NAMING STATE HIGHWAYS

1.Purpose: The purpose of naming a segment of state highway or a bridge is to bring to public attention and recognize officially a person, organization or other entity who has contributed significantly to the well-being of others.

*** This document provides policy for processing requests to name state highways and bridges. The office of primary responsibility for this DOT-OI is the Traffic Engineering Division. This DOT-OI supersedes DOT-OI 60-01 dated December 18, 2017.

2. Requests: A written request to name a state highway or bridge must be made by the applicable sponsoring organization or agency to the Department of Transportation. When a state highway bridge is located on the state line and, therefore, is located partially in another state, the request to name the bridge must be approved, in writing, by the highway department or department of transportation (whichever is applicable) of the other state. A request to name a state highway segment must be submitted with a resolution of support from each County Board and/or City Council whose jurisdiction the segment to be named would occupy.

a. Individual interchanges may not be named.

b. Rest Areas each have an official name and are not eligible for additional naming.

c. Only those border bridges crossing the Missouri River are eligible.

d. No more than one name per major highway segment will be approved. The Director and State Highway Commission will determine what constitutes a major highway segment.

*** (1) The naming of an isolated roadway segment or bridge along a highway may be allowed to overlap a statewide memorial named highway only if approved by the Director and Highway Commission. Similarly, a proposed statewide route may be allowed to overlap named segments or bridges only if approved by the Director and Highway Commission.

e. There is a limit of one named highway segment or bridge per person, organization or other entity.

f. While it is recognized that there are many that have given their lives in service to their country, it is not feasible to honor them all. There are simply not enough highways to honor all the Fallen Heroes, so cities and counties are encouraged to establish local memorials off the State Highway System to honor Fallen Heroes.

3. The name requested and their accomplishments must be widely recognized across the entire State of Nebraska. Requests will be evaluated using the following criteria:

a. A person shall have been deceased five years to be considered.

b. A person shall meet at least one of the following three requirements:

(1) Have been born in Nebraska.

(2) Have lived a significant part of his or her life in Nebraska.

(3) Made a contribution to society that was affected by his or her residence in Nebraska.

c. The honored person, organization, or other entity must be widely recognized across the entire state and must have contributed to the betterment of Nebraska.

d. Primary consideration will be given to contributions in fields such as public affairs, the arts, the sciences, the professions; secondary consideration will be given to contributions in entertainment, athletics, and kindred fields where interest, publicity, and general recognition may for a time be intense but where a contribution to society is secondary.

e. Activities that have added to the welfare of society and to the reputation of the state shall be weighed more heavily than activities primarily benefiting the individual or organization.

4. Interstate routes have been designated by Congress as the "Dwight D. Eisenhower National System of Interstate and Defense Highways." Except for I-480 which has previously been named, interstate highways and bridges will not be further named.

5. The Department of Transportation will refer requests to name state highways or bridges to the State Highway Commission for review and recommendations to the Director and Governor. Final approval is by the Governor.

Limitations: The Highway Commission will select not more than one name for consideration by the Director and Governor in any one-year period. Requests may be received at any time. Only those requests submitted before October 1 of each year will be considered for that year’s single name approval. An opportunity for a brief presentation to the State Highway Commission will be offered in December. If necessary, the number of requests may be narrowed to an appropriate group of finalists prior to recommending a single name to the Director and Governor.

6. After approval by the Governor, the sponsoring organization or agency will be required to fund, at its own expense, the roadway signs to designate the route, including installation costs. These signs, limited to one at an appropriate location in each route direction, must conform with the "Manual on Uniform Traffic Control Devices" and must be installed by the Department of Transportation. Replacement and repair costs necessary to maintain the signs will be borne by the sponsoring organization or agency.

*** a. For designated routes that are statewide or span multiple counties, the sponsoring organization may request the installation of additional signs. The location of these additional signs will be limited to no more than one sign per direction in each county. Additional signs will not be installed within municipalities on NDOT ROW. NDOT has final approval of the number and location of any additional signs and if necessary, may deny a specific location due to existing signing in the area, roadway geometry, etc.

7. The Department of Transportation will not place directional signs on interstate or other state highways in order to direct traffic to a state highway which has been “named” in accordance with the procedures in paragraphs two through six above. The policy in this paragraph does not apply to or affect directional signs which were in place prior to August 23, 1996.

8. This policy is supplementary to and does not infringe upon the authority of municipalities within their jurisdictions in accordance with Sections 60-6, 120 and 60-6, 121, Nebraska Statutes.

Briefly summarize how the proposed honoree is widely recognized across the entire State and has contributed to the betterment of Nebraska. For hundreds of years the Pawnee Nation laid claim to the majority of Nebraska as their homeland. The Table Creek Treaty of 1857 established the Pawnee Reservation in the Loup River Valley which is now Nance County. In 1864,

3c 3c nearly one hundred Pawnee men and boys enlisted in the U.S. Army as Pawnee Scouts from the Genoa Agency. The Pawnee village was located at the eastern termius of the section of Highway 22 we are proposing to be named, "Pawnee Scouts Memorial Highway". This eastern terminus actually lies within the center of the last Pawnee village in DOT-OI 60-01 Nebraska. The village site was placed on the National Register of Historic Places. One of the main objectives for the elite Pawnee Scouts Company was the protection of the Union Pacific Railroad as it was being built across Nebraska.

Briefly list and describe contribution(s) to the State of Nebraska:

The Pawnee Scouts protected workers of the Union Pacifice Railroad as it was laying track through central and western Nebraska. They fought with extreme bravery and valor throughout the Indian Wars with the US. Army on the Powder River Expedition, Plum Creek, Dull Knife fight, Battle of Rosebud and other battles in Nebraska, Kansas, , Wyoming and South Dakota. They protected the way stations and telegraph lines. Their actions saved many lives

3 d & e 3 d & e including the railroad workers, the westward immigrants on the Oregon, California and Mormon Trails and the settlers in Central and Western Nebraska. The Pawnee Scouts contributions from the first enlistment year of 1864 near the Genoa DOT-OI 60-01 Agency of nearly 100 Pawnee (with an eventual force of up to two hundred Pawnee) until their final "muster out" in 1875 helped in the formation of the great State of Nebraska. The proposed section of highway was a significant byway of the Pawnee Scouts and their families in Nance County

- 2 - Pawnee Reburial Site where over 800 Pawnee have been repatriated along with 6 Pawnee Scouts. This location was part of the Reservation Village and the eastern terminus for the “Pawnee Scouts Memorial Highway”. Dear Highway Commissioners,

The Genoa U.S. Indian School Foundation is proposing a section of Highway 22 from its eastern terminus at the intersection approximately one‐mile south of Genoa with Highway 39, west to its western terminus at the intersection with Highway 14 approximately two miles North of Fullerton, to be named the Pawnee Scouts Memorial Highway. This section of Highway 22 starts at the location of the Pawnee Reservation Village (1857 – 1875) just south of Genoa, extending west past many older Pawnee village sites including the Pawnee Mission site (1843‐ 1846) and ends near the Pawnee sacred site, Atawitakol, just north of Fullerton. This section of highway lies within Nance County, which was the Pawnee Reservation from 1857 to 1875.

The Company of Pawnee Scouts was enlisted in the U.S. Army at the Genoa Reservation Village in 1864. These nearly 100 men and boys were born and raised in this area. Their support aided in the development of the State of Nebraska from 1864 until 1875. The Pawnee Scouts, a unique U.S. Army battalion of about a hundred Pawnees, were scouts and soldiers during the height of the Plains Indian wars and earned the respect of prominent generals in the West, including , Eugene Carr, and Ranald Mackenzie. They were commanded by the famous North brothers Frank and Luther from Columbus. The Pawnee Scouts and the Norths helped protect the construction of the Union Pacific Railroad, scouted for the Connor Expedition in 1865 and along the in 1866, fought the at the Battle of Plum Creek, directed the Carr Expedition that led to the destruction of the Dog Soldier village at Summit Springs, fought in Crook's Campaign against Dull Knife in 1876‐ 77, and assisted with the campaign following Custer's defeat.

The Pawnee Nation have pledged their support to this project in conjunction with the City of Genoa, the Nance Co. Veteran’s Memorial & Resource Center and the unanimous support of the Nance County Commissioners. We ask that the committee give our proposal the highest consideration in naming this section of highway, the "Pawnee Scouts Memorial Highway".

ATTACHMENT "A" VX2005 Request of NDOT for Advice of the Highway Commission and Consent of the Governor for Highway Segment Relinquishment – Highway N-85 to City of Papillion Resolution No. 2020-4

The Nebraska Department of Transportation (“NDOT”) has authority to relinquish a fragment, section or route on the State Highway System after obtaining the advice of the State Highway Commission and the consent of the Governor (Neb. Rev. Stat. § 39-1313); The State Highway System fragment, section or route to be relinquished is described as: The portion of N-85 located within the City of Papillion from N-370 to the south (Highway Reference Post 0.00) to Giles Road at the northern end (Reference Post 2.51) (the “relinquished segment”) The location of the relinquished segment is shown on the attached map; The City of Papillion (the “Local Road Authority”) is the political or governmental subdivision accepting relinquishment of the relinquished segment; NDOT has discussed the proposed relinquishment with the Local Road Authority and those discussions have resulted in a relinquishment agreement, which NDOT believes meets all the statutory conditions and requirements for relinquishment of the relinquished segment under Neb. Rev. Stat. §§ 39-1314 and 39- 1315; The Local Road Authority understands its rights under State law concerning the relinquishment and has expressly waived: a. The right to a public hearing before the State Highway Commission (Neb. Rev. Stat. §§ 39- 1313 and 39-1110(1)(f), b. The right to a detailed State Highway Commission inspection of the proposed relinquished segment and separate consideration of all applicable considerations as to whether the segment should be relinquished (Neb. Rev. Stat. § 39-1110(1)(f).) (A Highway Commissioner has completed a field inspection of the proposed relinquishment.); c. The rights expressly waived in the relinquishment agreement between NDOT and the Local Road Authority;

NDOT HEREBY REQUESTS THE NEBRASKA STATE HIGHWAY COMMISSION provide its advice to the Governor of Nebraska in support of NDOT’s request for the relinquishment of the relinquished segment described above. NOW THEREFORE, BE IT RESOLVED in accordance with Neb. Rev. Stat. §§ 39-1313 thru 39-1315 and 39- 1110(1)(f), the Nebraska State Highway Commission hereby advises and recommends the following to the Governor of the State of Nebraska: 1. Approval of NDOT’s request to relinquish to the Local Road Authority the relinquished segment identified above; Moved and adopted by the Nebraska State Highway Commission this 11th day of December 2020.
