FOR RELIEF UNDER SECTION 2(d)

12. Opposer repeats and re-alleges each and every allegation contained in paragraphs

1 through 11 as if fully set forth herein.

13. Opposer’s CARTIER Marks and its CARTIER MANSION mark are exclusively associated with Opposer and have been used continuously by Opposer since a date prior to any date on which Applicant can rely.

14. Applicant’s Mark is identical to Cartier’s CARTIER MANSION mark, and confusingly similar in appearance and commercial impression to Opposer’s CARTIER Marks, and is likely to create an association with both.

15. Applicant seeks to register Applicant’s Mark for services closely related to goods that have been provided by Opposer under its CARTIER Marks and its CARTIER MANSION mark.

16. By virtue of Opposer’s longstanding use of the CARTIER Marks and the

CARTIER MANSION mark, the goodwill associated with the marks, and Opposer’s registrations (including the incontestable registrations) therefor, the registration by Applicant of a mark confusingly similar to the CARTIER Marks and the CARTIER MANSION marks for services related to those offered by Opposer under the CARTIER Marks and CARTIER

public into mistakenly believing that Applicant’s services offered in connection with

Applicant’s Mark originate from, come from, or are otherwise associated with Opposer, or that

Applicant’s services offered in connection with Applicant’s Mark are endorsed, sponsored, or in

some way connected with Opposer, in violation of Section 2(d) of the Lanham Act, 15 U.S.C. §

1052(d).

CLAIM FOR RELIEF UNDER SECTION 43(c)

17. Opposer repeats and re-alleges each and every allegation contained in paragraphs

1 through 18 as if fully set forth herein.

18. Opposer’s CARTIER Marks are famous marks, and became so prior to the

earliest date upon which Applicant can rely.

19. Because the CARTIER Marks have become famous, Applicant’s use and

registration of Applicant’s Mark will damage Opposer by trading on the enormous goodwill

associated with the CARTIER Marks and diluting their distinctiveness. Thus, Applicant’s use

and registration of Applicant’s Mark in connection with the services identified in its Application

are likely to cause dilution of Opposer’s famous CARTIER Marks, in violation of Sections

13(a) and 43(c) of the Lanham Act, 15 U.S.C. §§ 1063(a), 1125(c).

20. By reason of the foregoing, Opposer is likely to be harmed by registration of the

Application for Applicant’s Mark.
