The demands of thesis research and writing have, I found, exerted a personal toll on those closest to me and so to Nick Hempston, for his support both emotional and financial, his understanding, patience and strength, go thanks beyond words. v ABSTRACT This thesis investigates the meanings and representations of respectability in Pākehā women’s lives in nineteenth-century Lyttelton, New Zealand. Respectability was a form of gendered behaviour connected to ideals of appropriate femininity and women’s proper place. It was one of the values on which Lyttelton was founded and respectable women had an important role from the beginning as agents of civilization. However, respectability was not solely a behavioural norm imposed on women and an examination of the forms of respectability in this growing colonial town reveals that women were active agents negotiating and contributing to definitions of respectability. The forms of respectability in Lyttelton were related to the town’s character as a busy port, and the associated disorder contributed to divisions between respectable and unrespectable spaces. Women understood and represented respectability in different ways depending on their class position, social status, family responsibilities and involvement in the workforce. Not all women were able to conform to dominant norms of respectability, and others demonstrated an ambivalent commitment to ideals of respectable behaviour. It was not her first marriage. Elizabeth’s first husband had died in April the previous year, and she had lost two children from that union. Her daughter, aged one year when they left England in 1874, had not survived the voyage to New Zealand, and a son born in Lyttelton in August 1875 survived only until December. 1 A photograph thought to have been taken around the time of her second marriage shows the couple standing posed unassumingly against the mundane background of a garden fence with a fallen tree stump and a mix of dirt and stones around their feet. They stand about a metre apart. Sarah’s face is composed but enigmatic. She wears the archetypal garb of respectable Victorian femininity, her starched white apron a stark contrast with the dark ground. [Photograph 1] In September that same year Sarah Buchanan was called to appear in the Lyttelton Magistrate’s Court by the commission agent George McKay, over unpaid rent and ‘possession of tenement’, the sum in question being £14 6s 3d. 2 Sarah was a widow with children to support and had for some years been in straitened circumstances, gaining some income by taking in washing. 3 The judgment in the case went against her and she was ordered to give up possession of the property by 28 November. What happened to her in the period immediately after this is not known, but by around 1880 she had married again and a photograph from this time survives. Seated studio fashion, upright in a chair, she is dressed for the occasion, in a smart gown with lace cuffs, a shawl, gloves and with an elaborate bonnet tied under her chin. Like Elizabeth Harvey, her clothes and demeanor suggest respectable nineteenth-century womanhood. She gazes sternly from the frame. As one of her descendants puts it, ‘it is a hard face, but she had a hard life.’ 4 [Photograph 2] We can speculate that perhaps Elizabeth and Sarah may have known each other. Women living in nineteenth-century Lyttelton had their share of physical toil, hardship, and experienced the loss of family members to disease or accident. However, what is unusual in these cases is that photographs of both women have survived and some knowledge of their character and circumstances is known to descendants. Both women’s lives were constrained by the circumstances of marriage and widowhood. In nineteenth-century colonial New Zealand marriage, motherhood and family was the expected ‘career’ for women and most ‘respectable’ women did marry. Women’s lives were governed by the limited choices available to them. How they negotiated these choices and made sense of their lives has been addressed in a plethora of ways by the explosion of scholarship in women’s history that came out of the second-wave feminist movement. This study takes a feminist perspective and aims to address women’s experience in Lyttelton in terms of the discourses of respectability, a subject which has not been subjected to sustained analysis in New Zealand historiography. A central aim of women’s history as first conceived was to recover the experience of women in the past, and to address the invisibility of women in the writing of traditional history; the ‘hidden from history’ phenomena as Sheila Rowbotham’s significant early work phrased it. 5 This study is firmly within that tradition, and while it goes a small way towards illuminating the lives of women in Lyttelton in the nineteenth century, it does not claim to be a definitive study. While the ‘recovery’ of women’s lives provides a context for this work, it is also influenced by trends in feminist thought that recognize the danger of generalizing the experience of all women into a universal category ‘women’ and instead strives for accounts that accentuate difference and diversity.

George When the four eldest Pavitt brothers purchased Charles Barrington Robinson’s 100-acre block in Robinson’s Bay in the mid-1850s (Map 1), they were buying one of the oldest sections on Banks Peninsula, dating back to 1842. Robinson had been the British Police Magistrate in Akaroa from 1840 to 1845 (Ogilvie 2007:31), earning the respect of both Governors Hobson and FitzRoy. While in Akaroa, he purchased three sections of land from the Nanto-Bordelaise Company, organizers of the 1840 French settlement in Akaroa. Two of the sections (one of five-acre extent and another described as having an area of 43,875 square feet, i.e. one acre) were in Akaroa (bought on March 30 and August 27, 1842). The 100-acre block, co-owned by Robinson and William Watkins Wood (a trader from Manila), was situated just behind the foreshore in the bay named after Robinson himself. Its purchase is dated to June 3, 1842 (Hight and Straubel 1957: Appendix III). Map 1: RS 579 – diagram of conveyance Robinson to Pavitt Bros (Deeds Index 3D/133 Record 824). Note that the number 579 was added to the diagram in pencil after the original was prepared in ink. This was probably because the original document predated the allocation of the number. Charles Robinson resigned as magistrate in 1845 and travelled back to England. With his business partner Henry Smith, he organized his own settlement scheme and in 1850 chartered the ship Monarch , which was to call in at Akaroa before delivering its immigrants to Auckland.

Robert John Witty (‘Peter’ to his friends) was born in Nelson in 1913 and attended Christchurch Boys’ High School, College House and Canterbury College. Ordained priest in 1940, he was Vicar of New Brighton, St. Luke’s and Lyttelton. He reached the position of Archdeacon. Director of the British Sailors’ Society from 1945 till his death, he was, in 1976, awarded the Queen’s Service Medal for his work with seamen. Unofficial exorcist of the Anglican Diocese of Christchurch, Witty did not look for customers; rather they found him. He said of one Catholic lady: “Her priest put her on to me; they have a habit of doing that”. Problems included poltergeists, shuffling sounds, knockings, tapping, steps tramping up and down stairways and corridors, pictures turning to face the wall, cold patches of air and draughts. Witty heard the ringing of Victorian bells - which no longer existed - in the hallway of St. Luke’s vicarage. He thought that the bells were rung by the shade of the Rev. Arthur Lingard who came home to die at the vicarage then occupied by his parents, Eleanor and Archdeacon Edward Atherton Lingard. In fact, Arthur was moved to Miss Stronach’s private hospital where he died on 23 December 1899.

    1 2: Immigration during the Crown Colony period, 1840-1852 Context In 1840 New Zealand became, formally, a part of the British Empire. The small and irregular inflow of British immigrants from the Australian Colonies – the ‘Old New Zealanders’ of the mission stations, whaling stations, timber depots, trader settlements, and small pastoral and agricultural outposts, mostly scattered along the coasts - abruptly gave way to the first of a number of waves of immigrants which flowed in from 1840.1 At least three streams arrived during the period 1840-1852, although ‘Old New Zealanders’ continued to arrive in small numbers during the 1840s. The first consisted of the government officials, merchants, pastoralists, and other independent arrivals, the second of the ‘colonists’ (or land purchasers) and the ‘emigrants’ (or assisted arrivals) of the New Zealand Company and its affiliates, and the third of the imperial soldiers (and some sailors) who began arriving in 1845. New Zealand’s European population grew rapidly, marked by the establishment of urban communities, the colonial capital of Auckland (1840), and the Company settlements of Wellington (1840), Petre (Wanganui, 1840), New Plymouth (1841), Nelson (1842), Otago (1848), and Canterbury (1850). Into Auckland flowed most of the independent and military streams, and into the company settlements those arriving directly from the United Kingdom. Thus A.S.Thomson observed that ‘The northern [Auckland] settlers were chiefly derived from Australia; those in the south from Great Britain. The former,’ he added, ‘were distinguished for colonial wisdom; the latter for education and good home connections …’2 Annexation occurred at a time when emigration from the United Kingdom was rising.

Introduction This paper looks at the frequency and nature of litigation in the early years of the Canterbury settlement on the east coast of the South island of New Zealand. Because this was a new settlement in an area with virtually no pre- existing European population (and few indigenous people), but was a part of a more developed colony with an existing institutional base of courts and of inherited and local law, it provides an unusual opportunity to obtain a picture of litigation in a new community which inherited, rather than developed, its legal institutions. This paper focuses on civil litigation in the Supreme Court of New Zealand, the superior court of record, and is based primarily on archival records available in Christchurch, particularly the Supreme Court Minute Book, supplemented by other archival material and by contemporary newspaper reports. The termination date of the study, around the end of September 1861, is dictated by changes in the recording of matters before the Supreme Court, under which very many fewer details are entered into the Minute Book. I must begin with a caveat that this paper does not attempt at all to deal with all cases before the courts in Canterbury – there is clearly a substantial body of disputes which were heard in the lower courts which fall outside the purview of this study; I have not looked at these, partly because it would extend this paper substantially; partly because of pressure of time, and partly because the documentary record is patchy enough to raise some doubts as to the possibility of ever establishing a sufficiently accurate picture.

    HAGLEY HISTORICAL AND FIELD SOCIETY NO 4 IN A SERIES OF OCCASIONAL PAPERS HAGLEY & BLAKEDOWN IN TI{E 19TTI CENTURY DOMESTIC SERVICE ND SOCIAL BACKGROTIND This Hagley Historical & Field Society Occasional Paper No 4 is the third of the series to use the Census Returns of 1851 and 1881 as source material. Occasional Paper No 1 showed the number of incomers' into Hagley and Blakedown (then part of Hagley) and the consequent increase in new housing. Occasional Paper No 3 dealt with occupations, particularly the workforce in agriculture. industry, crafts/trades and services. The growing number of moneyed inhabitants was noted, especially in Upper Hagley. , Occasional Paper No 4 now closely investigates the large category of Domestic Servants. Family size is also examined, together with Schools, the Churches, and Leisure which formed the social background. As in Occasional Paper No 3, the parish is divided into two sections corresponding with the two Enumeration Districts adopted in the Census Return of l88l . i. e. Enumeration District No 2 (ED2) which included both sides of the Stourbridge Road to what is now thre crossroads, tfre east side of the present Bromsgrove Road to Hall Lane opposite the Lyttelton Arms corner, what is now Hall Lane, Hall Drive, Hagley Hall, the Castle, Birmingham Road/School Lane area, Hagley Hill, Broadmarsh and Wassell Grove, and Enumeration District No 3 (ED3)) which included the west side of Bromsgrove Road to the @,Middlefoot(nowMiddlefield)Lane,LowerHagley,TheBrake' The Birches, Stakenbridge, and Blakedown.
