The City Council refused, claiming the petition was invalid. Though the ordinance is steeped in controversy, the legal principles at play are relatively simple. First, “the power of . referendum . is the exercise by the people of a power reserved to them,” and this power should be protected. Taxpayers’ Ass’n of Harris Cnty. v. City of Houston, 105 S.W.2d 655, 657 (Tex. 1937). Second, city officials must perform their ministerial duties. See Anderson v. City of Seven Points, 806 S.W.2d 791, 793 (Tex. 1991).
