ART. 2º - A arrematação far-se á pelo maior lance. ART. 3º - Os produtos a serem licitados estarão à disposição dps interessados, no dia do leilão, quando poderão ser revisados. Antes disso poderão ser examinados nos respectivos Haras Vendesores. ART. 4º - É facultado aos interessados fazer examinar por técnicos de sua confiança os produtos a serem licitados, antes do Leilão. Portanto serão inaceitáveis quaisquer reclamações possíveis. ART. 5º - Os vendedores e a APPS não se responsabilizam por quaisquer alteração ocorridas no estado dos animais, após a arrematação, tampouco acidente de transporte. Parágrafo único - Lembramos aos interessados que procedam com antecedência a devida recisão dos animais. ART. 6º - Os animais, após o leilão, retornarão ao local de origem, e deverão ser retirados no prazo de 2 (dois) dias úteis a contar da data da arrematação. ART. 7º - Os lances corresponderão ao valor da parcela mensal e seu valor será determinado pelo leiloeiro. ART. 8º - Foram dispensados os necessários cuidados para que o catálogo esteja correto, mas a APPS, os vendedores e o leiloeiro não respondem por erros ou omissões no mesmo. Eventuais correções feitas durante o leilão prevalecerão sobre o catálogo. II - DOS COMPRADORES ART. 9º - Os compradores poderão optar pelas seguintes condições de pagamento: - 15 parcelas iguais, sem juros e sem correção; - à vista com desconto a ser anunciado pelo leiloeiro. - os animais arrematados por valor inferior ou igual a R$ 200,00 (duzentos reais) deverão ser pagos a vista. ART. 10º - Os interessados em obter financiamento deverão apresentar a APPS cadastro para apreciação até 10 dias antes do leilão. Parágrafo único - Os compradores que não estiverem cadastrados ou aqueles cujos cadas tros não forem aprovados terão que efetuar o pagamento à vista, gozando do mesmo desconto estipulado. ART. 11º - Os compradores deverão pagar as seguintes taxas: a. 7% (sete por cento) sobre o valor do arremate, para qualquer opção de pagamento. b. Transferência de propriedade - Até 30 dias após a realização do leilão - valor previsto na tabela; - Até 60 dias após a realização do leilão - valor previsto na tabela acrescido de 20 % (vinte por cento); - Após 60 dias da realização do leilão - valor previsto na tabela acrescido de 100% (cem por cento). NORMAS ESPECÍFICAS ART. 12º - Aos compradores compete ainda: a) Assinar as notas promissórias; b) Assinar, a transferência de propriedade; c) Assinar, o contrato de financiamento; d) Os acertos das compras deverão ser efetuados junto à APPS no local do leilão ou em seu escritório localizado à Rua Ibiapinópolis, 61, Jardim Paulista, São Paulo, Capital CEP 01457-030. ART. 13º - Caso ocorra atraso de 30 dias de pagamento de alguma parcela referente a compra efetuada neste leilão, a transferência do animal adquirido será bloqueada. Comprovado o atraso de 60 (sessenta) dias, à APPS poderá solicitar ao Stud Book Brasileiro o cancelamento da transferência, retomando o animal em questão, para a propriedade do vendedor. III - DOS VENDEDORES ART. 14º - Pagar as despesas do leilão que serão rateadas por animal. ART. 15º - No caso de não apresentação do animal inscrito, seu responsável também deverá pagar a importância mencionada acima. ART. 16º - No caso de defesa ou forfait, o vendedor terá 5 (cinco) dias úteis para efetuar o pagamento, após este prazo, incidirão juros sobre o débito. a) na defesa, o vencedor ficará responsável pelo pagamento das taxas de com prador, além das despesas previstas no artigo 14º. IV - CONDIÇÕES FINAIS ART. 17º - O animal arrematado será entregue pelo vendedor mediante autorização por escrito da APPS, a qual será dada imediatamente após a regularização da compra, correspondendo ao vendedor a responsabilidade de manutenção do animal até no máximo 2 (dois) dias úteis subsequentes à arrematação. A partir do 3º (terceiro) dia útil, as despesas de manutenção ficarão por conta do comprador, pagas diretamente ao vendedor, no dia da retirada do animal no valor de R$ 30,00 (trinta reais) a diária. Parágrafo único - Eventuais problemas decorrentes da não retirada do animal são de exclusiva responsabilidade do comprador. ART. 18º - A Palavra do leiloeiro, no decorrer do leilão está credenciada a alterar ou complementar estas normas, bem como as demais informações do catálogo. O leiloeiro reserva-se o direito de não aceitar lances de pessoas que a seu exclusivo critério julgar não responsáveis sendo seu julgamento soberano. ART. 19º - Fica estabelecido o foro da cidade de São Paulo, para a eventualidade de qualquer pendência judicial. ART. 20º - Após o prazo de 4 (quatro) dias úteis, caso não tenha ocorrido o acerto por parte do comprador, o vendedor poderá aceitar, ou não, com a anuência da APPS, a substituição do comprador. NORMAS ESPECÍFICAS ART. 21º - No caso de acerto direto entre as partes, as taxas deverão ser pagas à Agência. Após o prazo de 2(dois) dias, se o comprador não tiver efetuado o pagamen to, o débito será efetuado contra o vendedor. ART. 22º - A taxa do leilão são irrestituíveis, mesmo para os casos de anulação. ART. 23º - Os casos omissos serão julgados pelos vendedores e pela APPS, a seu exclusivo critério, sendo finais e definitivas as suas decisões, não podendo ser encaminha do nenhum tipo de reclamação, sem primeiro ocorrer o acerto inicial. ART. 24º - É facultada ao vendedor a exigência de avalista. No caso de não aprovação do avalista indicado, o comprador ficará sujeito ao pagamento à vista. ART. 25º - O não pagamento de uma das notas promissórias implica no vencimento automá tico de todas as demais ainda por vencer. ART. 26º - As vendas realizadas são irrevogáveis e irretratáveis não podendo o comprador recusar o animal ou solicitar redução de preço (art. 1106 do Código Civil). Todos os participantes obrigam-se a acatar as disposições do regulamento, não poden do se escusarem a aceitá-las, alegando que não conheciam (art. 3 da Lei de Introdução Civil). ART. 27º - As éguas dadas como cheias far-se ão acompanhar de atestado veterinário. Entretanto os compradores terão 48 (quarenta e oito) horas para confirmá-la, por veterinário de sua confiança.Após esse prazo não mais serão aceitas reclamações. ART. 28º - Os compradores terão o direito de fazer examinar os animais, por veterinários de sua confiança não sendo aceitas devoluções posteriores à arrematação, conforme regulamento dos leilões.

I express my sincere thanks to Chair Jan Schakowsky and Ranking Member Cathy McMorris Rodgers for conducting this hearing and offer special thanks to Representatives Paul Tonko, and, Andy Barr for introducing this reform effort.
