on the Sale and Export of Objects of Cultural Value

The Parliament has passed the following Act of the :

PART I

Sale and Export of Objects of Cultural Value

§ 1

(1) Objects of cultural value under this Act are natural objects or human artefacts or sets of, these, which are significant for history, literature, art, science or technology and meet the criteria contained in Appendix No. 1 to this Act.

(2) This Act does not apply to the sale and export of cultural monuments and national cultural monuments,1) registered museum-type collections and collection items that are parts of such collections;2) archive items;3) original works of art by living authors; and items imported to the Czech Republic under the regime of temporary use.

§ 2

(1) Objects of cultural value may be exported from the territory of the Czech Republic only if they have a certificate for export for a limited period of time or certificate for permanent export (henceforth only “Certificate”). An expert opinion may not substitute for the Certificate.

(2) Certificates are issued by museums, galleries, libraries and bodies of the National Heritage Institute (henceforth only “Specialist Organisations”), or the Ministry of Culture (henceforth only “Ministry”), upon request filed by a natural person or juristic person who is the Owner of the object of cultural value (henceforth only “Owner”). A list of the Specialist Organisations, their respective fields of concern and the territories they cover is given in Annex 2 to this Act.

(3) The Owner may issue a letter of attorney3a) to authorise a third party to carry out any steps related to the export of an object of cultural value.

(4) Certificate for export for a limited period of time is issued if the object of cultural value is not object protected according to special legal regulations.3b)

(5) Certificate for permanent export is issued if the object of cultural value is not protected on the basis of special legal regulations3b), if it does not exhibit traits of an object protected on the basis of special legal regulations,1) and if it is not indicated under Point XVII of Annex No. 1 to this Act.

§ 3

(1) Objects of cultural value from the field of archaeology and objects of cultural value of a sacral or cult nature offered for sale must have a Certificate for permanent export. To the buyer must be given three copies of the Certificate, denoted as B, C and D, together with the object of cultural value. (2) Offer for sale as referred to in section 1 also means display of the objects in public selling establishments, at auctions and collectors’ markets.

§ 4

(1) The Owner should submit to the Specialist Organisation the application for issue of a Certificate for export for a limited period of time and application for issue of a Certificate for permanent export, the blank forms of which are contained in Annexes No. 3 and No. 4 to this Act. The completed forms of the applications shall be so submitted in quadruplicate, the copies being denoted as A, B, C a D.

(2) The application referred to in section 1 should be submitted to the Specialist Organisation in the appropriate field and in the appropriate region, depending on the permanent residence or registered address of the Owner. If the Owner is a natural person or juristic person not having a permanent residence or registered address in the Czech Republic, the application shall be submitted to the Specialist Organisation in the appropriate-field in the appropriate region in which the object of cultural value was located at the time of its acquisition. If it is impossible to identify the appropriate region of the respective Specialist Organisation in accordance with the previous sentence, the application shall be submitted to any Specialist Organisation in the appropriate field.

(3) The Owner is obliged to enable examination of the object of cultural value and co-operate appropriately with the Specialist Organisation or the Ministry.

§ 5

(1) The period within which the Certificate must be issued by the Specialist Organisation is 21 calendar days from the date of delivery of the application to the Specialist Organisation.

(2) If the Specialist Organisation, having examined the object of cultural value, does not issue a Certificate, it shall refer the application to the Ministry within the period indicated in section 1 above, and shall inform the Owner to that effect in writing.

(3) The Ministry shall issue a Certificate to the Owner within 3 months from the delivery of the application to the Specialist Organisation or, if traits of an object protected on the basis of a special legal regulation1) are identified in the object of cultural value, or if an application for Certificate for permanent export has been submitted, the Ministry shall not issue the Certificate and shall commence proceedings based on special legal regulation.1) Also, no Certificate shall be issued if the object of cultural value as such is an object protected on the basis special legal regulations.3b)

(4) If an application for issue of a Certificate for permanent export was submitted, but the Certificate was not issued because the object of cultural value concerned ,is an object of cultural value indicated in Point XVII of Annex No. 1 to this Act, the Ministry shall issue a Decision on that effect within the period specified in section 3 of the Decision.

§ 6

(1) The Certificate shall be issued to the Owner in three copies, denoted as B, C and D. The Specialist Organisation or the Ministry shall keep the A copy in its archives for 20 years.6)

(2) Certificate shall be issued to the applicant for a fee of CZK 500. This provision does not apply to the issue of a Certificate in accordance with § 2 section 4, § 3 section 1 and § 5 section 3. The Specialist Organisation is the recipient of the fee.

(3) A Certificate for export for a limited period of time may be issued for a period no longer than 5 years.

(4) A Certificate for permanent export is valid for 3 years from the date of its issue.

§ 7

(1) The natural or juristic person exporting the object of cultural value (henceforth only “Exporter”) shall submit the copies denoted as B, C and D to the Customs Office through which that object enters the export regime or the outward processing regime. If such a Customs Office is a non- border Customs Office, those copies shall also be so submitted to the border Customs Office through which the object of cultural value leaves the country; the latter Customs Office shall indicate in the Certificate the exit abroad.

(2) The Customs Office through which the object of cultural value enters the export regime or the outward processing regime shall confirm all the submitted copies of the Certificate. The border Customs Office shall send copy denoted as B to the Ministry no later than 15 days from the date of export. Copy denoted as C shall accompany the object of cultural value. The Exporter shall keep copy denoted as D for inspection, if any.

(3) Re-import of an object of cultural value, which was exported for export for a limited period of time, shall be confirmed by the Customs Office in copies denoted as C and D. Copy denoted as C belongs to the Owner. The physical person or legal entity who imports the object of cultural value (henceforth only “Importer”) shall submit the copy denoted as D to the Specialist Organisation that issued the Certificate or to the Ministry, if it was the Ministry that issued the Certificate, and shall do so within 15 days from the expiration of the period determined in the Certificate for export for export for a limited period of time. The Importer shall, if so requested, also submit after re-import the object of cultural value for inspection and identification to the Specialist Organisation that issued the Certificate or to the Ministry, if it was the Ministry that issued the Certificate, or shall enable the inspection and identification to be performed in the place where the object is deposited.

(4) If the export did not take place, the Owner must return copies denoted as B, C and D to the Specialist Organisation that issued the Certificate or to the Ministry, if it was the Ministry that issued the Certificate, and shall do so within 15 days from the expiration of the validity of the Certificate.

(5) The Specialist Organisations shall monitor compliance with the periods of export for a limited period of time. They shall notify the Ministry of any case of non-compliance with those periods no later than 30 days after the expiration of the period at the maximum.

§ 7a

(1) If an Exporter submits to the Customs Office a customs declaration proposing that an object be left to enter the export regime or the outward processing regime and the Customs Office suspects that the object being exported is an object of cultural value exported without a Certificate, and the Exporter fails to prove that it is not an object of cultural value, then the Customs Office shall intercept the object, immediately inform the Specialist Organisation in the appropriate field and in the appropriate region (appropriate in respect of the address of the Customs Office) and allow the Specialist Organisation to examine the object. The Customs Office shall use a similar procedure when such an object is being exported without submission of the customs declaration.

(2) The Specialist Organisation shall immediately, no later than 15 workdays after the delivery of the information, prepare for the Customs Office an expert opinion concerning whether the object being exported is an object of cultural value. The Exporter shall receive one copy of such an opinion.

(3) The Exporter shall tolerate the use of measures needed for identifying and examining the object.

(4) The costs related to the interception of the object and to preparing the expert opinion shall be paid by the Exporter if it has been proved that the Exporter violated this Act.

§ 7b

Compliance with this Act shall be supervised by the Ministry and the Customs Offices. This is not to the prejudice of the authorisations given to Customs Offices on the basis of a special Act.6a)

Sanctions

§ 8

(1) A physical person commits a contravention if he: a) exports or has exported an object of cultural value without a Certificate; or b) offers for sale and permanent export an object of cultural value in the area of archaeology or an object of cultural value of sacral or cult type without a Certificate.

(2) An Owner commits a contravention if he: a) does not allow for examination of the object of cultural value or does not co-operate, as needed, with the Specialist Organisation or the Ministry (§ 4 section 3); b) does not return the copies denoted as B, C and D within the prescribed period of time to the Specialist Organisation that issued the Certificate or to the Ministry, if it was the Ministry that issued the Certificate, in the event that the export did not take place (§ 7 section 4); or c) does not re-import within the prescribed period of time the object of cultural value exported for the limited period of time indicated in the Certificate.

(3) An Exporter commits a contravention if he: a) fails to submit copies denoted as B, C and D to the Customs Office (§ 7 section 1); or b) fails to tolerate the use of the measures needed for identifying and examining the object (§ 7a section 3).

(4) An Importer commits a contravention if he fails in the prescribed period to deliver the copy denoted as D to the Specialist Organisation that issued the Certificate or to the Ministry, if it was the Ministry that issued the Certificate, or fails to submit the object of cultural value for inspection and identification upon request, or does not allow the inspection to be performed at the place where the object is deposited (§ 7 section 3).

(5) A fine of up to CZK 5,000,000 may be imposed for a contravention referred to in section 1 and section 2 letter c) and a fine of up to CZK 20,000 may be imposed for a contravention referred to in section 2 letters a) and b) and sections 3 and 4.

(6) If the unlawful conduct referred to in § 8 sections 1 to 4 is committed by a legal entity, a fine in the amount indicated in Subsection 5 shall be imposed on such a juristic person.

(7) A fine of CZK 20,000 shall be imposed on the Specialist Organisation that fails no notify to the Ministry in writing within the prescribed deadline period any case of non-compliance with the periods of export for a limited period of time (§ 7 section 5).

(1) When the amount of the fine to be imposed on a juristic person is being assessed, account shall be taken of the seriousness of the unlawful conduct, including, but not limited to, the manner in which it was committed, the consequences incurred, and the circumstances in which it was committed.

(2) Responsibility of a legal entity for any unlawful conduct shall lapse with the expiration of 3 years from the date on which the unlawful conduct was committed.

(3) Forfeiture shall be imposed for wrongdoing under § 8 section 1, § 8 section 2 letters a) and c) and § 8 section 4 on a legal entity, if the legal entity is the owner of the object being forfeited and if it was used or intended for the wrongdoing. The government shall become the owner of the forfeited object.

(4) Contraventions and unlawful conduct committed by legal entity hereunder shall be considered by the Ministry in the first instance.

(5) Unlawful conduct committed by a physical person who is an entrepreneur6b, or committed during business activities or in direct association with business activities, shall be considered on the basis of this Act’s provisions concerning responsibility of legal entity and sanctions against corporations.

(6) Fines shall be collected and enforced by the Ministry on the basis of a special legal regulation.6c)

(7) The revenue from the fines goes to the national budget.

§ 9

(1) Certificate based hereon does not substitute for export permit under special regulations.7)

(2) General regulations on administrative procedure do not apply to measures taken under this Act, except § 5 section 4, § 7a section 1, and § 8 and 8a.8) Appeal against decisions under § 7a section 1 shall not have an effect of suspension.

Amendment to Decree No. 41/1985 Coll. on Non-commercial Export and Import of Articles, as Amended.

§ 10

The Decree of Ministry of Foreign Trade No. 41/1985 Coll. on Non-commercial Exports and Imports of Articles, in the reading of Decrees No. 178/1988 Coll., No. 118/1989 Coll., No. 4/1990 Coll., No. 52/1990 Coll., No. 225/1990 Coll., No. 423/1990 Coll., No. 534/1990 Coll. and No. 398/1991 Coll., is amended as follows:

In Annex No. 2, leave out Item “1 Antiquities”.

Decree of the Ministry of Education and Culture No. 239/1959 on Export of Cultural Heritage Items and of Objects of Museum Value is repealed.

§ 12

This Act shall come into force on the day of its publication.

Selected Provisions of the Amendments

Article II of Act No. 80/2004Coll.

Transitory Provisions

(1) Certificates issued before the effective date of this Act shall remain in force for 3 years from the date of issue thereof but not longer than until 31 December 2004.

(2) If an application for the Certificate for export of an object of cultural value was issued before the effective date of this Act, the currently existing legal regulations shall apply to the issue of the Certificate and to the export regime or outward processing regime. Certificates issued in this manner shall remain in force for 1 year after the date of their issue.

(3) Proceedings concerning imposition of fines, commenced before the effective date of this Act, shall be completed in accordance with the currently existing legal regulations.
