She eventually pleaded guilty. Simpson said he exchanged 14,000 text messages in a four-month period with his intern because Vargas was tasked with going through a large amount of text messages in an unrelated case. At his March 2015 hear- ing, tenure commission examiners said Simpson did not get the messages from the case until after Vargas’ arrest. CASE DELAYED Although the JTC originally made its recom- mendation in August 2015, the case was remanded back to the commission in December after Simpson and his attorney filed a motion arguing that email evidence beneficial to his case was not presented in the March proceedings. In turn, the JTC remand- ed back to the judge who oversaw the original proceedings, Ingham County Judge Peter Houk. He determined the evi- dence — emails between Pittsfield Township police, Washtenaw County District Court Judge Kirk Tabbey and Pittsfield Township attorney Victor Lillich — would not have changed his opinion of the case. He also found JTC staff attorney Margaret N. Rynier’s reason for the nondisclosure at the original hearing — that she overlooked the email attachment — was credible and found claims by Mogill — that the nondisclosure was racially motivated — were unsubstantiated. Although the JTC has recommended Simpson be removed from the bench, the Michigan Supreme Court has the power ACCREDITED to remove a judge.
