Sealed tenders are invited by the undersigned from the bonafied and experienced contractors, Registered Co-operative societies formed by unemployed Engineers and Labour Co-operatives having credential of similar type of work and they have to abide by the following condition.

TERMS& CONDITIONS OF TENDER

1. Intending bidders may download tender document from e-procurement website https://wbtenders.gov.in from 15/09/2016 to 26/09/2016. The last Date of submission of Tender application with all documents is 27/09/2016 up to 5.00P.M. The prequalification documents will be opened on 28/09/16 after 2.00 P.M. by Executive officer, Jamuria Panchayat Samity. The qualified bidder list will be published up to 5 P.M on 4/10/2016. The date of financial bid opening will be on 05/10/2016.

2. Cost of tender form is to be submitted in form of demand draft in favour of ExecutiveOfficer, Jamuria Panchayat Samity only on 28/10/2016 up to 2P.M.

3. The tenderer should submit requisite earnest money mentioned in the column no. 5 in the form of BankDraft in favour of the ExecutiveOfficer, Jamuria Panchayat Samity,Burdwan only on 28/10/2016 up to 2P.M. Tender participation without requisite Earnest Money will be treated as non-responsive.

4. The following certificates should be submitted

i) Professional Tax certificate (Certificate of enrolment under state tax) along with valid up to date Challan in which valid period should be clearly mentioned.

ii) Vat registration certificate with up to date acknowledgement receipt.

iii) Income tax acknowledgement receipt (Form ITR-V) for the assessment year 2015-2016 along with PAN card.

The successful tenderer should also submit valid N.O.C. of Jamuria Panchayat Samity ( Trade license) issued for the purpose before issue of work order.

5. Registered Unemployed Engineers Co-Operating Societies are required to furnish valid By Law, Current Audit report, Certificate from, A.R.C.S along with other relevant supporting papers. 6. The undersigned preserves the right to cancel or reject any tender in partly or in fully without assigning any reason thereof.

7. Submitted credential certificate should be as follows i) It should be a certificate of similar type of work. ii) Bill value of the work mentioned in the certificate should not be less than the amount mentioned in column no 7of the above table . iii) It should be certificate of a single work, done on the basis of a single tender notice. iv) It should be signed by competent technical authority. v) Work order no, Job value, Bill value and name of work should be clearly mentioned in the certificate. vi) Date of completion of the work as mentioned in the certificate should be within five years from the date of publication of this notice.

8. The tenderer will have to visit the site of work before dropping of the tender.

9. Any other deduction like as VAT/IT/etc. will be strictly made as per Government norms from contractor’s bills.

10. The above work must be completed by the lowest accepted tenderer within stipulated time from the date of issue of written work order failing which necessary administrative steps shall be taken.

11. 1 % (one percent) cess will be deducted from bill at source over work cost for “the Building and other Construction works welfare fund” under section 18(1) of Welfare Cess Act 1998.

12. The tenders will be opened in presence of the tenderers who may be present at that time. In case tenderer sending their authorized representative to be present at the time of opening tender such authorized representative would have to comply with the requirement producing documents beforehand.

13 (a) Successful tenderer should strictly follow the time schedule of the contract allotted against each items of work deviation may lead to the imposition of penal clause as per West Bengal audit & accounts rules for Zillah Parisad & Panchayat Samiti 2013.The decision of the Tender inviting Authority in this regard is final binding.

(b). All tenders will be submitted by e-tender submission mode only.

(c) This tender will remain valid for a period of one year.

14. The N I T may be obtained from site https://wbtenders.gov.in.

15. Payment will be made as per availability of fund and work done measurement.

16.The successful tenderer will have to start the work within seven days from the date of issue of work order after execution of formal agreement in non judicial stamp paper of Rs.50.00(Rupees fifty) as per rule and will have to complete the work within the time allowed for completion. The work order will be issued after the agreement is done in between the Panchayat Samity & the agency.

17. Any rate above of the schedule rate of work will not be ordinarily entertained. 18. Acceptance of the lowest tender is not obligatory and the undersigned reserves the right to accept or reject any or all the tenders without out assigning any reason what so ever and also to split up the tendered work to more than one contractor in the interest of scheme execution.

19. (a).Separate tenders should be submitted in similar way for each work .

(b).Before submitting tender the tenderer must get his signature attested on the contract from by witness filling which his tender may be liable to be rejected.

20. Claim for idle labour from contractor will not entertained under any circumstances. No claim will be entertained for any increase in Railway freight and market price.

21. If the last date of submission of tender is declared as holiday, the tender will be received up to 13-00 hours and will be opened immediately afterwards as usual.

22. Successful tenderers will have to sign an agreement in the format prescribed by the undersigned at the beginning of contract.

23. Works & other details are attached with this notice may be available from other administrative offices to whom the copy is given.

24. Payment will be made as per availability of fund and full satisfaction of the payment authority.

25. Security money (where applicable) will be deducted at the rate of 10% of the total bill amount and the same will be released after the completion of the security period.

26. The terms and condition of this tender will remain valid till the completion of the work.

27. Canvassing in connection with the tender is strictly prohibited and the tender submitted by any canvassing contractor will be rejected.

28. The contractors are bound by the terms and conditions of the contract documents specified and for those not covered by the above they will have to abide by the terms and conditions and specifications of Govt.of West Bengal in all circumstances.

29. Those of purely extra item not covered by any of the above schedule the rates will be arrived at the market rate of labour and materials. The rate of all extra item must however be settled prior to the taking of such work and the decision of the Executive Officer, in this matter must be final and the binding on the successful tenderers. Any subsequent claims will not be entertained for any such work done without setting the rates.

30.The contractor should examine the drawing schedules before submitting his tender so as to have a clear idea of the work to be done. Any change of alignment, design etc. during execution of work will not vitiate the contract and entitle the contractor any claim. Before tendering the intending tenderers should thoroughly acquaint him with the proposed work by local inspection of the site and take into consideration of difficulties they are likely to be involved in the execution for the work. No claim whatsoever will be entertained afterwards for communication difficulties / climatic conditions, nature of soil etc. non-availability of materials and labour etc.
