Notification

No. 2467-PL Dated, the 15.06.2017 : In exercise of the power conferred by Section 2 of the Police Act, 1861 (5 of 1861), read with Section 2 of the Bengal Police Act, 1869 (Ben. Act VII of 1869), the Governor is pleased hereby to constitute two police districts namely Police District and Hooghly (Rural) Police District by dividing the existing Hooghly Police District having respective territorial jurisdictions as mentioned in the Schedule below for the purposes of the Police Act, 1861:-

The Schedule

2. This Notification shall take effect on and from the date of publication of this Notification in the official Gazette.

Notification

No. 2468-PL Dated, Kolkata the 15/06/2017 : WHEREAS the State Government have constituted Chandannagar Police District comprising the territorial areas and boundaries falling within 07 (Seven) Police Stations as fully described in the Schedule to the notification issued under this Department being No. 2467-PL Dated 15/06/2017 (hereinafter to be referred as the “Said Schedule”).

AND WHEREAS the said areas and boundaries of the said police stations in the district of Hooghly, as fully described in the said schedule, being a town area, consist of a population of 14, 37, 321 (As per census of 2011), which exceeds of one million;

NOW, THEREFORE, in exercise of the power conferred by sub-section (1) of section 8 of the Code of Criminal Procedure, 1973 (2 of 1974), the Governor is pleased hereby to declare that on and from the date of this Notification, the areas described in the said Schedule to be a metropolitan area for the purposes of the said Code.

2. This Notification shall take effect on and from the date of publication of this Notification in the official Gazette.

No. 2469-PL dated, Kolkata the 15/06/2017 : WHEREAS the State Government have constituted Chandannagar Police District consisting of the areas and boundaries fully described in the schedule of this department Notification No. 2467-PL dated 15/06/2017, for better regulation of the police within the limit so constituted;

AND WHEREAS the State Government have also declared the said areas and boundaries to be a metropolitan area for the purposes of sub-section (1) of section 8 of the Code of Criminal Procedure, 1973 (2 of 1974) vide this department Notification No. 2468-PL dated 15/06/2017;

AND WHEREAS it is felt expedient to establish such a police system in the said metropolitan area thus declared, which by an unitary chain of command, functional specialization and legal authority coupled with accountability is capable of responding to the complex problems of public order, crime and internal security in a more comprehensive way; f¢ÕQjh‰ Blr¡ A¢dL¡l, ih¡e£ ihe, B¢mf¤l, LmL¡a¡ - 27

West Bengal Police Gezette 04 th August 2017 3 AND WHEREAS in consonance with the said objective and purpose, it is felt further expedient to vest the administration of police in the said metropolitan area of Hooghly in an officer to be styled the Commissioner of Police, Chandannagar, a designated officer with the powers and authorities throughout the said metropolitan area of Hooghly under the Police Act 1861;

NOW, THEREFORE, in exercise of the power conferred by section 2 of the Police Act, 1861 (5 of 1861), the Governor is pleased hereby to re-designate the office of Superintendent of Police, Chandannagar District, as office of the Commissioner of Police, Chandannagar for the said area and to vest in the said Commissioner of Police, Chandannagar, the powers and authorities under the Police Act, 1861 or under any other Act, under the General control and supervision of the Director General and Inspector General of Police, West Bengal.

2. This Notification shall take effect on and from the date of publication of this Notification in the official Gazette.

No. 2070-PL dated, Kolkata the 15/06/2017 : WHEREAS the State Government have constituted Chandannagar Police District as fully described in this department Notification No. 2467-PL dated 15/06/2017, and declared the said areas as metropolitan area for the purposes of the Code of Criminal Procedure, 1973 (2 of 1974), vide this department Notification No. 2468-PL dated 15/06/2017;

AND WHEREAS the State Government have vested the administration of Police throughout the said metropolitan area on an officer designated as Commissioner of Police, Chandannagar for the area, vide this department Notification No. 2469-PL dated 15/06/2017;

AND WHEREAS it is felt expedient to confer on Commissioner of Police, Chandannagar, the powers of an Executive Magistrate in relation to that metropolitan area for the purposes of the Code of Criminal Procedure, 1973 (2 of 1974) (hereinafter to be referred as the Code);

Now, THEREFORE, in exercise of the power conferred by sub-section (5) of section 20 of the Code, in this behalf in relation to that area, the Governor is pleased hereby to confer on the said Commissioner of Police, Chandannagar, the powers of an Executive Magistrate in relation to that metropolitan area.

2. This Notification shall take effect on and from the date of publication of this Notification in the official Gazette.

No. 2471-PL dated, Kolkata the 15/06/2017 : In exercise of the power conferred by paragraph (3) of section 2 of the Sarais Act, 1867, (22 of 1867), the Governor is pleased hereby to confer on the Commissioner of Police, Chandannagar, the power to exercise all the functions of Magistrate of the District in respect of the Chandannagar Metropolitan area declared as such vide this Department Notification No. 2470-PL dated 15/06/2017.

2. This Notification shall take effect on and from the date of publication of this Notification in the official Gazette.

No. 2472-PL dated, Kolkata the 15/06/2017 in exercise of the power conferred by sub-section (1) of Section 144 of the Code of Criminal Procedure, 1973 (2 of 1974), the Governor is pleased hereby to specially empower the Commissioner of Police, Chandannagar, to exercise the power under Sub-section (1) of Section 144 of the said Code for the purpose of the said Code.

2. This Notification shall take effect on and from the date of publication of this Notification in the official Gazette.

Sub : Exclusion of the area of Kolkata Leather Complex Police Station in the district of South 24-Parganas from the jurisdiction of West Bengal Police and inclusion to the jurisdiction of – Regarding handing over of immovable properties. Sir,

Kolkata Leather Complex Police Station in the district of South has been excluded from the Jurisdiction of West Bengal Police and included to the jurisdiction of Kolkata Police vide this department’s Notification No. 958-PL dated 10/03/2017. Also order in respect of handing over of assets including all the vehicles, wireless equipment, furniture etc. in possession of Kolkata Leather Complex Police Station and its allied units for use of Kolkata Police has been issued vide this department’s Order No. 978-PL dated 10/03/2017.

Regarding handing over of the immovable assets including the buildings to Kolkata Police, the following particulars may kindly be furnished:

(i) Whether there is any proposal on behalf of West Bengal Police for handing over of immovable assets to Kolkata Police for their use and whether the Commissioner of Police, Kolkata wants such handing over.

(ii) Whether such handing over, if necessary, will be permanent in nature and if so whether Kolkata Police will have to bear the cost of owning such transferred assets.

(iii) If the handing over is required at all, whether it will be with effect from the date of actual handing over of the immovable assets in question.

The information in respect of the above mentioned points may kindly be furnished at the earliest.
