TWENTY-SIXTH REPORT

(Presented on 23.11.2016 )

I, the Chairperson of the Committee on Private Members’ Bills and Resolutions, having been authorised by the Committee to present the Report on their behalf, present this Twenty-sixth Report.

2. The Committee met on 21 November, 2016 for examination of ten Constitution (Amendment) Bills under rule 294(1) (a) of the Rules of Procedure.

Examination of the Constitution (Amendment) Bills

3. The Committee examined the following ten Constitution (Amendment) Bills:-

(1) The Constitution (Amendment) Bill, 2016 (Amendment of article 15, etc. ) by Dr. Satya Pal Singh, M.P.

The Bill seeks to- (a) amend article 26 to ensure that the State shall not control, administer or manage, whatsoever, any institution including its properties, established or maintained for religious or charitable purposes by a religious denomination; (b) amend article 27 to provide that no Government money shall be appropriated for advancement or promotion of a section of citizens solely or primarily on the basis of their religious affiliation or belonging to one or more religious or linguistic denomination; (c) amend article 28 to enable teaching of traditional Indian knowledge or ancient texts of in educational institutions, wholly or partly maintained out of State funds; (d) amend article 29 to substitute the words "protecting of interests of minorities" by the words "protecting of cultural and educational rights" ; and (e) amend article 30 to substitute the words "Right of all sections of citizens, whether based on religion or language” for the words "Right of minorities to establish and administer educational institutions". After considering all aspects of the Bill, the Committee recommend that the member may be permitted to move for leave to introduce the Bill.

(2) The Constitution (Amendment) Bill, 2016 (Amendment of article 15) by Shri Maheish Girri, M.P.

The Bill seeks to amend the Constitution with a view to bring minority educational institutions, within the purview of article 15 so as to enable the State to make special provisions relating to admission of socially and educationally backward classes of citizens or the Scheduled Castes or the Scheduled Tribes in minority educational institutions also.

After considering all aspects of the Bill, the Committee recommend that the member may be permitted to move for leave to introduce the Bill.

(3) The Constitution (Amendment) Bill, 2016 (Amendment of article 338) by Dr. Udit Raj, M.P.

The Bill seeks to amend article 338 of the Constitution with a view to provide that recommendations made by the National Commission for the Scheduled Castes shall be binding upon, and implemented by, the Central Government and the State Governments within a period of one year from the date of making of such recommendations.

After considering all aspects of the Bill, the Committee recommend that the member may be permitted to move for leave to introduce the Bill.

(4) The Constitution (Amendment) Bill, 2016 (Amendment of article 312) by Dr. Udit Raj, M.P.

The Bill seeks to amend article 312 of the Constitution with a view to provide that the Parliament shall, within one year of the coming into force of this Act, by law, provide for creation of an all-India judicial service, common to the Union and the States.

After considering all aspects of the Bill, the Committee recommend that the member may be permitted to move for leave to introduce the Bill.
