1. PROCEDURE

(1) On 28 June 2013 the Commission adopted the Guidelines on Regional State Aid for 2014-20201 (hereinafter "RAG"). Pursuant to paragraph 178 of the RAG, each Member State should notify to the Commission, following the procedure of Article 108(3) of the Treaty on the Functioning of the European Union ("hereinafter: "TFEU"), a single regional aid map applicable from 1 July 2014 to 31 December 2020. In accordance with paragraph 179 of the RAG, the approved regional aid map is to be published in the Official Journal of the European Union and will constitute an integral part of the RAG.

(2) By letter dated 17 March 2014, registered at the Commission on the same day (2014/030058), the Spanish authorities submitted a proposal for a regional aid map applicable for the period from 1 July 2014 to 31 December 2020. By email dated 15 April 2014, the Spanish authorities submitted additional information regarding the eligibility of some of the areas included in the map.

(3) In their notification, the Spanish authorities propose a list of regions with a total population of 32.25 million inhabitants, or 68.59% of the national population, for eligibility for regional aid on the basis of the derogation provided for in Article 107(3)(a) and (c) of the TFEU for the period from 1 July 2014 to 31 December 2020. The notification lists 'a' areas, pre-defined 'c' areas and non-predefined 'c' areas.

(4) The NUTS 2 regions proposed for eligibility on the basis of the derogation provided for in Article 107(3)(a) TFEU for the whole period from 1 July 2014 to 31 December 2020 are presented in Table 1 below. The table also presents the maximum aid intensities proposed for each region.

(5) In their notification, the Spanish authorities also propose three NUTS 2 regions, which were designated as ‘a’ areas during the period 2011-2013, as predefined areas eligible for regional aid on the basis of the derogation provided for in Article 107(3)(c) TFEU.

Table 2 below presents the list of former a areas proposed as predefined 'c' areas along with the maximum aid intensities proposed for each area.

(6) In their notification, the Spanish authorities also propose two NUTS 3 regions, which are sparsely populated areas, as predefined areas eligible for regional aid on the basis of the derogation provided for in Article 107(3)(c) TFEU. .

(7) Table 3 below presents the list of sparsely populated areas proposed as predefined 'c' areas along with the maximum aid intensities proposed for each area.

(8) In their notification, the Spanish authorities also propose to designate several non- predefined areas as eligible for regional aid on the basis of the derogation provided for in Article 107(3)(c) TFEU for the period from 1 July 2014 to 31 December 2020. The non-predefined 'c' areas are proposed in accordance with the criteria set out in paragraph168 of the RAG. The tables 4 to 6 below present the list of non-predefined

'c' areas proposed along with the maximum aid intensity proposed for each area. The tables also show the total population of each zone proposed2. A more detailed description of the composition of each non-predefined 'c' area is presented in Annex 1.

(9) Table 4 below presents the list of non-predefined ‘c’ areas, along with the maximum aid intensities proposed, for which the Spanish authorities submit that the conditions of criterion 1 of paragraph 168 of the RAG are fulfilled:

(13) The Spanish authorities confirm that the proposed maximum aid intensities presented in the tables 1 to 7 above are those for investments by large enterprises. Those intensities can be increased by 10 percentage points for medium-sized enterprises and by 20 percentage points for small enterprises3. The maximum regional aid ceilings proposed for large enterprises, as well as the increased ceilings for small and for medium-sized enterprises are only applicable to projects with eligible expenditure below € 50 million.

3. ASSESSMENT

(14) In accordance with Annex I of the RAG, two NUTS 2 regions of Spain are eligible for regional aid under the derogation laid down in Article 107(3)(a) TFEU for the whole period from 1 July 2014 to 31 December 2020. In addition, three NUTS 2 regions of Spain, which are former ‘a’ areas, are eligible for regional aid as "predefined areas" under the derogation laid down in Article 107(3)(c) TFEU for the same period. Moreover, two NUTS 3 regions of Spain, which are sparsely populated areas, are eligible for regional aid as predefined areas under the derogation laid down in Article 107(3)(c) TFEU for the same period ). Finally, Annex I of the RAG provides that Spain has the possibility to designate areas containing 33.00% of its national population as non-predefined areas eligible for regional aid under the derogation laid down in Article 107(3)(c) TFEU for the period from 1 July 2014 to 31 December 2020.

3.1 Article 107(3)(a) TFEU areas

(15) The areas proposed by the Spanish authorities for eligibility for regional aid under the derogation in Article 107(3)(a) TFEU for the period from 1 July 2014 to 31 December 2020 are those listed in Annex I of the RAG.

(16) Paragraph 172 of the RAG provides that maximum aid intensities applicable to investment by large enterprises in ‘a’ regions should not exceed: - 35% GGE in NUTS 2 regions with a GDP per capita between or equal to 45% and 60% of the EU-27 average; - 25% GGE in NUTS 2 regions with a GDP per capita above 60% of the EU-27 average.

(17) In accordance with paragraph 173 of the RAG, the maximum aid intensity may be increased by up to 10 percentage points in outermost regions, even if their GDP per capita is above 75 % of the EU-27 average. Article 349 TFEU lists the Canary Islands as one of the outermost regions of the EU.

(18) The aid intensities proposed by the Spanish authorities respect the provisions set out in paragraphs 172 and 173 of the RAG, as can be seen from Table 8 below:

3.2 Predefined Article 107(3)(c) TFEU areas

(19) The predefined areas proposed by the Spanish authorities as eligible for regional aid under the derogation of Article 107(3)(c) TFEU for the period from 1 July 2014 to 31 December 2020 are those listed in Annex I of the RAG.

3.3 Non-predefined Article 107(3)(c) TFEU areas

(20) According to Annex I of the RAG, the Spanish authorities can designate areas with a population of up to 33.00% of the total national population as non-predefined ‘c’ areas. Compliance with the population ceiling established in the RAG will be determined on the basis of the most recent data of total resident population of the areas concerned as published by the national statistical office.

(21) The non-predefined ‘c’ areas proposed by the Spanish authorities have a total population of 15 516 727 inhabitants, which represents 33.00% of the total national population. The population coverage of the proposed non-predefined 'c' areas is in line with the maximum population coverage allocated to Spain for this type of areas in Annex I of the RAG.

(22) The population statistics used are the most recent data (2010 population census) on the total resident population published by the Spanish statistical office. This is in line with the requirement set out in paragraph 170 of the RAG.

(23) The statistics on unemployment used in this section are the average unemployment rates for the period 2010-2012 (i.e. the last three years for which such data are available), as published by the national statistical office. This is in line with the requirement set out in footnote 68 of the RAG.

(24) In cases where non-predefined 'c' areas are proposed that are not defined as whole NUTS 3 regions or islands, paragraph 169 of the RAG provides that the notion of contiguous areas normally refers to whole LAU 2 areas or to a group of whole LAU 2 areas which share an administrative border with another LAU 2 area in the group. In the case of Spain the LAU 2 level corresponds to a municipality.

3.3.1 Non-predefined 'c' areas in application of criterion 1 of paragraph 168 of the RAG

(25) According to paragraph 168 of the RAG, a Member State may designate as non- predefined ‘c’ areas, under criterion 1, contiguous areas of at least 100,000 inhabitants located in NUTS 2 or NUTS 3 regions that have a GDP per capita below or equal to the EU-27 average or an unemployment rate above or equal to 115% of the national average.

(26) Each of the non-predefined ‘c’ areas proposed by the Spanish authorities under criterion 1 satisfies the minimum population size condition, as well as the GDP and/or unemployment condition (see Table 9 below). Moreover, the Commission is satisfied that each 'c' area proposed under criterion 1 consists of contiguous LAU 2 areas as required in paragraph 169 of the RAG.

3.3.2 Non-predefined 'c' areas in application of criterion 3 of paragraph 168 of the RAG

(27) According to paragraph 168 of the RAG, a Member State may designate as ‘c’ areas, under criterion 3, islands that have a GDP per capita below or equal to the EU-27 average. All non-predefined ‘c’ areas set out in Table 10 below fulfil the conditions of criterion 3, since they are islands with a GDP per capita below the EU-27 average.

3.3.3 Non-predefined 'c' areas in application of criterion 4 of paragraph 168 of the RAG

(28) According to paragraph 168 of the RAG, a Member State may designate as ‘c’ areas, under criterion 4, NUTS 3 regions or parts of NUTS 3 regions that form contiguous areas, that are adjacent to an ‘a’ area or share a land border with a country outside the EEA or the EFTA. All non-predefined ‘c’ areas proposed by the Spanish authorities, fulfil the conditions of criterion 4, since they are NUTS 3 regions which share a land border with a non-EEA/EFTA country (Morocco).

3.3.4 Non-predefined 'c' areas in application of criterion 5 of paragraph 168 of RAG

(29) According to paragraph 168 of the RAG, a Member State may designate as ‘c’ areas, under criterion 5, areas of at least 50,000 inhabitants that are undergoing major structural change or are in serious relative decline provided that such areas are not located in whole NUTS 3 regions or other contiguous areas that fulfil the conditions to be designated as 'c' areas under criteria 1 to 4.

(30) Table 11 presents the non-predefined 'c' areas proposed by the Spanish authorities under criterion 5: 7

(31) The Commission considers that the areas proposed fulfil the conditions for eligibility under criterion 5, and this for the following reasons: - The areas proposed are located within NUTS 2 and NUTS 3 regions not fulfilling the conditions to be designated as a 'c' area under Criteria 1 to 4 of paragraph 168 of the RAG, as they have a GDP above the EU-27 average and an unemployment rate below 115% of the national average;

- Spain has used the following socioeconomic indicators to select the areas concerned: per capita income, unemployment rate, and evolution in employment of the workforce. The Commission considers that these indicators are appropriate indicators for measuring relative problems of structural change or decline. Moreover, the data used for these indicators were drawn from official statistics provided by Spain's national statistical office. - The areas proposed in application of criterion 5 scored poorly on the national income/cap indicator. The data provided by the Spanish authorities on the other indicators also show that these areas are scoring well below the national average - Each of the areas proposed has a total population of at least 50,000 inhabitants and consists of contiguous LAU 2 areas as required in paragraph 169 RAG.

3.3.5 Respect of population ceiling for non-predefined Article 107(3)(c)TFEU areas.

(32) Annex I of the RAG sets the population ceiling for non-predefined ‘c’ areas at maximum 33.00% of the total national population. The non-predefined ‘c’ areas proposed by the Spanish authorities have a total resident population of 15 516 727 inhabitants. This amounts to 33.00% of the total resident population of that Member State and respects therefore the population ceiling set in Annex I of the RAG.

3.4 Maximum aid intensities proposed for Article 107(3)(c) areas

(33) Paragraphs 174 to 175 of the RAG provide that the aid intensity applicable to investment by large enterprises in 'c' areas should not exceed the following percentages: - 15% GGE in sparsely populated areas and in NUTS 3 regions or parts of NUTS 3 regions that share a land border with a country outside the EEA or EFTA; - 10% GGE in non-predefined 'c' regions; - in former 'a' regions, 15% GGE in the period from 1 July 2014 to 31 December 2017 and 10% GGE in the period from 1 January 2018 to 31 December 2020.

(34) The aid intensities applicable to investments by large enterprises proposed by the Spanish authorities for the pre-defined 'c' regions listed in tables 2 and 3 above respect these provisions, since they are limited: - to 15% GGE between 1 July 2014 and 31 December 2017 and to 10% GGE between 1 January 2018 and 31 December 2020 in the former 'a' regions of Galicia, Castilla-La Mancha and Andalucía and - to 15% GGE in the sparsely populate regions of Teruel and Soria for the period between 1 July 2014 and 31 December 2020.

(35) The maximum aid intensities proposed by the Spanish authorities for the non pre- defined 'c' regions also respect these provisions. As shown in table 6 above, the aid intensities applicable to investments by large enterprises in Ceuta and Melilla are limited to 15% GGE for the period between 1 July 2014 and 31 December 2020. The intensities applicable to investments by large enterprises in all other non-predefined 'c' areas are limited to 10% GGE.

3.5 Increased aid intensities for SMEs

(36) In accordance with paragraph 177 of the RAG, the maximum aid intensities applicable to large enterprises can be increased by 20 percentage points for small enterprises or by up to 10 percentage points for medium-sized enterprises. However, the increased maximum aid intensities for SMEs will not apply to aid awarded for large investment projects.

3.6 Other commitments made by the Spanish authorities

(37) The Commission takes note of the following commitments made by the Spanish authorities in the notification: (a) The Spanish authorities confirmed that all intentions to grant regional aid will be notified to the Commission in accordance with Article 108(3) TFEU, either as an aid scheme, or as an individual notification, unless a block exemption regulation applies. (b) The Spanish authorities confirmed that all regional investment aid will respect the maximum aid intensities of the region concerned as defined in the regional aid map approved by the Commission and published in the Official Journal of the European Union. (c) The Spanish authorities confirmed that for large investment projects (as defined in paragraph 20(l) of the RAG) the aid ceilings of the region concerned, as defined in the regional aid map approved and published by the Commission, will be adjusted according to the formula in paragraph 20(c) of the RAG.

3.7 Conclusion

(38) In view of the above, the Commission concludes that the regional aid map notified by the Spanish authorities for the period from 1 July 2014 to 31 December 2020 is in line with the RAG.

(39) The Commission recalls that the maximum aid intensities specified in the regional aid map apply only to investments carried out in sectors that fall within the scope of the RAG, as defined in paragraph 10 thereof. In particular, these aid ceilings apply to the processing and marketing of agricultural products only to the extent laid down in the Community guidelines for State aid in the agriculture and forestry sector4, or any guidelines replacing them.

4. DECISION

(40) The Commission has accordingly decided: - to approve the regional aid map of Spain for the period from 1 July 2014 to 31 December 2020 as set out in the Annex, as it fulfils the conditions laid down in the Guidelines on regional State aid for 2014-2020.
