Marriage is a life-long sacrament, and once a valid bond has been created, only death can break it. However, we all know that sometimes fall apart and end in divorce. It is critical to remember that the divorce takes place only in the eyes of the state; a judge has no power to break a bond God has created. When someone who is divorced would like to marry again validly in the Church (which is the duty of every Catholic), the individual needs to get an . An annulment does not break the bond of marriage – only death does that. Rather, an annulment states that an element necessary to create the bond at the time the marriage took place was missing, therefore, the marriage is null and void. An annulment is the Church’s compassionate way by which we can reach out to people whose marriages have not worked out the way they planned but still remain faithful to Jesus’ teaching that divorce and remarriage is not permissible. Unfortunately, there are many people out there who, whether through ignorance or their own personal agenda, sour the good news for people and dissuade them from seeking an annulment by feeding them false information. Let’s mention a few of the common misconceptions: “You cannot get an annulment if the marriage produced children.” FALSE! Whether or not there were any children from the marriage makes no difference at all. And no, they are not considered illegitimate (and called “the b- word”) if an annulment is granted. A marriage that is later annulled is referred to as a – one that was assumed valid at the time. It enjoys the full privilege of validity. Furthermore, since there are no longer any impediments in law from being born outside a valid marriage, it is a moot point. “You cannot get an annulment if you were married for more than a year.” FALSE! The longevity of the marriage makes no difference at all! “If you have enough money you can buy an annulment, but if you can’t afford it you’ll be turned down!” – MALISCIOUSLY FALSE!! This is usually touted by people with an ax to grind against the Church. While there is a fee involved, the Archdiocese of New York picks up 2/3 of the fee and asks the petitioner to pay the other 1/3. In a case of true financial hardship, the fee will be scaled back, even eliminated if necessary. UNDER NO CIRCUMSTANCES WHATSOEVER IS ANYONE EVER TURNED AWAY FROM THE PROCESS OR DENIED AN ANNULMENT BECAUSE THEY CAN’T AFFORD IT. Our parish website has a page on including answers to FAQ’s and the downloadable paperwork to get the process started. Please help us correct the errors out there and spread the proper information to people. Encourage them also never to withhold applying for an annulment without speaking to a priest. This will assure that they have received proper information and are not succumbing to the fallacies people spread. If you or someone you know needs our help, by all means call us!
