York Theatre Royal - Service Level Agreement Performance Bi-annual Update Report (Pages 11 - 22) This report is to inform the Scrutiny Committee of the progress and performance of the York Theatre Royal under the current Service Level Agreement (SLA). 5. Careers Review- Further Update on Implementation of Recommendations (Pages 23 - 38) This report provides Members with a second update on the implementation of the recommendations arising from the previously completed scrutiny review of Careers, Education, Information, Advice & Guidance (CEIAG). Members are asked to sign off all those now considered fully implemented. 6. Draft Final Report -'Disabled Access To York's Heritage & Cultural Offer' Scrutiny Review (Pages 39 - 426) This report presents the findings from the recently completed scrutiny review of Disabled Access to York’s Heritage & Cultural Offer, and asks the Committee to agree the Task Group’s draft recommendations, to enable the final report to be presented to a future meeting of Cabinet. 7. Draft Final Report - 'Narrowing the Gap' Scrutiny Review (Pages 427 - 486) This report presents findings from the recently completed Narrowing the Gap scrutiny review and asks the Committee to agree the Task Group’s draft recommendations, to enable the final report to be presented to a future meeting of Cabinet. 8. Learning and Culture Overview and Scrutiny Committee Workplan 2014/15 including a verbal update on ongoing 'Entrepreneurship in York Schools' Scrutiny Review (Pages 487 - 488) Members are asked to consider the Committee’s workplan for the 2014-15 municipal year and receive a verbal update on the ongoing Entrepreneurship in York Schools scrutiny review. 9. Councillor Taylor declared a personal interest in agenda item 6 (Attendance of Chair of York@Large) as he is employed by the City Screen who have been involved with red letter nights. 39. Minutes Resolved: That the minutes of the last meeting of the Learning and Culture Overview and Scrutiny Committee held on 19 November 2014 be approved and signed by the chair as a correct record. 40. Public Participation It was reported that there had been no registrations to speak under the Council’s Public Participation Scheme. Page 2 41. York Theatre Royal - Service Level Agreement Performance Bi-annual Update Report This item had been withdrawn prior to the meeting. Members were advised that the update on the progress and performance of the York Theatre Royal under the current Service Level Agreement SLA) would be provided at the next meeting of the committee due to take place on 24 February 2015. 42. Attendance of Chair of Learning City The Chair of Learning City York attended the meeting with the Learning City Partnership Manager to provide an update on how the organisation had been working with the Council and other partners to deliver joint services since it provided its last update in March 2014. The Powerpoint presentation has been attached to the online agenda. Members were reminded that Learning City York’s aim and priorities which were sustainable business growth, enterprise and an enterprising culture, employability and economic inclusion, and personal, social and community development. The partnership provided support to children and young people (including undergraduates / graduates), families and communities, working age adults (both those in and out of work) and employers, including self-employed. Officers explained that while York Learning Partnership focused on young people up to the age of 19 and Learning City York focused on adult provision from age 19 upwards, there was some overlap in the19 to 24 age range with crucial links with York Economic Partnership and other key groups and organisations. Officers updated the committee on services which had been delivered with City of York Council during 2014. A key focus had been on business growth & productivity with a lot of work taking place in this area and a number of projects led by partners. With regard to employability & career progression, work had been taking place with the unemployed, Job Centre Plus and schools with lots of activity around apprenticeships, as well as the celebration of Page 3 skills and lifelong learning. Members noted that key factors in delivering services included signposting where necessary, building links with Make it York and making the most of European funding. The Chair of Learning City York and the Council’s Learning City Partnership Manager responded to Members questions in relation to the use of intelligence in informing priority actions, European funding, and with regard to information which they felt could help inform the review currently being carried out by the committee on Entrepreneurship in York Schools. Resolved: That the update be noted. Reason: In order that Members are kept informed on work undertaken by the Council’s strategic partners. 43. Attendance of Chair of York@Large The Chair of York@Large attended the meeting and provided an update on how the organisation had been working with the Council and other partners to deliver joint services since Members had received their last update in September 2013. A copy of the PowerPoint presentation has been attached to the online agenda. The Chair advised Members that, as well as the City of York Council, the cultural partnership had partners from within the arts, education, festivals, media and creative industries, museums, universities, the voluntary sector, visitor attractions and tourism. He provided an update on activity which had taken place in relation to the following initiatives: Red Letter Nights; Make it York; Festival of Faith; Tour de France Yorkshire Festival; York@Large recruitment; York TV; Cultural Plan; UNESCO City of Media Arts; Urban Realm; York@Large workshop; and Legible York, which he explained would see the introduction of new signposting in the city. Page 4 He confirmed that during 2015, the cultural partnership would be working with City of York Council as its strategic partner and the council, York Explore and Make it York as its delivery partners, to promote the following priorities: – Red Letter Nights, York City of Media Arts, York TV – Legible York, Case for Culture, York Awards – Research – Review partnership in new context He provided further information in response to specific queries raised by members during discussion. Resolved: That the update from York@Large be noted. Reason: In order that Members are kept informed on work undertaken by the Council’s strategic partners.

    (SD531/95) Pension Schemes Act 1993 (c. 48) Contents The Pension Schemes Act 1993 (Application) Order 1995 (SD531/95) was made 25 October 1995 and approved by Tynwald 12 December 1995. Article 2(1) of that Order provides that in that Order “the applied legislation” means the Pension Schemes Act 19931 and paragraphs 56 to 58 of Schedule 1 to the Social Security (Incapacity for Work) Act 19942 which amends the Pension Schemes Act 1993, and are set out in the Schedule to the Order. Article 1(1) provides that the Order subject to section 1(4) of the Pension Schemes Act 1995 and to paragraph (2), shall come into operation on 1st January 1996. Article 1(2) provides that subject to paragraph (3), except so far as it imposes any penalty or increased penalty in respect of anything done or omitted to be done before the date mentioned in paragraph (1), any provision of this Order applying any legislation of the United Kingdom to the Island shall be deemed to have had effect from the day on which that legislation had effect in Great Britain. Article 1(3) provides that any provision of this Order applying any provision of legislation of the United Kingdom, so far as the latter repeals any provision of legislation of the United Kingdom imposing a penalty for any contravention (a “penal provision”), shall have effect from the date specified in paragraph (1) as if the penal provision related to a contravention of the corresponding provision of the applied legislation3. This Order makes provision for a purpose mentioned in section 2(2) of the European Communities Act 1972 and it appears to Her Majesty that it is expedient for certain references to provisions of a Community instrument to be construed as a reference to those provisions as amended from time to time. The Pension Schemes Bill was introduced in the House of Commons on 26th June 2014. 2. This memorandum identifies the provisions for delegated legislation in the Bill. It explains the purpose of the powers, the reasons why they are left to delegated legislation, the Parliamentary procedure selected for the exercise of these powers and why that procedure has been chosen. 3. The Department has followed the precedent in pensions legislation by setting out the overall legislative framework on the face of the Bill but giving the Secretary of State the power to make detailed provision in secondary legislation. INTRODUCTION Directive 80/987/EEC1 provides for protecting employees’ rights in the event of the insolvency of their employer, in particular in order to guarantee payment of their outstanding claims (wages, pensions and other benefits). It was extended and adapted by Directive 2002/74/EC2 to cover insolvency proceedings other than liquidation also and to give legal certainty in the event of insolvency of transnational undertakings. Article 8 of Directive 80/987/EEC, which was not affected by the 2002 revision, concerns old-age benefits, including survivors’ benefits, under supplementary company or inter-company pension schemes outside the national statutory social security schemes. All the Member States are facing the social and economic effects of ageing. Many have launched pension reform strategies giving an increasingly important role to occupational pension schemes and other forms of privately managed schemes.
