3 Glossary Affected Household: All members of a project affected household residing together and operating as a single economic unit, who are adversely affected by the Project or any of its components; may consist of a single nuclear family or an extended family group. Compensation: Money or payment in kind to which the affected masses are entitled in order to replace the lost asset, resource or income. Displaced Persons: In the context of involuntary resettlement, displaced persons are those who are physically displaced (relocation, loss of residential land, or loss of shelter) and/or economically displaced (loss of land, assets, access to assets, income sources, or means of livelihoods) as a result of (i) involuntary acquisition of land, or (ii) involuntary restrictions on land use or on access to legally designated parks and protected areas. Entitlement: Range of measures comprising compensation, income restoration, transfer assistance, income substitution, and relocation which are due to displaced persons (DPs), depending on the nature of their losses, to restore their economic and social base. Involuntary resettlement: Development project results in unavoidable resettlement losses that DPs have no option but to rebuild their lives, incomes and asset bases elsewhere. Land Acquisition: The process whereby a person is compelled by a government agency to alienate all or part of the land a person owns or possesses to the ownership and possession of the government agency for public purpose in return for compensation. Relocation: The physical resettlement of a DP from her/his pre-project place of residence. Replacement Cost: Compensation for acquired land, structures and other assets, including (i) fair market value, (ii) transaction costs, (iii) interest accrued, (iv) transitional and restoration costs, and (v) other applicable payments, if any Resettlement plan: A time-bound action plan with budget setting out resettlement strategy, objectives, entitlement, actions, responsibilities, monitoring and evaluation Vulnerable groups: Distinct groups of people who might suffer disproportionately from resettlement effects

I. Executive Summary A. Project Description 1. The Peshawar Sustainable Bus Rapid Transit Corridor Project (PSBRTC) will contribute to the development of a sustainable urban transport system in Peshawar. The project outcome will be to improve public transport in Peshawar, directly benefiting a population of at least 0.5 million. The project will consist of two interlinked outputs: (i) full restructuring of a 24.65-kilometer (KM) BRT corridor, which is 16+302 KM at grade and 8+348 KM elevated, 5+279 KM underpass u turns including BRT dedicated lanes, mixed traffic lanes, bicycle lanes, parking lanes facility at 39 stretches, sidewalks, green areas, 32 bus stations, 2 depots on eastern and western side, 1 staging station, 2 U-turns flyover, 24 pedestrian bridges (including 1 with access through a tunnel), 8 feeder routes and 102 off corridor bus stations, sub-bus stations (# are not known yet), energy-efficient streetlights and proper drainage to climate-proof the BRT infrastructure; and (ii) effective project management and sustainable BRT operations through institutional and organizational developments. The project will provide an integrated bus rapid transit (BRT) corridor, focusing on accessibility, passenger time savings and alleviating congestion for car users and reducing vehicle operating cost and carbon emissions, which will in turn help make Peshawar safer, more live able, and would foster gender equity. As part of the Detailed Design Works, Mott MacDonald Pakistan (MMP) was contracted by Peshawar Development Agency (PDA) in May 2017 in order to update the draft Land Acquisition and Resettlement Plan (LARP) (which was prepared by following the Preliminary Design of Peshawar BRT and approved by the Asian Development Bank (ADB) in April 2017 by following the changes made at the stage of detailed design. 2. In order to ease the approval, implementation and monitoring processes, the land acquisition and resettlement requirements of the Project is documented separately for each civil works package.

B. Summary of Land Acquisition Impacts/Status of compensation payment- Reach1 3. A total of 174.4 kanals of private land (~21.8 acres) have been acquired for construction of BRT at Sardar Garhi, impacting 73 DPs including 44 Males and 29 Females with a total cost Rs.1.095.181 Million for payment as compensation. Of this amount, Rs. 1,090.654 million (~99%) have been paid to 67 DPs (~92%). The payment of remaining amount of Rs. 4.527 Million to the remaining 6 DPs is under process, which is expected to be

5 achieved by end of January 20189. The affected building structures at Reach1 had a cost of Rs. 36.581 million payables to 74 DPs (that included 73 Males and 01 Female). To date, 67 DPs (~ 91%) have received Rs. 35.090 (~96%) while the cases of remaining amount Rs.1.491 Million (4%) to 7 DPs are under process and are expected to be paid in January 2019. 4. The Resettlement and Rehabilitation (R&R) Assistance involve two types of allowances covering lump sum and monthly payments for income loss. Total costs of Resettlement & Rehabilitation of DPs at Reach1 are Rs.71.215 Million for R&R assistance to 266 DPs including 263 Male and 03 Female. out of 266 DPs 232 DPs have paid 62.460 Million, the remaining 34 DPs will be paid Rs.8.755 Million hopefully by January 2019. 5. Compensation for crops will be paid to a total number of 12 DPs. The compensation amount calculated as Rs. 0.777 Million. Out of 12 DPs 09 DPs have paid Rs. 1,090.654 Million, the remaining 03 DPs will be paid an amount of Rs.0.284 Million hopefully by January 2019. In case of fruit and wood trees, a total of 26 DPs had to be paid an amount of Rs.4.744 Million, out of Rs.4.744 Million Rs.2.760 have paid to 21 DPs, the remaining 05 DPs will be paid Rs.1.984 Million hopefully by January 2019.

C. Summary of Land Acquisition Impacts/Status of compensation payment- Reach2 6. In Reach 2, under the category of allowances for rehabilitation/livelihood restoration payments, 18 DPs were paid an amount of Rs. 2,520,000 and vendors 18 have paid Rs. 810,000. D. Summary of Land Acquisition Impacts/Status of compensation payment- Reach3 7. In Reach 3, under the allowances (Rehabilitation/ Livelihood Restoration) payments, 7 DPs (vendors) were paid an amount of Rs. 980,000 and 07 vendors have given Vulnerability allowance worth Rs. 315,000. E. Overall cost of LARP Implementation 8. Total cost is Rs1,215.683 Million, out of which amount worth Rs. 1,197.007 Million have paid to 474 DPs, remaining 75 DPs will be paid Rs.18.676 Million hopefully by the end of January 2019.

6 II. Introduction A. Project Background and Description 9. The Peshawar Sustainable Bus Rapid Transit Corridor Project (PSBRTC) under construction with the financial assistance from the Asian Development Bank will contribute to the development of a sustainable urban transport system in Peshawar. The project will improve public transport in Peshawar, directly benefiting a population of at least 0.5 million. The project will consist of two interlinked outputs: (i) full restructuring of a 26-kilometer BRT corridor, including BRT dedicated lanes, 31 stations, 2 depots, mixed traffic lanes, bicycle lanes, parking, sidewalks, green areas, energy-efficient streetlights and proper drainage to climate-proof the BRT infrastructure; and (ii) effective project management and sustainable BRT operations through institutional and organizational developments. The Location Map of the Project is given as Figure 1.

7 B. Introduction and Purpose of internal Monitoring Report (IMR) Introduction 11. Monitoring of development activities provides government officials, development manager, and civil society with better means for learning from past experience, improving service delivery, planning and allocating resources and demonstrating results as a part of accountability to key stakeholders. The purpose of internal Monitoring is to look into the physical as well as financial progress of the projects and analyze the compliance with the approved Resettlement Framework, Resettlement Plans and ADB’s Safeguard Policy Statement 2009 (SPS). Internal Monitoring Report is presented twice in a year, the objective of Internal Monitoring Report is to determine whether resettlement objectives are being achieved and more importantly whether livelihoods and living standards of those affected are enhanced or at least restored, and project risks and negative impacts mitigated. The specific objectives for internal monitoring are to determine: (i) whether the implementation of land acquisition and resettlement of project is in compliance with the approved LARF and LARPs; (ii) the availability of resources and the efficient, effective use of these resources to implement land acquisition and resettlement (LAR) activities; (iii) hat resettlement institutions are well- functioning during the course of project implementation; (iv) LAR activities are undertaken in accordance with the implementation schedule described in the LARP/RPs and; (v) to identify problems, if any, remedial actions and to consolidate lessons learned from practical experiences. 12. Thus, the purpose of this IMR is to present progress of ongoing implementation of LARP/RPs The report reflects current situation of land acquisition disbursement of compensation and the DPs views related to LAR matters of the project. Scope in LARP Implementation 13. The second semi–annual monitoring report outlines the monitoring of the implementation LARPs of Reaches 1, 2 and 3 to a period of May 2018 to November 2018. 14. As per the loan agreement (para 12a Schedule 5), draft/updated LARPs/RPs internal monitoring is to be done on a semi-annual basis. The report covers most of the key indicators provided in the monitoring chapter of the approved LARP, (including brief explanation in case of deviation from the original plan) as follows: a) Review effectiveness of land acquisition and resettlement planning process, i.e., adequacy of enumeration of project land acquisition and resettlement impacts, timeframe, budgetary provision, institutional arrangements, GRM, mitigation of unforeseen resettlement impacts etc.). b) Consultations organized, and dissemination campaign carried out with regard to LARP and DPs are aware of, i.e., entitlement packages, payment procedures, grievance redress mechanism, etc. c) Verification whether land and assets situated to the land, resettlement and rehabilitation assistance payments made only to entitle DPs recorded before cut- off date. d) A grievance redress committee is established during the stage of detailed engineering design to ensure fairness and transparency during the LARP implementation process. e) Finances for compensation, resettlement and rehabilitation assistance provided on time.

8 f) Advance notices were served to DPs including LARP categories: One-month notice to Vendors and 2 months’ advance notices to land owners/agriculture, tenants of Sardar Garhi, owner/lessees/shopkeepers/employees of Zia market, Hashtnagri & Firdous Underpasses and mosques committees given before shifting/relocation. g) Timely disbursement of compensation, resettlement and rehabilitation assistance amount to DPs as per schedule in an efficient and transparent manner and in conformity with the provisions in the Entitlement Matrix. h) The LARP compensation amount facilitated /enabled relocation of affected vendors which simplified shifting their businesses to alternative business sites. i) Provision of employment opportunities to potential eligible project affected households in construction works. j) Verify recording and addressing the concerns/grievances of DPs are dealt on timely basis during and after land acquisition and resettlement process and consistent with the LAR. k) Major issues of conflict between DPs and contractors are addressed efficiently during implementation of resettlement activities. l) Effective monitoring of LRP and issues identified for immediate actions will be referred to the PM-PMU and Project Director of TMTD, and NGO for modifications in the LRP based on the progress and lessons learned in the course of LRP implementation and additional funds to cover additional activities. m) Effective implementation of Gender Action Plan, collection of gender disaggregated data and gender specific consultations with women. n) Degree of satisfaction of DPs and AHs with support received for restoration of their income and livelihood. o) Any changes in social and economic parameters related to living standards of AHs. p) Efficient restoration of public utilities and/or other affected services/infrastructure. q) Lease agreements signed for the temporary use of land, full restoration of land after completion of construction. 15. The project is categorized as category A for social safeguards issues. This report presents project background and its components, project’s progress in terms of consultations with DPs, compensation of Rehabilitation & resettlement assistance and grievance management. This internal monitoring report, prepared by PDA provides an updated status of LARP implementation and payments made to the DPs covering the following: a) No. of affected persons (DPs); b) Status of land acquisition; c) Loss of structures and status of payments and income restoration; d) Affected fruit and timber/ wood trees and status of their payments; e) Affected crops and payments; f) No. of DPs paid, unpaid and being paid; g) Payment of allowances; h) Linear map of the BRT and visualization of impacts and compensation Payment i) Consultation meeting with stakeholders j) Complaints/redress management; k) Gender action plan implementation l) Conclusions and recommendations.

9 III. Methodology And Approach A. Approach Followed 16. The methodology and approach has been adopted for the preparation this internal monitoring report included the following: formal and informal consultative process are being carried out for the project including, but not limited to Focus Group Discussions (FGDs), public meetings, community discussions, and in-depth and key informant interviews in addition to the censuses and socio-economic surveys. The following procedures have been adopted during monitoring of resettlement plan implementation:  Reviewing the functioning of the institutional mechanism and resettlement implementation proposed in the LRP/RPs;  Analyzing LARP, procedures of entitlement, compensation payments processes, and agreed ADB’s Social safeguard & Resettlement Policy;  Verifying the records of data/information on compensation payment to DPs against their entitlement by types of compensation for each individual DPs provided in LARP/RP documents;  Conducting consultation/meetings with different stakeholders of the project including project affected & project beneficiaries and contractor’s staffs/workers employed for BRT construction works;  Interacting with DPs through consultations and interviews to assess their level of satisfaction with resettlement and rehabilitation assistance disbursement process and grievance redress mechanism. 17. In line with the above procedures, following activities were carried out for internal monitoring and progress reporting. Review of Project Documents 18. The review of the documents was carried out during the reporting period. The main documents reviewed and finalized included the land acquisition and resettlement plans of various reaches and other safeguard related documents such as Due Diligence Report (DDR), addendum and design plans which enabled the PIU to follow an appropriate line of action for the implementation of LARP/RPs to accomplish the objectives of the assignment. 19. From design to implementation the project is being implemented on fast track. Due to changes in project design, the LARPs/RPs were required to be continuously, being revised and updated. As anticipated, the preparation of addendums and DDRs will continue till the completion of this BRT project. Data Collection and Analysis 20. The preparation of Due Diligence Report (DDRs), addendum of most of the LARP/RP related documents have been prepared through consultations with DPs, conducting surveys and collection of regular data and analysis. Both the social and resettlement units at PIU, PDA and Project Management Construction Supervision Consultants (PMCSC) were involved in data collection and analysis in the impact assessment and verification.

10 Consultation with Key Stakeholders 21. Several consultation meetings were held with the stakeholders during the progress reporting period summarized below.  A number of regular meetings held with Deputy Commissioner/District Revenue Office Tehsildar / Patwari confirming funds transferred, document sharing, request for sections notification under LAA and land demarcation in Sardar Garhi required for BRT.  Meetings held with Directors/Deputy Directors PDA of Reach 1, 2 and 3 for DPs right sensitization, on the spot complaint resolution and sensitive grievance redress.  Meeting with PMCSC for data cleaning, verification of missed DPs and current unit rate estimation and help for DP identification and determining eligibility for compensation payment.  Regular meetings with KPUMA, TMDT and Trans Peshawar to discuss allocating BRT Commercial spaces to DPs and gender related issues.  Conducted numerous meetings with representatives of DPs of Sardar Garhi, Zia market, Hashtnagri underpass, vendors of Reach 1,2 and 3.  Meetings held with DPs for disclosure of full information to women and vulnerable DPs to make them aware of their entitlements and obligations, compensation and allowances, complaints and grievance redress procedures.  Regular meetings with DPs to guide them in account opening and assisting them to obtain their CNICs.  Meetings and consultations undertaken with key stakeholder were regularly documented and action points were followed up.  Meeting with DPCs to make them to understand the grievance redress mechanism established at PIU.  Meetings with ADB mission for sharing project progress and updates.

11 IV. Institutionalisaion of LARP/RP Implementation Process A. Institutional Roles and Responsibilities 22. The Project’s executing agency (EA) is Khyber Pakhtunkhwa Urban Mobility Authority (KPUMA). Transport and Mass Transit Department (TMTD) provides administrative and secretariat support to KPUMA through the PMU at TMTD and with support of the Project Management, Coordination and Capacity Building (PMCCB) consultants. KPUMA is responsible for overall coordination of the project and ensure availability and timely release of counterpart funds. The project Implementing Agencies are (IAs) Peshawar Development Authority and Trans Peshawar. 23. Peshawar Development Authority (PDA) is the Implementing Agency of LARP/RPs. PDA is responsible for day-to-day implementation/operations of LARP/RPs and has established adequate and appropriate systems for LARP/RPs implementation including institutional arrangements, internal monitoring and reporting. PDA has also been managing functions of consultants, contractors and other relevant parties regarding social safeguards management. The Design and Supervision Consultants are carrying out the supervision of the project, including social and environmental management and supervision and monitoring of LARP/RPs and EMP implementation. 24. EA is supported by Project Implementation Unit (PIU) housed within PDA assisted by the Social Team for Resettlement Plan Implementation (STRPI). The PDA is using the services of the STRPI with assistance from the Project Management Construction Supervision Consultants (PMCSC) for implementation of the LAR related activities including implementation of R&R assistance to DPs and in liaison with Deputy Commissioner, Peshawar for land acquisition and subsequent compensation payment to DPs. 25. The Land Acquisition and Resettlement Plan Implementation Committee was established and notified by PDA to ensure that safeguard management including land acquisition is in compliance with ADB, SPS 2009 requirements as well as to resolve field related issues see Annex 1. 26. A Resettlement Assistance Disbursement Committee was established and notified to assist PDA, the implementing agency in fulfilling its obligations relating to transparent and timely payment of resettlement and rehabilitation assistance to DPs of the project according to the entitlements of each category of DPs as per approved LARP/RPs documents, Annex 2. 27. To ensure effective implementation of Grievance Redress Mechanism, a Grievance Redress Committee (GRC) was established and notified to review and investigate all grievances lodged by DPs and effectively address and resolve them in a timely manner. The Social Development and Resettlement Specialist has been serving as a member/secretary of the GRC, Annex 3and GRC Meeting Notification as Annex 4. 28. The Reach-wise focal persons were nominated and notified to lead to the “First Tier of the Grievance Redress Mechanism” for timely and effective resolution of grievances to ensure the successful implementation of the Project. The STRPI has been facilitating the focal person of each Reach in investigating and providing guidance in grievance redress matters and record keeping, Annex 5. 29. DPs Committees (Shura) already established was activated and revitalized to represent and safeguard interest of DPs. The Shura is also playing the role of a bridge

12 between PIU and DPs and helping in grievance resolution. Male & Female DPCs at Sardar Garhi were established and are functioning. 30. A Gender Focal Group comprised of KPUMA, Trans Peshawar, STRPI, PMCSC and Social Welfare Department was established to implement Gender Action Plan. The focal group convenes meetings on monthly basis to review the Gender Action Plan. 31. The EMA’s contract that was delayed much due to the procurement related issues, was signed by PDA and the EMA consultant on 10 Dec 2018. With this, EMA consultant is expected to mobilize within a week and provide 2nd semi-annual social monitoring report (external) for review, approval and disclosure before end of December 2018.

13 V. Progress on LARP/RP Implementation A. LARP/RP Review, Endorsement and Implementation 32. The Land Acquisition and Resettlement Plan (LARP/RPs) are prepared for Civil Works Construction of all three Reaches were approved by KPUMA and ADB and uploaded on PDA and ADB websites. The addendum of Reach 1 has prepared by the PMCSC due to additional impacts following the design changes. Land acquisition for construction purposes, e.g., for construction of bus stations and other allied structures as well as warehouses for storing construction materials & equipment at all reaches have done on need basis. B. Disbursement of compensation payments to DPs Compensation payments for affected Assets 34. For compensation payment, as per the entitlements of DPs provided in the LARP of each Reach were studied and analyzed. As per the project R&R policy, all affected households are entitled to a combination of compensation measures and resettlement assistance, depending on the nature of their ownership rights over the affected assets and the scope of the impact, including the social and economic vulnerability of the affected persons. The compensation disbursement plans have been prepared for all the affected non-titleholders and for the titleholders as per the provisions of the LAA 1894 and SPS 2009 are being followed in disbursement of land compensation to the affected land owners. The competent authorities for Land Acquisition (LAC) and PDA have prepared the plans for providing compensation for

18 those who lose their lands and assets as per the provisions. in general terms, the DPs in the project are entitled to the following types of compensation and assistance:  compensation for loss of land, trees, etc. at replacement value;  compensation for residential/commercial structures at replacement value;  assistance for loss of business/wage income;  assistance for shifting;  rebuilding and/or restoration of community resources/facilities; and  special additional assistance for vulnerable households Preparation of Claim Forms and Payment Vouchers 35. DPs claim forms and payment vouchers were prepared for each DP and verified by all concerned stakeholders with details category of women and vulnerable DPs, asset lost, compensation and all types of resettlement and rehabilitation assistance. LAC and Director Finance were orientated on claim forms and payment vouchers. All compensation payments conducted in transparent manner. ADB Consultants monitored the initial compensation payments process. C. Project Impacts and Compensation Disbursement Status of Reach 1 LARP Implementation: 36. Total number of DPs are 418 in number. Table 4 summarizes the type of impacts and status of compensation payment to each category of affected assets.

D. Land Acquisition Impacts and Compensation Payment 37. The list of DPs has been vetted and finalized by the LAC as per the details available in the revenue records and LARP. The compensation for the titleholders in the impact survey were estimated as per the provisions of Land Acquisition Act 1894. Most of the individual titleholders received their compensations. A total of 174.4 kanals land was required for the construction of BRT at Sardar Garhi, which has been fully acquired. A total amount of land compensation was calculated Rs. 1,095.181 Million was to be paid to 73 DPs. Out of which, Rs. 1,090.654 Million have been paid to 67 DPs. The remaining 6 DPs has to be paid an amount of Rs. 4.527 Million, there are six female titleholders who have not received their compensation due to incomplete documentation. Compensation payment cheques have been prepared by DC Office, community have communicated by PMCSC and STRPI, but due to inheritance issue these female affectees are not responding to DC Office despite repeatedly communicated to them by PMCSC. Further details about land compensation to the DPs are provided in Table 5. The rates of the crops and trees have been assessed by officials of agriculture and forest department keeping in view the of the current market rates. E. Payment of Residual Land 38. As far as payments of Residual lands are concerned, there is only one case of 5 Marla land strip owned by Zahidullah at Chamkani. Mr.zahidullah have approached to court four months ago to be consider his land as residual land, the case is in court for the last four months, pending for decision.

20 F. Payment of Affected Crops 39. Compensation for crops will be paid to a total number of 12 DPs. The compensation amount calculated as Rs. 0.777 Million. To date nine DPs were paid Rs. 1,090.654 Million and the remaining three DPs will be paid Rs.0.284 Million, Payments are expected by January 2019. G. Payment of Affected Trees 40. In case of fruit and wood trees, a total of 26 DP had to be paid an amount of Rs.4.744 Million. During the reporting period, 21 DP have been paid an amount of Rs. 2.760 Million. The remaining 5 DPs are to be paid an amount of Rs. 1.984 Million, Payments are expected by January 2019. 41. H. Payment of Affected Building Structures 42. Census survey results show that total amount of compensation for loss of residential/ commercial structures was Rs. 36.581 Million has to be paid to 74 DPs including one female owner of a commercial structure. Both residential and commercial structures will be impacted due the BRT construction. Out of 74 DPs 67 DPs have compensated Rs. 35.090 Million, the remaining 07 DPs will be paid Rs.1.491 Million by January 2019. I. Payment for Resettlement and Rehabilitation Assistance 43. The Resettlement and Rehabilitation (R&R) Assistance involve two types of allowances covering lump sum and monthly payments for income loss. For allowances (rehabilitation/ livelihood restoration) payments, 266 DPs including three female DPs had to be paid an amount of Rs. 71.215 Million. Out of total, 232 DPs have been paid an amount of Rs. 62.460 Million on account of allowances/ livelihood restoration including income loss, relocation, shifting allowance and vulnerability allowance. The remaining 34 DPs has to paid Rs. 8.755 Million by January 2019. The summary of the assistance provided for the affected persons are given in Table 7.

The compensation payment to the remaining DPs is undergoing. It was discussed with the Project Director that the Lump sum payment to all DPs will be completed at the end of September 2108. However, the monthly payments to DPs are conditional to the completion of the rehabilitation and construction work and handing over shops back to the DPs. The decision on the mode of payment to the unique DPs such as Afghan nationals, blocked NIC holders and underage DPs are still awaited. 51. Table 13 provides an Action Plan for the payment disbursement to the remaining unpaid DPs.

VI. Consultation, Participation and Information Disclosure A. Stakeholder Consultation and Participation 52. Consultation meetings, group discussions and in-depth interviews were conducted with DPs in each reach (including representatives of poor households, households which are required to resettle and households losing their business or agricultural land) and provided timely, relevant, understandable, and accessible information, in a culturally appropriate manner, free of coercion and intimidation. Stakeholder engagement logs, and meeting minutes were prepared and were made available to DPs and other relevant stakeholders when required. 53. Regular public consultations and meetings have made with the affected households to make them fully understand about the compensation and related procedures of the LAR. Majority AHs were satisfied with the LA process, fair appraisal of the property, timely payment and LAR policy arrangement. Consultation meeting with group of DPs continued on weekly basis especially in Sardar Ghari with DPs of Zia Market and Firdous and Hashtnagri underpasses affected significantly. 54. A number of preliminary field/ site visits, meetings, discussions with officials of PIU, STRPI, contractors, consultants as well other key stakeholders were carried out to coordinate, clarify and implement project design and LARP/RP implementation issues.

Meetings were held with Deputy Commissioner (DC), Additional Deputy Commissioner (ADC), Tehsildar to expedite the land acquisition process and issuing of the required sections under the Land Acquisition Act, 1894. The team made several visits along with Patwari to demarcate the acquired land in Sardar Ghari and conducted assessment of affected trees and crops to commence compensation payment to DPs for affected land and structure. The detailed findings of consultations with DPs during the reporting period are provided as Annex 7. B. Information Disclosure 56. The ADB-approved safeguards documents have been disclosed on PDA website in line with ADB’s SPS 2009 requirements. In view of difficulty for DPs to comprehend LARP in English, the LARP Reach 1 was translated in Urdu and disseminated to DPs of Firdous and Hashtnagri and Zia Market DPs. Executive summary and entitlement matrix of RPs of Reach 2 and 3 were also translated in Urdu and distributed among DPs. C. Status of Grievances Launched and Resolved Grievance Redress Mechanism 57. With a view to likeliness of grievances during LARP/RP implementation, provision of constituting a Grievance Redress Committee (GRC) has been made and notified to minimize expected protracted and expensive litigation. The GRC is being coordinated by Social Development and Resettlement Specialist as the Secretary of the committee. 58. The main responsibilities of the GRC at both PIU and DC level is (i) provide support to affected people on problems arising from land/property acquisition; (ii) record DP grievances, and resolve them. The GRC is expected to resolve grievance of the eligible persons within a stipulated timeframe. 59. The three-tier grievance redress mechanism (GRM) was established to ensure systematic disclosure of information, hearing and recording of complaints, proper arrangement for addressing conflicts and appeal procedures regarding eligibility and entitlements as well as the implementation of resettlement activities. Through an outreach program, DPs were informed on how the mechanism will work and ensured it is accessibility to vulnerable and women DPs. The GRM was translated in Urdu and distributed among DPs. D. Grievance Status 60. To date, 32 complaints were received, out of total 23 have resolved 03 have rejected, 02 have referred to concern department and 04 are under process at PIU level, these have summarized in Table 14. A close follow-up was carried out with the complainants to address their complaints. In this regard, precautionary measures were adopted through conducting various formal and informal meetings with the aggrieved persons to manage their grievances. In such meetings the BRT alignment design, PDA owned ROW limits, LAR impact assessment including eligibility, entitlement provisions under project resettlement plan were explained. Some of the grievances involved missing names of DPs in the impact assessment and misunderstanding regarding the unit rates and eligibility criteria of DPs to be entitled for compensation were resolved timely. However, the grievances of critical nature to be resolved are in process are provided in the Table15. PIU is involved in the preparation of the documents related to grievances, follow up action taken to resolve along with explanatory note on nature, seriousness of grievance to be redressed. Two complex nature of grievances were investigated, mediated and concluded and undertakings of DPs are provided as Annex 9.

The report comprises of the social achievements against the set social targets by social section and also describes the non-achievable, responsible institution, action taken and remarks etc. The report also discusses the variation in achieving these targets (if any) and highlights the challenges/ social constraints in the process of achieving these targets. It further elaborates the responsible actor in percentage failed in achieving them. 63. All the three Reach have the same targets & achievements and also the characters are the same at them. VIII. Gender Action Plan Implementation A. Introduction 64. This Gender Section shares updates and progress made on LARP/RPs implementation of Peshawar Sustainable Bus Rapid Transit Corridor Project (PSBRTCP) using gender lens. The gender mainstreaming initiatives were focused on facilitation of the more susceptible DPs particularly women and the potential BRT commuters including women, disabled and the vulnerable. 65. The PSBRTC is classified as Effective Gender Mainstreaming (EGM) Project. Women have been provided increased assistance in all project related activities that target men and women. A Gender Action Plan has been developed involving all stakeholders and is being implemented. Regular consultations were conducted with all stakeholders including DPs of the BRT corridor. B. Progress on GAD Implementation 66. Information disseminated to women DPs, and vulnerable DPs of Sardar Garhi and the two Underpasses were provided information through regular meetings on project impacts on assets/income; LAR and Gender Policy, entitlements/obligations, disbursement, complaints; GRMs, M&E of LARPs, GAP; information. Eviction, timeframe. In brief, during the reporting period, following activities were carried out for effective implementation of the GAP. 67. The GAP team (PIU/PMCSC) has successfully established and activated two DPCs at Sardar Garhi. DPCs have helped women where they easily communicate their grievances with

39 the committee team lead/president of their resettlement amount or their future livelihood plans. These meetings are part and parcel of GAP. The total number of DPs at Sardar Garhi are 73. This includes 17 families that are affected by the PSBRTC this includes 28 women. 68. Women groups have been formed in Sardar Garhi during the month of April and May 2018. The purpose of the formation of group was to ensure that women are equally consulted and participated in the implementation of the GAP and LARP implementation. During the meeting women shared their views regarding problems in getting compensation and resettlement assistance. 69. A series of visits s have been done to PDA during the compensation process and assisted women DPs and resettlement social and gender team. During the meeting women gave their views on the satisfaction of the DPs regarding compensation amount. Total 28 women are affected from the corridor and as per ADB safe guard policy they have been compensated. Women highlighted that they acquired job for their male family members who have different expertise. 70. Two meeting has been done with the Women Chamber of Commerce Entrepreneur Peshawar on5th, and 22nd March 2018 on the GAP output-1 section 1.5 (Entrepreneurship of women in BRT commercial places. WCCIP shared the Peshawar women entrepreneur’s lists which is further shared with the Trans Peshawar for the GAP out put one section 1.5 Establish commercial spaces for small women entrepreneurs in BRT system, prioritizing those in affected household. 71. Four to five liaison meeting have been done with the UN Women at Peshawar office for the introduction of PSBRTC related GAP.UN Women head invited BRT GAP Team to the CM House on the ceremony of hand over the Pink Buses to the CM for Abbottabad and Mardan. The ceremony was participated in by CM & his cabinet, UN Women, UNOPS, Ambassador Japan, Information Technology Board (KPITB) and the UN women Sakura buses safe women mobility mobile application. Conducted meeting with the UN women to collect their business community’s member’s list for BRT corridor commercial spaces. UN women head Wajid raised concerned that their affiliated business community’s members are very poor, may be they could not be the part of commercial places of the corridor. 40 Case study 1: The Amina is 50-year-old widow of Mohammad Naeem (late). She lives in Qissa Khawani Bazar, Peshawar with her in-laws. She has a 15 years old son. She got marry in out of caste called Mughal, she belonged to Awan family. She completed her middle level education from Government Girls Middle school Jogivala Hashtnagri Peshawar. After completion of her education she took admission in vocational training course (sewing/stitching /carpet weaving) from Ganj Patti sewing Centre. She completed short course successfully she earned her livelihood through the skill development activities. She worked from dawn to dusk and started earning from Rs.500 to Rs. 600 per day at that time. She married with her cousin Muhammad Naeem in 2002. This was a love marriage. She spent a very happy matrimonial married life with her husband. He was Chief Building Inspector in Municipal Corporation. Recalling her husband Amina says, “My husband was very caring he used to give me a separate pocket money all mine to spend according to my wish. But I had a habit of saving money. After spending some period, I told him about the amount I saved. I offered to him for this amount I still remember his expression and he was surprised so happy. He wanted to invest that money by starting his own business. Consequently, he also increased my pocket money from to”. The clouds of darkness prevailed in her life in 2011. Her healthy and wealthy husband died due to heart attack. The success light of her life deemed certainly. That was a very painful and crucial moments of her life. Her life was shattered. All the rays of hope vanished. Keeping in view the whole circumstances she knew that she had courage to face the winds of life in the presence of her son. She was of the view that a day will must come when she will be able to stand her son and fight against these difficulties She described the grater dream of her husband about the initiation of her own business. So, she thinks about the practical implementation of her husband’s dream. She was trying to fulfill the wishes of her husband. She was so ambitious and set a goals for her destination and started business. Her relatives and friends showed the importance of different types of business. One gave their own suggestions and recommendations in this regards. So she was undecided, she started thinking how to utilize that money. She converts her capital in an opportunity for investment. Her brother in law motivated her to invest in shop business in a trade Centre (Gul Centre and Noor Centre). Although she had nominal academic qualifications but with her knowledge, supporting experience combined with circumstances helped her to succeed in her endeavor. So she moved this titanic slowly. She did not see and care the blessing heat of summer and showering cold nights of winter. She devoted her life for the sake of her business. She had been learnt the art of business after met with variety of different cultural people. Consequently, she is the owner of two shops at this time. One is in Gul Centre and other one in Noor Centre. Her brother in-law Wajid Nadeem gave her the idea to engage labor in shop to manage business on monthly basis. She had innovative ideas regarding business management. She started two businesses at the same time one a saloon which was run through skilled labor and other a sell of cosmetics products in a shop. She optimum utilized the available resources by selling food commodities in the Holy month of Ramadan and earns more money. The urban area of Peshawar culturally is still rigid and conservative. The Women have faced difficulty to running their business in the open markets and open spaces. But in that culture her in-laws helped to find out best strategies to empowering her. They assist her a lot and provides management skill and troubleshooting, she has strong character in terms of trust

41 building, transparency and dignity among shopkeepers. They even record and share their communication with her regarding the financial record keeping that they record by making a film of their conversation to maintain transparency and mutual trust. Told she will in absence of Wajid Nadeem. He made all my work easer and created space where I could work easily and frequently communicate with my labor team”. Bus Rapid Transit proved to be a turning point of her return in the existing business. Her beautiful sources of earing stopped suddenly. Her shops were demolished. It was purely for the betterment of public interest. So she accepted it warmly and happy with the government initiatives. She was satisfied with the attitudes of all development player. She praised the field team of concerned department how contacted with her during that process. Now she is happy with the officials of Land Accusation Resettlement plan for the financial assistance provided by PDA on monthly basis. She explained about the appropriate evaluation of her business. She further told the monthly income and compensation amount from the concern department she said about the monthly receiving amount of Rs. 75000 per month. She was of the view that she will get back her shops very soon. She told another story of 12 years ago when the Revenue Department took her in-laws land still not yet been paid or compensated in any form. She compared the dealing of the both department and financial mode of payment. She and her brother in law praised PDA financial support and payment mechanism. She told her future plan of action to fulfill her husband’s dream. Now she has a dream to build her own house that will display the mane plate of her husband along with his designation. She intends to own shops in the BRT commercial spaces which will be allocated for women on the completion of corridor. She hopes for the best in future. 76. Case study 2: Rukhsana daughter of Raheem Bakhsh lives in QissaKhawani Bazar “the bazar of story tellers” the place where, caravans used to arrive from different Asian states, travelers/traders staying in the inns, enjoying cup of tea while listening to the stories of the story tellers till late nights in 19th, century. Qissakhawani Bazar has a historic value in the Peshawar city. She is with her parents since the last seven years after her separation from her husband Kifayat Khan. She was married in the year 2000 with Kifayat khan a Mohmand living in Charsadda. By family they are Mughal. She has an eleven years old son Ahmed Ali; her elder daughter Palwasha died of Diarrhea in2003 at the tender age of 3 months. Rukhsana was born in 1974.She completed her intermediate education from Frontier College Peshawar. She started typing and short hand at Government Rural Academy Bacha Chowk Peshawar. She got marry at the age of 27 years with Kifayat Khan. The hardships and bitterness of her life started. Her married life proved too unsatisfied for him due to the rough and tough behavior of her in laws. She victimized of domestic violence and harassment (physical & psychological) lot of times. Her husband used to beat her on petty mistakes in the daily affairs of life. The curial attitudes of her mother in-law depicted a true picture of her embodiment. She abused her in the routine matters and mentally and physically torched her. She felt pleasures and proud on her negative tactic’s. Rukhsana faced this situation from last 10 years. But her in-laws always be remained the same. She left her home several times due to physical &psychological violence from both

42 sides during that period. The elder sister of Rukhsana also got marry with Kifayat Khan’s elder brother. His brother was an Army Officer. Her sister and brother in law lived together where they placed. The negative thinking of her in laws again applied at his sister’s case. They were of the view that her sister played vital role to stop the financial assistance. They took revenge from her in this regard. They started teasing and pressurized Rukhsana, to compel her sister for timely financial assistance. She did not talk with her sister due to some certain reasons. Although she was well knowing the skills of typing and shorthand. This can be utilized for the earning purposes but her husband did not allow for a job. His life revealed a picture of help and hopelessness in the decision making. Her way of hardships came long to longer. She tried at her level best to get separation from her husband as early as possible. She always be in search of that opportunity and finally she decided to leave her husband’s home and shifted with her parents. Now she became the victim so social and cultural berries of community. Her parents were morally and financially strong in that area. They were fully cooperated and support her in these circumstances. They thanked Allah that their daughter came to their home safe and soundly. Rukhsana did not want to be a financial burden on her family. She sold her jewelry, a plot (which she got from her husband) her mother also gave her twenty-five lakh rupees to establish a business with the permission/consent of her other sons and daughters. Her brother Wajid Nadeem supported her a lot. He asked her to purchase a shop for a business purpose in the new emerging trade Centre Gul market. Rukhsana recognized the advantages and disadvantages from the household support in terms of personal independence and household support. Her initial investment was quite high compared to her economic background. She was successful in mobilizing her capital into a fruitful business due to her brother’s support. Now after all these years she is the owner of two shops in Gul Market, and also have two others shops that are rented on monthly basis by Mohmand Construction Company (Pvt) Ltd. She also hired skilled labor to run her salon business and food shops. But now the situation has changed. Due to the BRT project Firdous under pass named Gul Centre was also affected. Ruksana shops were unfortunately demolished, the PDA and ADB ensured her that they will build shops and hand over to her for business. She is hopeful waiting for the compensation. Her business was stopped since 28 November 2017. She hoped for the best. She appreciated the BRT corridor project. She also appreciated the 15 % commercial places allocation for the women. She is waiting for the completion of BRT project then she could open her shops and run their business once again with new spirit and enthusiasm. It is an evident of that single Women house hold have an opportunity to run their business in the urban area with the help of their family members. There is dire need to explore training programs for them. Where women can integrate their talent, ability and drive to transform resources in to profitable ventures. More appropriate training regarding business will provide knowledge, confidence, and calculated risk-taking capacity for the women. 77. Case Study 3: This is a case study of a 35 years old poor widow Mrs.Zakia Menhas. She lived in village Shaheed Abad Chamakni. She got marry with Younas Khan when she was only at the age of 16 years. Her husband was 30 years at that time. She was quite satisfied from her life from 1999 to the 2017. The Almighty Allah granted her five sons and one daughter. They both

43 contributed for the best future of their children. Their kids grooming day by day with the passage of time. Her husband was a security guard in the market of Firdous underpass. Her husband was very honest and dutiful person. He performed his duties from dawn to dusk. He tried at his level best to ward and watch security affairs regularly on daily basis. The market management committee was satisfied with the performance of her husband. All of sudden his husband died with sewer heart attack at the spot in October 2017.She told that after the death of Younas Khan the life become so difficult and hard to survive. She strived hard to earn her living but not yet been succeeded. Her 18 and 14years old sons are studying in 10th and 7th class, respectively. They both are providing their service in the welding work shop after their school things. They are the only source of her earning. Her brother in law more and often support them time to time. Her sons’ wages are up to Rs.1500 to 2000 per week. Her children are studying in local school excluding her daughter. Her daughter is 16 years old. She gets only primary education. Her father did not allow her to get more education. The owner of Market Mr. Mirza Khan collected a respectable Rs. 45000 amount from the resource full persons of markets. He bifurcated this amount in the different heads of her life i-e Rs. 15000 for her husband’s funeral and other arrangements. He gave her Rs. 25000 during her waiting period and livelihood. Finally, Rs. 5000 for the Ramadan and Eid celebration. Due to high rate of inflation she became under the debit Rs. 10000 from her neighborhood. Consequently, her worries increasing day by day. She had only one pet in the form of goat was only source of her earning this goat also victimized from various diseases. She thought about to sell her out in the future for the payment of her debit 10,000. On the other hand, she still forced to start her earning for other sources. Meanwhile Bus Rapid Transit project started on those days. Various types of meetings held with the community for the resettlement and compensation issues. Her husband Younas Khan was security guard of the whole market. He was also part and parcel of the affectees. His name was included in the list of beneficiaries for the compensation. She received a cheque captaining the amount of Rs.75000/= after her husband death as per Asian Development Bank’s (ADB) safe guard policy. She seemed satisfy with the cooperation and coordination of ADB’s timely financial assistance. She was illiterate and unskilled lady and unable to make some plan for the appropriate utilization of the amount of Rs.75000. First she thought about the business initiatives. Second shared out this amount as partner in the existing business. She was in a fix what to do and what not to do. Her mental situation and large family size with limited earning forced her to spend this amount on the daily expenditures. She utilized this amount from last ten months. Now her worst and miserable condition true depictions of a woman socially and economically deprivation from every aspect of the life. She is still much hope full that her eldest son will be able to get job in BRT project.

IX. CONCLUSIONS AND RECOMMENDATIONS A. Conclusions 78. As evident from the preceding sections, a considerable progress has been made for last six months in the process of the LARP/RPs implementation in terms of payment of land compensation and the disbursement of rehabilitation and resettlement assistance to DPs. Progress were also made in engaging with stakeholders, restoring livelihoods, addressing the needs of vulnerable people, ongoing follow up of grievance resolution and tracking monitoring impacts. However, the cases of unique DPs (Afghan Refugees, blocked and expired ID Cards holders and underage DPs) are still pending. Vulnerable DPs have given special attention in compensation payments and subsistence allowances. DPs have verbally asked during monthly payments about their trust and satisfaction on transparency of disbursement of compensation payments. All of them have found to be satisfied from LARP/RPs implementation process and our method of payments of disbursement. B. Recommendations 79. Potential Eligible project affectees should be given priority in project jobs, so that they may be able to earn livelihoods for their families. Lists of potential Eligible person have shared by PMCSC to concerned stakeholder including PDA, Trans Peshawar and contractor. 80. The compensation payment disbursement has been slow down due to authorization and approval process of cross checks. A dedicated time slot is required on daily basis from the Finance Department for compensation payment to DPs. 81. Following the approval of the First Semi-annual Internal Monitoring Report, the External Resettlement Monitor should be engaged for validation of the above-mentioned report. 82. in order to have on one page, strong coordination among technical and social teams needed, it is suggested that there should be a morning meeting of all stakeholders on daily basis for progress review discussions participated by all section heads in the chairmanship of team leader PMCSC. 83. Coordinated program to Brand BRT services and all of its physical elements (vehicles, Stations, Signage etc.) to differentiate it from traditional bus services and promote it as a convenient and fast alternative. 84. In connection with branding and marketing BRT should plan its schedule for potential users to use it going to office, school etc. in order to utilize bus services of BRT in the best interest of ordinary local people. 85. Unlike other public transport projects that could be managed by a single department, BRT by its nature is a project need multidisciplinary and multi-stakeholders approach. 86. Planning and implementation of BRT requires the attention and action of different institutions in the city and the provincial government.

Full participation of the relevant stakeholders in planning and implementation was essential for the smooth implementation of the project, the potential stake holders in this case were expert with huge experience, techniques, the operations of old public transport system such as mini bus, buses, vegans and actor involved in transport related activities and that felt threatened by the new system of transport. 88. Full participation of all stakeholders in planning & implementation of BRT demands communicating and networking with all stakeholders and in order to inform them about the implementation communication lines have been open to get the concerns and voices of people. 89. Consumer satisfaction survey are important tools to get feedback from the users of BRT, an expert impact assessment will be made on implementation of the project. 90. Implementation of BRT should not be limited to this corridor, expansion should take place as early as possible in order to reduce pressure on the early built system and maintain the quality of service. 91. Evaluate the system after implementation and take into consideration the response from the users 92. Lesson Learn from experience in other cities.
