Mahkamah Agu Mahkamah Agung Republik Indo Direktori Putusan Mahkamah Agung Republik Indonesia putusan.mahkamahagung.go.id P U T U S A N Nomor 5/Pdt.G/2020/PN Cbn DEMI KEADILAN BERDASARKAN KETUHANAN YANG MAHA ESA Mahkamah AgungPengadilan Negeri Republik Cirebon yang memeriksa dan Indonesia memutus perkara perdata pada tingkat pertama, telah menjatuhkan putusan sebagai berikut dalam perkara gugatan antara: EFFIE ROSIAN, perempuan, lahir di Indramayu, tanggal 13 November 1977 / umur : 43 tahun, agama Kristen, pekerjaan Mengurus rumah tangga, bertempat tinggal di Jalan Pertatean Gang II Nomor 72 B RT. 003 RW. 003 Kelurahan Karyamulya Kecamatan Pekalipan Kota Cirebon, selanjutnya disebut sebagai Penggugat; Lawan: VICTOR HALIM, PO, laki-laki, lahir di Pontianak, tanggal 18 November 1979 / umur 41 tahun, agama Katholik, pekerjaan Wiraswasta, bertempat tinggal di Jalan Petatrean Gang II Nomor 72 B RT.003 RW. 003 Kelurahan Karyamulya Kecamatan Pekalipan Kota Cirebon, Mahkamah Agung Republikselanjutnya disebut sebagai Tergugat; Indonesia Pengadilan Negeri tersebut; Setelah membaca berkas perkara beserta surat-surat yang bersangkutan; Setelah mendengar pihak Penggugat; TENTANG DUDUK PERKARA Menimbang, bahwa Penggugat dengan surat gugatan tanggal 14 Januari 2020 yang diterima dan didaftarkan di Kepaniteraan Pengadilan Negeri Cirebon pada tanggal 22 Januari 2020 dalam Register Nomor 5/Pdt.G/2020/PN Cbn, telah mengajukan gugatan sebagai berikut: 1. Bahwa Penggugat telah melangsungkan perkawinan dengan Tergugat di Pontianak pada tanggal 31 Juli 2004, Perkawinan tersebut telah dicatatkan / didaftarkan di Kantor Dinas Kependudukan dan Pencatatan Sipil Kota Pontianak, sesuai dengan Kutipan Akta Perkawinan Nomor 297/2004 tertanggal 2 Agustus 2004; 2. Bahwa setelah melangsungkan perkawinan antara Penggugat dengan Tergugat tinggal di Pontianak dirumah mertua/rumah orangtuanya Tergugat, Mahkamah sampaiAgung dikaruniai 2(dua) orang Republik anak, kemudian pada tahun 2010 Indonesia Penggugat Halaman 1 dari 20 Putusan Perdata Gugatan Nomor 5/Pdt.G/2020/PN Cbn Disclaimer Kepaniteraan Mahkamah Agung Republik Indonesia berusaha untuk selalu mencantumkan informasi paling kini dan akurat sebagai bentuk komitmen Mahkamah Agung untuk pelayanan publik, transparansi dan akuntabilitas pelaksanaan fungsi peradilan. Bahwa dari Perkawinan antara Penggugat dengan Tergugat telah dilahirkan Mahkamah Agung2 (dua) orang anak, masing-masingRepublik diberi nama: Indonesia 1. Marvel Fienanda Halim, laki-laki dilahirkan di Pontianak pada tanggal 3 April 2004, sebagaimana terbukti dari Kutipan Akte Kelahiran Nomor 208/2004 tertanggal 29 Juli 2004 serta Catatan Tepi Akta No.Akta:208/2004(Tambahan) yang diterbitkan dan ditandatangani oleh Kepala Kantor Catatan Sipil Kota Pontianak; 2. Charlene Anabel Halim, perempuan, dilahirkan di Pontianak, pada tanggal 30 Oktober 2008, sebagaimana terbukti dari Kutipan Akta Kelahiran Nomor 18834/G/2008 tertanggal 18 November 2008 yang diterbitkan dan ditandatangani oleh Kepala Kantor Catatan Sipil Kota Pontianak; Bahwa anak pertama bernama Marvel Fienanda Halim berusia 16 tahun dan anak kedua bernama Charlene Anabel Halim berusia 12 tahun; 4. Bahwa selama berumah tangga antara Penggugat dengan Terggugat belum pernah bercerai; 5. Bahwa sepanjang perkawinan Penggugat dan Tergugat sejak lahir anak kedua bernama Charlene Anabel Halim, perempuan, dilahirkan di Mahkamah AgungPontianak, pada tanggal Republik 30 Oktober 2008 antara Penggugat Indonesia dengan Tergugat sering terjadi cekcok dan sering terjadi pertengkaran serta perselisihan terus-menerus yang disebabkan banyak hal, antara lain sikap Tergugat sebagai suami yang tidak bijaksana, suka mencari-cari kesalahan Penggugat tanpa alasan yang jelas, sering cekcok dan Tergugat sebagai kepala Keluarga kurang bertanggungjawab dan banyak perbedaan prinsip hidup; 6. Bahwa menghadapi sikap Tergugat di atas, sebelumnya Penggugat selalu bersikap sabar dan mengalah, berusaha menuruti kemauan Tergugat sesuai dengan kewajiban seorang isteri serta berusaha menasehati Tergugat. Namun, nasehat yang diberikan oleh Penggugat tidak membuat Tergugat lebih baik, justru pertengkaran dan perselisihan antara Penggugat dan Tergugat semakin kerap terjadi dan semakin parah; 7. Bahwa terhadap kondisi rumah tangga Penggugat dan Tergugat tersebut diatas, pihak keluarga Penggugat dan pihak keluarga Tergugat telah berusaha berulangkali menasehati dan mendamaikan Penggugat dan Mahkamah Tergugat,Agung namun kemudian Republik Tergugat pada tahun 2018 akhir Indonesia ( Tanggal 5 Halaman 2 dari 20 Putusan Perdata Gugatan Nomor 5/Pdt.G/2020/PN Cbn Disclaimer Kepaniteraan Mahkamah Agung Republik Indonesia berusaha untuk selalu mencantumkan informasi paling kini dan akurat sebagai bentuk komitmen Mahkamah Agung untuk pelayanan publik, transparansi dan akuntabilitas pelaksanaan fungsi peradilan. Bahwa Penggugat sudah berusaha mencari Tergugat sampai menanyakan Mahkamah Agungkepada keluarga Tergugat, Republik akan tetapi usaha penggugat tidakIndonesia berhasil; 9. Bahwa dengan keadaan rumah tangga yang demikian, maka harapan Penggugat untuk mempertahankan keutuhan rumah tangga sudah tidak ada harapan lagi; 10. Bahwa untuk kepastian hukumnya Penggugat mengajukan gugatan perceraian ini kepada Bapak Ketua Pengadilan Negeri Cirebon; 11. Bahwa berdasarkan fakta diatas, perkawinan Penggugat dan Tergugat secara hukum dapat dinyatakan putus karena perceraian, sesuai dengan ketentuan pasal 38 Undang-undang No. 1 Tahun 1974 tentang Perkawinan jo. Pasal 19 ( f ) Peraturan Pemerintah RI No. 19 Tahun 1975 tentang Pelaksanaan Undang-undang No. 1 Tahun 1974 tentang Perkawinan; 12. Bahwa oleh karena kedua anak (keturunan) dari perkawinan Penggugat dengan Tergugat bernama: - Marvel Fienanda Halim, laki-laki dilahirkan di Pontianak pada tanggal 3 April 2004, sebagaimana terbukti dari Kutipan Akte Kelahiran Nomor 208/2004 tertanggal 29 Juli 2004 serta Catatan Tepi Akta No.Akta:208/2004 (Tambahan) yang diterbitkan dan ditandatangani oleh Mahkamah AgungKepala Kantor Catatan Republik Sipil Kota Pontianak; Indonesia - Charlene Anabel Halim, perempuan, dilahirkan di Pontianak, pada tanggal 30 Oktober 2008, sebagaimana terbukti dari Kutipan Akta Kelahiran Nomor 18834/G/2008 tertanggal 18 November 2008 yang diterbitkan dan ditandatangani oleh Kepala Kantor Catatan Sipil Kota Pontianak; Anak pertama berusia 16 (enam belas) tahun dan anak kedua berusia12 (delapan) tahun keduanya masih dibawah, maka adalah tepat dan benar apabila Penggugat ditetapkan sebagai wali Ibu dari anak-anak yang masih dibawah umur tersebut Hal ini sesuai dengan Yurisprudensi Mahkamah Agung RI sebagai berikut: Putusan Mahkamah Agung RI No. 27/K/Pdt/1993 tanggal 30 Agustus 1983 yang antara lain menyebutkan bahwa : “anak-anak yang masih kecil / dibawah umur berada dibawah asuhan ibunya”; 13. Bahwa Tergugat selaku Ayah kandung dari anak-anak dari perkawinan antara Penggugat dengan Tergugat bernama 1. Marvel Fienanda Halim, laki-laki Mahkamah dilahirkanAgung di Pontianak pada Republik tanggal 3 April 2004 (usia 16 tahun)Indonesia dan 2.     179 Journal of Southeast Asian Studies, 48(2), pp 179–195 June 2017. © The National University of Singapore, 2017 doi:10.1017/S0022463417000030 The two Kronik Tionghua of Semarang and Cirebon: A note on provenance and reliability Alexander Wain This article is the first comprehensive evaluation of the provenance and reliability of the two enigmatic Kronik Tionghua texts of Semarang and Cirebon (the ‘Malay Annals of Semarang and Cerbon’). Initially published by M.O. Parlindungan in 1964, historians have increasingly begun to use these documents when reconstructing Java’s early Islamic history. This article is a long overdue attempt to positively identify the Dutch colonial official (Cornelis Poortman) whom Parlindungan claims to have received the texts from. Although the article establishes that Parlindungan almost cer- tainly knew this individual, discrepancies between his version of Poortman’s career and official Dutch records raise questions about whether Poortman could have found the two Kronik Tionghua, at least in the manner described. The article then ends with a close textual analysis of both Kronik Tionghua which demonstrates the possibility that both texts were written by a modern, Dutch-educated author. The art- icle therefore concludes that both texts are probable fabrications, albeit ones based on authentic texts. In 1964, the Indonesian Batak historian, Mangaradja Onggang Parlindungan, published a book entitled Tuanku Rao. This text, designed to glorify a nineteenth- century Minangkabau teacher of the same name (and who had been active in the Batak lands), included as an appendix an edited version of two reputedly peranakan (Sino-Malay) Javanese manuscripts. Study on morphometric variations and genetic diversity of the mantis shrimp (Harpiosquilla raphidea) from Karimata strait and Java sea waters has been conducted from January 2013 to April 2014. H. raphidea samples were collected from six locations i.e. Teluk Jakarta, Cirebon, Semarang, Tanjung pandan, Pontianak and Jambi waters. A total of 360 H. raphidea individuals have been collected from Karimata strait and Java sea waters. Based on Canonical Discriminant Univariate Statistics Analyses, 20 out of 22 morphometric characters were significantly different (P<0.01). The highest internal diversity of H. raphidea population (84.16%) was in Teluk Jakarta, while the lowest one was in Pontianak (56%). According to the multiple alignment analyses, there were 10 haplotypes distributed from Karimata strait (Jambi, Tanjung Pandan, Pontianak) and from Java sea waters (Teluk Jakarta, Cirebon, Semarang). The results showed a classification of six populations into three groups among the H. raphidea population, based on the analysis of genetic distance.     CHAPTER IX The poor legacy of Sumatra The Capuchin friar Anthonius Brevoort opens his 1993 dissertation on the first decade of the Capuchin mission in Sumatra (1911-1923) with a chapter on the previous Catholic presence in Sumatra. The disputed Christian community of Fansur or Baros is mentioned as recorded by Saleh al-Armini around 1150-1171. Franciscans in Aceh who were the first martyrs around 1642 are mentioned, as well as the mission in Bengkulu in the early 1700s, when some 300 Catholics were counted. But after that time, only decline is recorded for the history of Catholicism in Sumatra. The nineteenth century did not bring much growth either. An earlier colleague of Brevoort, the Capuchin priest Gentilis Aster, thus started his history of the mission with the sad title De magere boedel, the poor legacy. ‘Catholics were late, had no proper strategy, and did not concentrate in their work on the vast island of Sumatra’ (Brevoort 1993, Aster 1961).1 The cultural, economic, and religious pattern of Sumatra around 1900 was much more diverse than that of any of the other large islands, Java, Kalimantan, Sulawesi, and perhaps even Papua. The diversity was not only evident among the inland regions, the people living in the mountains of the Bukit Barisan, and the inland tribes of Batak, Gayo, Minangkabau, Jambi, Lampung. There were and still are great differences among the coastal re- gions as well: the Malay sultanates of the east coast, Java-oriented Palembang, the proud and independent Aceh, just to mention a few of the important cultures.

As such, Cirebon has a diverse image as a tourist destination. But efforts to measure the image of Cirebon as a tourist destination empirically have never been undertaken. This research was conducted to fill the lack of empirical studies on the image of Cirebon as a tourist destination. This study uses a qualitative approach to provide opportunities for respondents to freely express their opinions.
