Clerk : Members-elect, you are welcome to Bauchi State House of Assembly; before I proceed I would like to call on a Member-elect Abdulkadir Mohammed Wahu to give us opening prayers.

Clerk : Members-elect, my name is Bala Abdullahi, Clerk, Bauchi State House of Assembly, let me start by congratulating you all for your victory at the polls, as Members of the highest Law making body in the State. Present to witness your inauguration is His Excellency, the Executive Governor of Bauchi State, Mallam (Dr) Isa Yuguda, the Deputy Governor of Bauchi State, Alhaji Sagir Aminu Saleh, and of course dignitaries too numerous to mention by names. By virtue of Section 105 of the Constitution of the Federal Republic of Nigeria 1999 as amended, the powers conferred on His Excellency, the Governor to issue a proclamation to be read by the Clerk to the House, signalling the commencement of inauguration of the State House of Assembly. The Governor has accordingly issued the proclamation for records, and I wish to read the said proclamation.

MALAM (DR) ISA YUGUDA GOVERNOR BAUCHI STATE

WHERE AS, it is provided in Sub-Section(3) of Section 105 of the Constitution of the Federal Republic of Nigeria 1999 that the person elected as Governor shall have powers to issue a proclamation for the holding of the First Session of the State Assembly immediately after his being Sworn-in.

NOW THEREFORE I, MALAM (DR) ISA YUGUDA Governor, Bauchi State in exercise of the powers conferred upon me by Sub-Section (3) of Section 105 aforesaid, and all other powers enabling me in that behalf, hereby proclaim that the first Session of the Bauchi State House of Assembly shall hold at 10:00 a.m. on Wednesday 13 th June, 2007 in the House of Assembly, Bauchi.

Presentation of INEC Certificate of Return and Asset Declaration Form from Code of Conduct Bureau .

Clerk : Having done that, Section 94(i) of the Constitution provided that a roll call of all the Members should be made and each member should come to the Clerk-at-

- 3 - table and present his/her certificate of return from INEC and evidence of Declaration of Assets from Code of Conduct Bureau, that must be complied with, that is Certificate of Return from INEC and Acknowledgement receipt from Code of Conduct Bureau, and Assets Declaration. We are lucky we have got the list from the Bureau. The purpose is to fulfil the Constitutional requirement. I will call your names one after the other, you will then come out and bring your certificates and publicly place them on the table. We shall cross-check them to confirm to us whether or not you were

actually elected. There are two Officers assigned to do this job.

ELECTION OF MR. SPEAKER

Clerk : Members-elect, every Member is a potential Speaker amongst his colleagues and this shall be done today and now, since there must be a leader to govern any Community. The Speaker is elected by Hon. Members. Now, before nomination, I want to state that I, Bala Abdullahi – Permanent Secretary/Clerk to the House and the Returning Officer for Mr. Speaker and Deputy Speaker, will start with the election of Mr. Speaker. Now, Members-elect, I will now call for nomination. I recognised Member-elect, Abdulkadir Umar Dewu to make his nomination. Abdulkadir Umar Dewu (Kirfi): Mr. Clerk, Members-elect, it is an honour for me to stand before this Hon. House this morning, today to nominate a Speaker that will preside over the affairs of this Hon. House. I nominate Yahaya Mohammed Miya – Member-elect from Ganjuwa West. It is indeed a great privilege and honour to me to stand before you to present the citation of an indefatigable Gentleman in person of Alhaji Yahaya Mohammed Miya – Member-elect in the State Assembly of Bauchi State. He is a gentleman, he has made tremendous stride in the development of the State. He is hardworking, possessed unalloyed commitment and loyalty to his responsibility. Let me read the biography of my nominee. Citation of Alhaji Yahaya Muhammad Miya, Member-Elect Bauchi State House of Assembly Representing Ganjuwa West Constituency . It is indeed a great privilege and honour to me to stand before you

- 4 - to present the citation of an indefatigable Gentleman in person of Alhaji Yahaya Mohammed Miya – Member elect in the Bauchi State Assembly representing Ganjuwa West Constituency. Unarguably, this brilliant, meticulous and hard working gentleman who is right now standing before us in very sound health and high spirit has made a lot of tremendous sacrifices towards the developments of this State and the nation in general. An advocate of good policies, who always accord respect, support and loyalty to this government as rightly deserves. He always works hand in hand with the government with a view to enhance its effectiveness by his positive attitudes and unalloyed commitments to his responsibilities without undue compromise. In fact I am so delighted with every sense of patriotism to give thanks to Almighty Allah for all His mercies to this great Country particularly for decreeing Hon. Yahaya Mohammed Miya to be a Member of the State House of Assembly at this trying period. I believe it is formulated principally with determination in mind and with appropriate objectives of achieving success within our framework. An experience administrator and financial manager of excellent reputation whom we always find his courtesy and assistance very encouraging and of remarkable importance. He made as much mark in the development of our democracy and practice as he made in the area of administration and financial management in the public service. Yahaya Mohammed Miya is a timeout resource material to this regime on account of his hard work, loyalty and support to this administration coupled with encouragement put into place for the PDP in the State. It is our conviction that an excellent performance in the public Sector is possible with the right spirit and right team. Mr. Clerk Sir, permit me to narrate the citation of Yahaya Mohammed Miya Member-elect Ganjuwa West Constituency in Bauchi State House of Assembly – (1) Alhaji Yahaya Mohamed Miya was born in Miya Village of Ganjuwa Local Government Area of Bauchi State on the 2 nd September, 1959. Both of his parents are of Muslim backgrounds. (2) He attended Central Primary School Miya from 1969-1975. (3) He attended Staff Training Centre Azare for his Post Primary Education from 1982-1983 where he obtains Confidential Secretary IV Certificate. - 5 -

(4) Thereafter he attended Federal Polytechnic Bauchi from 1985 1988 where he obtains His Assistant Executive Officer (Accounts) and Audit and OND in Accountancy. (5) From there he moves to Polytechnic in 1989-1991 where he obtains HND Accountancy. (6) He also attended University of Jos from 1993-1994 where he obtains Advance National Diploma in Public Administration. (7) Yahaya Mohammed Miya also attended Abubakar Tafawa- Balewa University Bauchi from 1996-1997 where he obtains Post Graduate Diploma in (Finance). (8) also he attended Bayero University Kano in 2000-2001 where he obtains Masters-Degree in Public Policy and Administration.

Yahaya Mohammed Miya has been making contributions to his community since he was young. At primary school level he held the post of - a Class Monitor from his primary I-VI from 1969-1974. - He also became the Head-Boy of Miya Primary School in 1975. - At Arabic Teachers College Gombe he held the position of Assistant Head-boy in 1982. - At Staff Training Centre Azare, he held the position of the Centre’s Secretary in 1983. - At the Federal Polytechnic Bauchi, he held the post of a Class representative. Moreover in his position as public servant he held many post at the State and Local Government levels such as the - Branch Secretary/Chairman NULGE - State Chairman NULGE, and - State Treasurer Nigeria Labour Congress, - Member Local Government Service Commission, - Member Local Government Pension Board, - National Vice Chairman NULGE and - 6 -

- Zonal Public Secretary PDP North East Zone. Apart from responsibilities he held since he was young and at school and other ad-hoc responsibilities aforementioned, Yahaya Mohammed Miya also confronted so many arduous responsibilities in his capacity as a worker; with both the Local and the State Governments respectively. He was one time a - Class Teacher in 1982. - A Clerical Officer Accounts 1983-1985, - Executive Officer Accounts 1987-1988, - Higher Executive Officer Accounts 1988-1991, - Local Government Education Authority Treasurer 1991-1994. - Head of Finance and supply 1995-1998, - Executive Chairman (Ganjuwa LGA) 1999-2002. - Special Assistant (Budget & Planning) 2002-2004, - Executive Chairman (Ganjuwa LGA) 2004-2006.

Clerk to the House Sir, Memers-elect, mention must be made specifically to you, that Yahaya Mohammed Miya, out of my own conviction and on account of his sheer determination and numerous services he rendered in Nation building coupled with his magnanimity in the areas of human development based on his experience at different levels of governance, someone whom we can trust, deserves to be the Speaker Bauchi State House of Assembly. It is based on the foregoing that I passionately wish to make this appeal. By and large I wish to say sound leadership shall be the basis of success for every dynamic and meaningful assembly devoid of rancor and disintegration. Thank you, may God bless Bauchi, may God bless Nigeria. . U.S.A. Certificate Obtained: Diploma Electrical Technologist, Diploma Electronic Communication, Diploma Television Technicians in 1977 – 1980, Certificate of achievement from Department of State Agency of international Development U.S.A. 1979. Working experience: Ministry of Work/Transport 1977-1980, Bauchi Radio Corporation 1980-2000. Assistant Director Technical Services – Retired 2000 and Joined Comfax Nigerian Limited, Apapa Lagos as Senior Engineer 2000-2006. I beg to move.

SPEAKER’S ADDRESS

Mr. Speaker : Hon. Members, it is with gratitude to Almighty Allah (SWT) that I welcome you all, to this most important and significant aspect of our democratic process:- the inauguration of yet another session of the elected Members of the Bauchi State House of Assembly. The strategic importance of the legislature as another Arm of the Government cannot be underestimated. Let me use this opportunity to express my deepest and sincere gratitude to the people of Bauchi State, especially the electorates who thought it most-wise to elect us into this exalted Chamber, under various political platforms. Indeed, we are most grateful and thankful to each and every citizen of Bauchi State for this honour. I would like to convey our appreciation to Mr. President Dr. Good-luck Jonathan GCFR and the Independent National Electoral Commission (INEC) for creating a level playing field which led to the successful organisation of a free and fair election in April, 2011. That singular effort was a clear testimony of the sincerity and good intention of the government in the peaceful handing over of power from Democratically Elected Civilian to Civilian Administration in the Country. This effort is therefore, worthy of commendation. It is absolutely necessary to commend the Bauchi State Government for its untiring efforts which ensured the prevalence of peace and security for the smooth conduct of elections throughout the State. Although, some misguided elements did try to sub-vert the noble intention of the government by causing some distractions which resulted to loss of lives and property, the State Government must be commended for the prompt and timely measures taken to contain the violence. Fellow Honourable Colleagues, our assignment is very clear and unambiguous. We are solely charged with the responsibility of making laws for the good of our State. Our primary function as law makers is therefore, to enact laws to guide the functions of the Executive Arm. It is in this direction that I call on us to work as a team by remaining focused and stead fast in the discharge of our responsibilities to live up to the expectations of the electorate. We need to concen- trate on the enactment of laws that are progressive, responsive and dynamic to ensure the accelerated transformation of our State. My Honourable Colleagues, the time for bench-warming and absenteeism in this Chamber is gone forever. We must strife to be proactive and issues oriented in our approach to governance. We need not wait until executive bills are presented to us before we make laws. We must initiate laws that would bring development closer to the grassroots in the State. We must understand that we have serious challenges necessitating hard work and team work to make our State the envy of other States. My dear colleagues, if - 10 - at the end of our tenure in 2015, we succeed in laying a good foundation for a peaceful, purposeful and stable government which permits the growth and development of the State anchored on mutual co-operation, tolerance, and understanding, then all of us here shall have cause to be proud of this day. My fellow colleagues, we should realize that our role as a legislature is probably the most significant in our efforts to give Bauchi State a place of pride in its historical processes. We must therefore, not forget that we have a historic mission and must conduct ourselves in the must honourable manner. We must act and guide ourselves as law makers in accordance with acceptable norms and code of behaviours expected of us. We should therefore, understand and abide by the limits of our authority, and not abuse our powers. We should always remember that call to duty requires us to be responsive, responsible, productive, proactive, upright and committed to offer our best to the people of Bauchi State. Your Excellency, distinguished ladies and gentlemen, as legislators, we need to commit ourselves to a decision making process that will always be guided by the principles of engagement, consensus and consultation. Our commitment to democracy requires that we adhere to its basic tenets so that we would remove the mistrust usually associated with leadership by the electorates. Let me use this opportunity to commend the position taken by His Excellency (Dr) Mal. Isa Yuguda the Executive Governor of Bauchi State, to run an open door policy in the exercise of his functions a governor. It is heart-warming that our governor intends to operate principally within the parameters set by the law and tenets of democracy. I want to emphasize that the executive arm of government and legislature have already established a good understanding and are very much ready to work hand-in-hand for the progress of Bauchi State. At this junction it is pertinent to state that our doors are open to advice and necessary guidance. We shall remain loyal to our royal fathers and always accord them the respect expected from us. We therefore, appeal to them to consider us as their son land daughters and give us the necessary fatherly advice and guidance in the discharge of our responsibilities. I want to inform all religious, and community leaders and other stakeholders, that our doors are open and we shall remain ears to the ground always to receive their advice in the execution of our functions. Once again, it is my ardent hope that our deliberations will enrich our faith and rekindle our hope in the future of this State. I congratulate each and every one of us, and pray that we shall discharge our duty faithfully without fear or favour and in the public interest. I want to assure you that on my part, I would as much as possible provide a good leadership that will give Bauchi State a good name and goodwill amongst the States Houses of Assembly in Nigeria. I also want to express my appreciation to my colleagues, for

- 11 - the confidence they have in chosen me as the Speaker. It is indeed, a truism that we are all equals and I don’t lay claim to any better qualification than anyone of you. However, destiny plays a key role in my election to lead this Honourable House. I therefore, promise to carry each and every one of you along, together we shall give our best to our Constituencies. I seek for your cooperation and understanding in the discharge of this onerous task. I would like to end by calling on all the staff of this Honourable House to give us their best in our efforts to give ours to the State. I also want to appeal to both the Security Agencies, the Media and the General Public to accord us their maximum support and cooperation in the discharge of our mandate. We shall accommodate all in the journey to a greater Bauchi State. Finally, while appreciating all those who are chanced to witness this ceremony, I pray to Almighty Allah to grant you journey mercies back to your destinations, may He grants us the Wisdom, courage, good health and the ability to serve the State better? Thank you and God bless. Members-elect, with the powers conferred on me, we will go straight to the Swearing-in of other Members-elect. Those who are to swear should move to the right hand side, while those who want to affirm should please move to the left hand side.

Members, I stand before you to allow me move a motion to present my Motion to adopt Hausa as a second Language in the Chamber during Proceedings. Mr. Speaker : Yes any Seconder? Hon. Abdulkadir Muktar (Udubo): Mr. Speaker Sir, Hon. Members, I stand to second the motion moved by our Colleague to adopt Hausa as a Second Language to be used in the Chamber.

Hon. Abdulkadir Mohammed Wahu (Sade): Mr. Speaker Sir, My Colleagues Hon. Members, the Motion, a call on the Bauchi State House of Assembly to adopt Hausa as a second Language in conducting its Business. You are aware that the functions of the legislators are enormous, among which include making laws and addressing other problems face by the citizens. It is therefore important that Legis- lators convey their activities to their electorates in a language they understand most hence the use of a popular and widely spoken language which in the case of Bauchi State, it is Hausa. As provided by section 97 of the 1999 Constitution “the business of the State House of Assembly shall be conducted in English, but the House may in addition to English conduct the business of the House in one or more other languages spoken in the State as the House may by resolution approve” Same is also provided in our Standing Orders. Prayers: In line with what has been mentioned, I urge the Honourable House to resolve and adopt Hausa to be the second language in conducting the business of the Hon. House. Mr. Speaker Sir, Hon. Members I beg to move. Mr. Speaker : Hon. Members, Hon. Abdulkadir M. Wahu have just read his motion before the Hon. House and the floor is now open for contribution. Yes any contribution? Hon. Mohammed Dan’abba Shehu (Katagum): Mr. Speaker Sir, Hon. Members, this is a welcome development. Already there is a provision in the Nigeria Constitution of 1999, that apart from English Language, any House of Assembly can adopt the Language that is widely acceptable in the State. More importantly, 97% of both the State Legislature and the indigenes of the State speak Hausa Language. Therefore, without any hesitation, I stand to move a motion that the motion be adopted since it is backed by Constitution.

PREAMBLE:- Honourable Members, as you are aware that by virtue of Section 103 of the constitution of the Federal Republic of Nigeria 1999 as amended and Order 15 of the Standing Orders of the Bauchi State House of Assembly 2011, this Honourable House at its sitting No.001 of Tuesday 14 th June, 2011 approved the composition of the Selection Committee whose functions include:- (a) Nominating Members to serve on any Ad-hoc Committee to consider any Special matter brought to Honourable House. (b) Nominating such members as may be going on Parliamentary delegation and (c) Selection of members of Special and Standing Committees

2. The Honourable House also mandated the Selection Committee to make recommendations for the establishment of Special and Standing Committees for the consideration of the Honourable House. This is based on the realization that activities in the legislature are better regulated and managed by means of Committees for effective participation of all the Honourable members with a view to achieving results.

APPOINTMENT OF TWENTY (20) SPECIAL ADVISERS

Pursuant to the provisions of Section 196 of the Constitution of the Federal Republic of Nigeria, I have been directed to intimate the Honourable House of His Excellency, the Executive Governor’s desire to appoint twenty (20) Special Advisers to assist him in the discharge of his functions. Consequently, the State House of Assembly is kindly being requested to pass a resolution supporting the request for the twenty (20) Special Advisers. Mr. Speaker : I recognised Hon. Abdulkadir Wahu. Hon. Abdulkadir Mohammed Wahu (Sade): Mr. Speaker Sir, Hon. Members, I rise to bring an urgent issue that needs the urgent attention of this Hon. House and the Executive Arm of Government. It is the issue of the heavy down-pour which we had yesterday. This heavy down- pour did a lot of havoc in my Constituency, where the only bridge that linked the two Comunities together that is Alija and Papa was broken down. As a result of this, they can no longer live as one entity. Everything has come to a stand still. It is in view of that, I am now calling on the Hon. House and the Executive Arm of Government, as a matter of urgency to intervene inorder to alleviate the suffering of those Communities. I beg to submit. Mr. Speaker : You have heard it, all. He needs the urgent intervention of the House and the Government for a lasting solution . any contribution? Yes, Hon. Dan’abba. Hon. Mohammed Dan’abba Shehu (Katagum): Mr. Speaker Sir, Hon. Members, I rise to commend the mover ;for his concern to his electorates. I am in support ;and it needs urgent attention because we are now in a rainy season. I am therefore, suggesting that the House Works Committee should go and investigate and bring the report to the House for our urgent attention. I think that is more appropriate, using our Committees on ground. Mr. Speaker : Is it the wish of the Hon. House as suggested for Works ;Committee (Interruption) Yes, Hon. Dayyabu? Hon. Dayyabu Chiroma (Darazo): Mr. Speaker Sir, Hon. Members, These people require urgent attention, by referring it to works Committee, it will amount to waste of time. I am therefore, suggesting that the mover should go to the Agency

- 3 - and investigate, bring report and we act on it immediately. Anything short of that, the Communities will continue to suffer. Hon. Iliyasu Ibrahim Zwall (Lere/Bula): Mr. Speaker Sir, Hon. Members, while I agree with the last Speaker Hon. Dayyabu, I am of the opinion that the matter should also be referred to SEMA after the resolution of the House so that it will carry more weight rather than leaving the mover to go and investigate himself. Hon. Bakoji Aliyu Bobo (Chiroma): Mr. Speaker Sir, Hon. Members, This is a serious matter, that can happen anywhere and this motion needs urgent attention (interruption). Hon. Mohammed Dan’abba Shehu (Katagum): Mr. Speaker Sir, Hon. Members, my reason for suggesting Works Committee of the House is that anything that has to do with Roads, they are the most appropriate Committee to go and investigate while SEMA has to do with the issue of Relief Materials and so on. Hon. Idi Shehu Tiyin (Warji): Mr. Speaker Sir, Hon. Members, I rise to read my motion as follows:- Motion, a call to the Government to undertake a Medical Research on liver-diseases in Warji Local Government area. Humans have always had to deal with diseases. Diseases have had a dramatic impact on human history for most of thousands of years that, humans have been on the earth, disease has played a central role in limiting population growth. As ways to combat disease were discovered, people lived longer and had more children, who lived enough to have children of their own. Mr. Speaker Sir, Hon. Members, in Warji local Government Area, Liver disease has been identified as the leading cause of Mortality. In view of this development and considering the democratic regime we are in, where the Government is put in place by the people and for the people, I found it necessary to bring the issue to the Hon. House soliciting for the blessing of my Colleagues , Hon. Members to resolve as follows that: The State Government should undertake a medical Research as to what cause liver disease in the entire Warji Local Government Area with a view to providing fact sheets for necessary medical interventions. Mr. Speaker Sir, Hon. Members, I beg to move. Mr. Speaker : Hon. Members, you have heard him. Health is wealth. Liver disease has been identified as the leading cause of Majority of death in his Constituency. So our attention and approval is needed in finding a lasting solution. Any contribution? Yes Hon. Baba Abubakar. Hon. Baba Abubakar Suleiman (Azare/Madangala): Mr. Speaker Sir, Hon. Members, In view of what our Colleague has brought is a matter that needs our urgent attention because it has to do with life. This disease has been bedevilling his constituency and more lives are being lost. It is a killer disease. So there is the need for the Government to look into the remote causes with a view to preventing future occurrence. - 5 -

Hon. Danlami A. Kawule (Zungur/Galambi): Mr. Speaker Sir, Hon. Members, this issue of the disease of the Liver is a serious one as mentioned by my Colleagues. It is something like the Kidney issue which I appeal to all of us to support the motion with utmost urgency it deserves. Hon. Rifkatu Samson Danna (Bogoro): Mr. Speaker Sir. Hon. Members, I really appreciate the mover for his effort for it comes at the right time. This really shows that he has his people at heart. The issue of Liver disease is serious in nature which needs urgent attention. I am therefore of the opinion that the motion be referred to Heath Committee for proper investigation which I believe will tremendously help in finding a lasting solution. Hon. Garba Babale Hardawa (Hardawa): Mr. Speaker Sir, Hon. Members, This is an issue that should be looked into with all seriousness as people one dying. I am in support of the motion in toto. I will also wish to suggest that, the investigation should go beyond Warji in order to stop the spread of the diseases to other neighbouring Local Government Areas. If it is mortality or morbidity, it should be buttressed clearly because people are dying. We do not know which is now which? Hon. Abdullahi Muktar (Udubo): Mr. Speaker Sir, Hon. Members, I am in total support of the motion. I am in support that Health Committee should go and make further investigation for a lasting solution and bring same to the House for our consideration. Hon. Abdulkadir Umar Dewu (Kirfi): Mr. Speaker Sir, Hon. Members, Notice of Motion. Motion for the Amendment of Standing Orders of the Bauchi State House of Assembly for the purpose of re-organizing the hierarchy of the House Leadership. Background. This motion is brought pursuant of Order 17 Rule 4 of the Standing Orders of this Hon. House which provides for the procedure of amending our Rules whenever the need arises. Mr. Speaker Sir, I wish to observe that from the inauguration of the current Assembly, it became glaring that there was a need to re-organize the hierarchy of the Hon. House and also of reposition the mind-set of the Hon. Members for better service delivery to their Constituencies and the State at large. Those needs are buttressed by the desire to have strong regulatory processes that will help in managing the business of the Assembly. GROUND UPON WHICH THE MOTION IS PREMISED. Mr. Speaker Sir, there exist an undeniable need to evolved certain strategies in order to create a more dynamic and purposeful Legislature that will be based on a strong regulatory environment which will be more capable of tackling administrative and protocol challenges. PRAYERS: Mr. Speaker Sir, I submit with all respect, from the foregoing that two(2) new Offices should be created and fixed in to the hierarchy no existing with only (6) six offices. I humbly submit that the offices of: (a) Deputy Majority Leader; (b) Deputy Majority Whip. Be create. Mr. Speaker Sir, I further submit that the Standing Orders of the Hon. House be amended to reflect the new offices so created. The proposed amendment shall be incorporated by adding new Rules (6) and (7) immediately after Order 9, Rule 5(2) as follows:- 6 (1) “The Deputy Majority Leader shall be a Member nominated from among the members in the Majority Party in the House.

(2) His functions shall be:

(a) Assisting the Majority Leader of the House in performance of his functions; (b) Deputising for the Majority Leader of the House in his absence; (c) Any other functions as may be assigned to him”.

7 (1) ”The Deputy Majority Whip of the House shall be a Member nominated from among

the Members in the Majority Party in the House. (3) His functions shall be, (a) assisting the Majority Whip of the House in the performance of his functions;

Deputising for the Majority Whip of the House in his absence; Any other function as may be assigned to him.” CONCLUSION: Mr. Speaker Sir, Hon. Members, in these days when the Majority of our citizens are waking up to their civic rights and responsibilities and have also acclimatized to the State of democracy, it becomes compulsory for us, the Members representing them, to adopt to the challenges. The proposed amendment is lone such ways of tackling the challenges. I invited the Hon. Members to give these proposed amendments the Vote that will indicate that this current Assembly means business when it comes to moving the State forward. I beg to submit. Mr. Speaker : Yes any contribution? Hon. Dayyabu Chiroma (Darazo): Mr. Speaker Sir, Hon. Members, It is our unanimous agreement that the Standing Rules is the guiding Principle/ procedure of this our noble House while the constitution is Supreme. The Speaker is the highest ranking Officer in the House. The Deputy Speaker presides while his Seat is vacant or on Special Assignment. In the absence of the two we have Speaker Pro-tempore. (Interruption) Mr. Speaker : Please contribute on the matter at stake. We are talking on the motion to amend the Standing Orders. Hon. Dayyabu Chiroma (Darazo): Mr. Speaker Sir, Hon. Members, in essence what I am suggesting is we should maintain the position of the 6 Leaders already on ground. I am not in support of creating another office because it will be a burden to the Government Financially or otherwise. We should avoid duplication of functions. Hon. Iliyasu Ibrahim Zwall (Lere/Bula): Mr. Speaker Sir, Hon. Members, I disagree with the last Speaker because there is nothing like a burden on the Government rather than a step forward for durable democracy to prevail. Our Standing Orders is not against the constitution. In as much as we are not going against the constitution we have the powers to amend the Standing Orders as regards to our day-to-day proceedings of the House, The office of the Majority Leader is very important because it serves as a bridge between the Legislators and - 8 -

MATTERS OF URGENT PUBLIC IMPORTANCE

Hon. Idi Shehu Tiyin (Warji): Mr Speaker, Hon. Members, I rise before you this morning, under this very important item to bring an issue bedevilling the Fulani Cattle-Rearers in the State particularly those in the northern parts of the State. Hon. Members, Fulani cattle rearers are faced with serious water shortage problems particularly those residing in the northern parts of the State. As a result of this problem they had to travel far down to Southern parts of the State and even beyond searching for water and other greener pasture. Secondly, there is also the Problems of lack of gracing reserved and cattle routes for the Fulanis in the northern parts of the State which results always to having problem with farmers during the rainy seasons. It is in view of the afore-mentioned problems that I am appealing to this hon. House to intervene with a view to bringing a lasting solution to the problems faced by our Fulani brothers. Dep. Speaker : Hon. Members, you all heard what the Hon. Member, representing Warji has just said; any contribution? Yes Hon. Dan’abba? Hon. Mohammed Dan’abba Shehu (Katagum): Mr Speaker, Hon. Members, I stand before you to make my contribution with regards to what my colleagues has just said. I also want to express my sympathy on how the Fulani found themselves in the State particularly those in the Northern part. However, in my opinion, I am suggesting that let this matter be referred to the Ministry of Agriculture by mandating the Committee to go and find out with a view to reporting back to the Hon. House on the way out. Hon. Abdulmumini Hassan Ningi (Ningi): Mr Speaker, Hon. Members, if you can recall previously the State Government had awarded contract for the construction of Earth dams in the State purposely for the Fulanis. However, unfortunately most of these earth Dams were not constructed by the contractors as such, I am suggesting that let these contractors be called upon and find out from them why such Dams were not constructed after having collected the money for - 4 - doing the jobs. Secondly, on this second issue, I am suggesting that the Committee on Agriculture be mandated to tackle the issue as well as the Water Resources Committee. I also second the motion that these two Committees should handle the issues. Dep. Speaker : Hon. Members, I will throw the question.

MATTERS OF URGENT PUBLIC IMPORTANCE

Hon. Dayyabu Chiroma (Darazo): Mr. Speaker Sir, Hon. Members, I stand to call on the attention of this Hon. House on a Law we made in this Hon. House for the establishment of Area Development Officers whose tenure had expired and this Hon. House resolved to dissolve them sometimes last year. It happens that alot of this Area Development Officers are still operating and collecting salaries which is a contravention of the Law. I therefore wish to draw the attention of the Hon. House that we should once again intervene so that the provisions of that Law is respected. Thank you. Mr. Speaker : Hon. Members you have all heard what the Hon. Member representing Darazo has just said. Any further contribution on this? Hon. Mohammed Dan’abba Shehu (Katagum): Mr. Speaker Sir, Hon. Members, I think this matter can best be handled by a Committee and the relevant Committee to handle this issue is the Cabinet Services Committee. Abdulkadir Umar Dewu (Kirfi): Mr. Speaker Sir, Hon. Members, I read:- REPORT BY THE HOUSE COMMITTEE ON APPROPRIATION BUDGET AND PLANNING ON A REQUEST FOR SUPPLEMENTARY ESTIMATE SUBMITTED TO THE HON. HOUSE ON 4 TH AUGUST, 2011. INTRODUCTION Mr. Speaker Sir, Hon. Members, You may recall that , this Hon. House has received a request for Supplementary estimates from the State Government on Tuesday, 4 th August, 2011. The request for the Supplementary estimates is aimed at augmenting the subheads in line with the Medium Term Expenditure Framework. The estimates is also aimed at meeting the anticipated additional resources inflow in the 2011 fiscal year and the need to utilize the funds for the betterment of the people of Bauchi State. Consequently, after the Supplementary estimates have passed the 1 st and 2 nd reading, it was referred to the Committee on Appropriation for scrutiny, and report. METHODOLOGY Mr. Speaker Sir, Hon. Members, in an effort to arrive at conclusion, the Committee critically examined the estimates according to code classifications and purpose. - 4 -

- 4 - - 4 - However, the Committee found it necessary to exercise Section 129 of the 1999 Constitution of they Federal Republic of Nigeria as amended by further inviting the Special Adviser on Finance, Budget and Treasury Matters along with the Permanent Secretary Budget and Planning to clarify some areas which led to the proper articulation of the estimates. THE 2011 SUPPLEMENTARY ESTIMATE Mr. Speaker Sir, Hon. Members, the 2011 Supplementary Estimates was necessitated in view of the urgent need by Government to provide and improve the socio-economic development of the entire citizenry and to meet the macro- economic development objectives of the present administration towards the total rehabilitation and reconstruction of our economic and social sectors for an improved social development. It is pertinent to State here that, some laudable projects which include the Construction of a befitting International Airport and a Standard Specialist Hospital are in-cooperated into the Supplementary bill. |The estimate was also necessitated in view of the current increase in our Capital receipts and budget augmentation from the Federation Account Allocation Committee. The Supplementary estimates comprises of total expenditure of Nineteen Billion Eight Hundred and Seventy Three Million, Seven Hundred and fifty six Thousand, Nine Hundred and Twenty Four Naira (N19,873.756,924) made up of recurrent expenditure of Six Billion, Eight Hundred and Sixty Three Million, Seven Hundred and Sixty Thousand Three Hundred and Thirty Four Naira (N6,863,760,334) which represent 14.16% and Capital Expenditure of Thirteen Billion, Nine Million, Nine Hundred and Ninety Six Thousand, Five Hundred and Ninety Naira (N13,009,996,590) which also represent 20% of the total Capital Budget. This relates to budget stability with the current market realities, and the desire to uplift the standard of living of the society. OBSERVATIONS AND RECOMMENDATION In consideration of the Government fiscal measure aimed at societal reorientation and development and also its determination to complete ongoing projects along with the viable new projects, the Committee observed as follows:

(a) The amount of money approved for Alkaleri-Futuk road in the 2011 approved budget was wrongly quoted. The actual amount approved was N500,000,000 not N900,000,000.

(b) The amount of money approved for the improvement of Government House and the subhead number were also wrongly quoted. The actual Sub-head is 03000017240000000112 not 03000017224028 and the approved money is N100,000,000 in the 2011 budget. - 5 - - 5 - (c) Also the Committee has observed that the following Ministries, Department and Agencies did not indicate their classification codes and details of expenditures: i) Agency for Persons with disability ii) Ministry of Finance iii) State Development Board iv) Ministry of Science and Technology

(b) The total expenditure submitted is N19,873,756,924 not N19,863,756,924 as quoted in the supplementary estimates.

RECOMMENDATIONS Mr. Speaker Sir, Hon. Members, the Committee recommends as follows:-

(a) The recurrent revenue and capital receipt of twenty three billion naira (N23,000,000,000) to fund the supplementary budget. (b) The Committee also recommends a recurrent expenditure of N6,863,760,334. And a Capital expenditure of N13,099,996,590 (c) The Committee also recommends N3,136,243,076 to fund code 1200017121957 as contained in the supplementary budget, to be implemented in accordance with the appropriation law. Mr. Speaker Sir, Hon. Members, I beg to submit. Mr. Speaker : Hon. Members you have heard the report of the Committee as presented by the Chairman any observation or comment? Yes Comrade Iliyasu. Hon. Iliyasu Ibrahim Zwall (Lere/Bula): Mr. Speaker Sir, Hon. Members, In fact I am very much impressed with what the Committee has done so far. However, I want to make some very critical observations in view of some mistakes I have observed from the submissions made by the Executive arm. These are very vital omissions and in future it should be avoided, care must be taken to ensure that all figures are corrected before bringing them to the Hon. House. Thank you. Commissioners in the Public Service of Bauchi State. The Selection Committee was mandated to make all the necessary arrangements to ensure that the nominees appear before the Hon. House today and our proceedings during the screening should be aired to the general public directly. He was appointed National Facilitator NSPFS and SSC as well as Financial Controller/Programme Leader (PCU) from June, 2005 – 31 st December, 2006. He became Bauchi State Accountant-General on 1 st January, 2007 – 30 th June, 2011. He has attended Workshop/Seminars on Professional Development that are numerous to mention, Number two Barrs. Mustapha Hassan Born in 1960 at Kafin-Madaki in Ganjuwa Local Government Area, He obtained his Teachers’ Grade II Certificate, in 1981 from ATC Gombe, LLB (Hons) Certificate in 1987 from Bayero University Kano and Barrister at Law Certificate in 1989 from Nigerian Law School Lagos. This renowned Layer and Private Practitioner served in many capacities among which includes being a Member in the 1996 Local Government Election Petition with H.A.T. Adegbite as Chairman. He also served as Secretary, Committee to investigate Disharmony at College of Education Azare between the Management and the Academic staff the Committee was chaired by the Late Zannan Katagum He is currently serving in the Tax Force for the implementation of Sharia Law in Bauchi State as a Member. He is also the artist and resource person for the Bauchi Radio Corporation Enlightenment Programme in Human and Citizen Rights generally and in Courts since 1994 till date. He served as Hon. Commissioner for Justice with the Bauchi State Government from 2010-2011, and Number three th Hajiya Talatu Barwa She was born on 26 August in 1962 and hails from Itas in Itas/Gadau Local Government Area. She attended Nasarawa East Primary School, Azare from 1967-1973, Katagum Government Secondary School Azare from 1973-1978, Bauchi College of arts and Science (BACAS) from 1978-1984, Ahmadu Bello University, Zaria 1986-1987 and Usman Dan’fodio University, 2005-date. Hajiya Talatu obtained the following Certificates West African Examination Certificate, B. Sc. Business Management with second class honours upper division, Masters in Business Administration and awaiting PhD in Management from Usman Dan’fodio University, Sokoto. I have also contributed in the formulation of policies and programmes of the state which have gone a long way in the Socio- economic developments of the state. This is just in a nut-shell Mr. Speaker Sir, Hon. Members. Mr.Speaker : I recognise Hon. Dan’abba. Hon. Mohammed Dan’abba Shehu (Katagum): Alh. Bappah, what can you say about the misunderstanding between the Board of Internal Revenue and some Commercial Banks in the State? Alh. Bappah Azare (Nominee): The bone of contention there is the issue of revenue for the State Government that are supposed to be paid by the Banks. There was a misunderstanding but hopefully, things are beginning to take shape. Of - 11 - course the issue has not been fully resolved but discussions are on-going and by the grace of God, a solution would soon be reached. Mr. Speaker : Yes Minority Leader. Hon. Baba Abubakar Suleiman (Azare/Madangala): Alh. Bappah, it is an acknowledged fact that you are a Season Civil Servant and a technocrat of the highest Order. One day it was in the treasury, precisely in the Accountant General’s office, I overheard some people making remarks that you have made tremendous reforms in the Accountant General’s office. Now, how do you intend to impact positively on the people of Bauchi State? Alh. Bappah Azare (Nominee): By the Special grace of God when I finally become part of the highest decision making body of the State; Which is the state Executive Council; I will use my wealth of experience to impact positively on the generality of the people of the state. Nobody can be an Island. We will continue to collaborate and corroborate in order to achieve maximum benefits for the state. Hon. Abdulmumini Hassan Ningi (Ningi): If by the Special grace of God you become a Commissioner and you happen to be assigned to the Ministry of Finance as an Hon. Commissioner, how do you intend to overcome the issue of delayed payments even after obtaining executive approvals? Alh. Bappah Azare (Nominee): Mr. Speaker Sir, Hon. Members, you need to understand that what is basically causing delays in payment is lack of liquidity to off-set the approvals given. What is left to the State Government after all the mandatory deductions is too small to take care of all the approvals given. So that is basically the issue. Hon. Abdullahi Mohammed Wahu (Sade): How do you intend to improve internally generated revenue? Alh. Bappah Azare (Nominee): Mr. Speaker Sir, Hon. Members, we will do our best because it is not going to be an individual effort but a collective one. There were certain measures we wanted to take to improve our internally generated revenue drive but because of the electioneering campaigns there was no way we could take them. But now that the elections are over, we will begin with sensitization before introducing whatever measures we intend to take. Mr. Speaker : Hon. Members, I am quite aware and In-sha- Allah immediately I am returned to the Ministry, I will advise the Government appropriately Hon. Yusuf C. Nuhu (Lame): There are so many people in Police custody awaiting trial sometimes stay far longer than the period they would have served had they been convicted. What are you going to say about that? Barr. Al-mustapha (Nominee): Mr. Speaker Sir, Hon. Members, it may interest you to note that I rather joined the State Executive Council rather late. However, we are doing our best in that regard and I can assure you that In-sha-Allah if I am returned to that Ministry as an Hon. Commissioner, I will do my best to minimize these types of case.

He attended Day Primary Schools Azare and Community Secondary School Azare from 1972-1974 and Katagum Government Secondary School from 1974-1976 where he obtained a General Certificate of Education. Alhaji Tasi’u obtained a Diploma in Business Management from ATBU in the year 2000. Alhaji Tasi’u was Managing Director B.M.G. (Nig). Ltd. Azare. A construction Company of repute that handled the construction of Women Teachers’ College Azare from 1976-1983 and Federal Government College Azare 1983-1990 under his supervision. He was a Member of Bauchi State Chamber of Commerce, Industry, Mines and Agriculture (BACCIMA) from 1980-2001. He was a member (BACCIMA) Delegation to India and Italy. Alhaji Tasi’u was elected Chairman Katagum Local Government from 1999-2003. He also served as Hon. Commissioner Ministry of Water Resources from 2002-2003. He also served as Hon. Commissioner Ministry of Information and Agriculture from 2010-2011. Alhaji Tasi’u was awarded with a certificate of Honour by the Nigerian Union of Teachers, and three Abubakar Ubale Ibrahim : He was born in 1962 and hails from Darazo Local Government Area. He attended GSS Bauchi, Kaduna Polytechnic and ATBU Bauchi where he obtained WAEC in 12980, OND in Business Administration 1988, Higher National Diploma in Business Administration in 1992, post graduate Diploma in Management Studies in 2002 and Master of Business Administration (MBA) 2003. Among the places he worked were Ministry of Health, Bauchi from 1980-1988, Establishment and Service Matters Bureau 1988-19994. Bauchi State Investment and Property Development Company Ltd. 1994-2006. While at the Investment and Property Development Company limited Abubakar Ubale started work as Senior Manager Admin. And Finance and rose to the rank of acting Managing Director before he left in 2006. He later joined Legacy Pension Managers Ltd in 2006 as Zonal Business Manager in charge of Bauchi, Yobe and Gombe States and left voluntarily in 2009. Mr. Speaker : Hon. Members, I have the following announcement to make. That the Security and Finance Committees to met after adjournment. The next item is matter of urgent public importance and I recognise Hon. Dayyabu Chiroma from Darazo Constituency.

MATTERS OF URGENT PUBLIC IMPORTANCE

Hon. Dayyabu Chiroma (Darazo): Mr. Speaker Sir, My Colleagues Hon. Members, I stand before you under this very Important item to draw the attention of this House based on the recent publication and approval made by His Excellency, the Governor of Bauchi State, in relation to political appointments. Mr. Speaker Sir, My Colleagues Hon. Members, with the little knowledge I have of the 1999 Constitution as amended, were highlighted vividly the kind of nomenclesure the Governor should appoint as his Personal Assistances. But to my surprise, yesterday I heard that Directors General now in Bauchi State form part of Political appointment. Therefore Mr. Speaker Sir, My Colleagues Hon. Members, I move a motion that should these people would be paid money under the Consolidated revenue funds of the State, the Hon. House should form a Committee to look at the Constitutionality of Political appointments that will be tag as Directors General. Mr. Speaker : Hon. Members, Dayyabu Chiroma have just moved a motion regarding the recent appointments of Political Office holders to the State made by His Excellency. Any contribution? Yes Minority Leader. Hon. Baba Abubakar Suleiman : (Azare): Mr. Speaker Sir, My Colleagues Hon. Members, I stand to second the motion. However, even though the House doesn’t have the power to make appointments but it has to power to regulate it. As earlier mentioned these political office holders would be paid from the Consolidated revenue of the State, there is need. Therefore, there is need for the House to look it critically and see the financial implication. Mr. Speaker : Hon. Members a motion has been moved to refer the case to a Committee. However, I don’t know whether we are going to refer it to a certain Committee or are we going to form the Committee right now? Hon. Iliyasu Ibrahim Zwall (Lere/Bula): Mr. Speaker Sir, Hon. Members, since the matter is in relation to making appointments, I think the Cabinet Committee can handle the matter adequately. Therefore, I am moving a motion in that respect. Mr. Speaker : Hon. Members, any contrary opinion? Hon. Saleh Abubakar Dumba (Dass): Mr. Speaker Sir, Hon. Members, this is a special issue therefore I am suggesting that a special Committee be formed by this Hon. House to handle the matter. Mr. Speaker : Hon. Members, we have a divergent opinion on this matter because a motion has been moved by Hon. Iliyasu Ibrahim Zwall that the matter be referred to Cabinet Committee while Hon. Saleh Abubakar Dumba moved a motion that the matter be referred to Special Committee. Members, mine is just a little observation. I am suggesting that the Chairmen of the Committee should come from the Cabinet Committee of the Hon. House. Hon. Abdullahi Muktar (Udubo): Mr. Speaker Sir, Hon. Members, I stand to make a little contribution on what Hon. Rifkatu have just say. Hon. Sale Mohammed (Jama’atre): Report of the Works and Tranport Committee of Bauchi State House of Assembly on the Collapse Bridege along Lanzai-Papa-Dukkuyel Road, Mr. Speaker Sir, Hon. Members, - PREAMBLE - The Hon. House would recall that at its plenary session on Wednesday, 3 rd August, 2011 a motion was brought under matters of urgent public importance sponsored by the Hon. Member representing Sade constituency concerning the collapse of a bridge along Lanzai-Papa-Dukkuyel road in Darazo Local Government Area of the State. The matter was extensively deliberated upon by the Hon. House after which, it was referred to the Works and Transport Committee with a clear mandate to undertake a fact finding tour of the road in question and report back to the Hon. House with appropriate recommendations on how best to address the situation. The Committee embarked on the assignment on Friday, 5 th August, 2011 by travelling the whole length of the road from Lanzai-Papa up to the site of the collapse bridge some few kilometers after Papa town. FINDINGS : It may interest the Hon. House to know that this 47km road was awarded since the time of Late Alh. Abubakar Tatari Ali of blessed memory. If not for the coup of 1984, the road would have been long completed. However, it was disheartening to note that in spite of the huge amount of money already committed into this road, previous administrations in the state did not find it expedient to complete this road for reasons beyond the comprehension of ordinary minds. This is because:- (a) All the earth works, on this road i.e. topsoil removal and filling has been completed as at that time but because of years of neglect and abandonment, erosion has taken the better part of the road. (b) All culverts and bridges along this road had all been completed and they are in a very good condition up to the present moment because of the quality of the workmanship. (c) All that is required on this road now is filling with laterite in places where it has been eroded, general surface dressing and the asphalted concrete overlay. (d) There is a four-cell culvert immediately after Papa town that is seriously being threatened by erosion. A lot of communal effort is being put by the communities around to salvage it but it appeared there is a limit to what they can do. (e) The bridge at Jan- ruwa linking the people of Northern part of Sade Constituency with their counterparts of the southern part has been completely washed away and submerged in water leaving no trace of it at all thereby cutting off the people of this Constituency and greatly jeopardizing trade and commercial activities.

MISAU-HARDAWA-BULKACHUWA ROAD : - The committee took time on the same day, to visit the above mention-ed road because of the numerous complaints it has received regarding the condition of this road and therefore decided to go and see things for itself with a view to making appropriate recommendation to the Hon. House for appropriate action.

FINDING/OBSERVATIONS :- (a) This 32 Kilometer road was constructed about 30 years ago and throughout this period of time, it has not received any serious rehabilitation as a result of which, numerous pot holes have appeared on the road obstructing traffic and constituting death traps. (b) The bridges between Misau and Hardawa and other numerous culverts along this road are seriously being being threatened by erosion and unless something is urgently done to save the situation, this particular bridge and most of the culverts may be washed away as a result of the volume of water gushing out whenever a heavy downpour is experienced.

RECOMMENDATIONS :

(a) The executive arm of government should be called upon to complete the Lanzai-Papa-Dukkuyel road in view of the huge resources already committed into it and the benefit the people of this area will derive when it is completed. (b) As an interim measure, an alternative route be provided for the people of Aliya and environs to get across to their kith and kin in Papa, Sade and environs as a result of the collapse bridge which has dismembered them. (c) The Misau-Hardawa-Bulkachuwa road should be rehabilitated because it is threatened by erosion and the importance of the road to the socio-economic development of the people of this area cannot be overemphasized. The road has linked 3 Local Government areas in the State (Misau, Katagum and Gamawa Local Government Areas). (d) Cases of abandoned projects of the Late Tatari Ali era abound in the state. It is therefore recommended that Hon. Members should be called upon to identify such projects in their various constituencies with a view to including them in the 2012 budget and the Hon. House on its part to direct the executive arm to complete them.

CONCLUSION :

The Committee would like to seize this opportunity to thank the Hon. House most profoundly for giving it the opportunity to serve in this capacity and hope that the recommendations proffered would be looked into and accepted. Mr. Speaker Sir, Hon. Members, I beg to submit. Mr. Speaker : Hon. Members, the Chairman Works Committee have just need his report to your hearing any contribution or observation? Hon. Iliyasu Ibrahim Zwall (Lere/Bula): Mr. Speaker Sir, Hon. Members, I will have love the Chairman to brief us on the situation of the people within that locality. Because it appears to me from what he says live is very much unbearable to the people there and most likely there may be some adverse effect on the people within the environment. This is because NUMED has issued a great warning that there will a heavy rain on some parts of the State which may result to flooding. Hon. Garba Babale (Hardawa): Mr. Speaker Sir, Hon. Members, the Work done by the Works Committee have really highlighted that we have problems in some of our roads. However, I want to comment particularly on Misau Hardawa road which was ear marked in this years budget 2011. So what I want to say has is that I want to draw the attention of the House to also draw the attention of the Executive Arm to hasten up to rehabilitate the road. Mr. Speaker : Any other contribution? Hon. Mohammed Dan’abba Shehu (Katagum): Mr. Speaker Sir, Hon. Members, I stand to appreciate for the job wel done by the House Committee on Work. Hon. Members, without wasting much of our time, going by the presentation of the Report the Committee is requiring the quick intervention of the House to write to the Executive Arm to intervene. Therefore I am in support of the Report as well as to write to the Executive Arm to intervene so that this abandon project will be looked into. Hon. Baba A. Suleiman (Azare): Mr. Speaker Sir, Hon. Members, I stand to comment the report so far presented by the Works Committee of this Hon. House. However, in my opinion these road should not be consider as abandon projects. This is simply because these are road that started to be constructed since the first Civilian Administration and has not been completed. Therefore these road should be revisited all over again in order to alleviate the suffering of the communities there. Finally, I am suggesting that the House to draw the attention of the Executive Arm to hasten up to rehabilitate the roads all over. Mr. Speaker : Hon. Members, we have listen various contribution from Hon. Members the report so far presented on the floor of the House. Hon. Members going by the recommendation of the report, the report is drawing the attention of the Arm to intervene with a view to find a lasting solution to the Communities concern. If it is the wish to the House I will now put the question to adopt the report.

Hon. Abdulmumini Hassan Ningi (Ningi): Mr. Speaker Sir, My Colleagues Hon. Members, - Report of the House Committee on Health and Human Services, Bauchi State House of Assembly on suspected outbreak of infectious hepatitis in Warji Local Government Area and other Parts of Bauchi State. Introduction – You may wish to recall that the Hon. House at its plenary session No.037 of 3 rd August, 2011 received a motion from a member of Warji Constituency on a suspected outbreak of infectious Hepatitis in Warji Local Government Area. The Hon. House, after a lengthy debate, resolved and committed the matter to the Health Committee for further investigation and recommendations accordingly. Hepatitis as you may wish to know, is the inflammation of the liver which is commonly caused by A.B.C.D or E viruses Hepatitis which is the early stage of all other liver diseases could also be caused by other non-infectious agents like heavy drinking of alcohol, some specific types of drugs, allergic reactions, hereditary and obesity. METHODOLOGY – The Committee invited all the stakeholders in the Health sector in the State viz Ministry of Health, Primary Health care Development Agency, Hospitals Management Board to mention but a few in order to put heads together and devise a means of investigate and collate data and report back to the Houses for further necessary action. FINDINGS/OBSERVATIONS WARJI LOCAL GOVERNMENT AREA While at Warji the Committee visited the following places for investigations. (a) General Hospital Katanga (b) Local Government Secretariat (c) ECWA Clinic Katanga

(a) At the General Hospital Katanga, the medical officer in charge confessed that he was not aware of any epidemics regarding hepatitis or any other liver diseases and last time he treated liver diseases was more in three month ago.

The Laboratory register contained only sixteen patens, who were Screened of Hepatitis from January-August, 2011 and only six of this number were reative (positive) (see appendix “A”).

A blood sample of three patients was taken from the admitted patients and were screened for Hepatitis using ACON reagent Hbs Ag for whole blood/serum/plasma. Two out of the three were not reative, only one was reactive. However, other forms of Hepatitis virus could not be screened.

(b) While at the Local Government Secretariat, the Committee met with the Director Primary Health Care and the Disease Surveillance Notification Officer (DSNO) who informed the Committee that, using the weekly Health facility reporting system form, the Committee established about 81 cases reported positive in the whole LGA from January to August, 2011. Week 6,7,16,17,18,19,20,23,24 and 28 reported zero cases in the whole LGA, whereas, the highest reported cases was week 2 with 16 cases. (c) At the ECWA Clinic Katanga which is a four room clinic attached to the ECWA Church, a meeting was conducted with the Officer in charge with all other staff of the Clinic. It was established that from January to August, 2011 about 29 people were screened for Hepatitis “B” and only 5 were found to be reactive and the reagent used was ACON (see appendix “B”). OTHER LOCAL GOVERNMENT AREAS - Investigation has shown that Hepatitis is endemic in Bauchi, Bogoro, Dass, Jama’are, Kirfi, Warji and Shira Local Government Areas, and it is virtually absent in all other 14 Local Government Areas.

The Comparative total Prevalence rate of the disease in all the Local Government Areas for 2010 and 2011 suggests a decline. The infection also remains well below epidemic threshold, compared to 2009. (see Appendix “C”)

Mr. Speaker Sir, Hon. Members base on the aforementioned facts, it was established that the disease is not epidemic in Warji and all other parts of the State as presumed by the mover of the motion. RECOMMENDATIONS : - Base on the inputs gathered above the Committee recommends as follows that:

1. Further surveillance activities should be instituted by the Ministry of Health and her agencies in order to trace other chronic hepatitis and other form of liver diseases in State generally. 2. Government should intensify awareness campaign in all the Local Government Areas on how to prevent the spread of the disease, most especially in the Endemic Local Governments. 3. Drugs should be provided in all General Hospitals and Health Care Centers in the State to treat those affected. 4. HBv vaccination should be intensified in all health facilities in the State.

CONCLUSION : - Mr. Speaker Sir, Hon. Members, I would like to express our profound gratitude to the Hon. House for giving us the opportunity to serve in this capacity. I beg to submit. Dayyabu Chiroma (Darazo): Mr. Speaker Sir, My Colleagues Hon. Members, when you look at the report right from day one there is zero complete from the mover of the motion. Based on the recommendation of the report. I am suggesting that the report should lay on a table. Mr. Speaker : Hon. Idi Shehu Tiyin do you want to comment please? Hon. Idi Shehu Tiyin (Warji): Mr. Speaker Sir, Hon. Members, I am the one who brought this issue before the Hon. House. Hon. Members you know very well that the reason of presenting my motion is that my Constituency is a remote areas and I have been receiving report from my electorates regarding the outbreak of the diseases. However, even though the report presented shows that as if there wasn’t any existence of such disease. But it could be possible some of the patient might have even die before the case is reported to the appropriate quarter. Also I want to tell you that there are reported cases of death as a result of liver diseases (H/B) because the Village head of Gabanga and one child from Dagu have die as a result of liver diseases. Hon. Members, it was based on the two reports that I reported the case to the Commissioner of Health where he advises me to table the matter before the House. Hon. Garba Babale (Hardawa): Mr. Speaker Sir, Hon. Members, there is need to look at the issue to surveillance as mentioned in the report. This is because in medical profession we don’t take a rumour lightly more especially when it comes to the issue of outbreak of an epidemic. There are agencies that deal with Health Care related cases in the State. Therefore the report cannot be right out by say to lay on a table because there are some little evidences that the diseases exist as rightly mentioned by the mover of the motion. Hon. Members, there is need for the State Government to form an emergency response Committee before the diseases spread. Mr. Speaker : Hon. Members, going by the report presented there is good professions touches in the report even though I am not a health professional. Therefore I am appealing to you to accept the report recommendation that is we should write to Ministry of Health to form an emergency response out in order to tackle the mater.

Hon. Abdulmumini Hassan Ningi (Ningi): Mr. Speaker Sir, Hon. Members, I rise to present my report:- AN INTERIM REPORT OF THE AD-HOC COMMITTEE ON THE INVESTIGATION OF THE APPOINTMENT OF DIRECTORS-GENERAL MADE BY THE EXECUTIVE ARM OF GOVERNMENT IN THE STATE

O.1 INTRODUCTION

Mr. Speaker Sir, Hon. Members, you will recall that the Hon. House at its sitting of 27 th September 2011, set up a seven-man an-hoc Committee and a Secretary to investigate the propriety or otherwise of the appointment of Directors-General made by the Executive Arm of Government in the State. The Committee was given two days to complete its assignment and submit its report to the Hon. House. The Committee was made up of the following: 1. Hon. Abdulmumini Hassan Ningi - Chairman 2. Hon. Bakoji Aliyu Bobo - Member 3. Hon. Bello I. Mashema - “ 4. Hon. Yusuf C. Nuhu - “ 5. Hon. Dayyabu Chiroma - “ 6. Hon. Abdullahi Muktar - “ 7. Hon. Tukur Ibrahim - “ 8. Barr. Umar Yusuf Gital - Secretary

The term of reference given to the Committee was to investigate the propriety or otherwise of the appointment of 24 Directors-General in State.

1.1 MODEUS OPERANDI

The Committee began its assignment by holding a meeting in which the modalities of conducting the assignment were set-out. It was resolved that the under listed persons be invited to furnish the Committee with reasons that informed the appointment of the said Directors-General: (1) The Chief of Staff (2) The Hon. Attorney-General and Commissioner for Justice, (3) The Head of Civil Service (4) The Chairman, Civil Service Commission.

It is also part of the modalities adopted that the Commissioner of Finance and the Accountant-General for the State, to come and explain to the Committee how the Directors-General so created will be paid.

1.2 OBSERVATIONS :

The Constitution of the Federal Republic of Nigeria 1999 as amended gives the legislative a broad range of powers to investigate anything with respect to which they have power to make laws, including the conduct of any person or authority responsible for executing or administering any laws made by the legislative or for disbursing or administrating moneys approved or to be approved by the Hon. House of Assembly. It is in the exercise or its investigative powers that this Hon. House took a dim view in the attitude of the Executive Arm of Government of appointing Directors-General without due regards to provisions of s the Constitution and the law. Following this, the Committee made the following interim observations:

1. The Office of the Directors-general is an Office without roots. Such person is not from the Civil service therefore grading him will not be in accord with the Civil Service Rules; 2. The Office of the Directors-General so created is at best a politically created office which has no bearing or relevance to the functioning of the Civil Service. 3. Provision has not been made in the appropriation law as required by Section 121 of the 1999 Constitution as amended, for the huge expenditure of accommodating the financial expenses of 24 Directors- General. Furthermore, the constitution provide under Section 120(2), (3) and (4) of the 1999, Constitution as amended, more particularly subsection (4) that; “…..No moneys shall be withdrawn from the consolidated Revenue fund of the State except in the manner prescribed by the House of Assembly”. It is clear that no such Prescription fo9r withdrawal had been made by the Bauchi State House of Assembly. 4. There are issues that have to do with accounting and reporting. The Directors-General apparently have no Schedule of duties. Would they be accounting Officers? Presently, All government Ministries have Permanent Secretaries, Director Admin. And Finance and other Directors. It is believed that functions will be duplicated and therefore will be wasteful and a source of crisis, frictions and would eventually negatively affect the civil service and the political office system. 5. There are issues that concern terminal benefits, discipline, etc. service records, progression etc. 6. Assuming without conceding that they are political office holders, the power to determine the remu7neration package for political, public and judicial office holders lies with the Revenue Mobilization Allocation and Fiscal Commission as provided in Sections 111, 124 and 84 (4) as well as paragraph 32(d) of the third schedule to the 1999 Constitution, of the Federal Republic of Nigeria as amended. It is pursuant to the aforesaid, that various Assemblies passed the Remuneration of public and political office Holders Law, 2007. Unfortunately, office of the Director-General was not mentioned and or contemplated by the Commission, Constitution and the Law. 7. The remuneration of public and political office holders’ law passed by this Honourable House in 2007 is the existing Law on political. Public and judicial office holders. Salaries and remuneration which was made pursuant to the recommendation of Revenue Mobilization Allocation and Fiscal Commission did not recognize and or capture the office of Directors-General. 8. It is further observed that it will amount to an infraction to the provisions of the 1999 Constitution as amended and the Law. Since the Hon. House pursuant to section 120,121 of the 1999 Constitution is the only organ of Government saddled with the powers and control over public funds, the Honourable House did not give any approval that will accommodate the 24 Directors-General. 9. The Committee also observed the incident that happened in 1988 when the Army created the position of the Directors-General in form of a reform, Permanent Secretaries were converted or appointed to the position of Directors-General and the functions of the two offices were not duplicated. 10. On the whole, the Committee observed that, the spirit of the Civil Service will be impacted upon negatively and the creation of the offices amounts to an unnecessary surplus sage.

1.3 RECOMMENDATIONS : 1. That the Hon. House pass a resolution halting any and all processes of incorporating the offices of the Director- Generals in to the State payroll and officially recognizing the offices in relation to the Civil Service or political office system of the State, pending the final determination of the investigation and consideration of the report by the Hon. House. 2. That the following offices: (a) Hon. Commissioner of Finance (b) The State Accountant-General be summoned to furnish the House with details of how the State Government intends to funds the created offices, outside the Appropriation or Supplementary Appropriation Law passed by this Hon. House. (c) The State Attorney-General and Commissioner for Justice Head of Civil Service, Chief of Staff, and (d) Chairman, Civil Service Commission, be summoned to explain the legality and practical functionality of the existence of the offices of the Director-Generals. 3. That considering the investigative nature of this assignment, the Committee prayed and recommends and extension of time not less than 2 weeks to enable it satisfactory complete/conclude its assignment. Finally, the Committee wishes to thank the Hon. House for the opportunity given to members to be of service to the good people of Bauchi State, Mr. Speaker Sir, Hon. Members, I beg to submit. Thank you. Mr. Speaker : You have heard the report. Any contribution? Yes Hon. Abdukadir M. Wahu. Hon. Abdulkadir Mohammed Wahu (Sade): Mr. Speaker Sir, Hon. Members, I wish to commend the Committee for a good work done. There is no much debate on the report because of its clearity. The only observation I would like to make is, it appears as the Government wants to over burden its treasury by mere looking at the number of the proposed Directors-General she wants to appoint. That aside, I move a motion for the adoption of the report. Mr. Speaker: Before then, could someone from Rules and Business Committee move a motion for the suspension of Order 6? Yes Hon. Based on the report before us. My observation is on the recommendation which is agitating for two more weeks to complete its assignment . In view of the time constraint I am suggesting that only one week be given because the Government has started giving them appointment letters. We therefore should not entertain any further delay. Hon. Rifkatu Samson Dunna (Bogoro): Mr. Speaker Sir, Hon. Members, My commendation goes to the Committee for the experience used in bringing to us a very good and well researched report. The last Speaker has spoken my mind, so it will only add that the final report should not exceed one week from today. Hon. Abdulkadir Muktar (Udubo): Mr. Speaker Sir, Hon. Members, I disagree with the opinions of the last 2 Speakers. There is the need to give them more time for proper investigation. Hon. Baba Abubakar Suleiman (Azare): Mr. Speaker Sir, Hon. Members, first of all, I will start by commending the Committee for a job well done. In view of the urgency of the matter, I will suggest that one week be given to the Committee to complete its assignment. Sometime the Executive can be recklessness. Although they have the right to appoint but they should abide by the Law governing every process. Hon. Iliyasu Ibrahim Zwall (Lere/Bula): Mr. Speaker Sir, Hon. Members, I would like to draw our attention to recommendations 1-3 and because of the cumbersome of the nature of the assignment additional two weeks cannot be too much. So even if appointment letters are being given now, It can be declared null and void once the resolution of the House is passed on the matter. I therefore suggest a time from of 2 weeks be given in order to allow there bring an appointments and thorough recommendations to the House. Hon. Rifkatu Samson Danna (Bogoro): Mr. Speaker Sir, Hon. Members, I am of the opinion that the issuance of the appointment letters be stopped pending the resolution of the House on the matter. Several Hon. Members: That has been taken care of by the recommendations. Hon. Abdulkadir Moh’d Wahu (Sade): Mr. Speaker Sir, Hon. Members, My observation is on the timing. I am of the opinion that lone week be given to report back findings to the House. By next week, most Hon. Members will going for their Holy Pilgrimages to Saudi Arabia.

MOTION

Hon. Garba Babale (Hardawa): Mr. Speaker Sir, Hon. Members, the Motion – A call on the State Government to Establish two Campuses of College of Health &Technology in the State - Preamble : Mr. Speaker Sir, Hon. Members, college of Health and Technology is an institution that train middle level health manpower such as Community Health Extension Workers (CHEW) among others, that take care of over 70% of the total population in the Rural Areas in terms of Health needs in the State. Ground of the Motion : - Mr. Speaker Sir, my Hon. Colleagues, as you are all award that presently Bauchi State has only one college of Health Technology which admits and graduates not more than 100 CHEW students annually based on the condition set aside by the National Board for Technical Education in Nigeria and National Board of Community Health practitioners which monitor both training and community health practice in Nigeria However, at the end of training not all of the 100 students sit for the National examination and graduate from the college, because of training procedures and modalities including weeding and internal/mock exams. And looking at the demand of these cadres of health workers in the state where we have more than one thousand one hundred (1,100) health ;facilities ranging from Health posts, Dispensaries, PHC centers and Hospitals, the need to establish two campuses will enable the State acquire more health workers by admitting 200 more CHEW students annually compared to 100 presently by the College. By admitting 300 CHEW students annually, we believe it will create more job opportunity for our teeming unemployed youths as well as reduce poverty which our dear State has been rated high. In addition, our health facilities would be manned by trained health workers compared to what is happening now where only one health worker is managing a health post, dispensary and PHC centers and or in some cases the facilities are there but no health worker. CHEWs are terms as mini doctor’s and they perform some functions of various health professionals by consulting patients like doctors but refer more complicated cases using the community health standing order, they also nurse patients, conduct antenatal and post natal services like nurses and midwives and they also carry out simple laboratory examination for malaria, sugar and pregnancy tests etc. Based on this, we can see that training of more of this health cadre would help the State ;reduce the high incidence of infant, under fives and maternal diseases and deaths in the rural areas as well as reduce the extent of complication of other diseases by conducting simple diagnosis and providing primary care before referral of such cases appropriately to either General, Specialist and or Teaching Hospitals) This is the basis for the alma-mater declaration in 1978 by United Nations which establish primary health care as the corner stone of health care system of all Countries in the world and the major implementers of the system are the community Health Extensions Workers with overall goal of providing preventive, curative and rehabilitative services to the communities. PRAYER:- Mr. Speaker Sir, Hon. Members, I wish the Hon. House to resolve as follows:- a) The State Government to establish two campuses –one each in Bauchi North and Bauchi South Senatorial Zones with College of Health Technology, Ningi providing an overall supervision and coordination. b) That the Ministry of Health should identify the potential LGAs and sites which could be one of the Secondary Schools or any building found appropriate, but with the pledge by the host Lo9cal Government for support while the Community Health department from Ningi College of Health Technology should develop modalities for the take off of the campuses by 2012 including the appointment of a coordinator for each campus. c) That a Memorandum of understanding (MOU) be signed between the college and the twenty LGAs in the state to identify 10 potential students each year for training and to enable them go back to their LGAs after the training to serve their communities since primary health care is the major responsibility of the Local Governments. Mr. Speaker Sir, Hon. Members, I beg to move .

Mr. Speaker : Hon. Members, as you all heard what he read in his motion, do you have any contribution? Hon. Dayyabu Chiroma (Darazo): Mr. Speaker Sir, Hon. Members, it is a very good motion but considering the huge amount of money that this project will consume, it is not an easy task. Already there is a roll before us for the establishment of College of Nursing and Midwifery. I don’t think the Government is in the position or capacity of handling such gigantic projects at the same time. Let this motion lay on the table for now until such a time that the economy of the state improves…..(interruption) Mr. Speaker: Thanks you, Hon. Dayyabu, you have already express your views; that let the motion lay on the table. Hon. Abdulkadir Mohammed Wahu (Sade): Mr. Speaker Sir, Hon. Members, the mover of the motion has done a good job. In the year 2009, I presented the same issue to the House. Almost all the 20 Local Government Areas are in need of Health Care delivery services, considering the value of our electorates in the rural areas. If we take an example of Bauchi State, it is the only state that has one School of Health Technology in the whole Federation. Other States, if not all some of them have three, four and five different Health Institution. How can we take care of our people without enough Health Institutions? Let us adopt the prayers of this motion as presented. Hon. Bello Sarki Jadori (Gamawa): Mr. Speaker Sir, Hon. Members, the motion comes in the right time. Medical /Health Care is one of the essential needs of our people. Take for example, if you go to advanced countries, you will find that every five persons are being taken care of by one Medical Officer. How do we catch them if we remain at the present level. Let us go ahead and adopt the motion. I am therefore moving for its adoption…..(Observation Mr. Speaker) Mr. Speaker : Yes Hon. Rifkatu observe. Hon. Rifkatu Samson Danna (Bogoro): Mr. Speaker Sir, Hon. Members, the last Speaker did not allow us to express our views because he is one of the co-sponsors …(general laughter) Hon. Tukur Ibrahim (Toro/Jama’a): Mr. Speaker Sir, Hon. Members, considering the importance of the motion though Hon. Dayyabu is saying there is no enough funds to carry out the projects but this motion needs our blessing. It is very important we adopt the motion. Hon. Iliyasu Ibrahim Zwall (Lere/Bula): Mr. Speaker Sir, Hon. Members, it is a very good and important motion. These two campuses will contribute a lot to our people. How many do we have, about 50 Doctors working for 4 million people. We need this motion and there is no going back.
