There will be a walk-through of the Glenmere Lake Property on Tuesday, March 23, 2010 at 10:00 A.M. All interested bidders must meet at the Glenmere Lake Property, Pine Hill Road, Chester, New York. Funding for this project comes in part through an Environmental Restoration Fund grant administered by the New York State Department of Environmental Conservation; however, the State shall not be a party to the awarded contract. The undersigned Bidder warrants and represents, if awarded the Contract, that the work proposed herein will be substantially completed in accordance with Section 14 of the General Conditions within 60 consecutive calendar days after the date when the Contract Time commences to run as provided in Section 2 of the General Conditions, and finally completed and ready for final payment in accordance with Section 14 of the General Conditions within 60 consecutive calendar days after the date of Substantial Completion. 2. The undersigned and County recognize that time is of the essence and that Owner will suffer financial loss if the Work is not completed within the times specified in paragraph 1 above. The parties also recognize the delays, expense, and difficulties involved in proving in a legal proceeding the actual loss suffered by Owner if the Work is not completed on time. Accordingly, instead of requiring any such proof, Owner and Bidder agree that as liquidated damages for delay, but not as a penalty, Bidder shall pay County $1,700 for each consecutive calendar day that expires after the time specified in paragraph 1 above for Substantial Completion. If Bidder shall neglect, refuse, or fail to complete the remaining Work within the Contract Time, or any proper extension thereof granted by County, Bidder shall pay County $900 for each consecutive calendar day that expires after the time specified in paragraph 1 above for Final Completion and readiness for final payment until the Work is completed and ready for final payment. 3. The undersigned Bidder proposes and agrees, if awarded the Contract, to enter into an Contract with County, in the form included in the Request for Bid, to perform all Work as specified or indicated in the Contract Documents for the prices and within the times indicated and in accordance with the other terms and conditions of the Contract Documents. 4. In submitting this Bid, Bidder represents that: a. Bidder has examined and carefully studied the Bidding Documents, the other related data identified in the Bidding Documents, and the following Addenda, receipt of all which is hereby acknowledged, but he or she agrees that he or she is bound by all Addenda whether or not listed herein. Bidder has visited the Site and become familiar with and is satisfied as to the general, local and Site conditions that may affect cost, progress, and performance of the Work. c. Bidder is familiar with and is satisfied as to all federal, state and local Laws and Regulations that may affect cost, progress and performance of the Work. d. Bidder has carefully studied all: (1) reports of explorations and tests of subsurface conditions at or contiguous to the Site and all drawings of physical conditions in or relating to existing surface or subsurface structures at or contiguous to the Site (except Underground Facilities) which have been identified in the Supplementary Conditions as provided in Section 4 of the General Conditions, and (2) reports and drawings of a Hazardous Environmental Condition, if any, which as been identified in the Supplementary Conditions as provided in Section 4 of the General Conditions. e. Bidder has obtained and carefully studied (or assumes responsibility for having done so) all additional or supplementary examinations, investigations, explorations, tests, studies and data concerning conditions (surface, subsurface and Underground Facilities) at or contiguous to the Site which may affect cost, progress, or performance of the Work or of construction to be employed by the Bidder, including applying the specific means, methods, techniques, sequences, and procedures of construction expressly required by the Bidding Documents to be employed by Bidder, and safety precautions and programs incident thereto. f. Bidder does not consider that any further examinations, investigations, explorations, tests, studies, or data are necessary for the determination of this Bid for performance of the Work at the price(s) bid and within the times and in accordance with the other terms and conditions of the Bidding Documents. g. Bidder is aware of the general nature of work to be performed by County and others at the Site that relates to the Work as indicated in the Bidding Documents. h. Bidder has correlated the information known to Bidder, information and observations obtained from visits to the Site, reports and drawings identified in the Bidding Documents, and all additional examinations, investigations, explorations, tests, studies, and data with the Bidding Documents. i. Bidder has given Engineer written notice of all conflicts, errors, ambiguities, or discrepancies that Bidder has discovered in the Bidding Documents, and the written resolution thereof by Engineer is acceptable to Bidder. j. The Bidding Documents are generally sufficient to indicate and convey understanding of all terms and conditions for the performance of the Work for which this Bid is submitted. 5.
