Recommendations: A. THE CONTRIBUTIONS MADE BY S.106 AGREEMENTS OR ANY OTHER ENABLING AGREEMENT BE NOTED.

1 PURPOSE OF REPORT AND EXECUTIVE SUMMARY 1.1. This report summarises the situation in relation to S.106 agreements for the 2nd quarter of financial year 2008/09. 1.2. £144,283 has been committed to the council in monetary obligations for Quarter 2. A breakdown can be found in item 2.6 and a list of agreements signed in Appendix B. 1.3. £241,500 was received in Quarter 2. 1.4. £250,155 was spent from S.106 funds in Quarter 2. Please refer to Appendix C for breakdown. 1.5. £1,989,735 remains available from S.106 income. Please refer to Appendix D.

2 DETAILS 2.1. S.106 of the Town & Country Planning Act 1990 (as amended) permits Local Planning Authorities to enter into agreements with applicants for planning permission to regulate the use and development of land. This may involve the payment of a financial contribution for off site works. 2.2. Government guidance on the use of planning obligations is set out in ODPM Circular 05/2005 issued on 18th July 2005. The guidance requires that a planning obligation must be: i) Relevant to planning; ii) Necessary to make the proposed development acceptable in planning terms; iii) Directly related to the proposed development;

9 iv) Fairly and reasonably related in scale and kind to the proposed development; v) Reasonable in all other respects. 2.3. Members requested an annual report detailing agreements signed, income received and expenditure funded by S.106 Agreements. At the Planning Applications Committee meeting of 18th August 2005, Members requested that this report be produced on a quarterly basis in future. The report is to be submitted to Cabinet.

2.13. Unspent S.106 at the end of Quarter 2 2008/09: £1,989,735 is available to spend from S.106 funding. Please see Appendix D for a breakdown.

8 HUMAN RIGHTS, EQUALITIES AND COMMUNITY COHESION IMPLICATIONS 8.1. The planning applications were considered in the light of the Human Rights Act. S.106 contributions are secured and allocated towards community benefits such as school improvement projects, open spaces, sustainable transport and community safety. As a consequence, equalities and community cohesion implications are taken into account.

13 10 RISK MANAGEMENT AND HEALTH AND SAFETY IMPLICATIONS 10.1. For a minority of contributions there are deadlines for which they have to be spent. The risk is minimised by undertaking the monitoring of these contributions. A full risk assessment will be carried out for the next quarter’s report.
