First Special & Organizational Meeting January 2, 2018

The First Special and Organizational Meeting of 2018 was called to order by the Legislative Clerk at 9:24 A.M.

The following County Legislators were present:

There were 9 people in attendance.

The Clerk asked Legislator Mullen to have a moment of Prayer. “Lord, I would ask that you look upon us this year of 2018 to govern well, serve the people well, that we have a safe and prosperous year for all the residents of Tioga County, that we continue to grow and achieve according to your son.”

Legislator Mullen led all Legislators and those in attendance in the Pledge of Allegiance.

County Clerk Andrea Klett swore in Legislators Hollenbeck, Roberts, Standinger and Weston along with District Attorney Kirk Martin.

District Attorney Martin spoke. “I just wanted to thank the citizens of Tioga County for giving me an opportunity for a second term. I also wanted to thank the Legislature for supporting the mission of the District Attorneys’ Office. It is an important mission and we continue to work hard in effecting that for the safety and the well-being of all Tioga County’s citizens.

“During the last four years we have accomplished much. We have stopped the bleeding of felony indictments that were being dismissed regularly by County Court. We have replaced walls amongst the Police agencies in Tioga County with bridges and relationships with them all and we have 2 PROCEEDINGS OF THE TIOGA COUNTY LEGISLATURE - 2018 continued to hold those who would do harm to our citizens accountable. We have implemented a dual policy regarding those involved in drugs. If you are an otherwise good person and an addict, and honestly seek treatment, we will make sure it is available to you and give you the opportunity to get back on your feet, but if you are a drug dealer and you profit from selling poison to our children, you will go to prison period, end of story. As an example, a person by the name of Dwuane Brown was investigated by a joint effort of our local Police agencies within the past couple of years and found with over 300 bags of heroin and an unlicensed pistol. He was ultimately convicted of possession of heroin with the intent to sell it and other crimes and is now serving more than 13 years in State Prison. I consider that good work.

“In my second term I look forward to continuing this leadership of law and order and to ensure our streets, villages and towns are as safe as we can make them, to continue with the partnership that we have with the great Police agencies serving our County. Thank you so much.”

The Clerk announced that the first order of business was the appointment of a Chair. Legislator Hollenbeck nominated Legislator Sauerbrey, seconded by Legislator Mullen. Legislator Monell moved to close the nominations, seconded by Legislator Hollenbeck. On roll call vote all members voted Aye and the Clerk cast one ballot and Legislator Sauerbrey was appointed Chair of the Tioga County Legislature for a one year term.

County Clerk Andrea Klett swore in Legislator Sauerbrey as Chair of the Tioga County Legislature for 2018.

Chair Sauerbrey spoke. “First of all I just want to thank everybody for your support. I think we have a really good team here. I think we have accomplished a lot last year. We did a lot of work, which I feel very proud of. We made some major changes that we have been talking about, which goes to show that if we chew on stuff long enough and work together we can make some progress. During my time on the Legislature, which is like 12 years or whatever, I have seen a lot of changes in government, specifically County government and my observation is that there is more and more pressure from the State coming down, instructing us on how to do business, mandating and controlling what we do. It is a challenge every day to stay up on issues, to stay informed, and to stay aware. I look forward to working with you to make some changes moving forward, to do a better job in government, and look for ways that we can improve our systems. Thank you very much.”

The Chair announced the next order of business is nominations for a First Deputy Chair. Legislator Mullen nominated Legislator Weston, seconded by Legislator Hollenbeck. Legislator Sullivan moved to close the nominations, PROCEEDINGS OF THE TIOGA COUNTY LEGISLATURE - 2018 3 seconded by Legislator Monell. On roll call vote, all members voted Aye and the Chair cast one ballot and Legislator Weston was appointed First Deputy Chair of the Tioga County Legislature for a one year term.

The Chair called for nominations for a Second Deputy Chair. Legislator Monell nominated Legislator Hollenbeck, seconded by Legislator Mullen. Legislator Sullivan moved to close the nominations, seconded by Legislator Monell. On roll call vote, all members voted Aye and the Chair cast one ballot and Legislator Hollenbeck was appointed Second Deputy Chair of the Tioga County Legislature for a one year term.

County Clerk Andrea Klett swore in Legislators Weston and Hollenbeck as Deputy Chairs of the Tioga County Legislature for 2018.

Chair Sauerbrey spoke. “Andrea, on behalf of the whole Legislature thank you for helping us out every year and swearing us all in. We appreciate it.”

The Chair called for nominations for Public Information Officer. Legislator Roberts nominated Douglas Barton, seconded by Legislator Standinger. Legislator Sullivan moved to close the nominations, seconded by Legislator Hollenbeck. On roll call vote all members voted for Douglas Barton as Public Information Officer, and the Chair cast one ballot and Douglas Barton was appointed Public Information Officer for a one year term.

The Chair called for nominations for Republican Majority Leader. Legislator Sullivan nominated Legislator Roberts, seconded by Legislator Standinger. Legislator Monell moved to close the nominations, seconded by Legislator Hollenbeck. On roll call vote all Legislators voted for Legislator Roberts as Republican Majority Leader, and the Chair cast one ballot and Legislator Roberts was appointed Republican Majority Leader for a one year term.

Chair Sauerbrey asked if there were any disclosures to be made.

Legislator Mullen stated, “I have nothing to disclose.”

Legislator Sauerbrey stated, “I have nothing to disclose.”

Legislator Roberts stated, “I have nothing to disclose.”

Legislator Standinger stated, “I have no disclosures.”

Legislator Sullivan stated, “I have nothing to disclose.”

RESOLUTION NO. 8–18 APPOINTMENT OF ADMINISTRATIVE CORONER

WHEREAS: The Tioga County Coroners have selected an Administrative Coroner for 2018; and

WHEREAS: Such Administrative Coroner will perform the supervisory duties of managing their budget, paying the bills, and various office functions of the Coroner’s office; and

WHEREAS: The Administrative Coroner will have no supervisory authority over the other Coroners; therefore be it

RESOLVED: That W. Stewart Bennett, Tioga County Coroner, has been selected by the four duly elected County Coroners to be designated as the Administrative Coroner for 2018 and be given a stipend of $5,000.00 as set forth in the County budget.

First Regular Meeting January 16, 2018

The First Regular Meeting of 2018 was held on January 16, 2018 and was called to order by the Chair at 12:00 P.M. All Legislative members were present.

Chair Sauerbrey asked Legislator Mullen to have a moment of prayer. “Lord, at the first meeting of the year I would just like to thank you for the opportunity for all of us to serve our fellowmen and may we as we just passed the Martin Luther King Holiday do as Dr. King asked us, to judge people by the content of their character and not what makes us different, but what brings us together. That our diversity is our strength to this great Nation, State and County and our communities.”

Legislator Mullen led all Legislators and those in attendance in the Pledge of Allegiance.

Chair Sauerbrey asked for a unanimous motion for the following two recognition resolutions, seconded unanimously and carried.

Legislator Mullen read and presented the following recognition resolution on Randy Kipling to Julie Kipling, Randy’s wife.

RESOLUTION NO. 11-18 RESOLUTION RECOGNIZING RANDY KIPLING’S 27 YEARS OF DEDICATED SERVICE TO TIOGA COUNTY

WHEREAS: Randy Kipling was appointed as a Corrections Officer on 4/21/90; promoted to Deputy Sheriff on 3/7/92; promoted to Sergeant on 1/1/2004; and promoted to Lieutenant on 2/12/11; and

WHEREAS: Randy Kipling has been dedicated and loyal in the performance of his duties and responsibilities during the past 27 years to Tioga County, thereby earning the respect of his colleagues and peers throughout Tioga County; and

WHEREAS: Randy Kipling retired from the Tioga County Sheriff’s Office on December 21, 2017; therefore be it 12 PROCEEDINGS OF THE TIOGA COUNTY LEGISLATURE - 2018

RESOLVED: That the Tioga County Legislature, on its own behalf, as well as on behalf of the citizens of Tioga County, express sincere gratitude to Randy Kipling for his 27 years of dedicated and loyal service to the residents of Tioga County; and be it further

Legislator Mullen spoke. “I have known Randy since we were in Kindergarten. We went to Kindergarten together. We lived up around the corner from each other in the Village of Waverly. I was a Road Trooper and he was a Road Deputy. Not everything that went on when we were working together can be stated in this decorum, so I will not go into some of that, but I can tell you that Randy had a unique reputation amongst his fellow law enforcement officers, especially when he was a dog handler. He was called the “Rottweiler” by the troopers. Even after he was no longer a dog handler Randy kept that title. When you went to a domestic or a serious incident there was nobody better in this County that you wanted coming through that door than Randy Kipling. A lot of people would be yelling and screaming and when he darkened the doorway it was as quiet as a Church mouse in quite a few residences in Tioga County, when that door kind of busted off its hinges and in came Randy Kipling.

“What I use to do to Randy, we both live in the Village of Waverly, and I would work the 3:00 to 11:00 shift and Randy would work the night shift as the nighttime Supervisor. I would go to some of the more frequent places we went to that are along Route 17C that have many small houses together and I would go through there and put the spotlight on all the houses at the end of my shift and then I would sprint across the County and as I was pulling into the barracks I could hear Tioga dispatching Randy to either the Maple Lane or the Wagon Wheel trailer park. When I finally told him what I was doing I got a taste of the Rottweiler for doing that to him for over a year. He kept saying why am I going to the Maple Lane trailer park every single shift at the beginning of my shift PROCEEDINGS OF THE TIOGA COUNTY LEGISLATURE - 2018 13 because I was in there stirring things up and then going home. Randy is going to be sorely missed. I am very happy that he was able to get through his career and is now retired.”

Legislator Mullen read and presented the following recognition resolution to Paul (Casey) Rhodes.

There was a unanimous motion for the adoption of the following recognition resolution, seconded unanimously.

RESOLUTION NO. 12-18 RESOLUTION RECOGNIZING PAUL C. RHODES 26 YEARS OF DEDICATED SERVICE TO TIOGA COUNTY

WHEREAS: Paul C. Rhodes was appointed as a Corrections Officer on 9/9/91; promoted to Deputy Sheriff on 6/1/93; promoted to Sergeant on 4/10/00; appointed as an Investigator on 1/2/04; and promoted to Lieutenant on 4/21/12; and

WHEREAS: Paul C. Rhodes has been dedicated and loyal in the performance of his duties and responsibilities during the past 26 years to Tioga County, thereby earning the respect of his colleagues and peers throughout Tioga County; and

WHEREAS: Paul C. Rhodes retired from the Tioga County Sheriff’s Office on December 21, 2017; therefore be it

RESOLVED: That the Tioga County Legislature, on its own behalf, as well as on behalf of the citizens of Tioga County, express sincere gratitude to Paul C. Rhodes for his 26 years of dedicated and loyal service to the residents of Tioga County; and be it further

Legislator Mullen spoke. “I worked with Casey also as a Road Trooper stationed in Owego for 17 and a half years. There are too many funny stories that we will share over a beer when it is not on the public record. I do remember the car deer incident on 17C outside of Lockwood that was the deer that just would not die. There were more rounds expended than should have been. I think there was a need for some extra firearms training after that incident, but I will not get into that.

“There is nothing better than a retired Police Officer getting an opportunity to be standing and be honored for making it through his career safe and sound and alive. We have buried an awful lot of police officers in this Country and in this State particularly, and we have had some local police officers that have lost their lives in the recent past, and I can only tell you it does my heart good and I know the Legislature shares this opinion. Congratulations, thank God you are retired and safe, and I can tell you as being retired one of the great things is to get paid to wake up.”

Sheriff Howard spoke. “I would like to thank the County Legislators for acknowledging the two employees, the two Lieutenants of nearly 60 years of experience I lost in a day. We are going to miss them both. We are headed on to new things. We have a couple of new Lieutenants, some new other promotions, two of them sitting here, Investigator Cornwell and Investigator Kipling. Julie was not sad to see Randy go because got promoted. I just would like to say that these two Lieutenants with the past events of 2006 and 2011, both these men stood up and were not asked to do anything, but were there every day working, through the nights and I cannot say enough of what they did for us, especially during 2011. They worked an awful lot of hours during those times without being asked and that says a lot. The County certainly has lost two great men and dedicated service to the County.

“The only thing I will say about Randy is I am going to miss our mornings because I come in early and one day he came in to me and said I am sorry boss I had to set one of my deputies straight this morning, I should have closed my door. I said Randy it does not really matter if you close your door, if you PROCEEDINGS OF THE TIOGA COUNTY LEGISLATURE - 2018 15 close my door, both doors are closed because I can hear every word that you are bellowing out to that employee, so it does not really matter. He certainly will be missed and we look forward to our new Lieutenants taking their place and hopefully doing what they did in the past. Thank you.”

RESOLUTION NO. 13-18 RE-APPOINT MEMBER TO THE TIOGA COUNTY PLANNING BOARD

WHEREAS: Georgeanne Eckley’s position on the Tioga County Planning Board representing the Village of Owego expired on 12/31/2017; and

PROCEEDINGS OF THE TIOGA COUNTY LEGISLATURE - 2018 17

WHEREAS: The Village of Owego Board of Trustees has nominated Georgeanne Eckley to serve another three-year term as their representative, and she is willing and able to do so; therefore be it

RESOLVED: That the Tioga County Legislature hereby reappoint Georgeanne Eckley to the Tioga County Planning Board for another three-year term of 1/1/2018 – 12/31/20.

ROLL CALL VOTE Yes – Legislators Mullen, Sauerbrey, Roberts, Standinger, Sullivan, Weston, Hollenbeck, Huttleston and Monell.

No – None.

Absent – None.
