15 LC 39 0838 Senate Resolution 40 By: Senators Dugan of the 30th, Hill of the 6th, Mullis of the 53rd, Williams of the 19th, Kirk of the 13th and others A RESOLUTION 1 Honoring the life of Captain Herbert "Herb" Lee Emory and dedicating the new flyover ramp 2 on Interstate 85 at Georgia 400 in his honor; and for other purposes. 3 WHEREAS, Captain Herbert "Herb" Lee Emory was born on April 2, 1953, in Transylvania 4 County, North Carolina; and 5 WHEREAS, Captain Herb moved to Atlanta in 1971 to attend the Atlanta School of 6 Broadcasting and National School of Broadcasting and began serving as a traffic reporter in 7 Atlanta; and 8 WHEREAS, throughout his career, Captain Herb worked with numerous local radio stations, 9 including WSNE of Cumming, WDGL of Douglasville, WFOM of Marietta, WACX of 10 Austell, WQXI-AM, 94 Q-Star 94, and Georgia Network News; and 11 WHEREAS, in 1991 Captain Herb moved to WSB Radio and Channel 2 Action News, where 12 he initiated and helped build the traffic team system and infrastructure, including the 13 concepts of "Red Alerts" and "Triple Team Traffic" which countless Atlanta commuters grew 14 to rely upon for accuracy and up-to-the-minute traffic advisories; and 15 WHEREAS, Captain Herb's commitment to helping Atlanta's drivers navigate traffic with 16 ease is evident by his numerous awards and accolades, including at least 15 First Place 17 Awards, including two Green Eyeshades, for news and traffic reports from the Georgia 18 Associated Press Association, and his induction into the Georgia Radio Hall of Fame in 19 2008; and 20 WHEREAS, his generosity of spirit and compassion for others was also widely recognized 21 as he hosted the annual Toys for Tots fundraiser at Fred's Barbeque House in Lithia Springs, 22 volunteered with the Douglas County Boys and Girls Club, was a dedicated member of the S. -

Small (Small), by his attorney, hereby replies to the various comments filed in the captioned docket. In reply thereto, the following is respectfully submitted: 1) WNNX's rule making petition seeks to remove existing service from 658,920 persons. WNNX's Technical Exhibit, Petition for Rule Making, p. 10. Paragraph 11 of the Notice of Proposed Rule Making ~RM) requires WNNX to "show what areas and populations will be separately served by the allotment ofChannel 261 C3 at Anniston and Channel 264A at Ashland . .." It is not apparent that WNNX's Comments respond to the Commission's inquiry. Figure 3 of WNNX's Comments, nominally titled, in part, "the Areas and Populations which will be separately served by Channel 261C3 at Anniston and 264A at Ashland," appears calculated to be responsive, however, WNNX's response presents combined, not separate, area and population figures for the two proposed fill-in stations. WNNX states that total service loss will be 658,920. However, WNNX's Figure 3 is not at all clear as to what is being counted. Figure 3 does not explicitly state ,., •.. :..•"-_.", .•._-~-,-,, ,,~,_._-- that the proposed Anniston and Ashland stations are excluded, Figure 3 does not provide separate data for service loss in the area to be served by the proposed stations, and Figure 3 does not contain separate service figures for the two proposed stations such that it is possible to determine how many people in the loss area each station would cover. -
