1 Purpose of Report/Recommendations 1.1 The purpose of this report is to seek Members' approval for the Service Level Agreement with Fermanagh and District Council for the delivery of Public Health Agency funded Tobacco Control services within City and District Council and the Legacy area of Borough Council. (Appendix 1)

2 Background 2.1 Council is responsible for enforcing a variety of tobacco legislation, introduced to protect public health by making it more difficult for young people to start smoking, supporting people to quit smoking and protecting the public from second hand tobacco smoke. 2.2 To support them in carrying out this important function, the Public Health Agency (PHA) provides funding to Councils for tobacco control enforcement. 2.3 Prior to Local Government Reform, the tobacco control function within the West was carried out on behalf of the five constituent councils by the Western Group Environmental Health Committee for which the employer Council was Omagh District Council and which had entered into a contract with the PHA for that purpose. 2.4 Under the contract, two Tobacco Control Officers (TCOs) were employed by Omagh District Council: one TCO covered the legacy Fermanagh District Council and Omagh District Council; the second TCO covered the legacy Limavady Borough Council, Strabane District Council and . 2.5 In February 2015 the PHA suggested to the eleven new Councils that the most pragmatic way to ensure continuity of service and ability to track the flow of funds would be for existing contracts to be transferred to the direct successor Council in the new structures. 2.6 Subsequently, following Local Government Reform in 2015, PHA entered into a contract with Fermanagh & Omagh District Council for the delivery of PHA funded tobacco control services across the 5 legacy Council areas in the West. 2.7 A Service Level Agreement (SLA) was subsequently entered into between District Council and Derry City and Strabane District Council for the delivery of PHA funded services during 2015/16. 2.8 Under the agreement Derry City and Strabane District Council employed a TCO to meet the required level of tobacco control services specified by PHA, both within our own district and within the legacy Limavady Borough Council part of Causeway Coast and Glens Borough Council.

3 Key Issues 3.1 The value of the contract that PHA has with Fermanagh and Omagh District Council for the current 2016/17 financial year is £107,852.75 3.2 Under the terms of the SLA between Fermanagh and Omagh District Council (FODC) and Derry City and Strabane District Council, FODC retains an administration fee amounting to 7.5% of the total budget, equivalent to £8,088.95 3.3 The remainder of the budget is split equally between both Councils, so that we will receive £49, 881.90 3.4 Receipt of the funding, which will be drawn down on a quarterly basis, is dependent on satisfactory progress against the PHA's targets, contained within the SLA, as evidenced by a quarterly performance monitoring report that must be submitted to FODC. 3.5 In addition to covering the salary and mileage costs associated with the TCO's work activities, the funds can be used for other tobacco control related expenditure, subject to prior approval by the PHA.

4 Financial, Equality, Legal, HR and Other Implications 4.1 Receipt of the PHA funding is conditional on acceptance of the Service Level Agreement. 4.2 Failure to receive the PHA funding may adversely affect Council's ability to provide an effective tobacco control service, which in turn would have a negative impact on the health of the local population.

5 Recommendations 5.1 Members are asked to approve the Service Level Agreement with Fermanagh and Omagh District Council for the delivery of Public Health Agency funded Tobacco Control services within Derry City and Strabane District Council and the Legacy Limavady Borough Council area of Causeway Coast and Glens Borough Council .
