Rules and Regulations Pertaining to the Installation of Antennas August 25, 1998 Due to the Federal Communications Commission's (FCC) rulings regarding antennas the Coles Crossing Community Association has adopted the following guidelines specifically related antenna installation. An antenna does not have to be submitted to the Architectural Modification Committee (AMC) as long as the aforementioned antenna complies strictly with the following guidelines: 1 The antenna and any mast must be located to the rear one-half (1/2) of the lot and must serve only improvements on the particular lot in which it is located. 2 To the extent feasible, the antenna and any mast, including its base and anchoring structure, shall not extend above the marline of the house located on the lot and shall not be visible from the frontage street or any adjoining street. 3 To the extent feasible, no antenna or mast shall be constructed or placed or permitted to remain on any utility easement or other easement or right•of-way located on any lot. 4 The antenna and any mast must be securely mounted to a base, so as to be able to withstand the effects of high winds or other extraordinary weather conditions; however, no guy wires or similar mounting apparatus will be allowed. No advertising slogans, logos, banners, signs, or any other printing or illustration whatsoever, other than that provided by the original manufacturer, shall be permitted upon or be attached to the antenna or mast. 6 No antenna shall ever be used for the transmission of'any signal Whatsoever and said antenna shall be for the purpose of receiving only normal through airwaves for television viewing purposes only. 7 No antenna shall be permitted to cause any distortion or interference whatsoever with respect to any other electronic device in the subdivision. 8 The antenna and any mast shall be a solid color consisting of whichever one of the colors best conforms with the color of the house located on the lot: white or black or shades of either brown, gray, or tan, 9 Each lot shall be permitted to have no more than one antenna and any related mast, as applicable, for each category of the following categories of video programming providers, to-wit: direct broadcast satellites, multi-channel multi- point distribution (wireless cable) providers, and television broadcast stations, •:‘ • : 5?9-94:2237, lithe antenna does not conform to the above mentioned guidelines it must be submitted to the ACC, prior to installation. In either case, the Association has the right to notification of installation of any antenna. Therefore, you must notify the Association via the notification form for conforming or non-conforming antennas. Each form is attached for your use. These guidelines are adopted under the Declaration of Covenants, Conditions, and Restrictions for Coles Crossing and comply with the Federal Communication Commission (FCC) rulings regarding antennas. INTRODUCTION Plaintiffs Barbara Nuss (“Barbara”) and the Estate of Robert A. Nuss (“Robert”) (collectively, “Plaintiffs”) commenced this action against Defendants Joseph William Sabad (“Joseph”) and Vicki Ann Sabad (“Vicki”) (collectively, “Defendants”), alleging several causes of action arising from an arrangement to acquire land in Mexico. See generally Dkt. No. 1 (“Complaint”). Currently pending before the Court is Defendants’ Motion for summary judgment. Dkt. No. 50 (“Motion”). For the following reasons, the Motion is granted in part and denied in part. II. BACKGROUND The facts of this case are widely disputed, but the parties agree about the following: Plaintiffs and Defendants first met sometime in late 2002 or early 2003. Dkt Nos. 50-29 (“SMF”) ¶ 2; 85 (“SMF Response”) ¶ 1. In 2003, they entered into an arrangement to acquire land in Mexico. SMF ¶¶ 2-5; SMF Resp. ¶¶ 2-5. In March 2003, Plaintiffs wired $135,000 to Defendants’ bank account in New York. SMF ¶ 8; SMF Resp. ¶ 8. A Mexican corporation was formed in that Case 7:10-cv-00279-LEK-TWD Document 100 Filed 09/30/13 Page 2 of 32 same month as a vehicle for acquiring the Mexican property, and Robert, Barbara, Joseph, and Vicki each received 25% of the shares.

BACKGROUND: In 2005, the City’s Redevelopment Agency initiated a capital improvement design process and project for the West Beach Cabrillo Boulevard area. Ultimately, the West Beach Pedestrian Improvement Project along Cabrillo Boulevard was approved and has now been constructed. As part of that process, interest was expressed to further evaluate and study the adjacent sandy beach area. The City’s Redevelopment Agency provided $15,000 in order to contract with Pat Saley and Associates to undertake a focus study of the area known as West Beach. This process was initiated in the spring of 2009. The goal of the West Beach Planning Study was to identify existing activities and consider adding or improving public uses and/or structures on or near the West Beach area. Additionally, evaluation was given to possibly encourage more use of the beach area and improve its overall appearance and ambiance, which would help draw people into the harbor. The consultant met with current users, stakeholders, business owners, City staff members, Coastal Commission staff and received input from the Parks and Recreation Commission, Planning Commission and Board of Harbor Commissioners.

[email protected], [email protected],[email protected] Abstract Teaching of architectural history to students of architecture leaves so many gaps to the rationale of its claim with no appropriate answer on the Malay heritage. The similarities found in the architectural styles in the Southeast Asian region have triggered many theories among architectural writers and critics. It is important to understand the development of civilisation in the said region that is profoundly connected to the architectural establishment in both styles and typologies. This paper intends to discuss selected theories and review some examples of architectural forms found in Thailand, Indonesia, Malaysia, Cambodia, Laos PDR and Vietnam. The analyses of case studies suggest the similarities and differences of the architectural forms that will explain the origins of the Malay heritage.
