NOTICE INVITING TENDER

On behalf of the Head ASC-Airport Services Centre, Chief Manager (Purchase) – Airport Services Centre invites E-Tender in single bid system for the following items:

The important dates with respect to Tendering are as under:

Bidder is required to upload their quotation in single bid system [both Technical Bid (Annexure I) & Price/Commercial Bid (Annexure II)] in the e-procurement portal of HAL (https://eproc.hal-india.com) on or before the last date for receipt of completed bid. Instructions for submission of bid in HAL e-procurement portal are enclosed.

STANDARD CONDITION:-

The seller confirms and declares to the buyer that the seller is the original manufacturer or authorized distributor / stockiest of original manufacturer of Govt. Sponsored / Designated Export Agencies (applicable in case of countries where domestic laws do not permit direct export by OEMS) of the stores referred to in this offer / contract / Purchase Order and has not engaged any individual or firm, whether Indian or Foreign whatsoever, to intercede, facilitate or in any way to recommend to Buyer or any of its functionaries, whether officially or unofficially, to the award of the contract / purchase order to the Seller; nor has any amount been paid, promised or intended to be paid to any such individual or firm in respect of any such intercession, facilitation or recommendation. The Seller agrees that if it is established at any time to the satisfaction of the Buyer that the present declaration is in any way incorrect or if at a later stage it is discovered by the Buyer that the Seller has engaged any such

individual / firm, and paid or intended to pay any amount, gift, reward, fees, commission of consideration to such person, party, firm or institution, whether before or after the signing of this contract / purchase order, the Seller will be liable to refund that amount to the Buyer. The Seller will also be debarred from participating in any RFQ / Tender for new projects / program with Buyer for a minimum period of five years. The Buyer will also have a right to consider cancellation of the Contract / Purchase order either wholly or in part, without any entitlement or compensation to the Seller who shall in such even be liable to refund all payments made by the Buyer in terms of the Contract / Purchase order either wholly or in part, without any entitlement or compensation to the Seller who shall in such event be liable to refund all payment made by the Buyer in terms of the Contract / Purchase order along with interest at the rate of 2% per annum above LIBOR (London Inter Bank Offer Rate) (for foreign vendors) and Base Rate of SBI (State Bank of India) plus 2% (for Indian vendors). The Buyer will also have the right to recover any such amount from any contracts / Purchase Order concluded earlier with Buyer.

TERMS & CONDITIONS:-

1. Please indicate your lowest price and all taxes & duties applicable for supply of required item for delivery at HAL.

2. Any order resulting from this enquiry shall be governed by enclosed General Terms and Conditions of Contract of HAL and any party quoting against this enquiry shall be deemed to have read and understood these Terms & Conditions and to have quoted subjected to these Terms & Conditions.

3. Prices quoted shall be valid for 90 days from the day of tender opening.

4. You are also required to indicate the quantum/percentage of taxes extra on the quoted price separately. If no taxes/duties are applicable the same to be indicated as ‘NIL’

5. HAL reserves the right to order quantity less than indicated in our enquiry / quoted for by you, at the quoted price without assigning any reason thereof.

6. Please certify in your quotation that rates quoted by you are the same as applicable to DGS & D & other Govt. Organization incase, the items offered are on DGS & D contract. Please furnish a copy of the same.

7. The rates quoted shall be FIRM and errors if any in the total shall be subject to correction.

8. The Tenderers are requested to write the rates in FIGURES as well as in WORDS. In case of any discrepancy between the two, those written in WORDS shall take precedence.

9. Tenderers shall initial all corrections; sign all pages of the tender documents.

10. The tender should confirm to our specifications and conditions in every detail and any tender not confirming to specifications & conditions are liable for rejection.

11. It is preferable to have sealed tenders to maintain confidentiality of your offer.

12. The goods on receipt in HAL will be subject to inspection and tests.

13. Conditional offers will not be accepted.

14. 100% payment will be made within 30 days from the date of receipt and acceptance of items at HAL. Please note that no other terms of payment are acceptable to HAL. Confirm the same in your offer.

15. DELIVERIES/CONSEQUENCES OF BREACH : The vendor shall indicate realistic, firm and exact delivery period. The time and the date of delivery of the stores stipulated in the purchase order shall be deemed to be the essence of the contract, and delivery must be completed not later than the dates specified there in. Should the contractor fail to deliver the stores or any consignment thereof with in the period prescribed for such delivery HAL shall be entitled at their option either :

a. To recover from the contractor Liquidated damages, as agreed and not by way of penalty, a sum of 0.5% of the price of any stores which the contractor has failed to deliver as aforesaid, for each week or part thereof during which the delivery of such stores may be in arrears with a ceiling of 10% of the price of the stores in default, or

b. To purchase elsewhere, without notice to the contractor on the accounts and at the risk of the contractor, the stores not delivered or others of a similar description (where others exactly complying with the particulars are not, in the opinion of HAL which shall be final, readily procurable) without canceling the contract in respect of consignments not yet due for delivery, or

c. To cancel the contract.

In the event of action being taken under (b) and (c) the contractor shall be liable for any loss which HAL may sustain on the account, but the contractor shall not be entitled to any gain on re-purchases made against default.

16. Please send your regret reply in case the subject item is not covered in your range of products or you are not willing to submit proposal.

17. HAL reserves the right to reject or ignore the lowest or any other tender either in full or in part without assigning any reason thereof.

18. REPEAT ORDER: HAL reserve the right to place Repeat Order upto 100% of the value of the original order within 12 months from the date of completion of order.

19. Please indicate whether any of your relatives are working in HAL and if so please furnish the details. In case you suppress this information your offer is liable to be rejected.

20. Kindly furnish your GST Number in your quotation and also in your Invoice/Bills. It is mandatory requirement.

21. Late and/or incomplete tenders shall not be opened and not considered.

22. HAL does not take any responsibility for non-receipt of Tender/Tender Document due to Postal / Transit delays.
