JANUARY, 2008 BACKGROUND

TRADEMARKS MUST SEND A CONSISTENT MESSAGE Polycom’ and services must be used in a consistent manner and project a consistent image across product and service lines that may share a given mark. That’s one of the reasons for these Guidelines. This is not strictly a legal issue. A mark that is misused from an image standpoint may nonetheless be correct from a legal perspective. Similarly, a mark or particular usage may meet advertising requirements, yet constitute a legal misuse that jeopardizes Polycom’s rights in the mark.

TRADEMARKS ARE ASSETS OF THE BUSINESS Everyone who uses any of Polycom’s trademarks is responsible for following these Guidelines. Polycom’s marketing depart- ment, in particular, has the responsibility to manage trademarks and to oversee third party use of its marks and monitor compliance. Wherever a Polycom mark is used, it must be consistent with the message of the mark and the strategy of Polycom’s business.

TRADEMARK RULES OF USAGE

1. TRADEMARKS SHOULD ALWAYS BE EMPHASIZED This manual sets forth precise guidelines for using some of Polycom’s most valuable trademarks and service marks. For trademarks and service marks that consist of words that are used in text, the marks should always be set apart from the surrounding text. The most common means for doing so are for the trademark or to be CAPITALIZED completely, used with “Initial Caps And Quotes,” or at the very least, used with Initial Caps. Other alternatives for distinguishing trade- marks include using italics and boldface fonts or a different type of style or color.

2. TRADEMARKS SHOULD ALWAYS BE PROPERLY DESIGNATED In printed advertising and publications, trademarks and services marks should be properly designated (with ® or TM or SM as appropriate) at the most prominent use (usually a headline) and again on the first occurrence in copy or text. The following are some more specific guidelines: • In the case of presentation graphics, trademarks should be designated with the proper at least once on each screen, page, foil and/or slide. • In the case of brochures, reports, technical documentation and other bound documents, the proper trademark symbols should be used on the first occurrence in the table of contents, in headlines, and on the first occurrence in text. • In the case of charts or graphs that may be copied or used independently, always use proper trademark designations at least for the first occurrences of the marks.

Note that the registered trademark symbol (“®” or “Reg. U.S. Pat. & Tm. Off.”) is ONLY used when a mark is registered with the United States Patent and Trademark Office. All other marks should be designated with the trademark symbol (TM) or service mark symbol (SM), as appropriate, before the marks are federally registered. One exception is that the trademark symbol (TM) may be used for both trademarks and service marks, as the service mark symbol is generally less recognized by the public. Please that the “TM”, “SM” and “®” symbols should typically be used in superscript text. In cases where super- script test in unavailable, such as electronic mail, use parentheses (TM), (SM) or (R) following the trademark.

Taglines (or legends) are also required in advertising and other documentation containing multiple trademarks. Note that trademarks used in tag lines should always have the correct trademark symbol in every usage. An example of a tagline is:

TRADEMARKS SHOULD ALWAYS BE PROPERLY USED Trademarks are Adjectives. Trademarks in text should always be used as an adjective and they should be followed by a generic noun. Approved generic nouns for Polycom’s trademarks are set forth in these Guidelines. Use Proper Spelling. Trademarks should never be misspelled or abbreviated. Trademarks should also never be joined with other words, symbols or numbers as a single word or with a . And, trademarks should never be pluralized. Source Identification. Trademarks and brand names are created to identify the source of products and services and they should only be used for that purpose and should not be used otherwise.

4. TRADEMARK VERSUS TRADE NAME USAGE Because the word “Polycom” is both a registered trademark and the commonly used name of the company, the POLYCOM mark or logo is sometimes misused as the company name in printed text. Such use blurs the distinction between trademark and service mark usage (on the one hand) and trade name usage (on the other hand) and ultimately weakens the mark. As set forth in these Guidelines, when the company address is used in written materials, it should be preceded by the corporate name “Polycom, Inc.” and the mark POLYCOM (whether in stylized font or not) and/or the “Triangles Logo” mark should stand alone and should not be used as a substitute for the trade name.

YOUR USE OF POLYCOM’S MARKS

USE OF POLYCOM’S TRADEMARKS • All use of Polycom’s trademarks and service marks should be coordinated through, or done with the approval of, the Marketing Department. • All trademark and service mark usage should follow these Guidelines. • Polycom’s trademarks and service marks may not be incorporated into another company’s name or the names of any other company’s products or services. USE OF POLYCOM’S LOGOS • Outside entities are rarely allowed to use Polycom’s logos. • Use of Polycom’s logos by channel partners and/or other third parties must be managed and overseen by Polycom’s Marketing Department. • Use of Polycom’s logos by outside parties must be approved in writing by Polycom. INTERNATIONAL COMMUNICATIONS • These trademark usage Guidelines apply to all uses of Polycom’s marks anywhere in the world.
