    WILL SONY’S FOURTH PLAYSTATION LEAD TO A SECOND SONY V. UNIVERSAL? † SETH ASCHER ABSTRACT Sony has included a “share” button on the next version of their popular PlayStation video game system. This feature is meant to allow players to record and share videos of their gameplay. This service shares similarities with the controversial “record” button that Sony included with its Betamax players over thirty years ago. The Betamax player was the subject of the landmark case Sony v. Universal, a foundational case for the modern application of copyright law to new technology. This Issue Brief examines how this “share” feature would fare under the framework laid out by Sony v. Universal and other evolutions in copyright law. INTRODUCTION On February 20, 2013, Sony announced their newest videogame system, predictably named the PlayStation 4.1 Chief among its new features is the share button displayed prominently on its controller.2 Microsoft’s newest offering also has a similar feature.3 Pressing the share button will allow a player to post images or videos of their gameplay to the internet, sharing them with their friends and complete strangers.4 The PlayStation 4 even buffers the last few minutes of gameplay so that a player can share their gameplay video after the fact.5 Sony’s intention is to provide an easy way for players to share images and videos online. I’m about the take the tour of Dreamland. DENNIS-Do you know what Dreamland is? LYN-No. DENNIS-Dreamland is the code name for the most off-limits place in the United States. It’s called Area 51. It’s just north of Nellis in Las Vegas, Nevada and that’s where all of the extremely secret testing of all kinds of things over the years after World War II. Area 51. LYN-I knew Area 51 but I didn’t know they called it “Dreamland”. DENNIS-Area 51 we call “The Box” because if you fly in “The Box” by mistake you are in big, big, big, big trouble. I never flew in the box by mistake but I was in a flight of guys where two guys flew in the box and they were met on the runway by Air Force security guys with guns. They were stripped of all their gear looking for cameras. In their flight gear they were brought to the airport, put on a TWA plane, and sent back here with orders of not to say anything of what they saw. So, when we began this place this was kind of a dream and we were shooting the breeze and said, “You know, why don’t we call this place Dreamland.

    HELLO AND WELCOME! As promised we’ve collected some of our Dizzy Returns concept work together in the following pages to share with you, our backers, as a thank you for your support throughout the Dizzy Returns Kickstarter campaign. This collection of location and character concepts offers a glimpse into the world we had imagined for a brand new Dizzy game, as well as insights into the game design process. The Dizzy series remains very close to our hearts, and the games encapsulate everything we believe that makes a fun, challenging and rewarding experience: quirky characters and story, interesting locations, platforming challenges, the satisfaction of a puzzle well- solved, exploring a colourful, fun world. These are things that we wanted to bring to Dizzy Returns, and we hope that these pages show some of that vision. Abstract When Netflix launched in April 1998, Internet video was in its infancy. Eighteen years later, Netflix has developed into the first truly global Internet TV network. Many books have been written about the five broadcast networks – NBC, CBS, ABC, Fox, and the CW – and many about the major cable networks – HBO, CNN, MTV, Nickelodeon, just to name a few – and this is the fitting time to undertake a detailed analysis of how Netflix, as the preeminent Internet TV networks, has come to be. This book, then, combines historical, industrial, and textual analysis to investigate, contextualize, and historicize Netflix's development as an Internet TV network. The book is split into four chapters. The first explores the ways in which Netflix's development during its early years a DVD-by-mail company – 1998-2007, a period I am calling "Netflix as Rental Company" – lay the foundations for the company's future iterations and successes. During this period, Netflix adapted DVD distribution to the Internet, revolutionizing the way viewers receive, watch, and choose content, and built a brand reputation on consumer-centric innovation.
