MAGHERAFELT DISTRICT COUNCIL MINUTES OF Proceedings of a Meeting of Magherafelt District Council held in the Council Chamber, 50 Ballyronan Road, Magherafelt on Tuesday, 13 December 2005. The meeting commenced at 7.30 pm. MINUTES Submitted Minutes of Meetings as follows: 1.1. It was PROPOSED by Councillor Mrs E A Forde Seconded by Councillor J J McPeake, and RESOLVED: that the Minutes of the Council Meeting held on Tuesday, 8 November 2005 (copy circulated to each Member) be taken as read and signed as correct. 2. SYMPATHY 2.1 Councillor G C Shiels commented on the recent demise of George Best and his previous contribution to the District as a player for Tobermore United FC. 2 It was PROPOSED by Councillor G C Shiels Seconded by Councillor J Crawford, That the Council send a letter of sympathy to the Best family. Councillor I P Milne joined the meeting at 7.32 pm. Members debated whether Council policy in relation to the issue of letters of sympathy to the families of deceased residents of the District could be interpreted sufficiently widely to allow a card to be sent to the Best family. On a vote being taken on Councillor Shiels’ proposal, 5 Members voted for, 0 Members voted against, 9 Members abstained. Voting being by show of hands. The Chairman declared Councillor Shiels’ proposal carried. 3. MATTERS ARISING 3.1 The Chief Executive submitted OUT OF THE MINUTES a letter of thanks for financial assistance from Wheelchair Bowls NI in respect of funding provided towards the costs of Mr Edmund Bruce’s participation in the British Isles Home Championships Noted. 4. SUSPENSION OF 4.1 Councillor G C Shiels requested STANDING ORDERS permission to bring forward an emergency motion on the proposed legislative changes outlined in the current Department of Social Development consultation document “Liquor Licensing – The Way Forward”. 4.2 The Chief Executive advised that for this to happen the Council required to set aside Standing Orders. 4.3 It was PROPOSED by Councillor G C Shiels Seconded by Councillor J Crawford, and unanimously RESOLVED: that Standing Orders be suspended. 3 5. EMERGENCY 5.1 Councillor G C Shiels proposed: RESOLUTION “That this Council write to the Minister of Social Development stating our strong opposition to the proposals contained in the consultation document ‘Liquor Licensing – The Way Forward.’ We believe if these proposals become law they will lead to more competition, cheaper drink and subsequently increased incidence of under-age drinking and anti-social behaviour. Further that we shall circulate this motion to the other 25 councils in Northern Ireland and ask that they lend their support and also write to the Minister before the deadline for responses at the end of January.” Councillor J Crawford seconded the motion. 5.2 Councillor Shiels explained the current legislative position in relation to the sale of alcohol and commented on the negative impact that the proposals would have. 5.3 Councillor Miss K A Lagan concurred with Councillor Shiels’ sentiments. 5.4 Councillor P McLean stated that he would support the motion on the basis that its effect would be to limit the availability of alcohol. 5.5 It was PROPOSED by Councillor G C Shiels Seconded by Councillor J Crawford, and unanimously RESOLVED: that the Council write to the other 25 councils and the Minister in accordance with Councillor Shiels’ motion. 6. RESUMPTION UNDER It was STANDING ORDERS PROPOSED by Councillo r T J Catherwood Seconded by Councillor Mrs E A Forde, and RESOLVED: that the Council resume under Standing Orders 4 7. BUILDING CONTROL The Director of Building Control presented the DEPARTMENT Department’s report for the period 2 November to 6 December 2005 (copy circulated to each 210/12/2005 Member). 7.1 Mr Glendinning stated that during the period of the report forty-five applications had been recommended for approval. A total of ninety-one applications required amending by architects and agents before granting approval. There were ten Building Regulation Notices and fourteen Regularisations issued. 7.2 There were eight cancellations: MA/0990/0059 – Ms Agnes Fullerton, 21 Lurganagoose Road, Knockloughrim for an extension to a dwelling; MA/0990/0413 – Ms Patricia O’Kane, 81c Annaghmore Road, Castledawson for an extension to a dwelling for disabled person, MA/0990/0199 – Mr Jackie Hancock, Station Road Industrial Estate, Magherafelt for an extension to industrial unit, MA/2001/0263 – Mr Henry Stewart, 15 Brown Drive, Maghera for alterations and extension to a dwelling, .MA/2012/0256 – Mr Liam McQuillan, 5 Moneysharvin Road, Swatragh for a monopitch extension to existing shed, MA/2012/0325- Mr James Duggan, 36 Tirkane Road, Maghera for a disabled shower, MA/2023/0304 – Mr Daniel McAtamney, 2 Bogashen Road, Ballymacpeake, Portglenone for improvements to a dwelling and MA/2034/0335 – Mr Tony McKeown, 20 Mayogall Road, Knockloughrim for change of house type. 7.3 Mr Glendinning reported that during the month of October 2005 work had commenced on site on eighty-one buildings. He also reported that twenty-one new postal numbers and postcodes had been issued and that 58 applications were found to be complete under Building Regulations. 7.4 Mr Glendinning advised the Members that there had been seventy-two applications for Property Certificates in the month of October. In each case there were no outstanding Statutory Notices or Orders under Building Regulations and suitable reports had been made in each case. 5 7.5 The Chief Executive asked Councillor McLean if the Building Control Group Committee had considered the problem of Building Control officers having to spend a lot of time effectively correcting architects’ and agents’ work and asking them to submit revised plans that met the requirements of the Building Regulations. 7.6 Councillor P McLean replied that he noted that ninety-one applications had to be returned to agents in the previous month. He advised the Members that he had brought the matter to the attention of the Group Committee but he had not received any meaningful feedback. Councillor McLean said that he would attempt to sit down with Mr Glendinning and the Chief Executive to discuss the matter further to see if he could take definitive proposals to the Group Committee to address this issue. 7.7 On consideration it was PROPOSED by Councillor P McLean, Seconded by Councillor Miss K A Lagan, and RESOLVED: to adopt the report as submitted. 8. NAMING AND Consideration was given to the naming and NUMBERING OF numbering of the following developments: STREETS 8.1 Six town houses on the Calmore Road, Tobermore for Gribben House Ltd. The name suggested was “Calmore Court”. 8.2 On consideration it was PROPOSED by Councillor Mrs E A Forde, Seconded by Councillor T J Catherwood, and RESOLVED: to name the six town houses on the Calmore Road, Tobermore as “Calmore Close”. 9.
