GOVERNING BOARD MEETING MINUTES – June 5, 2019
A. Meeting Opening Call to Order Ms. Hodge called the meeting to order at 5:46 PM.
Roll Call Board Members present: Berdetta Hodge (President), Brian Garcia (Vice President, left the meeting from 8:37 to 8:40 PM), Andres Barraza, Michelle Helm (left the meeting from 8:30 to 8:32 PM), and Sandy Lowe (left the meeting from 7:03 to 7:05 PM). Absent: None.
Adoption of the Agenda On motion of Ms. Hodge, seconded by Mrs. Lowe and passed 5-0 (Ms. Hodge: aye; Mr. Garcia: aye; Mr. Barraza: aye; Mrs. Helm: aye; Mrs. Lowe: aye), the Governing Board amended and adopted the meeting agenda with L-5, the letter of support for Nikola Motor Company’s request for property tax re-classification within Foreign Trade Zone, as the first action item.
B. Executive Session The Board did not meet in Executive Session.
C. Study Session Study Session was held from 5:47 to 7:02 PM. C-1—Budget Advisory Committee Recommendation Mrs. Meulemans presented Budget Advisory Committee 2019 – 2020 Recommendations. Mrs. Meulemans, Dr. Mendivil and Dr. Keller answered the Governing Board’s questions. Members thanked Mrs. Meulemans and the Budget Advisory Committee for their work.
C-2—Property Tax Re-Classification Christine Mackay, City of Phoenix Community and Economic Development Director, presented information on Nikola Motor’s property tax re-classification request for the property at 4141 E. Broadway Road, Phoenix, which is located within Foreign Trade Zone 75. She answered Governing Board members’ questions. Dr. Mendivil thanked Ms. Mackay, Mr. Camacho, Mr. Stringer, and Mr. Worthen for attending the Study Session. Board members thanked Ms. Mackay for providing more information.
D. Reconvene Welcome—Ms. Hodge welcomed everyone at 7:02 PM. She recognized Kyrene Board members Mrs. Fahy and Mr. Walsh and State Senator Bowie in the audience.
Pledge of Allegiance/Moment of Silence—Mrs. Helm led the Pledge of Allegiance. Ms. Hodge asked the audience for a moment of silence and to observe the passing of Mr. Garcia’s father and former teacher Marianne Mitchell.
E. Presentations/Recognition E-1—Circle K Fueling Our Schools Julie Thrush and Mitchell Miranda with Circle K said the organization was happy to be able to partner with Tempe Union and give back to the community through its Fueling Our Schools program. Dr. Mendivil thanked Circle K and led the audience in a round of applause.
Governing Board Meeting Page 1 of 27 June 5, 2019 E-2—Mountain Pointe Research Study ASU Professor Emeritus Charles Corbin presented the results of Project Active Teen, his twenty-year longitudinal study on high school physical education. He thanked the Board for allowing the study and asked that it continue to support the program. He asked for permission to release the name of the school now that the study is published.
F. Report from Superintendent F-1—Corona del Sol DECA DECA sponsor Robin Palmer said Charlotte McCabe, Tessa Perez, and Kaitlyn Johnson raised money through a community service project called “Steps for Solders.” The money went to the USO and will allow service members to make phone calls home. This project placed them in the top 10% at the DECA International Competition. Ms. Palmer thanked the Board for allowing Luca D’Ortenzio to travel to the competition where he participated in leadership training.
F-2—Staff Recognition – New School Administrators Dr. Mendivil introduced the school administrators who will be assuming new positions starting in school year 2019-20. Dr. Glenn said she and Mr. Lebowitz appreciate the opportunity to be co-principals at Tempe High School. Mr. Griffith said that as the Marcos Assistant Principal for Academics he will give his best to students. Ms. Ruiz is looking forward to serving as Marcos Assistant Principal for Athletics. Ms. Brandau said she is excited to be the next Assistant Principal for Activities at Corona; she thanked Mr. Kleve for the opportunity. Mr. Frana is looking forward to serving the Mountain Pointe community as the next Assistant Principal for Athletics; he thanked his wife for her support. Mr. Banach said he appreciates the opportunity to be the next Assistant Principal for Activities at Mountain Pointe; he thanked his wife for her support. The new administrators thanked the Board for the opportunity to serve in their new roles.

H. Communications H-1—Governing Board Members Mrs. Lowe wished staff and students a wonderful summer. Mr. Barraza said new fact sheets are available now; he thanked the teachers, staff and Executive Team. Mrs. Helm thanked everyone for a wonderful year and hopes they have a great summer; she looks forward to seeing everyone in the fall. Mr. Garcia thanked staff for all that they do; he thanked the individuals and organizations in Consent Agenda item I-6 for their support of the district’s students and programs. Ms. Hodge said Marianne Mitchell taught at Tempe and Mountain Pointe High Schools; she expressed the Board’s condolences to the Garcia family.

L. Business Services L-5—Approval of Letter of Support for Nikola Motor Company’s Request for Property Tax Re-Classification within Foreign Trade Zone (FTZ) 75
The following individual provided public comment: Rachel Clawson, Marcos de Niza, said the pie for education funding in Arizona is too small; in her meetings with state legislators they have told her there is no money to give to education; said if we continue to re-classify taxes then the size of the pie will not get bigger; she hopes Tempe Union can try to do better by its students.
Mrs. Lowe moved that the Governing Board approve the letter of support for property tax re-classification for designated Foreign Trade Zone 75 within Maricopa County. The motion was seconded by Mrs. Helm. Discussion followed.
Governing Board Meeting Page 2 of 27 June 5, 2019 Mrs. Lowe said there will be an economic impact in bringing jobs and increased salaries to the state; she understands the concerns people have but is confident this won’t have a significant impact to our budget. Mr. Garcia said he doesn’t see this as not impacting the budget; he looks at how the $35,000 or $70,000 could impact social/emotional wellness or expanding AVID; struggling students don’t always have the support they need and this impacts them. Mrs. Helm said she supports this because of Nikola’s commitment to provide opportunities for students. Mr. Barraza said he looks at this as an investment in our community; he is basing his vote on trust in Nikola’s commitment to investing in our students and trust in administration’s recommendation.
Ms. Hodge called for the vote. The motion passed 4-0 (Ms. Hodge: aye; Mr. Barraza: aye; Mrs. Helm: aye; Mrs. Lowe: aye; Mr. Garcia: abstained).

K. Board Policies The Governing Board agreed to vote on Board Policies Items K-1 through K-3 in one motion. Mr. Garcia moved approval of Board Policies items K-1, K-2, and K-3. L. Business Services L-1—2019 – 2020 Budget Recommendation The following individuals provided public comment: Lisa Merrin, Tempe Union lead psychologist, said the calendar day reduction for psychologists on the salary schedule doesn’t mean they will be working less than those in other districts; to attract and retain psychologists the district should offer a higher salary; recommends expanding the role of the psychologists beyond testing and placing special education students. Scott Madine, Tempe High teacher, said the Committee’s recommendation for teachers won’t make up for the increase he has to pay to the state retirement system; last year’s budget override was to be used exclusively for teacher salary increases and not stipends; if the budget is approved as recommended, he doesn’t know “if it would mean the TUHSD Board of funding priorities for teacher salaries.”
Mrs. Lowe moved that the Governing Board approve the Superintendent’s budget recommendations for the 2019-2020 school year. The motion was seconded by Mrs. Helm. Discussion followed.
In response to Board members’ questions Dr. Mendivil said that TSEA and CTEC have representation on the Budget Advisory Committee, and these representatives present the Committee’s work and final recommendations to their association members. Step movement is a priority of TSEA, and his recommendation includes step movement for all eligible teachers. The longevity stipend goes to staff who have been here for at least ten years. By law we must have an adopted budget in place by July 15. Funds are then encumbered for the items that are approved by the Governing Board. Apart from adjustments made because of current year funding, we are limited in making other changes to an approved budget.

L-4—Cooperative Contract for Employee Staffing Services On motion of Mrs. Lowe, seconded by Mr. Barraza and passed 5-0 (Ms. Hodge: aye; Mr. Garcia: aye; Mr. Barraza: aye; Mrs. Helm: aye; Mrs. Lowe: aye), the Governing Board approved the use of 1Government Procurement Alliance (1GPA) contract no. 17-14PV-02 for employee staffing services for return-to-work and substitute staffing with Educational Services, Inc. (ESI).

L-5—Approval of Letter of Support for Nikola Motor Company’s Request for Property Tax Re-Classification within Foreign Trade Zone (FTZ) 75 The Governing Board amended the agenda order and took action on this item at the beginning of its business meeting.
M. New Business M-1—Superintendent’s Fourth Quarter Goal – FY 2018 – 2019 Dr. Mendivil presented Superintendent’s Goal #4. Mr. Barraza asked that cultural context be included in suicide prevention training. Mrs. Helm said she hopes we have a way to also reach out to staff members.
On motion of Mr. Garcia, seconded by Mr. Barraza and passed 5-0 (Ms. Hodge: aye; Mr. Garcia: aye; Mr. Barraza: aye; Mrs. Helm: aye; Mrs. Lowe: aye), the Governing Board accepted that the Superintendent has successfully met his fourth quarter goal for FY 2018-2019 and approved fully executing the terms as set forth in paragraph 3.4 of, and the addendum to, the Superintendent’s contract.
