Speaker in the Chair) 14.34 hrs CONSTITUTION (ONE HUNDRED TWENTY-SIXTH AMENDMENT) BILL, 2019 माननीय अध्यक्ष: मद सख्ं या 19 ली जाती है । विवि और न्याय मत्रं ी; सचं ार मत्रं ी तथा इलेक्ट्रोवनकी और सूचना प्रौद्योविकी मत्रं ी (श्री रवि शंकर प्रसाद): मैं प्रस्ताव करता ह :ं “कक भारत के सकं वधान का और सशं ोधन करने वाले कवधेयक पर कवचार ककया जाए । ” मैं एक बहुत ही महत्वपूर्ण सकं वधान सशं ोधन कबल लेकर माननीय सदन के सामने उपकस्ित हुआ ह ।ं जब सकं वधान बना िा तो सकं वधान के कनमाणता बहुत ही गर्ु ी और अनभु वी िे। उन्होंनेभारत को कै सा बनाना है, इसके कलए मौकलक अकधकार कदए, नीकत कनदेशक तत्व कदए, इसके साि सामाकजक न्याय को भी महत्वपूर्ण दस्तावेज बताया। जैसा डॉ. अ륍बेडकर ने कहा िा –“This Constitution, apart from being a document of empowering India, is also a document of social justice.” जहां हमने मौकलक अकधकारों के अंतगणत अन楍ु छेद 14 में इक्वेकलटी की बात कही, अन楍ु छेद 15 में नॉन कडकस्िकमनेशन की बात मकहला, कपछड़े वगण, एससी एसटी के अगेंसट की बात कही, अन楍ु छेद 16 में पकललक ए륍पलाएमेंट में आरक्षर् की बात कही । इसके अलावा उनको लगा कक इस देश के दो समदु ायों को पोकलकटकल ररज़वेशन देना चाकहए । यह समझदारी बहुत ज셂री है, इस पर सकं वधान सभा में बहुत चचाण हुई कक पोकलकटकल ररज़वेशन ककसे देना है । इसके बाद कनर्णय ककया कक सकं वधान की धारा 330 के अंतगणत देश के शैड्यू쥍ड 10.12.2019 4 कास्ट और धारा 332 के अंतगणत शैड्यू쥍ड ट्राइब को आरक्षर् देंगे । यह आरक्षर् कै सा होगा? यह आरक्षर् उस रा煍य में उनकी आबादी के अन셂ु प के प्रकतशत पर होगा । माननीय अध्यक्ष जी, किर यह भी सवाल उठा कक अनसु ूकचत जाकत कौन सी होंगी और अनसु ूकचत जनजाकत कौन सी होंगी? इसका भी सवं ैधाकनक रास्ता कनकाला गया । There will be a Constitutional Order for Scheduled Castes, 1950 and there will be a Constitutional Order for Scheduled Tribes, 1950. उन्होंने यह स्प कहा कक शैड्यूल कास्ट कौन है तो उन्होंने उनकी भी सवं ैधाकनक व्याख्या की और मैं इसको पढ़ देना चाहता ह ं । The Constitution (Scheduled Castes) Order, 1950. मैं क्लॉज-3 पढ़ रहा ह -ं “Notwithstanding anything contained in paragraph 2, no person who professes a religion different from the Hindu, the Sikh or the Buddhist religion shall be deemed to be a member of a Scheduled Caste.” उसके बाद उन्होंने हर प्रदेश में कौन-कौन शैड्यूल कास्ट्स हैं, उसकी सवं ैधाकनक व्याख्या की। उनके सामने यह दृककोर् स्प िा कक कहन्दू समाज के अंतगणत जो कु रीकतयां आई,ं जो कडकस्िकमनेशन हुआ, उसके मआु वजे के 셂प में हमें यह आरक्षर् देना आवश्यक है । इसी प्रकार वन में रहने के कारर् हमार े जो अनसु ूकचत जनजाकत के भाई-बधं ु हैं, उनकी सूची भी अलग से बनाई गई । यह जो आरक्षर् कदया गया है, वह पहली बार हर दस साल के कलए प्रासंकगक रहता है । It is relevant for 10 years. बार-बार इसको सवं ैधाकनक सशं ोधनों से बढ़ाया गया । वर्ण 1959 में 20 साल, वर्ण 1969 में 30 साल और वर्ण 2009 में अंकतम बार 70 साल । यह 70 साल की अवकध 25 जनवरी, 2020 को समाप्त हो रही है । अभी हम ऐसा मानते हैं, हमारी सरकार मानती है और सदन भी मानता होगा कक हमार े जो अनसु ूकचत जाकत और अनसु ूकचत जनजाकत के जो बधं ु हैं, हालाकं क उनके जीवन में बहुत सधु ार आया है, किर भी और सधु ार करने की आवश्यकता है । इसकलए, इस आरक्षर् को आने वाले 10 सालों तक अिाणत् 25 जनवरी, 2030 तक चलाया जाए, 10.12.2019 5 यह सशं ोधन लेकर हम आपके समक्ष आए हैं । हमारी सरकार ने इनके कलए और क्या-क्या ककया है, वह जब मैं उत्तर दूगं ा, तो कवस्तार से बोलूंगा । लेककन, मझु े सदन को यह बताना आवश्यक है कक लोक सभा की 543 सीट्स हैं, कजनमें से 84 सीट्स शैड्यूल कास्ट्स के कलए आरकक्षत हैं । कवधान सभाओ ं में कु ल 4120 सीट्स हैं, कजनमें से 614 सीटें शैड्यूल कास्ट्स के कलए आरकक्षत हैं । जहा ं तक शैड्यूल ट्राइब का सवाल है, लोक सभा में उनके कलए 47 सीट्स आरकक्षत हैं और कवकभन्न कवधान सभाओ ंमें 554 सीट्स आरकक्षत हैं । मैं सदन को बहुत कवनम्रता से बताना चाह गं ा कक इन दोनों क륍यकु नटीज की पॉपलु ेशन ककतनी है । वर्ण 2011 के सेन्सस के मतु ाकबक देश के शैड्यूल कास्ट का पोपलु ेशन 20 करोड़ 13 लाख 78 हजार 372 और जो शैड्यूल ट्राइलस हैं, उनकी जनसख्ंया 10 करोड़ 45 लाख 45 हजार 716 है । So, this is the number as per 2011 Census of the Scheduled Castes and the Scheduled Tribes. सर, यह सवाल उठता है कक यह आरक्षर् कै से कमलता है, जनसख्ं या का कवचार कै से करते हैं? यह कवचार भी आया िा कक देश में पररवार कनयोजन हुआ है, उसके कारर् जनसख्ं या को कनयंकित करने की कोकशश होती है । लेककन, यह चचाण अटल कबहारी वाजपेयी जी की सरकार में चली िी, मैं उसमें मंिी िा, तो यह चचाण आई कक कई प्रदेशों ने पररवार कनयोजन को अ楍छी तरह से लागू ककया । माननीय राजनाि जी यहा ं बैठे हैं, उनको भी स्मरर् होगा, वे भी उस सरकार में मंिी िे । दकक्षर् और पकिम के कई प्रदेशों ने आपकत्त की कक हमने तो जनसख्ं या कनयंिर् को अ楍छी तरह से ककया है, तो यकद आप जनसख्ं या के आधार पर न륍बर तय करगें े, तो हमार े यहा ं सख्ं या कम हो जाएगी और कजन प्रदेशों ने इसको बकढ़या से कनयंकित नहीं ककया, उनको परु स्कार कमलेगा । तब हमने सकं वधान के आकटणकल 81 में सशं ोधन ककया कक वर्ण 1971 की जनसख्ं या के आधार पर ही हाउस की सख्ं या चलेगी, जब तक वर्ण 2026 की दोबारा जनगर्ना नहीं हो जाती है । वहा ं पर यह फ्रीज है । …(व्यवधान)You are a very brilliant Professor. I know that. जहां तक डीकलकमटेशन का सवाल है तो हमार े यहा ं डीकलकमटेशन 10.12.2019 6 कमीशन है, उसके अनसु ार इसको तय करते हैं । मेर े ख्याल में यह सकं वधान सशं ोधन की पृ भूकम है । मझु े लगता है कक पूरा सदन सवाणनमु कत से इसको पाररत करगे ा । हम सभी का ककमटमेंट होना चाकहए, वे हमार े बन्ध ु हैं, हमार े भाई हैं, बहन हैं, हमारा पररवार हैं, अगर ऐकतहाकसक कारर्ों से उनको कडसकिकमनेशन का सामना करना पड़ा तो इस देश का नैकतक कत्तणव्य है और इस सदन का वैधाकनक कत्तणव्य है कक हम इसे आगे बढ़ाए ं । इस दृककोर् के साि, मैं इस कबल को लेकर आपके सामने आया ह ं । इस सशं ोधन कवधेयक में मैं एक अन्य दृककोर् पर भी कटप्पर्ी करना चाह गं ा और बाद में, इस पर जो प्रश्न उठेंगे, उनके उत्तर दूगं ा । एग्ं लो इंकडयन के बार े में भी यह प्रावधान ककया गया िा, एग्ं लो इंकडयन को भी लोक सभा में दो और कवधान सभाओ ं में एक-एक स्िान कदया जाएगा । इसको हम आज लेकर नहीं आए हैं, लेककन कवचार कर रहे हैं । यह मैं आपको कहना चाहता ह ं । प्रो.
