193. Declarations of Interests

Councillor Muldoon declared a personal Interest in Item 8 as an elected governor of the SLAM NHS Foundation Trust.

Councillor Hall declared a personal Interest in Item 8 as an elected governor of the Kings College Hospital NHS Foundation Trust.

Councillor Fletcher declared a personal Interest in Item 8 as a Member of the Council of Management of the Lewisham Youth Theatre.

Councillor John Paschoud declared a personal Interest in Item 8 as a Trustee of Lewisham Disability Coalition

Councillor Mallory declared a personal Interest in Item 8 as a Board Member of Fair Share.

194. Minutes

RESOLVED that the minutes of the meeting held on January 22 2014 be confirmed and signed as a correct record.

195. Petitions

Mr John Hamilton presented a petition with 1,081 online signatures and more than 1,000 paper signatures calling on the Mayor to stop negotiations on selling the land currently leased to Millwall FC.

Councillor Mark Ingleby presented a petition supported by 72 persons calling on the Council to review the CPZ in Ballamore, Shroffold and Bedivere Roads as a matter of urgency. Page 4 Councillor Ami Ibitson presented a petition supported by 35 persons calling on the Council to consider road problems on Perry Hill arising from the construction of the Bell Green retail park.

Councillor Darren Johnson presented a petition supported by 114 online signatures calling on the Council to consider the road layout on Wickham Roadwork to ensure the 20mph speed restriction is enforced.

Councillor Julia Fletcher presented a petition supported by 53 persons calling on the Council to work with Phoenix to deal with fly tipping issues in the Downham Ward.

Councillor Chris Maines presented a petition supported by 53 persons calling on the Council to ensure SGN replace the temporary width restrictions on Lee Park near the junction with Lee High Road with a permanent structure to restrict large vehicles from using Lee Park.

196. Announcements or Communications

1.LCPCG

Councillor Jackie Addison, the third and final Chair of the LCPCG, addressed the Council regarding that organisation which was to hold its final meeting in the following week. She recalled the history and achievements of the LCPCG and concluded by saying it had been a privilege to serve as Chair.

2.Councillor Bowen

The Chair congratulated Councillor John Bowen on his recent marriage.

3.Convoys Wharf

The Mayor tabled a written report on Convoys Wharf and the agenda item and minutes from the Strategic Planning Committee in January 2014 were also circulated. The Mayor gave an oral update on his meeting with the Deputy Mayor for London responsible for Planning and said that while some of the Council’s concerns had been addressed, others remained and lobbying would continue until the decision expected to take place at the end of March.

Councillors Hall, Foxcroft, Curran, Maines, John Paschoud and Allison all addressed the Council on the subject of Convoys Wharf. Members suggested a formal agenda item on Convoys Wharf should have been included at this meeting and they pointed out that the updates promised in January at the Strategic Planning Committee had not yet been received.

4. Retiring Members

Prior to the end of the meeting, the Chair paid tribute to those Councillors who were known to be retiring. He thanked Councillors Jackie Addison, Peggy Fitzsimmons, Madeliene Long, Stephen Padmore, Marion Nesbit, Darren Johnson, Helen Gibson, Vincent Davis, Vicky Foxcroft, Dan Whittle, Anne

Page2 5 Affiku, Mike Harris, and Olufunke Abidoye for their service. He particularly recognised the contributions of Councillors Addison, Fitzsimmons, Long, Padmore, Nisbet and Johnson who between them had over 148 years of service. He also thanked his fellow Brockley Councillor Vicky Foxcroft and wished her well in her bid to become the next MP for Lewisham Deptford in 2015. He ended by hoping for a positive election campaign which engaged with the electorate and heralded a new administration that would best serve their interests.

199. Constitutional Amendment

The Chair moved that the recommendations be approved and this was seconded by the Vice Chair and it was:

RESOLVED that the proposed amendment of the Constitution appearing at Appendix 1 be approved.

200. Budget 2014-15

The Chair of Council had the Head of Law explain a procedure for consideration of this item which required the suspension of Council Procedure Rules. The Council agreed to have the Budget introduced by the Mayor and the Cabinet Member for Resources, Councillor Paul Maslin. The Council then considered the Liberal Democrat motion appearing as Item 12 on the agenda and held one debate on both the motion and the budget proposal. During this general debate on the budget the 5 minute limit on speeches for the Mayor and Councillors Hall and Maines was suspended.

The Mayor reported that he did not intend to vary the budget proposals he had already fully set out at Mayor and Cabinet on February 12 and 19. He stated he believed his Budget protected fundamental services despite horrendous Government cuts and that local government remained the most efficient of all public services. He alluded to the immensity of the task facing the next Council administration which would have to cut £95m over its term of office.

The Cabinet Member for Resources, Councillor Paul Maslin formally moved that the Mayor’s Budget be accepted.

Councillor Alan Hall formally seconded that the Mayor’s Budget be accepted.

Item 12, the Liberal Democrat motion was next moved by Councillor Feakes and seconded by Councillor Maines. The Council also considered a supplementary agenda document containing officer commentary on the Liberal Democrat proposals and the technical Budget update considered by

Page4 7 the Mayor on February 19.

There then followed a general debate on the Budget and Item 12 to which the Mayor, and Councillors Maslin, Johnson, Hall, Bell, Daby, and Bonavia contributed.

Once the debate was concluded, there was a vote on Item 10 in accordance with new legal provisions which had taken effect the day before. The result of the vote was as follows:

RESOLVED that that the recommendations shown below in respect of the 2014/15 budget be agreed;

(i) the consideration of the Public Accounts Select Committee of 6 February 2014, incorporating the views of the respective select committees on the previously agreed revenue budget savings proposals for 2014/16 be noted;

(ii) having considered the views of those consulted on the budget, subject to proper process and consultation, the following modifications be made to the published proposals;

Capital Programme

(iii) the 2013/14 Quarter 3 Capital Programme monitoring position as set out in section 5 be noted;

(iv) the 2014/15 to 2017/18 Capital Programme of £385.9m be approved, while noting that there are no new proposed major capital projects for this period, as set out in section 5 and attached at Appendices W1 and W2;

Housing Revenue Account

(v) the consultation report on service charges to tenants and leaseholders in the Brockley area, presented to area panel members on 19 December 2013, be noted, as attached at Appendix X3;

(vi) the consultation report on service charges to tenants and leaseholders and the Lewisham Homes budget strategy presented to area panel members on 17 December 2013, be noted, as attached at Appendix X4;

(vii) an increase of dwelling rents 5.05% be set (an average increase of £4.61 per week), in accordance with the Rent Restructuring formula;

(viii) an increase in the hostels accommodation charge by 4.66% be set (or £3.03 per week), in accordance with the Rent Restructuring formula;

(ix) the following average weekly increases for dwellings be approved for:

(A) service charges to non-Lewisham Homes managed dwellings (Brockley);

• caretaking 3.70% (£0.04) • grounds 3.70% (£0.04) • communal lighting 3.70% (£0.04) • bulk waste collection 3.70% (£0.04) • window cleaning 0.00% (£0.00) • tenants’ levy No increase

(B) service charges to Lewisham Homes managed dwellings:

(x) the following average weekly percentage decreases for hostels and shared temporary units be approved for;

• service charges (hostels) – caretaking etc.; -6.91% (-£6.03) • energy cost decreases for heat, light & power; -50% (-£5.24) • water charges decrease; -91% (-£1.88)

(xi) an increase in garage rents by inflation of 3.2% be approved (£0.25 per week) for Brockley residents and 3.2% (£0.31 per week) for Lewisham Homes residents;

(xii) the budgeted expenditure for the Housing Revenue Account (HRA) for 2014/15 be £104.0m;

(xiii) the HRA budget strategy savings proposals be approved in order to achieve a balanced budget in 2014/15, as attached at Appendix X1;

Dedicated Schools Grant and Pupil Premium

(xiv) subject to final confirmation of the allocation, that the provisional Dedicated Schools Grant allocation of £267.6m be the Schools’ Budget for 2014/15 and note that this level of funding will not be supplemented by a general fund contribution;

General Fund Revenue Budget

(xv) the projected overall variance against the agreed 2013/14 revenue budget as set out in section 8 be noted;

(xvi) the previous revenue budget savings of £24.5m for 2014/15 and £1.7m for 2015/16, as set out in section 8 of the report and summarised in Appendix Y1 be approved;

(xvii) revenue budget pressures of £3.6m in 2014/15 be funded, allowing the Executive Director for Resources & Regeneration to hold these resources corporately until such time that these pressures emerge during the year and it has been determined that the pressures cannot be contained within the directorates’ cash limits;

(xviii) the Executive Director for Resources & Regeneration maintain a fund of £3.9m against which risks and other potential budget pressures which emerge during the year would be considered for funding;

(xix) subject to decisions on the above proposals, the following option be approved:

That a General Fund Budget Requirement of £268.1m for 2014/15 be approved, and a 0% increase in Lewisham’s Council Tax element be agreed and the 1% Council Tax freeze grant of £1.0m be accepted. This will result in a Band D equivalent Council Tax level of £1,060.35 for Lewisham’s services and £1,359.35 overall. This represents an overall decrease in Council Tax for 2014/15 of 0.29% and is subject to the GLA precept for 2014/15 being reduced by 1.3% from its existing 2013/14 level;

(xx) the Council Tax Ready Reckoner which for illustrative purposes, sets out the Band D equivalent Council Tax at various levels of increase be noted as explained in section 8 of the report and set out Appendix Y3;

(xxi) the Executive Director for Resources & Regeneration issues cash limits to all Directorates once the 2014/15 Revenue Budget is agreed;

(xxii) the draft Chief Financial Officer’s Section 25 Statement at Appendix Y4 be received;

(xxiii) the draft statutory calculations for 2014/15 be approved as set out at Appendix Y5;

(xxiv) the prospects for the revenue budget for 2015/16 and future years be noted;

(xxv) officers continue to develop firm proposals as part of the Lewisham Future Programme to help meet the forecast budget shortfalls in future years;

Other Grants (within the General Fund);

Page 129 (xxvi) the allocation of £0.65m per annum of New Homes Bonus over the next ten years 2014/15 to 2023/24 be approved, to provide delivery support for housing and school pressures as set out in section 9

Treasury Management Strategy

(xxvii) the prudential indicators and treasury limits be approved, as set out in section 10;

(xxviii) the 2014/15 treasury strategy, including the investment strategy and the credit worthiness policy be approved, as set out at Appendix Z3;

(xxix) the credit and counterparty risk management criteria, as set out at Appendix Z3, the proposed countries for investment at Appendix Z4, and formal delegation of responsibility for managing transactions with those institutions which meet the criteria to the Executive Director for Resources & Regeneration be approved;

(xxx) authority be delegated to the Executive Director for Resources & Regeneration, during 2014/15, to make amendments to borrowing and investment strategies provided there is no change to the Council’s authorised limit for borrowing;

(xxxi) the maximum deposit limits with the part nationalised banks be increased from £50m to £65m for each of Lloyds Banking Group and Royal Bank of Scotland (RBS) Group;

(xxxii) lending to other local authorities up to a maximum of £5m and for a period of up to one year be approved;

(xxxiii) the development of the Municipal Bond Agency be noted, and once fully established, to note its potential as a suitable Agency from which to borrow as an alternative to the Public Works Loan Board (PWLB);

(xxxiv) the Minimum Revenue Provision (MRP) policy as set out in section 10 be approved;

(xxxv) the Treasury Management mid-year review attached at Appendix Z6; be noted;

(xxxvi) the recommendation in relation to further savings of £0.3m from the Attendance and Welfare Service (AWS), to be implemented in September 2014 be approved.

STATUTORY CALCULATIONS

1) It be noted that at its meeting on 22 January 2014, the Council calculated the number of 73,941.2 as its Council Tax base for 2014/15 in accordance with the Local Authorities (Calculation of Taxbase) Regulations;

2) The following amounts be now calculated by the Council for the year 2014/15 in accordance with the Local Government Finance Act 1992:

Page10 13 a. £1,061,052,900 being the aggregate of the amounts which the Council estimated aggregate of the amounts which the Council estimates for gross expenditure, calculated in accordance with Section 31A (2) of the Act; b. £792,990,900 being the aggregate of the amounts which the Council estimates for income, calculated in accordance with Section 31A(2) of the Act; c. £268,062,000 being the amount by which the aggregate of 3(a) above exceeds the aggregate of 3(b) above, calculated by the Council, in accordance with Section 31A(4) of the Act, as its General Fund budget requirement for the year; d. £187,349,823 being the aggregate of the sums which the Council estimates will be payable for the year into its General Fund in respect of redistributed non- domestic rates and Revenue Support Grant, increased by the amount which the Council estimates will be transferred in the year from its Collection Fund to its General Fund in accordance with Section 97(3) of the Local Government Finance Act 1988. This includes a settlement funding assessment adjustment of £900,000; e. £80,712,177 being the residual amount required to be collected from Council Tax payers. This includes the surplus on the Council’s Collection Fund of £2,308,625. f. £1,060.35 being the residual sum at (e) above (less the surplus on the Collection Fund), divided by the Council Tax base of 73,941.2 which is Lewisham’s precept on the Collection Fund for 2014/15 at the level of Band D;

Being the amounts given by multiplying the amount at (f) above by the number which, in proportion set out in Section 5(1) of the Act, is applicable to dwellings listed in a particular valuation band divided by the number which in that proportion is applicable to dwellings listed in valuation Band D, calculated by the Council in accordance with Section 36(1) of the Act, as the amounts to be taken into account for the year in respect of categories of dwellings listed in different valuation bands;

COUNCIL TAX CALCULATION

As part of the Localism Act 2011, any Council Tax increases that exceed 2% in 2014/15 will trigger an automatic referendum of all registered electors in the borough. The statutory calculation for whether the Council is required to hold a referendum is based upon the ‘relevant basic’ amount of Council Tax, which under accounting regulations, includes levies. Any final recommendations on Council Tax levels will need to meet statutory requirements.

To date, Lewisham has received estimations of its levies for 2014/15. Formal notifications are expected to be received week commencing 17 February 2014.

202. Catford Regeneration Partnership Ltd 14-15 Business Plan

“This Council recognises that London is in the middle of a severe housing crisis. Home ownership is falling. Rents are rising by ten percent a year. Standards in the private rented sector are declining. Overcrowding is getting worse and homelessness is rocketing.

This Council regrets that the crisis has dramatically deteriorated under the Coalition Government and Tory Mayor of London. Under David Cameron house building has fallen to the lowest level since the 1920’s. has missed every one of his own targets for building new affordable homes. On average, Conservative Councils in London have built half as many affordable homes as Labour Councils and a fifth as many Council homes.

This Council believes that tackling the housing crisis must be our highest priority. Accordingly, this Council will:

1. Build more genuinely affordable homes 2. Tackle rogue landlords and rip-off letting agencies 3. Build more homes for London’s growing population 4. Bring empty homes back into use 5. Create jobs and apprenticeships in the building industry”

“As a London borough that is privileged to have a professional football club within our boundaries, this Council recognizes the positive impact that team sports such as football can have on young people's lives. In addition, this Council recognizes that all sports and organised activities can play a vital role in local communities, and notes the benefits of sports and leisure opportunities for local people, including vulnerable people.

This Council wishes to ensure that London retains an Olympic legacy and that young people are encouraged to play sport, and therefore commits to support the development and uptake of sport and other organised activities by young people across the borough of Lewisham, through organised clubs or otherwise.

To demonstrate this support, this Council calls upon the relevant Cabinet Member to make an annual report to Council detailing the efforts that Member has made to encourage the development of sports and other organised activities within the borough.”

RESOLVED that the following motion be agreed:

“This Council recognizes the historical problem of rogue landlords across the borough of Lewisham, and welcomes the Council’s successful bid for £125,000 funding which has been boosted by a further £30,000 from Public Health in recognition of the link between poor housing and poor health outcomes. This funding will enable the Council to develop a programme which will include a dedicated enforcement co-ordinator and paralegal which will increase prosecutions.

This Council welcomes the findings of the recent Housing Select Committee report which highlighted there are currently some 50 rogue landlords and letting agencies in the borough, and some of these own large portfolios of properties, blighting the lives of residents and communities. Problems such as overcrowding, harassment, illegal eviction and illegal fees present a real problem for Lewisham's residents, and can have a devastating effect on the vulnerable. The Council’s strategic approach to tackling the problem of rogue landlords along with the launching of the Private Sector Housing Agency will raise standards and improve the lives of many Lewisham residents.”

208. Baroness Doreen Lawrence of Clarendon

The Vice-Chair welcomed everyone to the meeting and announced that this special meeting of the Council was to confer upon Baroness Doreen Lawrence of Clarendon the Honorary Freedom of the London Borough of Lewisham.

The Vice-Chair then announced that, under Section 249(5) of the Local Government Act 1972, a Borough Council can admit to the Honorary Freedom of the Borough, ‘persons of distinction and persons who have, in the opinion of the Council, rendered eminent services to the Borough’. He then called upon the Chief Executive to read out the resolution of the Council passed at a meeting of the Council on 26 June 2013.

The Chief Executive formally reported that it was resolved that Baroness Doreen Lawrence be admitted as an Honorary Freewoman of the London Borough of Lewisham “in recognition of her work in seeking justice for her son, Stephen and creating a positive and dynamic legacy in his honour through the setting up of the Stephen Lawrence Centre and Charitable Trust. To do one of these things in the wake of such a devastating personal tragedy would be remarkable but to do both indicates someone deserving of the highest recognition. The dignity and humanity that she has demonstrated throughout the last 20 years makes her a truly inspirational figure in our Borough.

Baroness Lawrence then signed the Freedom Roll of Honour and her signature was witnessed by the Mayor and the Chief Executive.

The Vice-Chair then called upon, in turn, the Mayor, the Rt Hon Jack Straw MP (via recorded video message), Councillor Duwayne Brooks, Councillor Darren Johnson, Imran Khan, Reverend David Cruise, Rt Hon David Blunkett Page 20

MP (via recorded video message), Her Excellency Aloun Ndomet-Assamba, High Commissioner of Jamaica, and finally, Stuart Lawrence, to speak in support of the Council’s recommendation.

The Mayor, on behalf of the Council, then presented to Baroness Lawrence a casket containing the Council’s resolution inscribed on a vellum scroll and sealed by the Council. The Honorary Freewoman then responded and thanked the Council for the honour that had been accorded to her.

1. Summary

This report sets out a proposed allocation of seats on committees to political groups on the Council and asks the Council to agree to that proposal.

2. Purpose

The purpose of this report is to comply with the Local Government and Housing Act 1989, which requires the allocation of seats on committees in accordance with the level of representation of political groups on the Council as a whole.

3. Background

Section 15 of the Local Government and Housing Act 1989 places a duty on the Council to review the representation of political groups on its committees where the members of the Council are split into different political groups. A council is deemed to be split into different political groups where there is at least one such group on the Council. There is a particular duty to conduct this review at the Annual General Meeting or as soon as practicable after that.

The Act requires that when it reviews membership of its committees, the Council is under a duty to determine the allocation to the different political groups into which the members are divided, in accordance with principles which are set out in the Act those principles are:-

• That not all the seats are allocated to the same group.

• That the majority of the seats are allocated to the group which has the majority of seats on the Council.

• Subject to the 2 principles above, the number of seats on the total of all the ordinary committees allocated to each political group bears the same proportion to the proportion on full Council.

However, a political group can only be properly established under the Local Government (Committees and Political Groups) Regulations 1990 if at least 2 members give notice to the Proper Officer that they wish to be treated as a political group. As there is only 1 Green Party member on the Council, he does not constitute a group and, though the statutory language may be a little confusing, legal advice is that that member is not entitled by law to the allocation of seats on committees. That said, in the opinion of the Head of Law, in the event of a challenge to a Council decision, a Court would look unsympathetically on a Council that did not allocate any seats to the only member of the Council outside the majority party.

Once the allocations to political groups have been determined, it is the duty of the Council to exercise the power to make appointments to that committee to give effect to the nominations of the political groups concerned.

These political balance requirements also apply to the Overview and Scrutiny Committee and its sub committees (select committees and business panels).

The Act also provides that the Council can make arrangements other than those complying with the political balance requirements if those arrangements are approved without any member of the authority voting against them.

Members may recall that following the Local Government and Public Involvement in Health Act 2007, Leading Counsel advised that an elected Mayor did not qualify as a member for the purpose of (inter alia) the allocation of seats on Council decision making bodies. That situation has since been reversed by implementation of the Localism Act 2011 and the Mayor is now included in the majority party number for the purposes of seat allocation. Amendments to the Council Constitution will be brought forward at the earliest opportunity to reflect this, though of course in the interim, current law prevails.

4. Proposed arrangements

The table attached at Appendix 1 shows the proposals for the Council’s ordinary Committees. The Proper Officer has been asked to confirm that he has received written confirmation from the Labour Party regarding its group membership and that only the Labour Party has the required minimum number of Councillors to sustain a political group.

Lewisham’s Constitution provides that the Council will appoint one overview and scrutiny committee consisting of all members of the Council who are not members of the Executive provided that this composition complies with the political balance requirements of the Local Government and Housing Act 1989. If that is not possible or if there is not unanimous agreement at the Annual General Meeting to such arrangements in any year, Article 6 provides that the Council will decide on the composition of the Committee so d:\moderngov\data\agendaitemdocs\9\7\4\ai00008479\$lky2cww4.docPage 33 as to give the widest possible membership to the committee, but excluding members of the Executive. As the Mayor has invited 9 Labour councillors to serve with him in the Cabinet, there would be 45 members of the Overview and Scrutiny Committee as follows:-

The select committees, which are effectively sub committees of the main Overview and Scrutiny Committee under the Constitution, have to have between 7 and 11 members. In the previous administration there were six select committees with 10 members each.

5. Constitution Working Party

The Constitution provides that this should consist of one representative of each political group and six or the smallest number higher, of councilors required to ensure the political composition of the Council is reflected.

6. Appointments Committee

The Constitution provides that this should consist of the Chair of Overview & Scrutiny, and two such executive members as the Mayor, as Leader of the largest political group, may nominate on a meeting by meeting basis, and two or the smallest higher number of non-executive members required to ensure that the political composition of the Council is reflected.

7. Council Urgency Committee

The Constitution provides that this should consist of the Chair of Council, the Deputy Mayor, one member of the Executive other than the Mayor, the Chair of the Overview and Scrutiny Committee and 2, or the smallest number higher of Councillors required to ensure the political balance of the Council is reflected.

8. Other Committees

In addition to the bodies referred to above, Article 9 of the Constitution also provides for the establishment of 3 Planning Committees, a Strategic Planning Committee, a Licensing Committee, a Licensing (Supplementary) Committee, a Pensions Investment Committee, a Health & Safety Committee, an Elections Committee, a Health and Wellbeing Board and an Audit Panel with the Terms of Reference set out in that Article. No changes to the composition or Terms of Reference are proposed..

9. Chairs of Overview and Scrutiny Select Committees

The Constitution provides in Paragraph 8 of Section E Overview & Scrutiny Procedure Rules that the Chairs and Vice Chairs of the Overview & Scrutiny Select Committees will be allocated in accordance with the proportion of seats held by the political groups on the Council.

The legal implications are contained in the body of the report. The political balance requirements of the Local Government and Housing Act 1989 do not apply to the Mayor and Cabinet. There is no legal requirement for the Chairs or Vice Chairs of any committee to be reserved for members of any particular group,. Any such requirement would be a constitutional and not a statutory provision..

There are no specific implications arising from this report

Members are asked to:

ANNUAL REPORT OF THE STANDARDS COMMITTEE 2013/14 presented by the Chair of the Committee, Councillor Mallory.

1 INTRODUCTION – PERSONAL STATEMENT OF THE CHAIR

1.1 This report sets out the membership of the Standards Committee, some key developments in the past year and our aspirations for the future.

2 MEMBERSHIP OF THE STANDARDS COMMITTEE

2.1 The Council’s Constitution provides for the Standards Committee to consist of 16 members – 6 of whom are independent and 10 of whom are councillors. This reflects the abolition of the legislative provisions allowing independent members of the Standards Committee to vote. Consequently the Committee could not be independently chaired and since July 2012, only those members who are elected members of the Council are allowed to vote on matters before it.

2.2 Throughout this year, the following people have served as independent members of the Committee:-

2.3 Appendix 1 gives a short summary of the background of those independent members.

2.6 As required by the Localism Act 2011 all local authorities must appoint at least one Independent Person whose views are to be sought and then taken into account by the local authority before it makes a decision on an allegation of breach of the Member Code of Conduct that has been investigated. Sally Hawkins served for part of the year as Independent Person and only stepped down because of a legal requirement to do so. Her work in that role was greatly appreciated and I would like to thank her on behalf of myself and the Council for her invaluable contribution during her lengthy tenure in that position.

2.7 Following public advert and interview by myself and the Monitoring Officer, Erica Pienaar and Wendy Innes were appointed by full Council to replace Sally Hawkins to act as Independent Persons to assist in the investigation of complaints under the Council’s Member Code of Conduct. Appendix 2 gives a short summary of the background of current Independent Persons.

3 THE ROLE OF THE STANDARDS COMMITTEE

3.1 The role of the Standards Committee is reflected in our terms of reference, which appear in the Council’s Constitution.

3.2 The key roles of the Standards Committee are:-

• To promote and maintain the highest standards of conduct within the Council and to assist members to follow the member Code of Conduct

• To consider allegations of breach of the Member Code of Conduct and any sanction where appropriate.

3.3 To fulfil these dual aims, the Committee embarks on other work such as training, reviewing compliance with and the effectiveness of the Code, monitoring whistleblowing allegations and corporate complaints to name but a few, but at no time does it lose sight of the fact that all of this work is geared towards achieving the highest standards of ethical conduct in Lewisham.

4 THE MEMBER CODE OF CONDUCT

4.1 The Council adopted a revised Member Code of Conduct to replace the previous national Member Code of Conduct which was abolished by the Localism Act 2011. The Code and accompanying protocols appear in the Constitution at part V Ethics. It is also available on the Council’s web site http://www.lewisham.gov.uk/mayorandcouncil/aboutthecouncil/how- council-is-run/Pages/constitution.aspx

4.2 There is a dedicated email address, again easily accessed from the Council’s website [email protected] on which complaints can be made. The email address is checked daily for complaints.

5 THE WORK OF THE STANDARDS COMMITTEE IN 2013/14

5.1 This year the Committee has met on 3 occasions:-

6 FORMAL COMPLAINTS RECEIVED

6.1 This year there were three formal complaints received. All of the complaints were made by a member against another member. Two were made by one member and pertained to closely related incidents and the other was also made by a different member against another.

6.2 In one case whilst the Standards Sub Committee did not make any finding of breach it did recommend training for the member concerned and that the member should not participate in licensing decisions until the training had been completed.

6.3 In the other case the Monitoring Officer conducted very preliminary enquiries in order to be able to apply the criteria for initial assessment. In the course of those preliminary enquiries, it transpired that the basis for the complaint fell away and the complaining member was notified accordingly.

6.4 During the course of the year the Committee conducted a review of the procedure for handling complaints of a breach of the Member Code of Conduct. The Committee also compared the Council’s procedures with a sample of procedures adopted by other local authorities. Save for some minor amendments, the Committee endorsed the current procedures which are designed to be flexible, fair and as uncomplicated as possible.

8 THE FUTURE

8.1 The Committee was keen that the diligent approach towards ethical governance which the Council has fostered over the last decade and more should be promoted and maintained.

8.2 The reports we have received as a Committee have demonstrated a high degree of compliance with the Code of Conduct and a willingness to keep the ethical agenda high. It seems that Lewisham aspires for this to be a matter not of begrudging compliance but a genuine desire to do the right thing. In future we would want to see this continue and grow.

8.3 The Committee hopes that the new administration after the local elections in May ensures that the ethical regime continues to have the same high profile as to date. It will be for the new Standards Committee, appointed in May 2014 to establish its priorities for the coming year.

9 CONCLUSION

9.1 There is much good practice in Lewisham in so far as the ethical governance agenda is concerned. We believe however that there is no room for complacency and urge the Council to ensure that robust arrangements remain in place and continue to give to the ethical agenda its continuing commitment to inspire public confidence in its elected representatives.

10 LEGAL IMPLICATIONS

10.1 The constitution and operation of the Standards Committee, as well as recruitment to it and appointment to be its Chair are all defined by regulation. The current legal requirements are reflected in the Council’s constitution and our practice accords with those legal requirements. Save where reflected in this report, there is nothing that requires further legal advice.

Cathy Sullivan

Holds a BA (Hons) Social Science and completed Graduate Research in Social Studies of Science. Currently Senior Lecturer, Department of Social Sciences at London Metropolitan University. Has an interdisciplinary background including extensive professional experience in education policy, research and planning at LEA level, Social researcher and evaluator in the field of Information Studies on British Library supported projects and senior manager within Inner and Outer London local authorities. Very experienced in research and analysis.

Gill Butler

Gill is a consultant in a firm of solicitors, Burton Woods, and advises on all aspects of family law. Gill has a degree in Economics from the London School of Economics and has been working in the justice system for 29 years. She has both public and private sector experience, as well as being involved with a number of community organisations. From 1991-2002 Gill was the Chair of Stonewall.

David Roper Newman

David is employed in a Unit within the Department for Works and Pensions dealing with the detection, prevention and investigation of internal fraud and related abuse by employees where he is a Policy and Professional Standards Manager. David has broad experience of investigating grievances and employee related matters. His experience spans over 30 years.

Leslie Thomas Q.C.

Leslie is a practicing barrister who resides within the Borough. Leslie was called to the bar in 1998 and has developed a strong “human rights” dimension to his work. He is regarded as a leading junior barrister who handles many difficult and complex police jury trials. He is a well-known jury advocate and is instructed nationally by solicitors.

Leslie Thomas is also recognised as a leading barrister in the field of inquest law and has represented families in many high profile inquests especially in cases involving deaths whilst in police custody. Leslie regularly speaks and provides training in the area of inquests and is one of the co-authors of “Inquests – A Practitioners Guide”. Leslie was also co –counsel to the New Cross Fire Parents Committee in the fairly recent second inquest.

Page 57 Leslie is a former director of the Civil Liberties Trust and is a member of the INQUEST management committee. Leslie is also currently Chair of the Central London Law Centre. He was appointed Queen’s Counsel in 2014.

Hannah Le Vay

Hannah Le Vay is a local resident who originated from Wales and studied Classics at UCL. She is a qualified AQCCA and CIPFA accountant. She has over 20 years experience in local authority corporate finance. She has worked in partnership with a number of public sector organisations , and has been a school governor as well as attendee at Lewisham Adult Education Centres.

Matthew Hill

Matthew Hill is a Deptford resident who has lived in the borough for over 5 years. He obtained a first class degree in English literature from Exeter University in 2003. He is a qualified financial advisor and is a volunteer mentor for ex-offenders in Lewisham.

APPENDIX 2

Erica Pienaar

Erica lives in Bromley and has a B.A. Certificate in Education from Goldsmiths as well as an MBA in Education from London South Bank University. She held various teaching posts in Bromley for 25 years before being appointed to the position of head teacher at Prendergast School in 1998, a position she held until 2008 when she was appointed as Executive Headteacher. Though working in Lewisham for the last 15 years, she never been a Lewisham Council employee. Throughout her professional life she has conducted a number of sensitive investigative and disciplinary procedures and hearings. She also served on the Council of Queen Mary College of London University. Having retired recently, she serves as a Chair of Governors at a Lewisham primary School. Erica has been granted the Freedom of Lewisham.

Wendy Innes

Wendy is based in Newcastle upon Tyne. She has an M.A. in Swedish Studies and is a solicitor with extensive experience of advising North Tyneside Council where she was employed for 17 years until 2013, most recently as head of the legal service and deputy monitoring officer there. Before that she worked for 5 years in a commercial legal firm. North Tyneside operates a directly elected mayoral system like Lewisham and Wendy is very familiar with the new ethical framework under the Localism Act, has conducted two independent investigations into allegations of breach of the Member Code of conduct in North Tyneside and presented reports about the investigations to their Standards Committee.
